Roll Call: Mayor Jessica Stockamp; Councilmembers: Tom Darkenwald, Brittany Moores, and Jeff Dahl. City Staff: City Administrator/Finance Director Adam Flaherty, Human Resources/Assistant City Administrator Sabrina Hille; City Engineer Ron Wagner; City Planner Daniel Licht; City Attorney Dave Kendall; and City Clerk Audra Etzel. Absent: Councilmember Tina Goede. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Open Forum: Mayor Stockamp opened the Open Forum at 7:01 PM. No one from the public spoke. Conduct Public Hearing. D. Consider Ordinance 2022-17 Amending the City Code Regarding the 2023 Fee Schedule. City Clerk Etzel attested to the legal notice being published and posted as required and confirmed no comments have been received. City Planner Licht presented the staff report reviewing the proposed fee schedule for 2023. Mayor Stockamp opened the Public Hearing at 7:11 PM. No one from the public spoke. Mayor Stockamp closed the Public Hearing at 7:11 PM. CM Darkenwald asked about the escrow fees for development. City Planner Licht noted staff has been experiencing increased work required to get them ready for Council consideration, having enough funds in the escrow benefits the City to ensure development pays for itself and involves less effort for the Finance Department in invoicing overdrawn escrow accounts. CM Darkenwald questioned the park dedication fee for industrial properties. City Planner Licht said now that the industrial areas are established, there is less of a need to incentivize the development and the fees will help with park development. CM Dahl motioned to adopt Ordinance 2022-17 amending the City Code regarding the 2023 fee schedule and approve publication in summary form, seconded by CM Moores. All in favor. Motion carried 4-0. 5. Engineering_ 5.1 Otsego Creek Hydraulic Stud A. Presentation by City Engineer. B. Consider Approval of Amendment No. 1 to the Professional Services Agreement. This item was previously discussed at the November 28t" meeting and City Council tabled for more information. City Engineer Wagner presented the staff report. City Engineer Wagner said the City needs to complete an Otsego Creek Rehabilitation Project in conjunction with the Prairie Pointe Development. The DNR had some additional modeling requirements to obtain permits for the rehab project. Earlier in the year the City entered a contract with AE2S to complete a model. In the review process with the DNR, the DNR added a requirement to complete a second model to better align with the pending renewal of FEMA flood plain mapping. A second model over the same area essentially doubles the scope of work necessary, thus the amendment for an additional $18,500. City Engineer Wagner noted Justin Klabo from AE2S was available for questions. CM Darkenwald asked about the original contract of $18,500 and why the cost is an additional $18,500, when some of the modeling would have been repetitive from the previous model. Engineer Klabo said the additional model needed to be recreated. CM Darkenwald asked which organization is working on the new model? City Engineer Wagner said most counties in the State have had their FEMA models Page 2 of 5 MINUTES OF THE CITY OF OTSEGO REGULAR CITY COUNCIL MEETING DECEMBER 12, 2022 updated and approved; Otsego is proposed to be updated in 2024. The Otsego Creek is a newer flood plain. City Engineer Wagner said since about 1998, all the developments have a stormwater overflow. Adding, no homes have flood with this added safety feature in place. Mayor Stockamp asked about FEMA and the DNR updating the maps in 2024. City Planner Licht said the preliminary review is more accurate and some areas currently in the flood plain will no longer be considered in the flood area. City Engineer Wagner noted the map was last updated in the 1960s. CM Moores said the City Council delayed approval at the last meeting due to lack of information. CM Darkenwald motioned to approve Amendment No. 1 to Professional Services Agreement for storm water hydraulic modeling of Otsego Creek with Advanced Engineering and Environmental Studies, LLC (AE2S) in the amount of $18,500, seconded by CM Moores. CM Darkenwald asked staff and AE2S to notify the City Council of increases in a timelier manner in the future. All in favor. Motion carried 4-0. 6. Administration: 6.1 Facility Design Services Agreement. A. Presentation by Wold Architects and Engineers. B. Consider Acceptance of Proposal and Approval of Facility Design Services Agreement. City Administrator/Finance Director Flaherty introduced Jonathan Loose from Wold Architects. Wold Architects and Engineer representative Jonathan Loose gave an update of the process from the last 18 months, including a new City Hall, Public Works buildout, cold storage, and updates to Prairie Center. The design phase will get into more detail for the core planning groups of the facilities. Wold has a solid basis with the square footage and needs. More feedback will be gathered before putting together the design phase and then construction documents. Mr. Loose said this is their formal proposal to move forward with the project, noting the design process will take 6-9 months. Attorney Kendall said the contract has been reviewed and their recommendations that were accepted. CM Darkenwald asked about Article 11 of the commission process of the contract. Mr. Loose said there are certain conditions where a third party would inspect and verify the buildout is functioning properly. CM Darkenwald asked about the fee listed in Article 11.2 and 11.3. Mr. Loose said the fixed fees are outlined in schedule A. CM Darkenwald further asked about Article 11.8.1.11. Mr. Loose said this is for the licensing software for modeling that may need to be updated. CM Darkenwald asked if Article 11.8.1.11 could be removed? Mr. Loose said they can remove this Article. CM Darkenwald motioned to approve the agreement between the City of Otsego and Wold Architects and Engineers and to accept the proposal to perform full architectural and engineering consulting services, excluding article 11.8.1.11, seconded by CM Dahl. CM Darkenwald asked to verify where this cost would be expensed. City Administrator/Finance Director Flaherty said the cost would come from Fund 414 — Capital Improvement Revolving. All in favor. Presentation by Assistant City Administrator/Human Resources B. Consider Approval of a Job Description. Assistant City Administrator/Human Resources Director Hille presented the Emergency Services Director job description that has been prepared for consideration. Staff is awaiting the position scoring in the Safe System. The Pay Grade within the City's pay plan will be brought as a future recommendation to City Council in January, as well as the proposed recruitment schedule. Mayor Stockamp asked if the interview panel has been finalized. Assistant City Administrator/Human Resources Director Hille said staff would like to have more information before making a recommendation. CM Darkenwald asked if this has been reviewed by the City's consultant. Assistant City Administrator/Human Resources Director Hille said Jerry Streich with Capstone Public Sector Solutions helped draft the job description. CM Moores motioned to approve the Emergency Services Director job description and authorize staff to begin the preparation of recruitment for later review by City Council, seconded by CM Dahl. All in favor. Motion carried 4-0. 6.3 2023 Budgets and Property Tax Levv. A. Truth in Taxation Presentation by City Administrator/Finance Director. B. Public Input. C. Consider Resolution 2022-98 Adopting the 2023 Annual Operating Budgets. D. Consider Resolution 2022-99 Setting the Final Property Tax Levy for Taxes Payable 2023. E. Consider Resolution 2022- 100 Adopting the 2023-32 Capital Improvement Plan. City Administrator/Finance Director Flaherty presented the 2023 Truth in Taxation Presentation. Mayor Stockamp opened the Public Comment at 8:14 PM. No one from the public spoke. Mayor Stockamp closed the Public Comment at 8:14 PM, CM Darkenwald noted the 2023 tax capacity and residential increase is part of the market value increase in relationship to taxpayers paying a higher portion of City taxes. CM Darkenwald motioned to adopt Resolution 2022-98 Adopting the 2023 Annual Operating Budgets; to adopt Resolution 2022-99 Setting a Final Property Tax Levy for Taxes Payable in 2023; and to adopt Resolution 2022-100 Adopting the 2023-2032 Capital Improvement Plan, seconded by CM Moores. CM Darkenwald asked how many budget meetings have been held? City Administrator/Finance Director Flaherty noted there have been eleven meetings including tonight. All in favor. Motion carried 4-0. 7. City Council Reports and Updates: Special Recognition: City Councilmember Tom Darkenwald. Mayor Stockamp said this was CM Darkenwald's last meeting and presented him with a plaque from the City to thank him for all his years of service. Dave Thomson, 8393 Ochoa Court said he has worked with CM Darkenwald on the Planning Commission and thanked him for his service. CM Darkenwald said he always tried to do his best and put the City and residents first. CM Moores attended the ribbon cutting for Gomez Law, their organization works with families in need. Mayor Stockamp said she and Assistant City Administrator/Human Resources Director Hille recently attended the Wright County Mayors Association. Santa Day was last Saturday and she thanked the Parks and Recreation staff. 8. Staff Reports and Updates Assistant City Administrator/Human Resources Director Hille noted the Emergency Services pay range and interview schedule will come back for review in January. City Administrator/Finance Director Flaherty said the I94 Corridor Coalition is hosting their annual Legislative Preview event on January 6th, more details to follow. Due to the mail interruption staff is recommending City Council consider waiving fees for delinquent utility bills due this month. CM Darkenwald motioned to waive the late fees for utility billings for this month, seconded by CM Moores. All in favor. Motion carried 4-0. City Clerk Etzel said staff has posted and published the Advisory Commission openings. City Planner Licht noted there is no Planning Commission scheduled until next year and there are many commercial projects in the works. Sergeant Jason Oltmanns with the Wright County Sheriff's Department noted a public thanks to one of their staff members that has been investigating an issue in Otsego. 9. Adjournment.
