BACKGROUND
Java Companies has submitted application to develop Lot 1, Block 1, Parkview Retail 3rd
Addition located west of Parrish Avenue (CSAH 42) between 87th Street and 88th Street. The
proposed development consists of a 6,062 square foot multiple tenant building, which includes
a drive through service window and lane for a bank automated teller machine. The
development requires application for a Conditional Use Permit for a convenience food
restaurant, site and building plan review, and vacation of an existing drainage and utility
easement. A public hearing to consider the application has been noticed for the Planning
Commission meeting on 5 June 2023.

ANALYSIS
Comprehensive Plan. The 2012 Comprehensive Plan guides the subject site for commercial
uses within the City’s primary retail, service, and office district located adjacent to the TH 101
and CSAH 39 interchange. The proposed building is shown to provide space for up to three
businesses, including opportunity for a convenience food use with a drive through service
window. The proposed land uses are consistent with the Future Land Use Plan and the
commercial development goals of the Comprehensive Plan.
Zoning. The subject site is zoned B-1, Retail Business District. The B-1 District allows for a
range of retail, service, office, and restaurant uses. Convenience food uses are allowed as a
conditional use, subject to the performance standards outlined in Section 11-75-6.A of the
Zoning Ordinance. The tenant spaces within the proposed building are configured to
accommodate the uses allowed within the B-1 District.
Surrounding Uses. The subject site is surrounded by the following existing and planned land
uses in the area shown in the table below. The development of the subject site provides for a
transition between commercial uses along Parrish Avenue (CSAH 42) to residential uses west of
Parkview Avenue. The site orientation and landscape plan assist with this transition and the
proposed development will be compatible with surrounding uses.

Lot Requirements. Lots within the B-1 District are required to be a minimum area of 1.0 acres
and 200 feet in width. The subject site is 1.29 acres in area. The width of the lot is 210 feet
measured along Parkview Avenue. The lot complies with the minimum requirements of the B-1
District.
Exterior Materials. The proposed building is designed with four-sided architecture using the
same design and materials on all elevations, which is important given the subject site’s visibility
from both Parrish Avenue (CSAH 42) and Parkview Avenue. The building is oriented with its
front having the tenant entrances facing Parkview Avenue. An orientation with the entrances
facing east to Parrish Avenue (CSAH 42) like Dunkin is preferred, or at least south similar to
ALDI, to maximize the visibility and provide better aesthetics from the commercial corridor.
The Planning Commission should provide direction as to the best layout for the subject site.
Section 11-17-4.D.1 of the Zoning Ordinance require the exterior finish of the proposed building
to be comprised of a minimum 65 percent Grade A materials, and not more than 35 percent
Grade B materials, or not more than 10 percent Grade C materials. The grade of materials is

defined by Section 11-17-4.B of the Zoning Ordinance and Grade A materials consist generally
of masonry materials, glass walls, windows, and doors. The submitted architectural plans
provide a schedule for the exterior elevation materials, which indicates the Grade A materials
comprise more than 65 percent of the exterior finish of each elevation and the exterior in total
for the proposed building as required by the Zoning Ordinance.
Building Height. Principal buildings within the B-1 District are allowed to be up to three stories
or 35 feet in height. The proposed building is a single-story structure with a height of 16 feet to
the top of the parapet. The proposed building complies with the height limits of the B-1
District. The submitted plans do not indicate the location of building mechanical equipment. If
mounted on the roof of the building, the mechanical units must be screened by the parapet or
other measures so as not to be visible from Parrish Avenue (CSAH 42) and Parkview Avenue, to
be verified by the Zoning Administrator prior to issuance of a building permit.
Access. The subject site abuts Parrish Avenue (CSAH 42) and Parkview Avenue. No access is
allowed onto Parrish Avenue (CSAH 42) as a minor arterial roadway. One driveway is proposed
to Parkview Avenue at the southwest corner of the subject site. Section 11-21-6.B of the
Zoning Ordinance requires that the access be setback 90 feet from any street intersection and
100 feet from any other driveways. The location of the driveway is setback more than 90 feet
from other streets to the north or south. There is a driveway to the garage of the Parkview
Grand apartment building on the west side of Parkview Avenue that is off-set slightly to the
south due to lot lines and the stormwater basin within the subject site. The off-set is not so
significant so as to cause traffic issues on Parkview Avenue.
Pedestrians. There is an existing sidewalk on the east side of Parkview Avenue and a trail on
the west side of Parrish Avenue (CSAH 42) abutting the subject site. The site plan provides for a
sidewalk connection between the principal building and the sidewalk on Parkview Avenue. A
connection from the sidewalk along the south side of the principal building to the trail on
Parrish Avenue (CSAH 42) is also to be provided.
Off-Street Parking. Section 11-21-8 of the Zoning Ordinance requires that multiple occupancy
retail buildings with three or more tenants provide one off-street parking stall per 160 square
feet of net building area, with a potential 10 percent reduction approved administratively based
on actual tenants. This is a higher requirement than applies to a standalone or two tenant
retail building intended to address occupancy by a higher parking demand user such as a
convenience food restaurant or coffee shop. The site plan illustrates 32 off-street parking
stalls, which exceeds the requirements of the Zoning Ordinance for a retail building, but is two
stalls short for a multiple tenant retail building. City staff will evaluate the buildout of the
building and tenants at the time a building permit is applied for to determine if the 10 percent
reduction in stalls is appropriate based on the type of tenant and occupied spaces.

The 90 degree off-street parking stalls are designed as nine feet wide by 18 feet in depth
abutting the sidewalk or perimeter of the parking area allowing for a two foot overhang and
accessed by a 24 foot wide two-way drive aisle. There are angled parking stalls on the south
side of the proposed building that are nine feet wide and 21 feet deep accessed an 18 foot wide
one-way drive aisle leading into the drive through lane. The dimensions of the off-street
parking area complies with Section 11-21-7.B of the Zoning Ordinance.
The drive aisle for the drive through service window and ATM located on the north side of the
building extends around the east elevation back to the southeast corner of the lot. The drive
aisle is 24 feet wide to allow stacking of vehicles and also provides an exit route for the angled
parking on the south side of the building. There is sufficient space to stack eight vehicles in line
behind the drive through service window.
The parking area is shown to be surfaced with asphalt and surrounded by perimeter concrete
curb as required by Section 11-21-7.C and D of the Zoning Ordinance. The construction
specifications for the off-street parking area are to be subject to review and approval of the City
Engineer.
Landscaping. A landscape plan has been submitted that provides for a mix of shade trees east
and west of the proposed building and along the driveway south of the stormwater basin, with
shrubs and grasses used as accents between the deciduous trees, at the building foundation,
and for screening the waste enclosure and an electric transformer on site. The site plan is to be
modified to provide additional deciduous trees along Parkview Avenue consistent with the ALDI
and Dunkin site plans. The sizes of proposed plantings comply with the provisions of Section
11-19-2.B of the Zoning Ordinance. Section 5-2-3.C.2 of the City Code requires installation of
in-ground irrigation for the yards and planting areas within the property, which is indicated on
the landscape plan.
Signs. Uses within the B-1 District are allowed the following signs:
One freestanding sign in the yard abutting Parrish Avenue (CSAH 42) up to 100 square
feet in area and up to a height of 20 feet.
One freestanding sign in the yard abutting Parkview Avenue up to 64 square feet in area
and up to a height of 15 feet.
Wall signs on the east and west elevations of the building up to 15 percent of the wall
area facing public streets with no individual sign larger than 100 square feet.
The site plan does not indicate a location for a free standing sign and the architectural plans
illustrate wall signs only generally. A sign permit subject to review and approval of the Zoning
Administrator is required prior to placement of any signs upon the property.

Hours. Convenience food uses within the B-1 District are allowed 24 hour operation unless
limited by the City Council as part of the Conditional Use Permit. City staff is not
recommending any limitation on the allowed hours of operation for the proposed
development.
Waste Storage. The submitted plans show a location for waste storage containers west of the
proposed building on the north side of the driveway to Parkview Avenue. The proposed
location of the waste storage enclosure is within a drainage and utility easement dedicated
with the Parkview Retail 3rd Addition final plat for the stormwater basin within the subject site.
The drainage and utility easement underlying the proposed waste storage enclosure is to be
vacated without effecting the functionality of the stormwater basin. The plans for construction
of the enclosure are to be submitted with application for a building permit for review by the
Zoning Administrator for compliance with requirements of Section 11-18-4.C of the Zoning
Ordinance.
Exterior Lighting. Section 11-16-6 of the Zoning Ordinance establishes performance standards
for exterior lighting. An exterior lighting plan including photometric measurements of light
intensity and indicating the type, location, and height of all exterior light fixtures has been
submitted. All exterior light fixtures are to have a 90 degree horizontal cut-off and not cast
more than 0.4 foot-candles of light at the property lines. A photometric lighting plan must be
submitted with application for a building permit and is to be subject to review and approval of
the Zoning Administrator.
Grading Plan. Plans for grading, erosion control, and storm water management have been
submitted for the proposed development. All grading, drainage, and erosion control plans are
subject to review and approval of the City Engineer.
Utilities. The subject site is within the East Sewer District established by the 2012
Comprehensive Plan and services are available to the property. The developer has submitted a
utility plan for connection of the proposed building to City sewer and water utilities. The
developer will pay Utility Connection Charges at the time a building permit is issued for build
out of the tenant spaces within the building based on the proposed occupancy and Fee
Schedule in effect at that time. All utility plans are subject to review and approval of the City
Engineer.
Site Improvement Performance Agreement. Section 11-9-7 of the Zoning Ordinance requires
that the developer enter into a performance agreement with the City to provide for
construction of the project improvements within the subject site. The City Attorney will draft a
Site Improvement Performance Agreement for development of the subject site for approval by
resolution of the City Council concurrent with consideration of the development application.

RECOMMENDATION
The proposed development of Lot 1, Block 1 Parkview Retail 3rd Addition is consistent with the
policies of the Comprehensive Plan and complies with the requirements of the Zoning
Ordinance. Our office recommends approval of the applications as outlined below.
POSSIBLE ACTIONS
A. Motion to recommend approval of Conditional Use Permit, site and building plans, and
vacation of drainage and utility easements for Lot 1, Block 1, Parkview Retail 3rd
Addition, subject to the following conditions:
1. The site and building plan approval and the stipulations, limitations, and
conditions therein shall be applied to the property in question. All written and
graphic materials officially submitted to the City shall be treated as a formal
agreement between the applicant and the City. Once approved, no changes,
modifications or alterations shall be made to any plan detail, standard, or
specifications without prior submission of a plan modification request to the
Zoning Administrator for review and approval.
2. Any mechanical equipment mounted on the roof of the building shall be
screened by the parapet or other measures so as not to be visible from Parrish
Avenue (CSAH 42) and Parkview Avenue, subject to review and approval of the
Zoning Administrator prior to issuance of a building permit.
3. The number of off-street parking stalls required shall be subject to review and
approval by the Zoning Administrator based on occupancy and floor area for
individual tenants in accordance with Section 11-21-8 of the Zoning Ordinance.
4. The construction specifications for the off-street parking area shall be subject to
review and approval of the City Engineer.
5. The site plan shall be revised to provide for a pedestrian connection between the
sidewalk along the south line of the principal building to the trail on Parrish
Avenue (CSAH 42).
6. Landscaping:
a. The landscape plan shall be revised to provide for planting of deciduous
trees in the yard along Parkview Avenue.
b. In-ground irrigation for the yards and planting areas within the property
shall be installed as required by Section 5-2-3.C.2 of the City Code.

7. All grading, drainage, and erosion control plans shall be subject to review and
approval of the City Engineer.
8. All utility plans shall be subject to review and approval of the City Engineer.
9. The developer shall pay Utility Connection Charges at the time a building permit
is issued for buildout of the tenant spaces based on the user and Fee Schedule
then in effect.
10. All drainage and utility easements shall be subject to review and approval of the
City Engineer.
11. The property owner shall execute a Site Improvement Performance Agreement
as required by Section 11-9-7 of the Zoning Ordinance, subject to review by the
City Attorney and approval of the City Council.
B. Motion to recommend the application be denied based on a finding that the request is
inconsistent with the Comprehensive Plan and intent of the Zoning Ordinance.

The project includes the construction of a new building, concrete sidewalks, bituminous parking lot, sanitary service extension,water service extension, and the installation of storm sewer piping and structures that outlet to an existing infiltration basin. The project is located in the Parkview Retail development in Otsego, MN. The majority of the underlying soilson the property are in Hydrologic Soil Group "A" and have high infiltration rates when thoroughly wet.Receiving Waters:Existing stormwater runoff from the development drains to the east and into the city's storm sewer system located within the Parrish Ave right-of-way. Proposed stormwater runoff will be direceted to a newly constructed storm sewersystem that discharges into the existing infiltration basin that was constructed to serve the development. The existing infiltration basin maintains the existing drainage pattern by discharging into the City's storm sewer located in theParrish Ave right-of-way via an existing storm sewer connection.Responsible Parties:The Owner and the Contractor are responsible co-permittees for the implementation of the SWPPP. The Contractor and Owner shall apply for the NPDES/SDS Construction Permit within 24 hours of award of Contract. The completeapplication must be submitted prior to start of construction activity. The Contractor shall construct erosion and sediment control BMPs in the following construction sequence:a. Install rock construction entrances where indicated in the plans.b. Install silt fence and inlet protection where indicated in the plans.c. Install silt fence around existing infiltration basin.d. Locate portable toilets on flat surfaces away from drainage paths. Energy dissipation devices shall be installed and functional within 24 hours of connecting pip outlets to surface waters.j. Protect and repair BMPs, as necessary.k. Perform street sweeping as needed.l. Temporarily stabilize areas not actively being worked.m. Site construction (Utilities, paving, buildings, etc...)n. Final grading.o. Final stabilization (seeding, planting). Stabilized soil with the seed mix indicated on the plans.p. Construct stormwater infiltration basins and bioretention basins only when contributing drainage area has been constructed and fully stabilized.q. Remove erosion control devices upon site establishment in accordance with the NPDES/SDS Notice of Termination (NOT) requirements.Final Stabilization:Final stabilization is not met until all of the following are completed:1. Stabilization by uniform perennial vegetative cover (70% density of it's expected final growth). The seed mix indicated on the plan or sod shall be used for final stabilization.2. All temporary synthetic and structural BMPs are removed.5. Sediment from conveyance systems and sedimentation basins are cleaned out (returned to design capacity).6. Notice of Termination (NOT) is submitted to the MPCA.Erosion Control Maintenance and Inspection: BMP inspection and maintenance Responsible Party: 1. Inspect erosion control devices and provide routine maintenance as follows:a. Inspect erosion control a minimum of once per week and within 24 hours of a rainfall event greater than 0.5" in 24 hours.b. Records of each inspection and maintenance activity shall include:xDate and time of inspections.xName of person(s) conducting inspection.xAccurate findings of inspection, including the specific location where corrective actions are needed.xCorrective actions taken (including dates, times, and party completing maintenance activities).xDate and amount of all rainfall events greater than 0.5" in 24 hours, and the amount of rainfall for each event. Rainfall amounts must be obtained by either a properly maintained rain gauge installed onsite, aweather station that is within 1 mile of the site, or a weather reporting system that provides site specific rainfall data from radar summaries.xIf discharge is observed during the inspection, the inspector must record and should photograph and describe the location of the discharge (i.e. color, odor, settled or suspended solids, oil sheen, and other obviousindicators of pollutants).xDocumentation of amendments to the SWPPP proposed as a result of the inspection as required by the NPDES/SDS Construction Permit.c. Inspections may be suspended where construction activity has been suspended due to frozen ground conditions. Inspections must resume within 24 hours of runoff occurring, or upon resuming construction, whichevercomes first.2. Provide maintenance for all devices as follows:a. Silt fences and erosion control devices at storm sewer inlets shall be inspected for depth of sediment, tears, to see if fabric is securely attached to support posts or structure, and to see that posts and devices are securelyin place.b. Silt fence, inlet protection at storm sewer inlets, and other erosion control devices shall be cleaned when sediment reaches 1/3 of the height of the erosion control device.c. Rock construction entrances shall be inspected for clogging of rock. Rock that has become clogged with sediment shall be removed and replaced with clean rock.d. Repairs or replacement of all erosion control devices shall occur within 24 hours of discovery.e. Temporary sediment basins shall be cleaned when sediment reaches 1/2 of the outlet's height or 1/2 of the basins storage volume. The basin shall be drained and sediment removed within 72 hours.f. Temporary diversion berms shall be inspected and any breaches shall be promptly repaired.g. Tracked sediment from construction vehicles onto public streets and paved areas (including paved areas on the construction site) shall be removed within 24 hours of discovery.h. The bottom and side slopes of the proposed stormwater treatment basins shall be stabilized within 200 feet of the property lines or point of discharge to any surface water, including curb and gutter, pavement, stormsewer, swales, or other similar stormwater conveyance devices.i. Removal of all deltas and sediment deposited in surface waters and re-stabilization of exposed soils shall be accomplished within 7 days of discovery.Pollution Prevention Management Measures:1. Storage, handling, and disposal of construction products, materials and wastes:a. The Contractor shall comply with the following to minimize the exposure to stormwater (any of the products, materials, or wastes/products which are either not a source of contamination to strormwater or are designed tobe exposed to stormwater are not held to this requirement):xBuilding products that have the potential to leach pollutants must be under cover (e.g. plastic sheeting or temporary roofs) to prevent the discharge of pollutants or be protected by a similarly effective meansdesigned to prevent contact with stormwater.xPesticides, herbicides, insecticides, fertilizers, treatment chemicals, and landscape materials must be under cover (e.g. plastic sheeting or temporary roofs) to prevent the discharge of pollutants or protected bysimilarly effective means designed to prevent contact with stormwater.xHazardous materials, toxic wastes (including oil, diesel fuel, gasoline., hydraulic fluids, paint solvents, petroleum-based products, wood preservatives, additives, curing compounds, and acids), must be properly storedin sealed containers to prevent spills, leaks, or other discharge.xRestricted access storage areas must be provided to prevent vandalism. Storage and disposal of hazardous waste or hazardous materials must be in compliance with Minn. R. ch. 7045 including secondarycontainment as applicable.xSolid wastes must be stored, collected, and disposed of properly in compliance with Minn. R. ch. 7035.xPortable toilets must be positioned so that they are secure and will not be tipped or knocked over. Sanitary waste must be disposed of properly in accordance with Minn. R. ch. 7041.2. Fueling and maintenance of equipment or vehicles; spill prevention and response:a. The Contractor shall take reasonable steps to prevent the discharge of spilled or leaked chemicals, including fuel, from any areas where chemicals or fuel will be loaded or unloaded including the use of drip pans orabsorbents unless infeasible.b. The Contractor must conduct fueling in a contained area unless infeasible.c. The Contractor must ensure adequate supplies are available at all times to clean up discharged materials and that an appropriate disposal method is available for recovered spilled materials.d. The Contractor must report and clean up spills immediately as required by Minn. Stat. 115.061, using dry clean up measures where possible.3. Vehicle and equipment washing:a. If the Contractor washes the exterior of vehicles or equipment on the project site, washing must be limited to a defined area of the site.b. Runoff from the washing area must be contained in a sediment basin or other similarly effective controls and waste from the washing activity must be properly disposed of.4. The Contractor must properly use and store soaps, detergents, and solvents.5. No engine degreasing is allowed on site.6. Concrete and other washout waste:a. The Contractor must provide effective containment for all liquid and solid wastes generated by washout operations (concrete, stucco, paint, form release oils, curing compounds, and other construction materials) related tothe construction activity.b. The liquid and solid waste must not contact the ground, and the containments must be designed so that it does not result in runoff from the washout operations or areas.c. Liquid and solid wastes must be disposed of properly and in compliance with MPCA rules.d. A sign must be installed adjacent to each washout facility that requires site personnel to utilize the proper facilities for disposal of concrete and other washout wastes.Dewatering and Basin Draining:Dewatering or basin draining that may have turbid or sediment laden discharge water must be discharged to a temporary or permanent sedimentation basin on the project site whenever possible. Discharge from the temporary orpermanent sedimentation basin must be visually checked to ensure adequate treatment is obtained in the basin and nuisance conditions, impacts to wetlands, and erosion in receiving channels or on down gradient properties will notresult from the discharge. Adequate sedimentation control measures are required for discharge water that contains suspended solids.If using using filters with backwash water, either haul the backwash water away for disposal and return the backwash water to the beginning of the treatment process, or incorporate the backwash water into the site in a manner thatdoes not cause erosion.Timing of BMP Installation:The erosion and sediment control BMPs shall be installed as necessary to minimize erosion from disturbed surfaces and capture sediment on site and shall meet the NPDES/SDS Construction Permit part VII requirements. Perimetercontrols shall be placed prior to the start of any construction. All disturbed areas not actively being worked must be stabilized within 7 days.Storm Water Pollution Prevention Plan:The Permitees must implement the entire SWPPP and the requirement of the NPDES/SDS Construction Permit. underground facilities within 150’ shall be shown.
4. Verify why is it necessary for storm manhole to be removed.
5. Use provided sewer and watermain stubs.
6. Show boundary lines of adjoining unsubdivided or subdivided land, identified by name and
ownership.
7. Provide the normal, 2-year, 10-year, and 100-year water level for the pond on all sheets.
8. Verify the proposed sanitary line has enough coverage.
9. Remove key note 4 on page C101. Bituminous shall not be removed.

12. Remove the Otsego Standard Plate No. 701. Current MnDOT Standard Plate shall be used
instead.
13. Provide a public construction cost for Financial Summary development agreement.
