12-13-10 CCITEM 3_1 OTSEGO CITY COUNCIL MEETING OTSEGO CITY HALL DECEMBER 13, 2010 7:00 PM 1 Mayor Jessica Stockamp will call the meeting to order. Mayor Stockamp called the meeting to order at 7 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Vern Heidner, Dan Scharber, Tom Darkenwald and Doug Schroeder. Staff: Mike Robertson, City Administrator; Tami Loff, City Clerk; Daniel Licht, City Planner; Ron Wagner, City Engineer; Andy MacArthur, City Attorney. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 2 Consider agenda approval. CM Heidner motioned to approve. Seconded by CM Scharber. All in favor. Motion carried. 3 Consider the following minutes. 3.1. November 22 2010 City Council Meeting. CM Scharber motioned to approve as written. Seconded by CM Heidner. All in favor. Motion carried. 4 Open Forum: (5 minute limit) Cedric Williams, 8784 Parell Ave, Otsego River Riders, at the youth training they held last Thursday they had 49 students, 41 from Otsego. They have a new trail off Odean and Cty Rd 37. They thanked the City Council for the use of the Public Works Building for the training. 5 Consent Agenda (Non -controversial items). 5.1. Approve Claims List. 5.2. Approve assessment rebate. 5.3. Davis Mississippi Cove -Release of Escrow CM Heidner motioned to approve. Seconded by CM Schroeder. All in favor. Motion carried. 6 PUBLIC HEARING. 6 1 Truth in Taxation. A Mayor will open the Public Hearing. Mayor Stockamp opened the Public Hearing at 7:07 PM. B. Comments by Finance Director. Finance Director Groen reviewed the 2011 budget. C. Public comments. John Ibeling, 15446 93'd St, is concerned with his valuation; staff informed him that this meeting is on budget only and that the valuation meeting is in April. City Council asked staff to review and contact Mr. Ibeling. John Holland, 6719 Packard Ave, said his land value went up 32%. City Administrator Robertson said the state changes in Green Acres and increases in agricultural land value are probably what caused this. The City Council recommends he call Keith Triplett the County Assessor. City Council Meeting December 13, 2010. Page 2. Mitch Nelson, 8665 Parsons, Otsego Care, property valuation went up over 33%, nothing has changed. City Administrator Robertson said the county determines the value not the city. The City Council asked City Administrator Robertson to contact the Assessor and then be in contact with them. D. Close the Public Hearing. Mayor Stockamp closed the Public Hearing at 7:42 PM. Mayor Stockamp asked staff for an update after speaking with the County. 7 Unfinished Business. No items. 8. Public Works. CM Heidner said he was informed by resident said that at 88t and Ohland Avenue there is a sign missing. Have the Public Works check out. City Administrator Robertson said regarding the complaint that the Mayor received regarding Parell Avenue path not being plowed, he said if the school district has not done it by the morning we will do it; the school plow could not get thru due to drifting. 9. Daniel Licht, City Planner. No items. 10 Ron Wagner, City Engineer. 10.1. Consider Resolution 2010-46 Ordering_ Preparation of a Feasibility Report for a Municipal State Aid Street. City Engineer Wagner reviewed. It would be about $160,000 for the right of away and about $2.5 million total project. CM Darkenwald asked about Federal Aid if we apply in January when should we know. City Engineer Wagner said we should know by April. CM Darkenwald motioned to approve Resolution 2010-46 ordering preparation of report on improvement for 70"' Street (Marlowe Ave to Oakwood Ave) option 1. Seconded by CM Scharber. All in favor. Motion carried. CM Darkenwald motioned to direct the City Engineer to prepare preliminary plans and specs for the purpose of acquiring right away for the 85t' Street Improvement Seconded by CM Schroeder. All in favor. Motion carried. CM Scharber had to leave the meeting at 8:04 PM. Mayor Stockamp asked the status of the school path. City Engineer Wagner said plans have been reviewed and returned and he should have bids out by February. 11 Andrew MacArthur, City Attorney. 11.1. Approve Electronic Filing Agreement. City Attorney MacArthur reviewed. The BCA is asking for a joint contract authorizing use of the BCA computer system for e-charging which is where criminal charging, complaints etc can be done electronically. The cost to the city is nothing.CM Darkenwald said this should be saving us money. CM Heidner said the agreement needs changing, it states Rockford and needs our correct phone number. City Council Meeting December 13, 2010. Page 3. CM Heidner motioned to approve Resolution 2010-48 with the corrections. Seconded by CM Schroeder. All in favor. Motion carried. City Attorney MacArthur said he looked at the Letter of Credit on Waterfront East. It requires a ten day notice. Would like to get the City Councils authorization to go ahead CM Schroeder motioned to authorize staff to draw on the letter of credit. Seconded by CM Heidner. All in favor. Motion carried. 12. Council Items. 12.1. Resolution 2010-47 Approving 2011 Tax Lew. CM Darkenwald thanked Staff for their time and effort. CM Darkenwald motioned to approve Resolution 2010-47 approving 2011 Tax Levy. Seconded by CM Schroeder. All in favor. Motion carried. 12.2 Approve 2012 & 2013 Assessment Services Agreement with Wright County. CM Darkenwald said it is a two year agreement from January 2011-June 13 but what about the rest of the year? CM Heidner said it is based on the assessment year and we should have a new agreement by the beginning of 2013. CM Heidner motioned to approve Assessment Service Agreement with Wright County. Seconded by Mayor Stockamp. All in favor. Motion carried. 13 Mike Robertson City Administrator. 13 1 2011 Leadership Conference for Experienced Officials. City Administrator Robertson said this also includes newly elected officials. CM Darkenwald, Mayor Stockamp, CM Heidner and CM Schroeder all would like to attend. Mayor Stockamp asked City Administrator Robertson to check with CM Scharber as well. 14 Gary Groen, Finance Director. 15. Tami Loff, City Clerk. No items. 16. Adjourn by 10 PM. CM Darkenwald said the lights on 85"' Street and County Road 42 are not working correctly. City Engineer Wagner said he will contact the county. CM Darkenwald updated that City Council that he is working on web design items to bring to the City Council. CM Heidner had a question on who cleans the sidewalk on the South side of Bank of Elk River. City Planner Licht said that is a path and that is ours. Mayor Stockamp said Santa Day had a good turnout even with the weather and thanked staff. CM Darkenwald motioned to adjourned. Seconded by CM Schroeder. All in favor. Motion carried.
