These additional restrictions include a 500 foot setback from any livestock pastured or within an open feedlot and a 500 foot setback from major roadways. The City Council also directed that the date for publication of the no discharge map be changed to September 1 at of each year. Draft Ordinance number 2007 -10 is attached for consideration at the City Council meeting on 24 September 2007. c. There was discussion by the City Council as to whether approval of the application without identification of users for the two lots proposed east of Kalland Avenue was consistent with the Interim Land Use Plan provisions of the Comprehensive Plan and past City Council actions The City Council requested our office provide additional information and tabled the application. The interim land use plan provisions of the Comprehensive Plan are intended to prevent zoning property for uses guided by the Future Land Use Plan until such time as there is 1) adequate City infrastructure and service capacity to support the planned use and 2) market demand for a given use. Implementation of the interim land use plan is accomplished by maintaining A -1 District zoning within the sewer districts until a development application is brought forward by a property owner so as to necessitate a Zoning Map amendment as part of the application. Zoning Map amendments are legislative decisions made as a matter of local policy, whereas applications for site&bullding plan reviews, conditional use permits, preliminary plats or final plats are judicial decisions to be made on the basis of compliance with established performance standards. Thus, the requirement for a Zoning Map amendment allows the City maximum discretion as to whether a proposed development is approved or denied based on the intent of the Interim Land Use Plan. The decision of whether a proposed development is cent with the interim land use provisions is typically a subdivision issue, although the interim land use plan can also be applied to a single parcel when a rezoning is required. Compliance with the Interim Land Use Plan is evaluated based on whether the proposed zoning is consistent with the land uses guided by the Comprehensive Plan, whether there is adequate sewer and water capacity to service the project and the location of trunk pipes to be extended, and the capacity of streets serving the property to accommodate estimated traffic generated by the development. The proposed Dara Glen subdivision is within the west sewer district, there is trunk sanitary sewer and water capacity available to service the use and the pipes are at the south plat line and Ka!land Avenue is an industrial section street providing adequate access to 70 Street for the three lots. The proposed lots meet the requirements of the 1 -2 General Industrial District and have adequate area to reasonably accommodate the uses allowed in the 1 -2 District. Performance standards applicable to the development of individual lots, such as setbacks, parking and loading requirements, screening, lighting, outdoor storage are adequate to address any use specific issue (although consideration should be given to making truck terminals a conditional or interim use instead of a permitted use) Applications similar to Dara Glen where not all of the future users were specifically identified that have been approved on this basis include the following: • Otsego Business Park (CSAH 42/85' Street) • Otsego Industrial Park (Golden Polygon) • Otsego 1 -94 West Industrial Park In some cases, the developers preliminary plat the project with several lots then final plat with fewer lots with the balance of the property reserved as outlots. This is done primarily as a convenience for the developer to allow the lot lines of future phases to be identified as specific users are proposed. There is also a property tax benefit in keeping future phases of the development as undivided, unbuildable outlots. When a final plat application for a future phase is submitted, City Council action is based entirely on consistency with the preliminary plat and technical compliance with the performance standards of the Zoning Ordinance, Subdivision Ordinance and Engineering Manual. Based on the considerations outlined above, our office sees no issue with approval of the Dara Glen application. The Planning Commission also recommended approval of the application by a 6-0 vote at their meeting on 4 September 2007. The City Council may consider the following possible actions at the meeting on 24 September 2007 at 6:30 PM. Please note that based on discussions with the developer regarding the use of Outlot A being subject to a purchase agreement, City staff now recommends the City accept a cash fee in lieu of land to satisfy park and trail dedication requirements. POSSIBLE ACTIONS Decision 1 - Zoning Map Amendment A. Motion to approve a Zoning Map amendment rezoning the subject site from A-1 District to 1 -2 District based on a finding that the action is consistent with the Comprehensive Plan. B. One resident from the Kittredge Crossings development to the south of the subject site spoke in favor of the proposed land use during the public hearing. The Planning Commission was supportive of the proposed use at this location to provide for a transition between the residential uses in Kittredge Crossings and future industrial uses to the north. The Planning Commission's primary discussion focused on the design of the parking lot and the ability to move bus and drop -off traffic within the site. The Planning Commission directed that City staff work with the developer to improve the segregation of the buses and provide easier access for drop off traffic. The Planning Commission also discussed the layout of the proposed building and planned future expansion of the facility onto Outlot A. The Planning Commission closed the public hearing and voted 6-0 to recommend approval of the applications. Possible actions for City Council action are outlined below consistent with the Planning Commission's recommendations and the attached findings- of-fact The applications will be considered at the City Council meeting on 24 September 2007 at 6:30 PM. RECITALS WHEREAS, each of Falcon Heights and Otsego is a municipal corporation and a "municipality" as defined in Minnesota Statutes, Sections 469.152 to 469.1651 (the "Industrial Development Act "), with the power thereunder to issue bonds and loan the proceeds thereof for certain projects; and WHEREAS, Minnesota Statutes, Section 471.59 and 471.656, as amended (collectively, the "Joint Powers Act "), provides that two or more governmental units, by agreement entered into through action of their governing bodies, may jointly or cooperatively exercise any power common to the contracting parties or any similar powers, and that the agreement may provide for the exercise of such powers by one or more of the participating governmental units on behalf of the other participating units; and WHEREAS, KCS Building Company, a Minnesota nonprofit corporation (the "Borrower") has requested Falcon Heights to issue its $7,620,000 Lease Revenue Bonds, (Kaleidoscope Charter School Project) Series 2007A (the "Series A Bonds ") and its $520,000 Taxable Lease Revenue Bonds (Kaleidoscope Charter School Project) Series 2007B in (the "Series B Bonds," and together with the Series A Bonds, the "Bonds"), on behalf of itself and Otsego, and to loan the proceeds of the Bonds to the Borrower so that the Borrower may finance a project consisting of the acquisition, construction and equipping of an approximately 40,000 square foot public elementary schoolhouse to be located on Kollard Avenue west of County Road 19 in Otsego (the "Project "); and WHEREAS, the governing bodies of Falcon Heights and Otsego have authorized the execution and delivery of this Agreement and consented to the issuance of the Bonds as contemplated herein; NOW, THEREFORE, the parties hereto hereby agree as follows: 1. In order to finance the Project, Falcon Heights shall issue the Bonds pursuant to the Joint Powers Act, the Industrial Development Act, and the terms of a bond resolution (the "Bond Resolution ") adopted by Falcon Heights on September 26, 2007. The proceeds of the Bonds will be loaned to the Borrower pursuant to a loan agreement, and the Borrower will apply such proceeds to payment of costs of the Project. 2. The liability of Falcon Heights and Otsego with respect to the Bonds shall be limited as provided in the Industrial Development Act and the Bond Resolution. Except to the extent specifically provided herein, Falcon Heights and Otsego shall not incur any obligations or liabilities to each other as a result of the issuance of the Bonds or the use of the Project by the Borrower. The Bonds shall be a special, limited obligation of Falcon Heights payable solely from proceeds, revenues and other amounts pledged thereto and more fully described in the Bond Resolution. The Bonds and the interest thereon shall neither constitute nor give rise to a pecuniary liability, general 2062953v2 or moral obligation or a pledge of the full faith and credit of Falcon Heights, Otsego, the State of Minnesota or any political subdivision of the above, within the meaning of any constitutional or statutory provisions. 3. All costs incurred by Falcon Heights and Otsego in the authorization, execution, delivery and performance of this Agreement shall be paid by the Borrower out of proceeds of the Bonds or other funds legally available to the Borrower. 4. Any property acquired as a result of this Agreement shall be and remain the property of Falcon Heights, to be disposed of pursuant to the terms of the loan agreement and the Bond Resolution. Any surplus moneys remaining after the purpose of this Agreement has been completed, unless otherwise provided for in the agreements related to the Bonds shall belong to Falcon Heights. 5. This Agreement may not be terminated by any party so long as any portion of the Bonds is outstanding. 6. This Agreement may be amended by Falcon Heights and Otsego at any time. No amendment may impair the rights of the holders of the Bonds, unless they have consented to such amendment in the manner provided for an amendment of the Indenture. 7. PURPOSE. The Otsego City Council has determined that in order to pay for the cost of construction, reconstruction, repair, enlargement, improvement, maintenance, operation, and use of the City of Otsego water, sanitary sewer systems and stormwater systems; the cost of State and Federal regulations; and the principal and interest to become due on obligations issued or to be issued, it is necessary to impose just and equitable charges for the use and availability of the City of Otsego municipal water and sanitary sewer systems pursuant to Minnesota Statutes Chapter 444. SECTION 2. ACCOUNTS. 2.1. Owners or users of any property within those areas where City water, sanitary sewer and/or stormwater service is available (meaning physically available to the property and deliverable pursuant to the City's assessment policy and the applicable sections of the City Comprehensive Land Use Plan) to the property. may not use a non - municipal system without specific written agreement with or some other specific approval from the City of Otsego. 2.2. All accounts shall be carried in the name of the property owner who personally, or by his or her authorized agent, applied for such service. The owner shall be liable for services supplied to and consumed by the property, whether he or she is occupying the property or not. The owner shall be liable for services supplied to and consumed by the property even if the property is a rental property. SECTION 3. BILLING. 3.1. Charges shall be billed on one bill as applicable to each account. All charges shall be due upon receipt and considered delinquent immediately after the due date of the current bill. 3.2. All bills shall contain the address and telephone number of the City Utility Department; that information shall be clearly visible and easily readable on all bills. 3.3. Residential, commercial and industrial property bills shall be mailed to the owner on a monthly basis and shall specify the water consumed in accordance with the current fee schedule set by ordinance of the Otsego City Council. SECTION 4. UTILITY RATE SCHEDULE. 4.1. The utility rate schedule for all properties subject to this ordinance shall be adopted annually by ordinance of the City Council. The utility rate schedule shall include, but not be limited to, the items set forth in Chapter 6 -1 -4 of the Otsego City Code. SECTION 5. DELINQUENT ACCOUNTS. 5.1 Penalties. A late payment fee of ten percent (10 %) shall be assessed on the unpaid portion(s) on all accounts with a past due balance. The unpaid portions and late payment penalty shall be due immediately. 5.2 Payment Plan. City Utility Department may authorize an adjustment and/or payment plans for delinquent accounts for total delinquent amounts not exceeding $5,000.00. A request for a payment plan shall be directed to the City Utility Department. The City will only authorize adjustments and/or payment plans on a case -by -case basis based upon the facts and circumstances of each account. The City Utility Department reserves the right to obtain City Council approval before authorization of an adjustment or payment plan is finalized. 5.2.1 Shut -off for nonpayment. If any bill is not paid by the due date listed on the bill, a shut -off notice will be mailed by first class mail and shall state that if full payment is not made by the date specified in the shut -off notice OR if a mutually agreeable payment plan is not approved by the City Utility Department (pursuant to Paragraph 5.2 herein), water service to the premises will be shut off for nonpayment. 5.2.2 The shut -off notice shall contain the address and telephone number of the City Utility Department in charge of billing; that information shall be clearly visible and easily readable on the shut -off notice. 5.2.3 A disconnection fee and a reconnection fee, as set forth in the City of Otsego fee schedule and duly adopted by ordinance, must be paid in addition to the outstanding delinquent balance before water service will be turned back on. 5.3 Certification for collection with taxes. Unpaid charges on sewer and water accounts shall not be certified to the Wright County Auditor until notice and an opportunity for a hearing have been provided to the owner of the premises involved. The City may certify unpaid charges to Wright County on a quarterly basis beginning on October 1 2007. After October 1st, 2007, certifications may be made on or about January 2 °d, April 1 July 1st and October 1 of each year. The notice shall be sent by first class mail and shall state that if payment is not made within thirty (30) days after adoption of the assessment roll, the entire amount unpaid plus penalties or fees will be certified to the county auditor for collection as other taxes are collected. The notice shall also state that the occupant may attend the scheduled hearing on the matter to object to certification of unpaid utility charges. There shall be an administrative charge due upon the mailing or electronic transmittal of the notice of the proposed assessment. The administrative charge shall be set forth in the City of Otsego fee schedule which is duly adopted by ordinance. 5.4 The owner of the property shall have the option of paying the balance due on the account until the date the notice of the certification hearing is mailed. After the date the notice of certification hearing is mailed, payments will still be accepted but will include unpaid penalties. 5.5 A hearing shall be held on the matter by the City Council. Property owners with unpaid utility charges shall have the opportunity to object to the certification of unpaid charges to be collected as taxes are collected. If, after the hearing, the City Council finds the that the amounts claimed as delinquent are actually due and unpaid and that there is no legal reason why the unpaid charges should not be certified for collection with taxes in accordance with this ordinance, the City may certify the unpaid charges to the county auditor for collection as other taxes are collected. 5.6 For each certification sustained, the property owner shall have the following options after the hearing: 5.6.1 To pay the delinquent amount listed on the preliminary roll, but without additional interest after the hearing, within thirty (30) days of the hearing date. 5.6.2 To pay the certified charges as billed to them by Wright County on their property tax statement with a collection term of one year. 5.7. After the hearing, the certified roll, minus any payments, shall be delivered to the Wright County Auditor. SECTION 6. WATER LINE CONNECTIONS. 6.1. Every premises served by a water hookup shall have a separate connection and a separate meter. For purposes of this ordinance, a premise may include more than one residential unit if approved by the City or pursuant to a specific agreement with the City. 6.2. No person, firm, or corporation shall hook up any water connection or meter to the City water line without first obtaining a permit therefore from the City. The initial connection and turn -on operation for any water system connection shall only be performed by a City employee or authorized agent. 6.3. Licensed plumber required. No person, firm, or corporation may hook up or service any water line connected to the City water system unless said person, firm or corporation is a plumber duly licensed under the laws of the State of Minnesota or the ordinances of the City. 6.4. The connection charge imposed by the City for hookup to the municipal water system shall be set by a duly adopted ordinance of the Otsego City Council. 6.5. Residential Equivalent Connections (RECs) will be established for non- residential users. The number of RECs per use will be per the current version of the Metropolitan Council Environmental Services Procedures Manual or will be otherwise determined by City Council decision. 6.6. Each property shall connect to the City of Otsego water, sanitary sewer and stormwater system unless excepted by a City Council decision, resolution, or unless previous approval by the City Council. Specific exceptions may be made for certain properties allowing the continued use of a well for irrigation purposes only after connection to City water. SECTION 7. METERS. 7.1. All water consumption shall be measured by a City- provided meter. Meters shall be supplied to customers at a price determined by the City. 7.2. Except for the extinguishment of fires, no person other than an authorized City employee shall use water from the City water system unless the water passes through a meter supplied by or approved by the City. No person not authorized by the City shall connect, disconnect, take apart, or in any manner change or interfere with any such meter or its use. 7.3. Every water meter shall be installed pursuant to City specifications. 7.4. Authorized meter readers and repair personnel shall have free access at reasonable hours of the day to all parts of every building and premises connected with the City water supply system in order to read meters, make inspections and make repairs. Denial of such access may result in water service being shut off. 7.5. The property owner or builder shall pay for the initial water meter(s) installed at each property. After such initial purchase and installation of the water meter(s), the City shall maintain and repair, at its expense, any meter that has become unserviceable through ordinary wear and tear and shall replace the meter if necessary. Where repair or replacement is made necessary by act or neglect of the owner or occupant of the premises, any City expense caused thereby shall be a charge against and collected from the water consumer, and water service may be discontinued until the cause is corrected and the amount charged is paid. 7.6.1. When a consumer complains that a bill for any past water consumption and • use is excessive, the City shall have the meter re -read upon the consumer's written request. If the consumer remains dissatisfied, the consumer may, upon written request, have the meter tested. If the test shows an error in the City's favor exceeding five percent (5 %) of water consumed, a new meter shall be installed, and the bill shall be adjusted accordingly. If the test shows an error in the customer's favor exceeding five percent (5 %) of the water consumed, such adjustment shall not extend back more than the last billing period from the date of the written request. The result of any test shall be reported to the owner or consumer in every case. 7.6.2. If the City becomes aware of an error for any past water consumption or billing in the property owner's favor, the City will reimburse the property owner for the amount paid in error. Adjustments shall not extend back more than six (6) years from the date of notice of the error. 7.6.3. If the City becomes aware of an error for any past water consumption or billing in the City's favor, the City may correct said error and collect unpaid amounts from Owner for water service provided. In that event the City shall provide owner with documentation and an explanation of the error and the adjustment shall not extend back more than six (6) years from the date of notice of the error and the City shall provide for a payment plan. 7.7. The City reserves the right to remove and /or replace meters as to size and type when deemed necessary by the City. SECTION 8. SERVICE PIPES; RESPONSIBILITY FOR REPAIRS. 8.1. The service pipe from the water main to the meter and the connections thereto shall be the property of the consumer. The pipe must be protected and maintained by the consumer. In the event the consumer fails to make any necessary repairs to the service connections or pipe within 24 hours after being notified to do so by the City, the City shall disconnect the premises from City water. 8.2. The cost of all repairs and replacement of any plumbing or service pipes between the property and the main city utility line(s) shall be borne entirely by the owner of the property affected, and if such repair or replacement work is performed by the City, the cost of time and material shall be assessed against the owner of the affected property. SECTION 9. CITY LIABILITY 9.1. The City shall not be liable for any damages resulting from stoppage of the supply or flow of water as the result of breaks in any mains, service pipes or fixtures, by reason of the breaking of machinery or stoppage for necessary repair or any other interruption of service. SECTION 10. FIRE HYDRANTS 10.1. No person, except a person authorized by the City, shall be allowed to use any fire hydrant in the City for any purpose whatsoever without first securing a permit from the City. Payment for the water used, except for firefighting, shall be made in accordance with the rate schedule duly adopted by the City Council. SECTION 11. DISCONTINUED SERVICE. 11.1. A property owner desiring to discontinue the use of city water shall notify the City to that effect, who shall have the service at the curb stop box cut off by authorized personnel. No unauthorized person shall cut off the water service. Where City water has been turned off, it will be turned on only when: (1) a fee is paid; and (2) all unpaid fees, usage charges and late payment penalties are paid. In addition, water service may be shut off at any stop box connection whenever: - (1) the owner or occupant of the premises served or any person working on any pipes or equipment thereon which are connected with the water system has violated or threatens to violate any of the provisions of this Ordinance; (2) any charge for water, service, meter or any other financial obligation imposed on the present or former owner of occupant of the premises served is unpaid and in default; and (3) fraud or misrepresentation by the owner or occupant of the premises served in connection with any application for service. SECTION 12. PENALTY. 12.1. Violation of a provision of this Ordinance is a misdemeanor and, upon conviction thereof, a person may be punished by a fine of not more than one thousand dollars ($1,000.00), or such other amount set by law, or imprisonment for a term not to exceed ninety (90) days, or such other term set by law, or both, but in either case, the costs of prosecution may be added. Each act of violation and each day on which a violation occurs or continues is a separate violation. The provisions of this Section notwithstanding, no penalty shall be greater than that established by state statute for the same offense. The City reserves the right to enforce the terms and conditions of this ordinance by use of Administrative Enforcement procedures or any applicable action in law or equity. SECTION 13. REPEAL. 13.1. Chapter 6, Sections 2 and 3 of the Otsego City Code (which codified City of Otsego Ordinances #00 -11 (June 26, 2000) and #00 -12 (June 26, 2000)) are hereby repealed in their entirety. 13.2 Any other ordinances or parts of ordinances in conflict with this Ordinance are to the extent of such conflict hereby repealed. One ordinance proposes to prohibit lawful gambling in the City of Otsego, subject to exceptions provided for by state law (for example, certain raffle events). The other proposed ordinances provides for city regulation of lawful gambling. Specifically, this proposed ordinance provides for a trade area, which requires that a licensed organization conducting lawful gambling within the City's jurisdiction expend all or a portion of its expenditures for lawful purposes conducted or located within the city's trade area. The percentage that the city requires to be spent within the trade area must be specified in the ordinance defining the trade area. The trade area must include contiguous cities and townships in addition to the City of Otsego. In addition, the proposed ordinance regulating lawful gambling may require organizations conducting lawful gambling within the City to contribute 10 percent of their net profits derived from lawful gambling to a fund administered and regulated by the City. The City may disburse the funds for lawful purposes. Lawful purposes for which these funds may be expended are listed in Minn. Stat. § 349.12, subd. 25. and I have attached a copy of that provision for your reference. Cities may also expend these funds for police, fire, and other emergency or public safety- related services, equipment and training, (excluding pension fund contributions). A city making expenditures authorized under this paragraph must by March 15 of each year file a report with the Board, on a form the Board prescribes, that lists all such revenues collected and expenditures for the previous calendar year. Another item for you to consider is whether you would like to limit the number of locations where lawful gambling may occur. (10) a contribution to the United States, this state or any of its political subdivisions, or any agency or instrumentality thereof other than a direct contribution to a law enforcement or prosecutorial agency; (11) a contribution to or expenditure by a nonprofit organization which is a church or body of communicants gathered in common membership for mutual support and edification in piety, worship, or religious observances; (13) a contribution to or expenditure on projects or activities approved by the commissioner of natural resources for: (i) wildlife management projects that benefit the public at large; (ii) grant -in -aid trail maintenance and grooming established under sections 84.83 and 84.927, and other trails open to public use, including purchase or lease of equipment for this purpose; and (iii) supplies and materials for safety training and educational programs coordinated by the Department of Natural Resources, including the Enforcement Division; (14) conducting nutritional programs, food shelves, and congregate dining programs primarily for persons who are age 62 or older or disabled; (17) expenditure by a licensed veterans organization of up to $5,000 in a calendar year in net costs to the organization for meals and other membership events, limited to members and spouses, held in recognition of military service. No more than $5,000 can be expended in total per calendar year under this clause by all licensed veterans organizations sharing the same veterans post home; (18) payment of fees authorized under this chapter imposed by the state of Minnesota to conduct lawful gambling in Minnesota; or (19) a contribution or expenditure to honor an individual's humanitarian service as demonstrated through philanthropy or volunteerism to the United States, this state, or local community. ADOPTION OF STATE LAW BY REFERENCE The provisions of Minnesota Statutes, Chapter 349, as they may be amended from time to time, with reference to the definition of terms, conditions of operation, provisions relating to sales, and all other matters pertaining to lawful gambling are hereby adopted by reference and are made a part of this ordinance as if set out in full. It is the intention of the Council that all future amendments of Minnesota Statutes, Chapter 349, are hereby adopted by reference or referenced as if they had been in existence at the time this ordinance was adopted. Section 2. CITY MAY BE MORE RESTRICTIVE THAN STATE LAW The Council is authorized by the provisions of Minnesota Statutes, Section 349.213, as it may be amended from time to time, to impose, and has imposed in this ordinance, additional restrictions on gambling within its limits beyond those contained in Minnesota Statutes, Chapter 349, as it may be amended from time to time. Section 3. PURPOSE The purpose of this ordinance is to prohibit lawful gambling within the City of Otsego. Section 4. DEFINITIONS In addition to the definitions contained in Minnesota Statutes, Section 349.12, as it may be amended from time to time, the following terms are defined for purposes of this ordinance: CITY, as used in this ordinance, means the City of Otsego. COUNCIL, as used in this ordinance, means the City Council of the City of Otsego. LAWFUL GAMBLING, as used in this ordinance, means the operation, conduct or sale of bingo, raffles, paddlewheels, tipboards, and pull -tabs. Section 5. APPLICABILITY This ordinance shall be construed to prohibit all forms of lawful gambling within the city except: (i) Bingo conducted within a nursing home or a senior citizen housing project or by a senior citizen organization if the prizes for a single bingo game do not exceed $10, total prizes awarded at a single bingo occasion do not exceed $200, no more than two bingo occasions are held by the organization or at the facility each week, only members of the organization or residents of the nursing home or housing project are allowed to play in a bingo game, no compensation is paid for any persons who conduct the bingo, and a manager is appointed to supervise the bingo. (ii) Raffles if the value of all prizes awarded by the organization in a calendar year does not exceed $1,500. Section 6. LAWFUL GAMBLING PROHIBITED No person or organization shall conduct lawful gambling within the City of Otsego. Section 7. PENALTY Any person who violates: (1) Any provision of this ordinance; (2) Minnesota Statutes, Sections 609.75- 609.763, inclusive, as they may be amended from time to time; or (3) Minnesota Statutes, Sections 349.11- 349.21, as they may be amended from time to time or any rules promulgated under those sections, as they may be amended from time to time shall be guilty of a misdemeanor and shall be subject to a fine of not more than $1,000 or imprisonment for a term not to exceed 90 days, or both, plus in either case the costs of prosecution. In addition, violations shall be reported to the State Gambling Board and recommendation shall be made for suspension, revocation, or cancellation of an organization's license. Section 8. SEVERABILITY If any provision of this ordinance is found to be invalid for any reason by a court of competent jurisdiction, the validity of the remaining provisions shall not be affected. Section 9. EFFECTIVE DATE This ordinance becomes effective on the date of its publication, or upon the publication of a summary of the ordinance as provided by Minnesota Statute, Section 412.191, Subdivision 4, as it may be amended from time to time, which meets the requirements of Minnesota Statute Section 331A.01, Subdivision. 10, as it may be amended from time to time. LICENSED ORGANIZATION, as used in this ordinance, means an organization licensed by the Board. LOCAL PERMIT, as used in this ordinance, means a permit issued by the city. TRADE AREA, as used in this ordinance, means the City of Otsego, City of Albertville, City of Elk River, City of Dayton, Hassan Township and Monticello Township. Section 5. APPLICABILITY This ordinance shall be construed to regulate all forms of lawful gambling within the city except: (i) Bingo conducted within a nursing home or a senior citizen housing project or by a senior citizen organization if the prizes for a single bingo game do not exceed $10, total prizes awarded at a single bingo occasion do not exceed $200, no more than two bingo occasions are held by the organization or at the facility each week, only members of the organization or residents of the nursing home or housing project are allowed to play in a bingo game, no compensation is paid for any persons who conduct the bingo, and a manager is appointed to supervise the bingo. (ii) Raffles if the value of all prizes awarded by the organization in a calendar year does not exceed $1,500. Section 6. LAWFUL GAMBLING PERMITTED Lawful gambling is permitted within the city provided it is conducted in accordance with Minnesota Statutes, Sections 609.75- 609.763, inclusive, as they many be amended from time to time; Minnesota Statutes, Sections 349.11- 349.23, inclusive, as they may be amended from time to time; and this ordinance. Section 7. COUNCIL APPROVAL Lawful gambling authorized by Minnesota Statutes, Sections 349.11- 349.23, inclusive, as they may be amended from time to time, shall not be conducted unless approved by the Council, subject to the provisions of this ordinance and state law. Section 8. APPLICATION AND LOCAL APPROVAL OF PREMISES PERMITS Subd. 1. Any organization seeking to obtain a premises permit or renewal of a premises permit from the Board shall file with the city clerk an executed, complete duplicate application, together with all exhibits and documents accompanying the application as will be filed with the Board. Subd. 2. Upon receipt of an application for issuance or renewal of a premises permit, the city clerk shall transmit the application to the county sheriff for review and recommendation. Subd. 3. The county sheriff shall investigate the matter and make the review and recommendation to the City Council as soon as possible, but in no event later than 45 days following receipt of the notification by the city. Subd. 4. Organizations applying for a state issued premises permit shall pay the city a $100.00 investigation fee. This fee shall be refunded if the application is withdrawn before the investigation is commenced. Subd. 5. The applicant shall be notified in writing of the date on which the Council will consider the recommendation. Subd. 6. The Council shall receive the police chiefs report and consider the application within 45 days of the date the application was submitted to the city clerk. Subd. 7. The Council shall, by resolution, approve or disapprove the application within 60 days of receipt of the application. Subd. 8. The Council shall deny an application for issuance or renewal of a premises permit for any of the following reasons: (i) Violation by the gambling organization of any state statute, state rule, or city ordinance relating to gambling within the last three years. (ii) Violation by the on -sale establishment, or organization leasing its premises for gambling, of any state statute, state rule, or city ordinance relating to the operation of the establishment, including, but not limited to, laws relating to alcoholic beverages, gambling, controlled substances, suppression of vice and protection of public safety within the last three years. (iii) Lawful gambling would be conducted at premises other than those for which an on -sale liquor license has been issued. (iv) Lawful gambling would be conducted at more than _ premises within the city. (v) An organization would be permitted to conduct lawful gambling activities at more than one premises in the city. (vi) More than one licensed, organization would be permitted to conduct lawful gambling activities at one premises. (vii) Failure of the applicant to pay the investigation fee provided by Subdivision 4 within the prescribed time limit. (viii) Operation of gambling at the site would be detrimental to health, safety, and welfare of the community. Otherwise the Council shall pass a resolution approving the application. Section 9. LOCAL PERMITS Subd. 1. No organization shall conduct lawful gambling excluded or exempted from state licensure requirements by Minnesota Statue, Section 349.166, as it may be amended from time to time, without a valid local permit. This section shall not apply to lawful gambling exempted from local regulation by Section 5 of this ordinance. Subd. 2. Applications for issuance or renewal of a local permit shall be on a form prescribed by the city. The application shall contain the following information: (i) Name and address of the organization requesting the permit. (ii) Name and address of the officers and person accounting for receipts, expenses, and profits for the event. (iii) Dates of gambling occasion for which permit is requested. (iv) Address of premises where event will occur. (v) Copy of rental or leasing arrangement, if any, connected with the event including rental to be charge to organization. (vi) Estimated value of prizes to be awarded. Subd. 3. The fee for a local permit shall be $100. The fee shall be submitted with the application for a local permit. This fee shall be refunded if the application is withdrawn before the investigation is commenced. Subd. 4. The Council shall receive the public safety department's report and consider the application within 45 days of the date the application was submitted to the city clerk. Subd. 8. The Council shall deny an application for issuance or renewal of a premises permit for any of the following reasons: (i) Violation by the gambling organization of any state statute, state rule, or city ordinance relating to gambling within the last 3 years. (ii) Violation by the on -sale establishment, or organization leasing its premises for gambling, of any state statute, state rule, or city ordinance relating to the operation of the establishment, including, but not limited to, laws relating to the operation of the establishment, laws relating to alcoholic beverages, gambling, controlled substances, suppression of vice and protection of public safety within the last three years. (iii) The organization has not been in existence in the city for at least three consecutive years prior to the date of application. (iv) The organization does not have at least 15 active members. (v) Exempted or excluded lawful gambling will not take place at a premises the organization owns or rents. (vi) Exempted or excluded lawful gambling will not be limited to a premises for which an on -sale liquor license has been issued. (vii) Exempted or excluded lawful gambling will occur at more than premises within the city. (viii) An organization will have a permit to conduct exempted or excluded lawful gambling activities on more than one premises in the city. (ix) More than one licensed, qualified organization will be conducting exempted or excluded lawful gambling activities at any one premises. (x) Failure of the applicant to pay the permit fee provided by Subd. 3 within the prescribed time limit. (xi) Operation of gambling at the site would be detrimental to health, safety, and welfare of the community. Otherwise the Council shall approve the application. Subd. 9. Local permits shall be valid for one year after the date of issuance unless suspended or revoked. Section 10. REVOCATION AND SUSPENSION OF LOCAL PERMIT Subd. 1. A local permit may be revoked, or temporarily suspended for a violation by the gambling organization of any state statute, state rule, or city ordinance relating to gambling. Subd. 2. A license shall not be revoked or suspended until notice and an opportunity for a hearing have first been given to the permitted person. The notice shall be sent by certified mail and shall state the provision reasonably believed to be violated. The notice shall also state that the permitted person may demand a hearing on the matter, in which case the permit will not be suspended until after the hearing is held. If the permitted person requests a hearing, the Council shall hold a hearing on the matter at least one week after the date on which the request is made. If, as a result of the hearing, the Council finds that an ordinance violation exists, then the Council may suspend or revoke the permit. Section 11. LICENSE AND PERMIT DISPLAY All permits issued under state law or this ordinance shall be prominently displayed during the permit year at the premises where gambling is conducted. Section 12. NOTIFICATION OF MATERIAL CHANGES TO APPLICATION An organization holding a state issued premises permit or a local permit shall notify the city within 10 days in writing whenever any material change is made in the information submitted on the application. Section 13. CONTRIBUTION OF NET PROFITS TO FUND ADMINISTERED BY CITY Subd. 1. Each organization licensed to conduct lawful gambling within the city pursuant to Minnesota Statute, Section 349.16, as it may be amended from time to time, shall contribute 10 percent of its net profits derived from lawful gambling in the city to a fund administered and regulated by the city without cost to the fund. The city shall disburse the funds for lawful purposes as defined by Minnesota Statutes Section 349.12, Subdivision 25, as it may be amended from time to time. Subd. 2. Payment under this section shall be made on the last day of each month. Subd. 3. The city's use of such funds shall be determined at the time of adoption of the city's annual budget or when the budget is amended. Section 14. DESIGNATED TRADE AREA Subd. 1. Each organization licensed to conduct gambling within the city shall expend 100 percent of its lawful purpose expenditures on lawful purposes conducted within the city's trade area. Subd. 2. This section applies only to lawful purpose expenditures of gross profits derived from gambling conducted at a premise within the city's jurisdiction. Section 15. RECORDS AND REPORTING Subd. 1. Organizations conducting lawful gambling shall file with the city clerk one copy of all records and reports required to be filed with the Board, pursuant to Minnesota Statutes, Chapter 349, as it may be amended from time to time, and rules adopted pursuant thereto, as they may be amended from time to time. The records and reports shall be filed on or before the day they are required to be filed with the Board. Subd. 2. Organizations licensed by the Board shall file a report with the city proving compliance with the trade area spending requirements imposed by Section 16. Such report shall be made on a form prescribed by the city and shall be submitted annually and in advance of application for renewal. Section 16. HOURS OF OPERATION Lawful gambling shall not be conducted between 2 a.m. and 8 a.m. on any day of the week. Section 17. PENALTY Any person who violates: (1) Any provision of this ordinance; (2) Minnesota Statutes, Sections 609.75- 609.763, inclusive, as they may be amended from time to time; or (3) Minnesota Statutes, Sections 349.11- 349.21, as they may be amended from time to time or any rules promulgated under those sections, as they may be amended from time to time shall be guilty of a misdemeanor and shall be subject to a fine of not more than $1,000 or imprisonment for a term not to exceed 90 days, or both, plus in either case the costs of prosecution. In addition, violations shall be reported to the Board and recommendation shall be made for suspension, revocation, or cancellation of an organization's license. Section 18. SEVERABILITY If any provision of this ordinance is found to be invalid for any reason by a court of competent jurisdiction, the validity of the remaining provisions shall not be affected. Section 19. EFFECTIVE DATE This ordinance becomes effective on the date of its publication, or upon the publication of a summary of the ordinance as provided by Minnesota Statute, Section 412.191, Subdivision 4, as it may be amended from time to time, which meets the requirements of Minnesota Statute Section 331A.01, Subdivision 10, as it may be amended from time to time. The Park & Recreation Commission recommends that these be posted at the entrances to all City parks. The City of Otsego believes these rules are necessary to limit damaging behaviors and to preserve our park facilities for the future. Park Hours are 5:00 a.m. to 11:00 p.m. All litter must be placed in trash cans. Motor vehicles are prohibited except on designated streets and parking lots. No firearms, weapons, fireworks, or glass containers are allowed. Fires are allowed only at picnic grills and must be extinguished before leaving. Skateboards, Rollerblades and Bikes are not permitted in the play equipment areas. No loud music or disorderly behavior. Pets must be leashed and all droppings picked up. Permits for rental of the Park Shelter can be obtained at Otsego City Hall, 763/441 -4414. (Only in parks with shelters). No vandalism of park property or destruction of vegetation.
