10-23-06 CCOTSEGO CITY COUNCIL MEETING OTSEGO CITY HALL OCTOBER 23, 2006 6:30 PM 1. Mayor Lan Fournier will call the meeting to order. Mayor Fournier called the meeting to order at 6:30 pm. Roll II: Mayor Fournier; Councilmembers: Vern Heidner, Dan Scharber, Jessica Stockamp, and Mark Thorsted. Staff: Mike Robertson, City Administrator; Judy Husdon, City Clerk/Zoning Administrator; Tami Loff, Administrative Assistant; Dan Licht, City Planner; Ron Wagner, City Engineer; Andy MacArthur, City Attorney; Brad Belair, Public Works Director. P. Igd_ge of Allegiance: Mayor Fournier led in the Pledge of Allegiance. 2. Consider agenda apl2roval. Mayor Fournier requested to add item 9.3. Wellhead Protection Manager. CM Heidner motioned adoption of the October 23, 2006 City Council Agenda as amended. Seconded by CM Scharber. All in favor. Motion carried. 3. Consider the following minutes 3.1. October 9, 2006Ci�' y Council Meetirmg Mike Robertson asked for the addition of CM Mark Thorsted to the list of Otsego Festival Committee members presented with certificates of appreciation. CM Heidner motioned adoption of the October 9, 2006 City Council Minutes as amended. Seconded by CM Stockamp. All in favor. Motion carried. 4. Open Forum: (5 minute limit Ed Pearsall, Police Commission, thanked the City Council for the purchase of McGruff suit. They have already used the suit twice, once at the Otsego Festival and again at the Otsego Elementary Carnival. Mr. Pearsall also stated that the Otsego Police Commission is wondering how long roadside memorials should stay with respect to the families. It was brought up because of the recent memorial on County Road 37 and Quaday Ave. Dan Licht, City Planner, said that there is no time limit and that since it is in the right away the city could move it if necessary. Mayor Fournier asked that the Police Commission bring back suggestions on this matter. 5. Consent Agenda (Non -controversial items). 5.1. Approve Claims List. 5.2. Approve Final Pay Estimate for Lift Station No.3 (West WWTF) to Barbarossa & Sons in the amount of $17,457.10. 5.3. Approve Final Pay Estimate for Lift Station No.4 (Martin Farms) to Barbarossa & Sons in the amount of $42,228.79. 5.4. Received August 8, 2006 Otsego Police Commission Minutes. 5.5. Received September 13, 2006 Otsego Park & Rec Minutes. City of Otsego Meeting October 23, 2006. Page 2. 5.6. Approve Pay Request to SRF in the amount of $5,374.81 for Otsego Parks. 5.7. Approve Pay Request to KUE Contractors in the amount of $769,497.00 for Public Works Facility. Cm Scharber motioned to approve consent agenda. Seconded by CM Stockamp. All in favor. Motion carried. 6. Old Business 6.1. Elk RiverArts Alliance- Request for Funding Toni Darkenwald, Elk River Arts Alliance was present. Mayor Fournier asked how Otsego is directly benefited by their organization. Mrs. Darkenwald replied that the Elk River Arts Alliance is providing a regional center for the arts for all ages and all surrounding communities. They have been involved in the surrounding School Districts with their Art Performances. Mrs. Darkenwald said that they hold their Art Soup Festival in Elk River that draws residents from surrounding cities. Mayor Fournier asked her to look into holding an event in Otsego. 6.2. Prairie Park Drinking Fountain Brad Belair, Public Works Director, went over Prairie Park Fountain options. The quote for the drinking fountain is about $5850. Council also asked for a quote to bore deeper instead of running electricity, to horizontal bore 600' water line at a minimum of 42" feet deep would cost $4500. They also have a option of adding a light to keep away vandalism. Mayor Fournier asked that these options be brought to the Park Commission for their review. 7. Public Works 7,1. Winter Road Mpintenance Brad Belair, Public Works Director, went over his memo to the Council regarding winter road maintenance. Mayor Fournier asked Brad if the new shed would hold salt for the whole season. Brad said yes. CM Heidner asked Brad to put up arrow direction signs North and South of Marlowe and 83rd Street. Brad said he has already ordered them and will get them up when they arrive. 8. Dan Licht, City Planner. Dan Licht, City Planner, had no items. 9. Ron Wa ner,City Engineer. 9.1. Consider Resolution Ap roving Plans and Specs for Otsego Creek Improvements and Order Ad for Bids Ron Wagner, City Engineer, went over the Otsego Creek Improvement. Ron said that he meet with five residents after they staked out the project. Talking with residents their main concern was saving trees. He recommends that the typical creek sections be changed from 4 to 1 slope to a 2 to 1 slope, this will reduce the amount of trees that will be removed. They will also be adding replacement trees. Mayor Fournier said that he would like a letter and plans sent to the residents. City of Otsego Meeting October 23, 2006. Page 3. Chuck Juve, 11551 77"' St, said that his major concern is the need for replacement trees. He will lose some to the cleaning. Mr. Juve is wondering if there would be an issue with him planting trees on his side. Dan Licht, City Planner, said to draw up plans on proposed placement and he will look it over. Beverly Kumar, 11395 77"' St, wanted Council to know that her husband and her are happy with the 2 to 1 slope instead of 4 to 1. Steve Book, 11297 77th St, had a question on the stakes that were put out. Ron explained that the stakes will move 8 to 10 feet closer to the creek. There is a 50 foot easement on both sides, 100 foot total. Tom Bramwell, 11501 77"' St, said that he is happy with the 2 to 1 slope. CM Heidner motioned to approve Resolution 06-78 Approving Plans and Specs and Ordering Advertisements for bids for Otsego Creek. Seconded by CM Scharber. All in favor. Motion carried. 9.2. Order Feasibility Study for Grenins Mississippi Hills Sewer. Ron Wagner, City Engineer, went over Resolution 2006-79 Ordering Preparation of Report on Improvement for Grenins Mississippi Hills. CM Scharber motioned to approve Resolution 06-79 Ordering of Feasibility Study for Grenins Mississippi Hills. Seconded by CM Stockamp. All in favor. Motion carried. 9.3. Wellhead Protection Manager. Mike Forman with Hakanson-Anderson, will replace the old Wellhead Protection Manager. CM Heidner motioned to designate Mike Forman as Wellhead Protection Manager. Seconded by CM Scharber. All in favor. Motion carried. 10. Andrew MacArthur City AtWrnev Andy MacArthur, City Attorney, had no items. 11. Council Items 1.1.1. Tax Comparisons with surrounding cities Mike Robertson, City Administrator, went over tax comparisons with surrounding cities. He noted that Otsego had the lowest city tax rate of all of the surrounding cities. He said that in Wright County only Buffalo had a lower city tax rate. 11.2. Alcohol Compli nce Issues Andy MacArthur, City Attorney, said that Wright County notified the City of two failed alcohol compliance checks conducted October 17, 2006 at Holiday Inn and Riverview Liquorette. Andy went over Ordinance 06-12 regarding liquor license violations. This is the second violation for Riverview Liquorette and the first violation for Holiday Inn. City of Otsego Meeting October 23, 2006. Page 4. Tim and Pat Phillips, Riverview Liquorette, were present. Mrs. Phillips stated she attended the alcohol sales training on September 27th after their last violation and they have signed up for class in February. Mayor Fournier asked her what she thought of the training. Mrs. Phillips replied that the training is good but it may give a false sense of security. She feels like this violation was just human error. CM Scharber stated that he feels that this is a serious issue. Since this is Riverview Liquorette second violation in three months he feels the full penalty should apply. Mayor Fournier also stated that he feels this is a very serious violation and that he feels that the full violation as written should be applied. CM Thorsted stated that he is against the one day suspension but in favor of the fine. Bill Dollansky, Riverview Liquorette, is the server who did not ID the 17 year old buyer. He admits fault. Said he will have to just ID everyone. CM Stockamp stated since he admits fault on this the full penalty should be applied. CM Thorsted motioned that Riverview Liquorette receive a $2000 fine and must attend Best Practices Training. Motion failed. CM Scharber motioned that Riverview Liquorette receive a $2000 fine, must attend Best Practices Training and receive a one day suspension. Seconded by CM Stockamp. Motion carried 4-1, CM Thorsted voted against. CM Scharber motioned that Holiday Inn receive a $2000 fine and must attend Best Practices Training. Seconded by Mayor Fournier. All in favor. Motion carried. 12. Mike Robertson,ity Administrator Mike Robertson, City Administrator, had no items. 13. Judv Hudson, City ('lerk Judy Hudson, City Clerk, had no items. 14.
