Based on the information presented by the applicant, the recommendations of City staff, and testimony received during the public hearing and 30 day comment period for the EAW, the Planning Commission voted 5-0 to adopt findings and recommendations making a negative declaration on the need for an Environmental Impact Statement and denial of the IUP. City staff finds no authority either in State Statute or the Zoning Ordinance that allows the City Council to act upon an application that an applicant requests be withdrawn. With regards to the EAW, the City Council has the option to accept the recommendations of the Planning Commission and City staff to make a negative declaration on the need for an EIS, make a finding that the project has potential for significant environmental effects and order preparation of an EIS or make a motion of no decision in response to the IUP application being withdrawn. If the City Council takes no action regarding the EAW based on withdrawal of the IUP application, any future request to excavate the site will be subject to the need for an EAW ordered by the City Council on 23 April 2007 or the mandatory EAW thresholds outlined in Minnesota Rules 4410.4300. Even if a negative declaration were approved by the City Council, City staff would anticipate that any future project would face a request for a new EAW on the basis of any changes to the project in accordance with Minnesota Rules 4410.1000, Subp 5. As such, City staff recommends the City Council make a motion to take no action with regards to the EAW based on the IUP application being withdrawn and direct staff to inform the Environmental Quality Board and EAW Petitioner's Representative of its no decision as outlined by "C" below. MN 55422 Telephone: 763.231.2555 Facsimile: 763.231.2561 planners@nacplanning.com MEMORANDUM TO: Otsego Mayor and City Council FROM: Daniel Licht, AICP DATE: 20 February 2008 RE: Otsego — Banack CUP NAC FILE: 176.02-08-01 The Planning Commission opened a public hearing at their meeting on 22 January 2008 to consider a conditional use permit application to allow construction of a home on Lot 5, Block 1 Island View Estates. Information was submitted as part of the public hearing indicating that the subject site and an abutting lot were under common ownership, which in accordance with Section 20-95-4 of the Zoning Ordinance would make the property unbuildable. The Planning Commission tabled the application to allow City staff to research the issue further. City staff concluded that the subject site had been under common ownership on the date the WS District provisions were adopted by Wright County in 1978 and by the City of Otsego in 1994. To avoid an application for variance, City staff and DNR staff recommended the applicant apply to amend the text of the Zoning Ordinance to address development of substandard lots of record within the WS District. The proposed amendment would back date the effective date of the regulations to when originally adopted by Wright County. The second provision of the proposed amendment would allow for development of a substandard lot of record that was under common ownership upon the effective date of the WS District as a conditional use provided that the area/width of the two contiguous parcels is equal to at least 60 percent of the WS District minimums and that all other requirements of the WS District are met. DNR staff said that the ordinance in the form attached hereto would be certified as consistent with the Mississippi Wild Scenic and Recreational River Management Plan and Minnesota Rules. The Planning Commission conducted a second public hearing at their meeting on 19 February 2008 to consider the proposed Zoning Ordinance text amendment and the CUP that would be required by the amended ordinance for development of a single family home upon the subject site. The applicant Mr. Joe Banack and property owner Ms. Barbara Henk were present. Comments from the public included testimony from the owner of abutting Lot 6, Block 1 and property owners south of Kahler Avenue concerned about potential impacts to area stormwater drainage if Lot 5, Block 1 were developed. The owner of Lot 6, Block 1 was particularly concerned about potential erosion of the steep slope between Lot 5 and Lot 6, Block 1 if vegetation is cleared from Lot 5, Block 1 to allow for construction of the proposed home and related septic drainfield. One property owner noted that the existing culvert under Kahler Avenue is blocked by vegetation and needs to be cleaned out. The City Engineer was present at the meeting and responded that the applicant has provided a grading plan for development of the site that provides for proper management of area stormwater drainage. Based on the limited amount of water going from Lot 6, Block 1 to Lot 5, Block 1 outside of public drainageways, the City Engineer stated that there will be no impact to Lot 6, Block 1 from development of Lot 5, Block 1. There was additional discussion regarding the standards for stormwater management that Island View Estates was approved under versus contemporary practices and requirements. The Planning Commission closed the public hearing. There was discussion by the commissioners as to the appropriateness of the amendment. Chair Nichols noted that it is common for the City to reconsider sections of the Zoning Ordinance when presented with unanticipated situations such as this. The Planning Commission also raised the issue of requiring preservation of the vegetation between Lots 5 and 6, Block 1 to ensure stability of the steep slope on Lot 6, Block 1. After discussion, the Planning Commission voted 6-0 in separate motions to recommend approval of the proposed Zoning Ordinance amendment and CUP as outlined below. The base charge for water and sewer will be based on the number of REC's assigned. For instance, the base charge for Target will be based on 24 REC's. Therefore, the base charge will be $72 for water and $72 for sewer rather than $3 for each. The reason for the difference between residential and commercial base rates takes into consideration the additional maintenance and sewer cleaning required in commercial areas. The additional revenue generated from the base charge will help offset this additional maintenance and cleaning expense. Currently the commercial sewer rate is based on the calculated average of the December thru February actual usage. The actual usage will more accurately reflect the seasonal fluctuations of different businesses. Section 6-2-4 of the Otsego City Code is hereby amended to read as follows: 6-2-4: UTILITY RATE SCHEDULE: A. The utility rate schedule for all properties subject to this ordinance shall be adopted annually by ordinance_ of the City Council. The utility rate schedule shall include, but not be limited to, the items set forth in Chapter 6-1-4 of the Otsego City Code. B Base fees for utility services for residential and non-residential Dronerties shall be charaed for each Residential Equivalent Connections (RECs) of the user calculated in accordance with the current version of the Metr000litan Council taL Services Procedures Manual or as otherwise determined by City Council decision. Section 3. This Ordinance shall become effective immediately upon its passage and publication. Otsego, Minnesota 55330 RE: John McDonald House County Highway 39 Otsego, Minnesota Dear Ron: Thanks for inviting me to your Heritage Preservation Commission meeting last Thursday. I appreciate your interest in my firm and look forward to helping you develop a restoration program for this historic residence. 1. SCOPE OF PROJECT 11.1. The McDonald House is probably the oldest house in QaMbuilt by the first resident in the area.. Preservation of the house is of primary importance to preserve and interpret the history of the area. 1.2. Based on our walk through after your HPC meeting, the house appears to be in sound condition and is basically weather tight. 1.3. The HPC recommends that the house be restored to its historic appearance when McDonald occupied the house and be open to the public to interpret the history of Ostego and the life of John McDonald. 1.4. Since the current site of the house is close to highway 39, future road expansion could require that the building be moved. The HPC recommends that the building be moved prior to restoration due west along highway 39 to city owned property adjacent to the old school house and be incorporated into an Ostego Heritage park- 14 ark14 Our proposed services would help accomplish the above goals. 1.6. We were provided with the known historic documents and photographs of the building. 2. SCOPE OF SERVICES 11. Our team would schedule a visit to the building to photograph and measure existing conditions in order to familiarize ourselves with the building and to prepare existing condition floor plans, exterior elevations and relevant building sections. The rear single story addition would not be measured and would be demolished prior to moving the structure. 2.2. We would develop an existing condition report that would include our observations on the original materials and construction, and existing historic fabric. 4.4. The method of selecting a contractor would be decided at this time as this will have ars effect on our services. 5. INTERPRETIVE PLAN 5.1. At a future date, development of an interpretive plan for the McDonald house and Otsego should be developed by you or in conjunction with an architectural historian. We have a few selected historians that we have worked with on other projects. 5.2. The interpretive plan would explore the historic contexts of the house and community that could be presented. These could include the history of John McDonald, pioneer settlement prior to the Civil War, transportation including the river ferry and government road, logging and saw mills, effects of economic recession prior to Civil war, Ginseng industry, etc. If this proposal is acceptable, please sign, date and return a copy to me. We will start work upon receipt of the signed proposal. We would anticipate starting on the project upon your approval of the proposal and would complete these services in approximately 60 days of the initial site visit.
