1 Mayor Larry Fournier will call the meeting to order.
Mayor Fournier called the meeting to order at 6:30 pm.
Roll Call Mayor Fournier; Councilmembers: Vern Heidner, Dan Scharber,
Jessica Stockamp, and Mark Thorsted.
Staff: Mike Robertson, City Administrator; Judy Hudson, City Clerk/Zoning
Administrator; Tami Loff, Administrative Assistant; Dan Licht, City Plannner; Ron
Wagner, City Engineer; Andy MacArthur, City Attornery; Brad Belair, Public Works
Director; and Gary Groen, Finance Director.
Pledge of f Allegiance: Mayor Fournier led in the Pledge of Allegiance.
2. Consider agenda approval.
CM Thorsted requested to add item 11.2 Heritage Commission. Ron Wagner asked to
add item 9.3. Change Order No. 1. for Highway 101 Forcemain. CM Stockamp asked to
add item 12.2. Update on cell phone plans.
CM Heidner motioned adoption of the October 9, 2006 City Council Agenda as
amended. Seconded by CM Scharber. All in favor. Motion carried.
3 Consider the following. minutes.
3.1. ftmber 25 2006 City Council Meeting.
CM Stockamp motioned adoption of the September 25, 2006 City Council
Minutes as amended. Seconded by CM Scharber. All in favor. Motion carried.
4. Oben Forum: (5 minute limit
41 Commendations for Otsego Festival Committee.
Mayor Fournier presented certificates of appreciation to Otsego Festival Committee
members Rose Cassidy, Cone Goodrich, Lynne Kasper, Beverly Kumar, Sheri Olson,
Zach Olson, Kathy Roberts, Vicky Hasselgrave, Kathy Bandy, Jerry Struthers, Chris Hall,
John Jesso, Lisa Jesso, Jay Dupruis and CM Mark Thorsted.
Dawn Sculthorp, 9771 Kahler Ave, Presented an invoice she would like the City to
reimburse in the amount of $1,654.59. Mayor Fournier said this item will be brought up
later in the agenda under 9.1.
5 Consent Agenda (Non -controversial items).
5.1. Approve Claims List.
5.2. Received August 9, 2006 Park & Rec Commission Minutes.
5.3. Pay Request to Bonestroo in the amount of $27,466.75 for WWTF
West and East.
5.4. Special assessments of Bob's Produce Ranch SAC/WAC charges.

5.5. Pay Request to Buffalo Butuminous in the amount of $195,512.13
for Beaudry Meadows Park, Otsego Preserve Park and Kittredge
Crossing Park Improvements.
5.6. Pay Request to Greystone Construction for Otsego Public Works
Salt/Sand Storage in the amount $107,814.55.
5.7. Pay Request No. 13 to Oertel in the amount of $7,400.40 for the
Public Works Study.
5.8. Pay Request No.19 to Bonestroo in the amount of $150,010 for
East WWT Facility.
5.9. Final Pay Request to GM Contracting in the amount of $17,921.55
for Kadler Ave Forcemain.
5.10. Pay Request No. 3 to Dresel Contracting, Inc. in the amount of
$670,704.35 for CSAH 42 Reconstruction.
5.11. Pay Request No. 1 to Ryan Construction in the amount of
$902,541.80 for Queen Ave Construction.
5.12. Resolution 2006-76 A Resolution setting a charge for bounced
checks on sewer and water bills.
5.13. Resolution 2006-77 A Resolution increasing the amount the City is
authorized to deposit in any one bank.
5.14. Change Order #3 to Dresel for Street Grade Adjustment in the
amount of $2,500.
CM Scharber motioned to approve consent agenda. Seconded by CM Heidner.
All in favor. Motion carried.
6. Old Business.
6.1. Elk River Arts Alliance request for funding.
Tony Darkenwald, Elk River Arts Alliance was present. They are asking the city to
contribute $5,000 to their organization. CM Thorsted asked Andy MacArthur if this is an
organization the City is able to contribute to. Andy replied that he will take a look at the
State Statue. Council requested that this be brought back to the next Council Meeting.
Mrs. Darkenwald said that she knows that other cities in the area have contributed.
6.2. Prairie Park Drinking Fountain.
Brad Belair, Public Works Director, said that he has not received any quotes yet for
getting electricity to the purposed drinking fountain in Prairie Park. CM Heidner asked if
it is possible to bore deeper down instead of running electricity to the fountain. Brad
said that he will bring back quotes for both options.
6.3. 62nd Street Drainage Issue.
Mayor Fournier asked Brad how wide of road he would need. Brad Belair, Public Works
Director, said he would like to have a 22 ft road with a ditch on the south side about
two and a half feet deep and a cul-de-sac turn around at the end. Brad said that the
ditch may need to be lowered for proper drainage. Mayor Fournier said he wants the
road safe for residents and also for emergency vehicles. CM Stockamp asked if we have
heard from the other property owners affected. Mayor Fournier said that he has heard
from some. He suggests that we contact the owners and see where they stand.

CM Scharber motioned to contact residents and ask whether they want to
upgrade the road or post it as a minimal upgrade road. Seconded by CM
Heidner. All in favor. Motion carried.
7. Public Works.
Brad Belair, Public Works Director, suggested on taking a tour of the City Parks with
Council. The tour was set for Tuesday October 174' at 1:30 pm.
8. Dan Licht, City Planner.
8.1. Rental Housinaodle.
Dan Licht gave the Planner's report. Given the calls city staff have received regarding
the regulation of rental properties, Dan said that the City has the option of a Rental
Housing License Code which would ensure that the property is maintained to a level to
avoid creating a nuisance to the public's health, safety and welfare. CM Thorsted
expressed concern for the owner if they can't get renters out. Andy MacArthur, City
Attorney said that we would have something written in the code about the landlord's
responsibility.
CM Heidner motioned to have City Planner prepare a Rental Housing License
Code for review. Seconded by Mayor Fournier. All in favor. Motion carried.
9. Ron Wagner, City Engineer.
9.1. Update on Grenins Mississippi Hills.
City Engineer Ron Wagner reviewed their examination of the septic systems.
A Workshop was set up for these issues on Tuesday, October 17'h at 12:00 pm.
9.2. CSAH 42 Boulevard Tree Planting Quotes.
City Engineer Ron Wagner went over the Quotes for trees for CSAH 42 boulevard.
Midwest Landscapes has the lowest bid at $5,024.67. Target will maintain the trees
once they are installed.
CM Thorsted motioned to accept Midwest Landscapes low bid in the amount
of $5,024.67. Seconded by CM Stockamp. All in favor. Motion carried.
9.3. Change Order No. 1 for Highway 101 Forcemain.
Ron Wagner, City Engineer went over Change Order No. 1 to Hennen Construction for
Trunk Watermain and Forcemain along Highway 101, CSAH 42 and CSAH 37. MNDOT is
requesting that the City relocate approximately 320 feet of forcemain and watermain in
the vicinity of 6e Street. MNDOT has agreed to pay for 50 percent of the costs. The
amount the City would pay is around $30,000. CM Heidner said that the funds to pay
this will come out of sewer and water fees.
CM Scharber motioned to approve payment to Hennen Construction in the
amount of $30,000 through the sewer and water fees. Seconded by CM
Heidner. All in favor. Motion carried.
10. Andrew MacArthur, City Attorrmey.
10.1. Request from Remington Cove.
Andy MacArthur said that he had a request from Remington Cove to replace the
maintenance Letter of Credit with a security bond. Mayor Fournier asked if there is

much difference between the two. Andy replied that a Bond is basically the same as
Letter of Credit.
CM Thorsted asked if this is for all developments. Andy replied just for this one project.
CM Scharber motioned to Bond for construction money and Letter of Credit
for the rest. Seconded by CM Thorsted. All in favor. Motion carried.
11. Council Items.
11.1. Castle Plumbing Invoice in the amount of $137.60 for City Well
Pump Room/Irrigation.
Dave Castle assisted Brad with the work and has invoiced for parts only no labor costs.
CM Scharber motioned to approve payment to Castle Plumbing in the amount
of $137.60. Seconded by CM Heidner. All in favor. Motion carried.
11.2. Heritage Commission.
CM Thorsted stated that the Heritage Commission would like to get more information
on what is going on in the city. City Clerk/Zoning Administrator, Judy Hudson replied
that agenda's and hearing notices are put in the Heritage Commission mailboxes
regularly.
12. Mike Robertson, City Administrator.
12. 1. Set Workshop to review 2007 Budget.
Workshop date set for Thursday, November 9t' at 5:30 pm.
12.2. Update on Cell Phone Plans.
CM Stockamp was wondering if there are any updates on the cell phone plans. Brad
Belair has obtained costs and it will be cheaper to change to a Nextel system. Mike
Robertson said the cost estimate will be part of the budget for 2007.
13. Judy Hudson, City Clerk.
13.1. 2007 Fre Assessments.
Gary Groen, Finance Director was present to go over the 2007 Fire Assessments. Mayor
Fournier asked if it would benefit to move Rogers Fre District into Elk River District. CM
Scharber was concerned with the distance from Elk River to Rogers. He recommends
leaving as is. CM Scharber asked why we have funds in four different districts with
different charges, why not have one amount. CM Heidner said then one district would
subsidize the others. CM Scharber asked Gary what is each District charging per parcel.
Gary said that he will get that information together for the City Council.
Mayor Fournier motioned to approve the 2007 Fire Assessments and to
increase the amount by $5.00 per parcel. Seconded by CM Stockamp. All in
favor. Motion carried.
CM Heidner requested a tracking of all the Letter of Credits. Judy Hudson said that the
list is being worked on at this time.
