2023.01.09 City Council MinutesOTSEGO CITY COUNCIL MEETING MONDAY, JANUARY 9, 2023 7:00 PM OTSEGO PRAIRIE CENTER Call to Order: Mayor Stockamp called the meeting to order at 7:00 PM. Roll Call: Mayor Jessica Stockamp and Councilmembers: Brittany Moores, Jeff Dahl, and Ryan Dunlap. City Staff: City Administrator/Finance Director Adam Flaherty, Human Resources/Assistant City Administrator Sabrina Hille, City Engineer Ron Wagner, City Planner Daniel Licht, City Attorney Dave Kendall, and City Clerk Audra Etzel. Absent: Councilmember Tina Goede. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Oath of Office: City Clerk Etzel performed the duty of swearing in Councilmember Ryan Dunlap. 2. Open Forum: Mayor Stockamp opened the Open Forum at 7:03 PM. Walter Hudson, of 6027 I<alland Cir NE, Albertville and Minnesota House Representative District 30A, introduced himself and gave a brief update. CM Dahl asked if there was any talk to raise the homestead market value exclusion? Representative Hudson. noted the homestead market value exclusion has not kept up inflation and he will look into this. Corey Tanner of 7952 Palm�ren Ave NE, congratulated Councilmember Dunlap on being elected. Mr. Tanner stated he has concerns about Councilmember Elect Goede's attendance over the last four years, noting she missed 25 City meetings. He asked what are the rules and how does the City Council hold members to be accountable? Mayor Stockamp closed the Open Forum at 7:13 PM. 3. Consider Agenda Approval: CM Moores motioned to approve the agenda as written, seconded by CM Dunlap. All in favor. Motion carried 4-0. 4. Consent Agenda. 4.1 Approve Claims List. 4.2 Approve City Council Meeting Minutes. A. December 12, 2022 Meeting. 4.3 Approve City Council Special Compensation for December 2022, Page 1 of 6 MINUTES OF THE CITY OF OTSEGO REGULAR CITY COUNCIL MEETING JANUARY 9, 2023 4.4 Adopt Resolution 2023-01 Designating an Official Newspaper. 4.5 Adopt Resolution 2023-02 Designating Depositories and Approving Investment Brokers. 4.6 Adopt Resolution-03 Accepting Public Improvements for ISD #728 Otsego &8 School Addition. 4.7 Accept the Wellhead Protection Plan Annual Report. 4.8 ADDrove Pav Application #2 (Final) for the 2022 Street Maintenance Project. 4.9 Approve Pay Application #5 for the West WWTF Improvements Phase 1 Project. 4.10 Approve the 2024-2025 Assessment Services Agreement with Wright County. 4.11 Adopt Resolution 2023-04 Approving the Aeencv Agreement with the State of Minnesota. CM Moores motioned to approve the consent agenda as written, seconded by CM Dahl. All in favor. Motion carried 4-0. 5. Engineering: 5.1 TH 101 Ramps Signals Improvement Project: A. Presentation by City Engineer. B. Consider Approval of Change Order No. 1. City Engineer Wagner stated MnDOT determined an additional signal was needed at the intersection of CSAH 42. Change Order #1 includes an additional pedestal, base, signal head and associated materials are needed to meet the requirements of MnDOT and MN Uniform Traffic Control Devices. The Contractor's quote is $9,229.36 and the City would pay 25%, which is $2,307.34, CM Moores asked if the County was paying the other 75% of the costs and the City is paying 25%r City Engineer confirmed this is correct. CM Dahl motioned to approve Change Order No. 1 in the amount of $9,229.36 for the TH101 Ramps Signals Improvement Project, Ci#y Project No. 22-09, seconded by CM Dunlap. All in favor. Motion carried 4-0. 5.2 70th Street Turn Lanes Improvement Project: A. Presentation by City Engineer. B. Consider Authorization to Prepare Plans and Specifications. City Engineer Wagner stated staff is recommending adding turn lanes at the intersection of 70cn Street (CSAH 38) and Martin Farms Avenue for improved safety. Noting the additional pavement and adjusted curb line and bike trail will provide space for dedicated left and right turn movements off of CSAH 38 and into the housing developments north and south of CSAH 38. If approved, the City would have completed prior to the County completing a mill, overlay and restriping project in 2023. City Administrator/Finance Director Flaherty said the funds would come from the same source and the budget estimate is based on the construction estimates but did not include the engineering costs. Mayor Stockamp had concerns and asked if there were any plans to address a pedestrian crossing at CSAH 38? City Engineer Wagner said this is a 50 MPH zone switching up to 55 MPH and it is not recommended to have a pedestrian crossing at that location for safety reasons. City Planner Licht added with all the sidewalks that developed in the neighborhood, the expectation was people would walk west to Maciver and take the trail to cross at the roundabout. Staff has discussed with adoption of the crosswalk policy to plan for trails on both sides of County Roads in the future. If a person is coming north out of that neighborhood, they could go west to the roundabout and another roundabout at McAllister is planned in the future. CM Dahl motioned to authorize preparation of plans and specifications for the Martin Farms Avenue and 70th Street Turn Lanes Improvement Proj Aect, seconded by CM Moores. All in favor. Motion carried 4=0. 6.1 Planning: 6.1. Minnesota Otsego Industrial Properties, LLC: A. Presentation by City Planner. B. Consider Ordinance 2023-01 Amending the Zonine Ma C. Consider the Preliminary Plat, Site and Building Plans and an Interim Use Permit. City Planner Licht presented the staff report. The applicant and a representative were available to answer questions. CM Dunlap had a question regarding revised condition #10. City Planner Licht noted the Findings of Fact and Decision regarding condition #10 has been updated in accordance with the Planning Commission recommendation. CM Dunlap asked about the interim use permit requirement for outdoor storage. City Planner Licht explained interim use permits versus conditional use permits. CM Dunlap asked if it was common to require an interim use permit? City Planner Licht stated most cities approve outdoor storage with a conditional use permit or an interim use permit. CM Moores asked about the Parl< Dedication fee change for 2023. City Planner Licht said the developer is aware of the Parl< Dedication fee. CM Moores motioned to adopt Ordinance 2023-01 amending the Zoning Map and approve a preliminary plat, site and building plans, and Interim Use Permit for IOS Otsego, subject to Page 3 of 6 MINUTES OF THE CITY OF OTSEGO REGULAR CITY COUNCIL MEETING JANUARY 9, 2023 the conditions state in the Findings of Fact and Decision as presented, seconded by CM Dahl. All in favor. Motion carried 4-0. 7. Annual Business. 7.1 Appoint Acting Mayor. Mayor Stockamp asked for nominations for Acting Mayor, Mayor Stockamp motioned to appoint Brittany Moores as Acting Mayor, seconded by CM Dahl. All in favor. Motion carried 4-0. 7.2 City Council Appointments for 2023. Mayor Stockamp handed out a list of the appointments for 2023 as follows. Planning Commission Liaison: Mayor Stockamp; Alternate CM Dahl. Parks and Recreation Commission Liaison: CM Moores; Alternate CM Dunlap. Heritage Preservation Commission Liaison: CM Moores; Alternate CM Dunlap. Public Safety Commission Liaison: CM Goede; Alternate Mayor Stockamp. Public Worl<s Subcommittee: CM Dahl and CM Dunlap; Alternate CM Goede. Administrative Subcommittee: Mayor Stockamp and CM Moores; Alternate CM Dahl. Otsego Creel< Authority: TBD if needed. CM Dahl motioned to approve the Appointments as listed, seconded by CM Dunlap. All in favor. Motion carried 4-0. 8. City Council Reports and Updates: CM Dunlap noted he met with the Lal<e Johanna Fire Department in December. City staff provide a tour of City Hall, Utilities (east site) and Prairie Center, On Friday he attended the 1-94 Corridor Coalition, Mayor Stockamp asked CM Dunlap why he chose to tour Lake Johanna? CM Dunlap said it was a private Fire Department that operates under budget compared to similar sized communities and he was interested how they operated. Mayor Stockamp attended the I-94 Corridor Coalition and Senator Amy I<lobuchar was at City Hall to discuss the funding the City was awarded. The staff has done a great job with all the now that has been received. Otsego River Riders recently hosted a snowmobile event with about 80 people in attendance. 9. Staff Reports and Updates: 9.1 Schedule Advisory Commission Interviews. MINUTES OF THE CITY OF OTSEGO REGULAR CITY COUNCIL MEETING JANUARY 9, 2023 Mayor Stockamp motioned to call for a special City Council meeting on January 24, 2023 at 5:30 PM to be held at the Prairie Center for the purpose of interviewing Advisory Commission Applicants, seconded by CM Dunlap. All in favor. Motion carried 4-0. 9.2 Schedule Special Meeting for Elected Official Training Session. Mayor Stockamp motioned to call for a special City Council meeting on January 23, 2023 at 5:30 PM to be held at the Prairie Center for the purpose of elected official training session, seconded by CM Dunlap. All in favor. Motion carried 4-0. .3 Emereencv Services Director Recruitment. Human Resources/Assistant City Administrator Hille stated this position was discussed at the December 12tn meeting and a proposed recruitment schedule has been prepared. Since this being a public safety position, an additional assessment is recommended as part of the process. The job is proposed to be posted January 24tn with an estimated start date of June 2023. Human Resources/Assistant City Administrator Hille said the top priorities for this position would be department creation, policy development, fire station, emergency operation plan, emergency responders and fiscal responsibility. The tentative interviews with City Council will be April 12tn CM Dunlap asked what is a competitive salary for this position? City Administrator/Finance Director Flaherty said this position is still being scored. Staff has looked at the LIVIC salary survey and estimate over $100,000 with a paygrade between 17-20. CM Dunlap asked about the tax capacity impact. City Administrator/Finance Director Flaherty said the funding was included in the 2023 budget and didn't have a percentage prepared. Human Resources/Assistant City Administrator Hille said the RFPs for compensation/job classification ends January 19th and will bring back for City Council approval. City Administrator/Finance Director Flaherty noted City offices will be closed Monday, January 16tn in observance of Martin Luther King, Jr. City Planner Licht said recent applications had a difference of opinion between the Planning Commission and City Council and the Planning Commission has concerns about meeting the City Council's expectations. Mayor Stockamp said the Planning Commission's role is to review proposed developments in detail and make a recommendation for the City Council to consider, which is an important role benefiting the City Council. CM Dunlap was at the meeting and noted the members' frustration agreeing they do a lot of work for the City Council. Mayor Stockamp suggested a future joint workshop with Planning Commission and will offer this at a future meeting. City Engineer Wagner gave an update on the TH on backorder. 101 left-hand turn signals, noting the heads are Page 5 of 6 MINUTES OF THE CITY OF OTSEGO REGULAR CITY COUNCIL MEETING JANUARY 9, 2023 Sergeant Jason Oltmanns with the Wright County Sheriff's Department said Otsego staff has done a great job getting the snow off the streets. The Otsego 2023 schedule has been established for the patrol deputies and Sergeant Oltmanns will provide staff with a copy. Sergeant Oltmanns confirmed that the Wright County Sheriff's Department does have a snowmobile patrol. 10. Adjourn. CM Dahl motioned to adjourn at 8:27 PM, seconded by CM Dunlap. All in favor.
