BACKGROUND/JUSTIFICATION:
Title 3, Chapter 1 of the City Code establishes a schedule of fees and charges for various City services and
facilities known as the Fee Schedule. The City Council annually reviews the proposed fee schedule to be
adopted as part of the City Code for the upcoming year to ensure that the established fees are consistent
with the City’s intent to recover costs incurred for the specific activities from those benefited. A redlined
version of the proposed 2023 Fee Schedule is attached with major changes summarized below:
▪ Utility Fees. Title 8, Chapter 1 of the City Code establishes requirements for utility availability and
connection charges to be paid by system users as the utilities are funding entirely by system users
and not through general property taxes. Availability charges fund construction of water
distribution and sewer collection pipes. Connection charges fund construction of the operational
components of the water and sewer systems such as wells, water towers, pressure stations, lift
stations, and wastewater treatment facilities. Availability charges are collected at the time of final
plat approval and connection charges are collected at the time a building permit is issued.
The basis of the fees collected is a Residential Equivalent Connection (REC) to establish an
equitable means of estimating the demand or contribution to the water and sewer systems,
respectively, for various land uses. One REC is equal to the average water use of a single family
dwelling of 175 gallons per day. The number of RECs for other uses is based upon a schedule
developed by Metropolitan Council Environmental Services. The RECs system ensures that the
payment of availability and connection charges is proportional to the utility services delivered for a
specific use. A high-water user like a car wash or restaurant will pay availability and connection
fees higher than that of a residential dwelling, commercial office, or industrial warehouse.
The utility availability and connection charges are adjusted each year to account for construction
cost increases using the Engineering News Record Construction Cost Index. The change in the ENR
Construction Cost Index for the period from November 2021 to November 2022 is 5.68%. The fee
schedule ordinance attached reflects this percentage increase in the utility availability and
connection charges for 2023. The utility rate study to be undertaken in 2023 will review the
current utility availability and utility fee structure and rates in advance of the 2024 fee schedule
review based on on-going debt service, utility master plan staging, and Capital Improvement Plan.
▪ Park Dedication. Minnesota Statutes 462.358, Subd. 2b enables the City to require dedication of a
portion of a subdivision to the public for parks, recreational facilities, playgrounds, trails, wetlands,
or open space to be received as land or as a proportional cash fee in lieu of land to be placed in a
specific fund used only for park development. Minnesota Statutes 462.358, Subd 2c. further
requires that there be a nexus between the dedication of land or payment of fees based upon the
City’s purpose for the dedication and that the dedication must be roughly proportional to the need
created by the development. The percentage of land required to be dedicated to the City for new
subdivisions is established in Section 11-8-15 of the Subdivision Ordinance as range between 12
percent and 17 percent for residential subdivisions and 10 percent for commercial and industrial
subdivisions. The park dedication fees for residential, commercial, or industrial subdivisions are
established as part of the fee schedule reviewed annually.
The Wright County Assessor’s office indicates that the value of undeveloped land with access to
sewer and water utilities to allow for planned residential development will increase by
approximately five percent for 2023. The calculation of the proposed park dedication fee in lieu of
land for residential subdivisions is shown below based on a five percent increase in land value:

The current cash fee in lieu of land for commercial subdivisions was established in 2003 based on
appraised land values for the TH 101 improvement project. A cash fee in lieu of land dedication for
industrial subdivisions was also in effect at that time but removed from the fee schedule in 2017 as
an economic development incentive. City staff is proposing to increase the commercial
subdivision and reestablish an industrial subdivision cash fee in lieu of land as five percent of the
estimated average land value based on recent appraisal and sale information.
City staff compiled the following survey of surrounding communities’ park dedication fees in lieu of
land for residential, commercial, and industrial subdivisions. The information is not to be used in
establishing the City fee schedule for park dedication in lieu of land but is useful for comparison
purposes to ensure that the City’s dedication fee does not put it at a competitive disadvantage
with comparable communities in the region relative to economic development objectives.

▪ Development Review. Fees related to the processing of zoning and subdivision applications
required by the City Code for public hearings, special meetings, or other such City Council or
Planning Commission actions as are necessary to process applications, as well as expenses incurred
by the City for planning, engineering, attorney, and other services are passed through to the
applicants with fees and escrow requirements established with the Fee Schedule. Minnesota
Statutes 462.353, Subd. 4 requires a public hearing to be held for consideration of fees to defray
the costs incurred by it in reviewing, investigating, and administering of an application for zoning or
subdivision approvals. City staff is proposing to increase the escrow amounts required for various
development reviews for non-single family applications. This increase is based on more time being
required to review applications for third party residential development, as well as more complex
commercial and industrial development. City staff’s intent is to avoid the need for the Finance
Department to have to invoice and collect expenses incurred more than the escrow from individual
developers.
▪ Stormwater Impact Fees. The City has completed stormwater management plans for the Otsego
Creek, Lefebvre Creek, and North Mississippi River. The stormwater management plans direct
public stormwater system improvements within the respective watersheds to be implemented as
development occurs. Fees are collected from subdivisions within the watersheds to fund the
improvements necessary to allow for the development to occur with adequate stormwater
management. The impact fees for the respective watersheds are to be increased for 2023 by 5.68
percent in accordance with the Engineering News Record Construction Cost Index from November
2021 to November 2022.
▪ City Equipment. The Fee Schedule includes a list of hourly rates for use of various City equipment.
The proposed rates are based on Federal Emergency Management Agency (FEMA) schedules. The
rates are included in the Fee Schedule to establish a basis for grant, insurance, or disaster relief
funds, or for the City to be able to recover costs incurred from abatements. The proposed 2023
Fee Schedule rates reflect the current FEMA schedule.
▪ Water Meters. The fee schedule includes a charge for water meters for new construction. These
fees are proposed to be increased based on the cost incurred by the City to obtain the meters.
The Administrative Subcommittee reviewed the proposed fee schedule at their meeting on 7 December
2022. Discussion focused on the proposed commercial and industrial park dedication fee in lieu of land.
The Administrative Subcommittee recommended establishing the fee at five percent of average land value,
which is within the range of surrounding cities. The Administrative Subcommittee also supported the
increase in development review escrows to minimize the amount of work undertaken by the Finance
Department to administer development accounts.

NOTICE IS HEREBY GIVEN that on December 12, 2022, Ordinance 2022-17 was adopted by the
City Council of the City of Otsego, Minnesota.
NOTICE IS FURTHER GIVEN that the ordinance adopted by the City Council amends City Code
establishing the 2023 schedule of fees, charges, and expenses for various City services and facilities.
