Iran various combinations ot'the electrical loads through a generator sizing program, and at worst case came up with 2 7 5kW. However, that assumed every single light was turned on, all of the motors in the building running at the same time, etc., so a 250kW unit should be more than adequate. The enclosed specifications only cover the generator itself; the 'front end' sections (general contract conditions, bidding requirements, etc.) are not included. 1 spoke to Ron Wagner at Hakanson Anderson Associates, and he said they have a more -or -less standard set of front end specifications for Otsego projects that you can get from Joe MacPherson. The specifications call for the contractor to furnish and install the generator on the existing pad, install power wiring in the existing conduits, and then furnish and install conduit and wiring for 1) control wiring from the automatic transfer switch, so it will call for the generator to run and shut if oft as required, and 2) for power wiring to a engine block heater and battery charger, so the generator will always be warmed up and ready to run. I am assuming these new conduits and wiring will be routed overhead from the electric room, across the ceiling in the service bay area, then down the wall on the west end of the building and then out and underground to the generator. The contractors will be required to visit the building prior to bidding, so they know how much cable and conduit will be required, and where it will need to be installed. Depending on the brand of generator, it is also possible the existing concrete slab will need to be expanded to fit. In addition, some minor wiring modifications will need to be made to the makeup air units so they will start sequentially instead of all at once, to minimize the starting loads on the generator set (otherwise a larger generator would be required.) I spoke to Bob Rosenberg at Trane Company, who • was responsible for the installation of the HVAC equipment during the construction of the building, and he said it would be a straightforward job to add time delay relays so that the first makeup air unit would wait 5 seconds, the next one 10 seconds and so on before they turned on. This work should. be done separately from the generator project; 1 am also enclosing a memorandum that you can give to Trane that explains what needs to be done. I spoke to Andy Tripp at Paulsen and Clark, the electrical engineer who did the electrical design for the building, and the circuit for the fire pump is connected directly to the utility transformer so it bypasses the main switchgear and automatic transfer switch in the electrical room. Andy told me that during construction, the fire marshal determined that service from the electric utility is reliable enough that the fire pump would not need standby power. if the generator is being used for peak shaving purposes during high demand periods, even though utility power to the rest of the building is disconnected, the fire pump will still be able to operate since it is connected directly to the utility transformer. However, if there is a power outage from the utility and there is a fire, the fire pump will not run. 1 checked with Ziegler and Interstate Power for budgetary numbers on the generator. Ziegler gave a budgetary cost of $74.000 for a Caterpillar unit, while Interstate Power gave a budgetary cost of • 563.000 for a Detroit Diesel unit. 1 suggest using the Caterpillar price for budgeting purposes, since it is probably worst case; including several thousand for installation costs plus the contractor's markup (assuming 15 %), the cost for the generator will be approximately (574,000 + $3,000) x 1.15 — $88,500. • Installing the power cable from the generator to the automatic transfer switch will cost about $100 /foot. From the drawings it appears the total distance from one to the other is about 225 feet, so the power cable cost will be approximately 225 feet x $100 /foot = S22,500. Installing the cable and conduit for the control wiring and the 120 /208VAC power (for the block heater and battery charger) will cost about $7.50 /foot each. Assuming the total distance will be about 225 feet, the cost will be approximately 225 feet x 57.501foot x 2 runs = $3,375. Budgeted Plow Truck Purchase - Brad said that costs of new plow trucks have risen rapidly. Two years ago he had estimated the cost at $130,000 and now it has risen to $165- 170,000. The reasons for the increases are new emission standards, rising steel costs, and rising electronic controls costs. Three plow trucks are scheduled to be purchased in the next five years. Brad is looking at whether one of the trucks could be replaced with several smaller trucks, which would be cheaper. He will also look at used trucks. Larry said he thought that a new truck should be purchased. Mike agreed, and said we weren't likely to get as good a deal again as when we bought our last used truck because most cities don't sell two year old trucks. Brad said that it is in the budget to purchase one plow truck this year. He said we have to order the truck by December to get the 2007 State price for this year. Next year's price is expected to be 6 -8% higher. The Committee directed Mike to put the purchase on the November 26 Council agenda. Purchase of Plow - Brad said they were not satisfied with how their equipment cleaned heavier snowfalls from paths last winter. They have moved the V plow off the recently purchased used truck and put it on the John Deere tractor. They think this will do a much better job on trails in heavy snows. That means they need to purchase a plow for the used truck. The Committee directed Mike to put this on the November 26 agenda. Specs for Public Works Building Generator - Brad discussed some new information he had received on the Public Works building generator. He said that based on the information he didn't think he would have a recommendation at the next Council meeting. The Committee said to keep the item on the Council agenda and update next meeting. Cell Phones - Brad discussed his review of cell phones. He finds that he can't reach some employees at home on the current cell phones. He recommends Nextels, which function as both cell phones and two way radios. After discussion, the Committee recommended that Council set a workshop to discuss this, and that the Building department be involved so that the City could come up with one system that worked for everyone. Streetlight Installation Requests - Brad and Mike said they had received several requests for streetlights at the intersections of 70 Street & CSAH 19; 67 Street & CSAH 37; and CSAH 37 & CSAH 42. Larry noted that Council policy is that they will install streetlights at intersections but that all requests should come to the City Council for final approval. The requests will be put on the November 26 agenda. Update on Hiring - Mike noted they had interviewed five people and brought three back for a second interview in which Brad will have them drive to City equipment to see if they can operate it. Brad and Mike plan to have a recommendation to the Council on November 26. Winter Hours - Brad reviewed some proposed changes to winter hours. He is going to have two employees start at 5:00 a.m. so that they can stagger shifts for snow plowing. When there is no snow employees will work on signs, vehicle maintenance, etc. 2008 Contract Mowing - Brad said he would like to meet with Randy and start discussions on the 2008 mowing contract. Mike said they should add prices to the contract when Randy mows the ordinance violations. The Committee said to go ahead and bring the contract before the Council for review and approval. Public Works Uniforms - Brad noted that current City uniforms are polyester and that they are uncomfortable in the summer and most employees do not like to wear them. He asked for permission to work with employees to develop a new uniform policy. Mike suggested that they involve Andy in the discussion because he knew there were some State restrictions on what could and could not be required for uniforms and we want to comply with City law. Jessica said that Mike should get rid of his old City hat and get one with a more modern design. Mike said he had thrown out the old hat at the request of Tom Darkenwald because it was dirty but that he had two other hats that were the same that hadn't been used yet. After considerable discussion everyone agreed that Jessica knew more about aesthetics than anyone else at the meeting. Tree Planting - Brad and Mike said that they purchased some trees from Midwest Landscapes at their year end sale because the deals were so good. They got two to two and half inch trees for $30 (normally $150 -$250) and planted them in Prairie Park along the trails for $40 a tree. The Committee agreed these were great prices and asked staff to come up with a tree plan that could be approved by the Park & Recreation Commission and the City Council. That way when there are deals on trees they could be planted per plan. Budget Discussion - Brad said that there are certain line items in the Public Works budget that he would like to carry over from year to year if all the money hasn't been spent. He mentioned gravel, special repairs and pavement management. Mike said the Council had already directed that a Pavement Management account be set up. The Committee said that they would discuss this idea with the rest of the Council. Brad said that in the future he will review projects and the budget with the Committee at the end of summer. (MNL) and Michael and Alice Helfert. Mr. Joe Schaffer of MNL and Mr. and Mrs. Helfert were present at the public hearing but had not comments. There were no public comments. The Planning Commission briefly discussed the annexation and provision of a right -of- way easement for access to the MNL parcel. City staff noted that MNL had submitted a survey of the property that shows the westerly parcel to be divided from their site will have frontage to the public right -of -way easement. The Planning Commission closed the public hearing and voted 7 -0 to recommend approval of the applications. The City Council will consider the applications at their meeting on 26 November 2007 at 6:30 PM. THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY RESOLVE: WHEREAS, the 77 Street between the west of Jalger Avenue is a public street under the jurisdiction of the City of Otsego; and, WHEREAS, 77 Street was constructed 77 Street NE was constructed in October 1994 as part of a cooperative experimental project between the Finnish National Road Administration and several units of Minnesota government including the University of Minnesota's Center for Transportation Studies, the Minnesota Local Road Research Board, Wright County, Stearns County, Benton County, Sherburne County MnDOT and the City of Otsego; and, WHEREAS, prior to the Finnish Overlay Paving project, this section of 77 Street was reconstructed along with the Mn /ROAD Research Project located to the south and west by subcutting 2 feet to remove unsuitable soils and replacing with good subgrade soil, 4 inches of Class -5 aggregate and 2 inches of Class 1 surfacing aggregate; and, WHEREAS, as part of the cooperative Finnish Overlay project a 2 inch layer of the Finnish oil gravel mix was placed on an additional 6 inches of Class 5 aggregate base and surface was built to 22 foot wide with 1 foot wide shoulders for this section of 77 Street; and, WHEREAS, tests were taken on the in place soils of this section of 77 Street and found to have R- values between 8 and 12, indicating a soft subgrade; and, WHEREAS, this section of 77 Street was constructed in numerous test sections varying in thickness to determine which area will maintain a passable road condition the longest; and, WHEREAS, this section of 77 Street constructed during this experiment does not meet the City of Otsego's current commercial /industrial street section established by the adopted City Engineering Manual; and, WHEREAS, this section of 77 Street has already required maintenance and patching due to some sections failing; and, 1 WHEREAS, the City Council directed at their meeting on 11 June 2007 that this section of 77 Street be designated as a minimum maintenance street as part of the City's Annual Street Maintenance Program; and, WHEREAS, two properties recently annexed to the City access to this section of 77 Street; and, WHEREAS, the proposed Minnesota Native Landscapes, Inc. development is a commercial wholesale business related to restoring wetlands, woodlands and shorelines; and, WHEREAS, the opinion of the City Engineer, Hakanson Anderson Associates, Inc., is that 77 Street in its current condition does not have the capability to support heavy truck traffic generated by a business such as Minnesota Native Landscapes, Inc., whether proposed in the City of Otsego or Monticello Township; and, WHEREAS, use of this section of 77 Street by a business such as Minnesota Native Landscapes, Inc. has the potential to cause damage to the public street outside of expected normal wear increasing the burden on the City's Public Works Department and City budgets for Street maintenance and construction. WHEREAS, Minnesota Statues 169.87 allows Cities to prohibit the operation of vehicles upon any such roadway or impose restrictions as to the weight of vehicles to be operated upon any such roadway, whenever any such roadway by reason of deterioration will be seriously damaged or destroyed unless the use of vehicles thereon is prohibited or the permissible weights thereof reduced; WHEREAS, the City Council adopted Resolution 2007 -40 establishing a five ton weight restriction for this section of 77 Street; and, WHEREAS, as a condition of annexation, Minnesota Native Landscapes, Inc. shall be required to enter into an agreement to provide for an overlay of 77th Street to a specification as determined by the City Engineer within three (3) years of a certificate of occupancy being issued for a building on their property or earlier if determined necessary by the City Engineer; and, WHEREAS, said agreement addresses the use of 77 Street by Minnesota Native Landscapes and the existing substandard condition of the roadway to the satisfaction of the City Council. RELATIVE TO ROAD IMPROVEMENTS AND RIGHT OF WAY AGREEMENT entered into this _ day of November, 2007 between Minnesota Native Landscapes, Inc. (hereinafter DEVELOPER), a corporation under the laws of the State of Minnesota and City of Otsego (hereinafter CITY), a Minnesota municipal corporation. WHEREAS, this Agreement affects that real property located in Wright County, Minnesota described as follows: See Exhibit A WHEREAS, DEVELOPER has requested approval of a business located within the CITY and such business will directly affect 77th Street within the CITY from the Helfert property line east to Jalger Avenue; and WHEREAS, said 77th Street is now little used by the public and the proposed business use will provide most of the impact to said road; and WHEREAS, said roadway is currently in substandard condition, and; WHEREAS, DEVELOPER requires access to 77 Street across the Helfert Parcel in a location that will serve as a future City street upon further development of the area; and 1 WHEREAS, the parties wish to reach Agreement regarding responsibility for upgrade, repair and maintenance of the roadway and dedication of necessary right of way easement across the Helfert parcel. NOW THEREFORE, it is agreed between the parties as follows: 1. DEVELOPER shall immediately dedicate 80 foot right of way acceptable to the City Engineer across the Helfert parcel (PID # 213000281400) connecting DEVELOPER's parcel (PID # 213000281200) to 77 Street (as set forth in Exhibit B attached hereto) for roadway use. DEVELOPER shall construct and maintain to City satisfaction a gravel driveway at least 20 feet wide meeting all applicable City standards for interim use of the proposed business. Construction of a public street within the 80 foot easement shall be deferred until such time as the Helfert or DEVELOPER parcels are rezoned for industrial use and require sanitary sewer and water services. The City reserves the right to require earlier construction of the Industrial road in the event that the MNL or Helfert properties are to be developed with industrial uses consistent with the Comprehensive Plan, other unique circumstances arise, or use of the access road justifies early construction of the Industrial road or portions thereof. 2. DEVELOPER shall be responsible for interim upgrade of 77 Street by paving. The proposed paving is estimated to cost $65,000.00. The upgrades must be actually constructed within three years from the date of issuance of a Certificate of Occupancy for a principal building upon the MNL parcel, unless the City Engineer determines that impact to the road is such that earlier Interim upgrade is required. In order to secure this obligation, DEVELOPER shall post with the CITY an irrevocable standby Letter of Credit with automatic roll over provision in the amount of $65,000.00. The paving may be accomplished by the DEVELOPER under the supervision of the City Engineer or, alternatively, DEVELOPER may petition the CITY to undertake the paving as a CITY project and may request that the cost be assessed against the MNL parcel either in one payment or over a period of years. 3. Upgrade of 77 Street is recognized as an Interim measure necessitated by the greater volume and type of traffic generated by DEVELOPER's business. In the event that permanent improvements are determined to be necessary after the interim upgrade, DEVELOPER's funding of such interim repairs shall not be raised as an objection to any further assessment for permanent improvements found to be necessary, at the sole discretion of the CITY. Further, funding of the Interim Improvements shall not be used as an objection to any charge or assessment for construction and/or improvement of the future Industrial road extending through the Helfert and MNL parcels or beyond. 4. In the event of any breach of the terms and conditions of this Agreement, CITY may, at it's sole discretion, collect upon the Letter of Credit provided for herein, and make necessary improvements and bill to DEVELOPER the actual cost of 2 said improvements including any additional engineering, legal or administrative costs incurred by the CITY as a result of DEVELOPER's breach. In the event that such costs are billed and not promptly paid for by DEVELOPER, the CITY may assess these additional costs against the property and DEVELOPER hereby agrees to said assessment and waives any and all right to appeal the assessment of additional costs. In addition to the above, the CITY may also, at its sole discretion, not issue or revoke any building permit, Certificate of Occupancy or Planned Unit Development/ Conditional Use Permit required for business use of the site. 5. The terms and conditions of this Agreement shall run with the land and shall obligate any person or entity succeeding in title to the property. This Agreement shall be recorded against the property. 6. The above are a full and complete recitation of the Agreement between the parties and no prior agreement either written or oral shall survive this Agreement. 7. If any term or condition of this Agreement is found to be invalid by a court of competent jurisdiction, the remainder of the Agreement shall remain and shall be construed so as to effectuate as closely as possible the original intent of this Agreement. Otsego — Subdivision Ordinance; Park and Trail Dedication NAC FILE: 176.08 — 07.04 BACKGROUND • The City Council has directed City staff to annually review the park and trail dedication requirements in Section 21 -7 -18 of the Subdivision Ordinance. The purpose of this review is to ensure and demonstrate that there is a nexus between the cash fee in lieu of land accepted by the City for park and trail acquisition and development purposes is representative of the costs incurred by the City in relation to new development as required by Minnesota Statutes 462.358, Subd. 2c. ANALYSIS Current Fee. The City's current residential park and trail fee in lieu of land for residential development was adopted to be effective 1 January 2007 and is $3,230 per dwelling unit. The fee is based on the following cumulative factors stated on a per residential unit basis: Land acquisition: $1,600.00 Neighborhood park development: $ 770.00 Community center development: $ 800.00 Trails $ 60.00 TOTAL $3,230.00 For 2007, park and trail dedication fees in lieu of land for commercial and industrial subdivisions were established at $7,000.00 and $3,500.00 per gross acre, respectively, based on 2003 land values. Land Cost. No change in residential land values of approximately $60,000 per gross acre (cited originally in our office's 29 January 2004 memorandum) has been observed by City Staff during 2004. Lennar Corporation offered to sell the City a parcel of land ofr a potential park near the Riverpointe and River Place neighborhood at $90,000 per acre but no action has been taken on the proposal. We do not recommend a change in the land value component of the residential cash fee in lieu of land on this basis. Commercial and industrial land values along the TH 101 corridor have increased greatly over the last few years. These increases are reflective of continued residential growth within the City, increases in commuter traffic through the City and MNDoT's plans to upgrade TH 101 to a four lane freeway in 2006 to 2007. The current cash fee in lieu of land for commercial and industrial is reflective of land values equal to $70,000 an acre for commercial property and $35,000 an acre for industrial property. Recent commercial land sales and appraisals being done as part of the TH 101 and CSAH 42 improvement projects suggests minimum commercial property values of approximately $350,000 per acre for commercial land and approximately $100,000 per acre for industrial land. Based on this information, the City could justify an increase in the commercial and industrial cash fee in lieu of land for park and trail dedication as the current fees are approximately two percent of the land value of commercial property and four percent of industrial land values. However, from an economic development standpoint, City staff would recommend that the commercial and industrial cash fees in lieu of land for park and trail dedication not be changed. Construction Cost. The City undertook construction of three new neighborhood parks in 2006 based on facilities and site designs intended to define a typical neighborhood park. The City also received a preliminary cost estimate for Roskaft Park to be constructed in the Wildflower Meadows subdivision. The individual construction cost estimates for these facilities and an adjusted average for the end of the third quarter of 2007 are shown below. The adjusted construction costs are based on information published by the Engineering News - Record Construction Cost Index and indicate an approximate 2.7 percent increase in construction costs between the third quarters of 2006 and 2007. Beaudry Meadows: $701,615.00 Zimmer Farm: $601,964.00 Kittredge Crossing: $634,128.00 Roskaft Park: $638,103.00 Mean Cost: $643,953.00 Each neighborhood park guided by the Comprehensive Plan is anticipated to serve an approximate one square mile area. Assuming an average density of 2.5 dwelling units per acre within residential areas of the City based on existing development and established development regulations, there are approximately 804 households per square mile. As such, the cost per dwelling unit for neighborhood park construction based on the current typical park facility design and construction costs is $801.00. 2 Trails. The 2007 cash fee in lieu of land included a trail construction element to account for full buildout of the remaining trail system. Approximately 1.79 miles or 9,450 linear feet of trail were constructed in 2007 along CSAH 42 and within the Great River Center. The Future Parks and Trails Plan map included in the 2004 Comprehensive Plan identifies15.8 miles or 83,440 linear feet of future trails yet to be constructed. The 2007 cost estimate for the construction of trails as part of street projects or stand -alone construction is $16.24 a linear foot. To determine a cost factor for future trail construction the following equation is used: 73,990ft. x $16.24/ft. / 21,079 households = $57.00 / dwelling unit Community Center. Research was also done in the 2003 analysis regarding the cost for construction of a community center similar to that built by Monticello, Maple Grove, Becker and Elk River. The assumed cost of a similar facility for Otsego was $14,800,000 based on that data. Under park and trail dedication requirements, the City has included that portion of the cost for a community center to be borne by new residents moving into the community. The 2000 Census identifies Otsego as having 2,062 households. The 2004 Comprehensive Plan projects the City to have a household count of 21,471 by 2040 based on a growth rate of 400 to 600 new households per year. The initial community center portion of the park dedication cash fee in lieu of land was therefore set in 2003 at $690.00 reflecting the anticipated cost of a community center and 2040 household estimate. The adjusted 2007 fee was set at $801.00. Using ENR CCI for the period between the third quarter of 2006 when the 2007 fee was calculated and the third quarter of 2007 reflecting current prices, a 2.7 percent adjustment is required. The cost per household for construction of a future community center should be set at $822.00 for 2008. Community Parks. It has been suggested that the park and trail dedication fee be modified to include a component for the acquisition of land for community parks. The Parks and Trails Plan guides that there be 5 to 8 acres of community park land per 1,000 people. Based on a projected population of 59,045, there should be 295 to 472 acres of community park land in Otsego in 2040. Otsego has one existing community park, Prairie Park, which is 52 acres in area. As such, 243 to 420 acres of additional land for community parks would need to be acquired. The Future Parks and Trails Plan map recommends acquisition of two community park sites, one east of TH 101 and one located near CSAH 19. The Parks and Trails Plan recommends individual community parks have an area of 50 to 100 acres. At currently know land prices of $60,000.00 per acre, the anticipated land acquisition cost would be $12,000,000.00. In calculating an impact fee for the costs of community park land acquisition, City staff recommends that the cost be spread across all 2040 households. This method attributes a portion of the future land costs to in place residents consistent with the community -wide benefit of these facilities. The calculation of the land acquisition is addressed below: 3 $12,000,000 / 21,471 households = $559 /household Public Hearing. The Planning Commission held a public hearing on 19 November 2007 to consider the proposed 2008 Park Dedication requirements. There were no public comments and the public hearing was closed. The Planning Commission discussed the proposed park dedication fee at length, including information regarding a new amount for acquisition of community park land. The Planning Commission also discussed changes in land values for residential, commercial and industrial properties and the current housing market. Another idea discussed by the Planning Commission was discounting the park and trail dedication fee for A -1 and A -2 District subdivisions based on the need for neighborhood parks being generated by urban density development. A separate park dedication fee for A -1 and A -2 District subdivisions would be based only on future land acquisition costs and trails system construction. The Planning Commission voted 4 -3 to recommend no change to the current park and trail dedication fees. CONCLUSION Our office recommends that the park and trail cash fee in lieu of land for residential subdivisions paid on a per dwelling unit basis as set forth by Section 21 -7 -18.1 of the Subdivision Ordinance be established at $3,280.00 (rounded to the nearest $10.00) for 2008 as shown below. The proposed fee is $50.00 or 1.5 percent higher than the 2007 fee. This increase reflects adjustments in the mean park development costs, 2007 trail construction and inflationary construction costs. No increase is recommended for the commercial and industrial cash fee in lieu of land dedication requirements based on a potential negative effect to the City's economic development efforts. The City Council will consider changes to the park and trail dedication fees for 2008 at their meeting on 26 November 2007. The City Council may consider the recommendations of City staff and the Planning Commission with respect to the current fee structure as well as the potential for a community park land component or separate fee for A -1 and A -2 District subdivisions. c.
