A phone call was received from Franklin Sign Company requesting that the proposed Zoning Ordinance amendment make allowance for billboards within the City. There were no other public comments. The Planning Commission discussed the issues related to the need to update the City's sign regulations. After some discussion, the Planning Commission voted 7 -0 to recommend approval of the Zoning Ordinance in the form attached hereto. The proposed Zoning Ordinance amendment will be considered by the City Council at their meeting on 12 December 2005 at 6:30 PM. A resolution repealing the current sign moratorium is also attached for consideration. c. Mike Robertson Judy Hudson Andy MacArthur RESOLUTION NO. 2005 -67 CITY OF OTSEGO WRIGHT COUNTY, MINNESOTA A RESOLUTION REPEALING INTERIM ORDINANCE 2005 -21 TEMPORARILY PROHIBITING THE APPROVAL OF SIGN PERMIT APPLICATIONS THE CITY COUNCIL OF THE CITY OTSEGO HEREBY ORDAINS: WHEREAS, the intent of Ordinance 2005 -21 is to allow the City of Otsego time to review its sign ordinances. WHEREAS, the time needed for review of the sign ordinances and regulations is necessary for the following reasons: • Lawsuits have been filed against the City of Hopkins and the City of Eden Prairie challenging the constitutionality of their sign ordinances. • The lawsuit involving the City of Hopkins (Advantage Media, LLC, et al. v. City of Hopkins, U:S. Dist. Ct. File No. 04- 04959), has so far resulted in the U.S. District Court Judge declaring the city's entire sign ordinance unconstitutional. • Based upon legal actions initiated against the Cities of Hopkins and Eden Prairie, as well as other cases, and the need to continually evaluate and update City ordinances, the City Council has directed City staff to review the Otsego Sign Ordinance and make recommendations as to modifications to the Sign Ordinance resulting from their study and investigation. • Minnesota Statutes, Section 462.355, Subd. 4 authorizes the City of Otsego to adopt an interim ordinance which imposes a moratorium on building and /or development activities in the city while the city considers modifications to its comprehensive plan or official controls. WHEREAS, for the purpose of protecting the planning process pending completion of modified ordinances, regulations and Official Controls regarding signs in the City of Otsego, a moratorium was adopted on the construction, installation and display of all signs in excess of eight (8) square feet in area. WHEREAS, the City of Otsego has considered and adopted changes to Official Controls regulating signs within the City as contemplated hereunder. NOW, THEREFORE BE IT RESOLVED THAT, the temporary moratorium established by Ordinance 2005 -21 is hereby repealed. THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN: Section 1. Section 37 of the Otsego Zoning Ordinance is hereby repealed in its entirety and replaced by the following provisions: SECTION 37 SIGN REGULATIONS Section 20 -37 -1: Purpose 20 -37 -2: Substitution Clause 20 -37 -3: General Provisions 20 -37 -4: Permitted and Prohibited Signs 20 -37 -5: Zoning District Regulations 20 -37 -6: Special Use Regulations 20 -37 -7 Permits Required, Inspection and Removal 20 -37 -8: Non - Conforming Signs 20 -37 -1: FINDINGS, PURPOSE AND EFFECT: A. Findings. The City Council hereby finds as follows: 1. Exterior signs have a substantial impact on the character and quality of the environment. 2. Signs provide an important medium through which individuals may convey a variety of messages. 3. Signs can create traffic hazards, aesthetic concerns and detriments to property values, thereby threatening the public health, safety and welfare. 37 -1 4. The City Code has included the regulation of signs in an effort to provide adequate means of expression and to promote the economic viability of the business community, while protecting the City and its citizens from a proliferation of signs of a type, size, location and character that would adversely impact the aesthetics of the community and threaten the health, safety and welfare of the community. The regulation of physical characteristics of signs within the City has had a positive impact on traffic safety and the overall appearance of the community. B. Purpose and Intent. It is not the purpose or intent of this sign ordinance to regulate the message displayed on any sign; nor is it the purpose or intent of this article to regulate any building design or any display not defined as a sign, or any sign which cannot be viewed from outside a building. The purpose and intent of this article is to: 1. Regulate the number, location, size, type, illumination and other physical characteristics of signs within the City in order to promote the public health, safety and welfare. 2. Maintain, enhance and improve the aesthetic environment of the City by preventing visual clutter that is harmful to the appearance of the community. • 3. Improve the visual appearance of the City, while providing for effective means of communication, consistent with constitutional guarantees and the City's goals of public safety and aesthetics. 4. Provide for fair and consistent enforcement of the sign regulations set for herein under the zoning authority of the City. C. Effect. A sign may be erected, mounted, displayed or maintained in the City if it is in conformance with the provisions of these regulations. The effect of this sign ordinance, as more specifically set forth herein, is to: 1. Allow a wide variety of sign types in commercial zones and a more limited variety of signs in other zones, subject to the standards set forth in this sign ordinance. 2. Allow certain small, unobtrusive signs incidental to the principal use of a site in all zoning districts, subject to the standards set forth in this sign ordinance. 3. Prohibit signs whose location, size, type, illumination or other physical characteristics negatively affect the environment and where the communication can be accomplished by means having a lesser impact on the environment and the public health, safety and welfare. 4. Provide for the enforcement of the provisions of this sign ordinance. 37 -2 20 -37 -2: SUBSTITUTION CLAUSE: The owner of any sign which is otherwise allowed by this sign ordinance may substitute non - commercial copy in lieu of any other commercial or non - commercial copy. This substitution of copy may be made without any additional approval or permitting. The purpose of this provision is to prevent any inadvertent favoring of commercial speech over non - commercial speech, or favoring of any particular non - commercial message over any other non - commercial message. This provision prevails over any more specific provision to the contrary. 20 -37 -3: GENERAL PROVISIONS: A. No signs, other than those of governmental jurisdictions, shall be permitted within public right -of -way or roadway easements. B. No sign or sign structure, unless otherwise regulated by this Section, shall be closer to any lot line than ten (10) feet. On comer Tots, no sign shall be located within the visibility triangle required by Section 20 -16 -8 of this Chapter. C. No sign shall be placed within any drainage or utility easement. D. No signs, guys, stays or attachments shall be erected, placed or maintained on rocks, fences, or trees, nor interfere with any electric light, power, telephone or telegraph wires or the supports thereof, with the exception of signs necessary for security, or to preserve public safety, as determined by the City Council. E. No sign shall be attached or be allowed to hang from any building until all necessary wall and roof attachments have been approved by the City Building Official. F. No sign shall be permitted to obstruct any window, door, fire escape, stairway or opening intended to provide light, air, ingress or egress of any building or structure. G. The installation of electrical signs shall be subject to the State's Electrical Code. Electrical service to such sign shall be underground. H. Illuminated signs shall comply with Section 20 -16 -10 of this Chapter and shall be shielded to prevent lights from being directed onto residential property, or at oncoming traffic in such brilliance that it impairs the vision of the driver. Nor shall such signs interfere with or obscure an official traffic sign or signal. This includes indoor signs which are visible from public streets and highways. I. Landscaping that accompanies signage must be approved by the Zoning Administrator with regards to installation, design and maintenance. 37 -3 J. Signs and sign structures shall be properly maintained and kept in a safe condition. Sign or sign structures which are rotted, unsafe, deteriorated or defaced, as determined by the City Building Official or Zoning Administrator, shall be removed, repainted, repaired, or replaced by the permit holder, owner or agent of the property upon which the sign stands. K. The owner, lessee or manager of any ground sign and the owner of the land on which the same is located shall keep grass or weeds and other growth cut and debris and rubbish cleaned up and removed from the lot on which a sign is located. 20 -37 -4: PERMITTED AND PROHIBITED SIGNS: A. Permitted Signs. The following signs are allowed without issuance of a sign permit as provided for by Section 20- 37 -6.A of this Chapter: 1. In addition to the signs allowed by Section 20 -37 -4 of this Section, two (2) signs not exceeding sixteen (16) square feet shall be allowed per lot. 2. Campaign Signs. Notwithstanding any other provisions of the sign ordinance, all signs of any size containing non - commercial speech may be posted from August in any general election year until ten (10) days following the general election and thirteen (13) weeks prior to any special election until ten (10) days following the special election, in accordance with Minnesota State Statutes Section 211 B.045. 3. Window signs shall be allowed subject to the sign area allowances of the respective zoning districts provided that the sign not exceed twenty -five (25) percent of the total area of the window in which they are displayed. 4. Any Signs in the public interest, erected by, or on the order of, public officers in the performance of their public duty, such as directional signs, regulatory signs, warning signs, and informational signs and all warning signs posted by public utilities whether or not such signs are in the public rights -of -way. B. Prohibited Signs. The following signs are prohibited: 1. Off - premises signs. 2. Motion signs except as allowed by Minnesota Statutes Section 173.16, Subd. 3. 3. No private sign shall be erected that resembles any official marker or sign erected of a governmental agency or shall display such words as "stop" or "danger" unless so specified by this Chapter or the City Code. 37 -4 4. Projecting Signs. 5. Roof Signs. 6. Signs on or attached to equipment such as vehicles, semi -truck trailers or other portable trailers where signing is a principal use of the equipment on either a temporary or permanent basis. 20 -37 -4: ZONING DISTRICT REGULATIONS: A. Agricultural Zoning Districts as defined by Section 20 -50 -1 of this Chapter. 1. All signs as outlined in Section 20- 37 -4.A of this Section. 2. One (1) sign provided that: a. The area of the sign shall not exceed sixty -four (64) square feet. b. Freestanding signs shall be limited to a maximum height of eight (8) feet. 3. In addition to the signs allowed by Section 20- 37 -4.A.1 and 2 of this sub- section, one (1) sign shall be allowed subject to the following provisions: a. The area of the sign shall not exceed thirty -two (32) square feet. b. Freestanding signs shall not exceed a maximum height of eight (8) feet. c. The sign shall be displayed for not more than twenty -one (21) days within a calendar year, except by interim use permit. B. Residential Zoning Districts as defined by Section 20 -50 -1 of this Chapter. 1. All signs as outlined in Section 20- 37 -4.A of this Section. 2. One (1) sign provided that: a. The area of the sign shall not to exceed sixty -four (64) square feet. b. Freestanding signs shall be limited to a maximum height of eight (8) feet. 3. In addition to the signs allowed by Section 20- 37 -4.B.1 and 2 of this sub- section, one (1) sign shall be allowed subject to the following provisions: 37 -5 a. The area of the sign shall not exceed thirty -two (32) square feet. b. Freestanding signs shall not exceed a maximum height of eight (8) feet. c. The sign shall be displayed for not more than twenty -one (21) days within a calendar year, except by interim use permit. C. Business and Industrial Zoning Districts as defined by Section 20 -50 -1 of this Chapter. 1. All signs as outlined in Section 20- 37 -4.A of this Section. 2. The total area of all signs displayed on a lot shall not exceed fifteen (15) percent of the total building facade fronting not more than two (2) public streets. 3. Freestanding. Not more than one (1) double -sided freestanding sign. Sign area may not exceed one hundred (100) square feet each side with a maximum height of twenty (20) feet, except that for signs within the Freeway Corridor District, the sign area shall not exceed two hundred (200) square feet each side with a maximum height of fifty (50) feet. 4. Wall, Canopy, or Marquee. Wall, canopy, or marquee signs shall be permitted on one facade fronting a public street, except in the case of a corner lot or through lot where wall signs may be installed on two facades fronting a public street. The area of individual signs shall not exceed one hundred (100) square feet, except that for signs within the Freeway Corridor Districts, the area of signs installed on the facade of a principal building fronting to a principal arterial roadway shall not exceed two hundred (200) square feet. 5. Multiple Principal Buildings and Multiple Tenant Buildings. When property is developed with two (2) or more principal buildings on one property or a principal building has more than (2) tenants each with an exclusive exterior entrance, signs shall be allowed subject to review and approval of the Zoning Administrator based upon the following requirements: a. A comprehensive sign plan is submitted that includes all of the following information: (1) A site plan to scale showing the location of lot lines, buildings, structures, parking areas, existing and proposed signs and any other physical features of the area included within the proposed comprehensive sign plan. 37 -6 (2) Elevations to scale of buildings included within the comprehensive sign plan including the location of existing or proposed wall, canopy or marquee signs. (3) To scale plans for all existing and proposed signs of any type included within the comprehensive sign plan indicating area, dimensions, height, materials, colors and means of illumination (if any). (4) No permit shall be issued for a new or replacement sign for an individual use except upon a determination by the Zoning Administrator that it is consistent with the approved comprehensive sign plan for the site. b. One temporary sign as provided for by Section 20- 37 -4.C.6 of this Section shall be allowed for each tenant provided that only one (1) such sign per property is displayed at any time. 6. In addition to the signs allowed by Section 20- 37 -4.C.1 through 5 of this sub - section, one (1) sign shall be allowed subject to the following provisions: • a. The area of the sign shall not exceed thirty -two (32) square feet. b. Freestanding signs shall not exceed a maximum height of eight (8) feet. c. The sign shall be displayed for not more than twenty -one (21) days within one (1) calendar year, except by interim use permit. D. Institutional Zoning Districts as defined by Section 20 -50 -1 of this Chapter. 1. All signs as outlined in Section 20- 37 -4.A of this Section. 2. Not more than one (1) double -sided freestanding sign. Sign area may not exceed one hundred (100) square feet each side with a maximum height of twenty (20) feet. 3. Wall, canopy, or marquee signs shall be permitted on any facade fronting a public street. There shall be no limit as to the area of individual signs. 4. In addition to the signs allowed by Section 20- 37 -4.D.1 through 4 of this sub - section, one (1) sign shall be allowed subject to the following provisions: a. The area of the sign shall not exceed thirty -two (32) square feet. 37 -7 b. Freestanding signs shall not exceed a maximum height of eight (8) feet. c. The sign shall be displayed for not more than twenty -one (21) days within one (1) calendar year, except by interim use permit. 20 -37 -5: SPECIAL USE REGULATIONS: A. Area Identification Signs. Signs at the entrance to an area or subdivision from collector or arterial street defined by the Otsego Comprehensive Plan shall be allowed provided that: 1. Not more than one (1) sign shall be allowed at each entrance from a collector or arterial street. 2. Area: a. For agricultural and residential districts, the area of each sign shall not exceed thirty -two (32) square feet. b. For business, industrial or institutional districts, the area of each sign shall not exceed two hundred (200) square feet. 3. Height. a. For agricultural and residential districts, the maximum height of each sign shall be eight (8) feet. b. For business, industrial and institutional districts, the maximum height of each sign shall be twelve (12) feet. 4. Signs shall be located on outlots of sufficient size and area to accommodate said structure. An association or other form of deed restriction and ownership deemed acceptable by the City Council and involving all the properties within the designated area shall be required, which shall own and be responsible for the upkeep, perpetual maintenance, taxes, insurance, utilities and other costs associated with the sign(s) and the outlot upon which it is located. The association rules or by -laws, or similar legal document, shall specify how the aforementioned sign responsibilities will be delegated and paid for. Such legal document shall be subject to the review and approval of the City Attorney. 5. Outlots for signs shall be considered and planned for at the time of preliminary plat application and be included in the final plat. The subdivision development contract between the City and the developer 37 -8 shall specify the designated use of the outlot, its ownership and the respective responsibilities regarding the outlot. 6. The outlot area around the sign shall be landscaped in such a manner to accent and enhance the sign while remaining sensitive to the natural features of the site. Detailed site and landscape plans shall be included with each sign permit application and shall be subject to City Council review and comment. 7. The design and construction of area identification signs shall be done with the highest quality materials and workmanship to keep maintenance and upkeep costs to a minimum and to minimize the potential for vandalism. Area identification signs are to be aesthetically pleasing when designed and constructed. The sign shall be compatible with nearby structures in the area. Detailed construction plans and a materials list shall be included with each sign permit application and shall be subject to City Council review and approval. 8. The City reserves the right to require the removal, at the owner's expense, of any sign when the requirements of this section are not completely followed and adhered to, or if the sign is not properly maintained or falls into a state of disrepair. The City shall not have any obligation or liability to replace any sign when removed by the City. B. Motor Fuel Station. Signs for motor fuel stations shall be regulated by the sign provisions for the zoning district in which the station is located, except that a sign not to exceed thirty -two (32) square feet shall be allowed to display current fuel prices in accordance with Minnesota State Statutes Section 239.751. C. Planned Unit Development District. Within a planned unit development district as defined by Section 20 -50 -1 of this Chapter, sign allowances shall be based upon the individual uses and structures within the development in compliance with the standards applied for the conventional zoning district where such uses are allowed. 20 -37 -6: PERMITS REQUIRED, INSPECTION AND REMOVAL: A. Except as provided in Section 20- 37 -4.A, no sign or structure shall be erected, constructed, altered, rebuilt or relocated until a permit has first been issued by the Zoning Administrator. 1. Sign Application. The following information for a sign permit shall be supplied by an applicant upon submission of a sign permit application: a. Name, address and telephone number of person making application. 37 -9 b. Name, address and telephone number of person owning sign. c. The name, address telephone number and signature of the person owning the property upon which the sign is to be located. d. A site plan to scale showing the location of lot lines, building structures, parking areas, existing and proposed signs and any other physical features. e. Plans, location and specifications and method of construction and attachment to the buildings or placement method in the ground. f. Landscape plans for area around signs. g. Written consent of the owner or lessee of any site on which the sign is to be erected. h. Any electrical permit required and issued for the sign. i. Future maintenance plans. • j. Sign value. k. The applicant shall certify that the application is in full compliance with this Chapter and all other applicable provisions of the City Code. 2. Application Processing and Action. a. Within fifteen (15) working days of receiving an application for a sign permit, the Zoning Administrator shall review it for completeness. If the application is complete, it shall then be processed. If the Zoning Administrator finds that it is incomplete, the Zoning Administrator shall, within such fifteen (15) working day period, send to the applicant a notice of the specific ways in which the application is deficient, with appropriate references to the applicable sections of this Chapter and /or the City Code. b. Upon receipt of a complete application, the Zoning Administrator shall review and comment upon application and shall either: 1. Issue the sign permit, if the sign(s) that is the subject of the application conforms in every respect with the requirements of this Chapter and the City Code. 2. Reject the sign permit if the sign(s) that is the subject of the application fails in any way to conform with the requirements of this Chapter and the City Code. 37 -10 c. In case of a rejection, the Building Official shall specify in the rejection the Section or Sections of this Chapter and /or the City Code with which the sign(s) is inconsistent. d. If the work authorized under a permit has not been initiated within sixty (60) days after the date of issuance, the permit shall be null and void. 3. Fees. Fees for the review and processing of sign permit applications shall be imposed in accordance with the schedule established by Section 2 -4 -1 of the City Code. B. Inspection. All signs shall be subject to inspection by the Zoning Administrator and /or Building Official. C. Removal of Signs. 1. The Zoning Administrator and /or Building Official shall order the removal of any illegal non - conforming sign erected or maintained in violation of this Chapter. Notice in writing shall be given by the City to the owner of such sign, or of the building, structure or property on which such sign is located, to remove the sign or to bring it into compliance with the provisions of this Section within fifteen (15) days from the date of said notice. 2. Upon failure to remove the sign or to comply with this notice, the City may remove the sign. Any costs of removal incurred by the City shall be assessed to the owner of the property on which such sign is located and may be collected in the manner of ordinary debt or in the manner of taxes and all costs shall be assessed against the property. 3. The Zoning Administrator and /or Building Official may order the immediate removal of any sign without notice, which is in violation of the following: a. Signs located within the public right -of -way. b. Temporary signs that have exceeded the time limits allowed in this Section. c. The condition of the sign is such as to present an immediate threat to the safety of the public. 20 -37 -7: NON - CONFORMING SIGNS AND USES: 37 -11 A. Non - Conforming Signs. Any non - conforming on- premise sign lawfully existing upon the effective date of this Section may be continued at the size and in the manner existing upon such date, subject to the following provisions: 1. Maintenance and Repair. Nothing in this Section shall be construed as relieving the owner or user of a legal non - conforming sign or owner of the property on which the legal non - conforming sign is located from the provisions of this Section regarding safety, maintenance, and repair of signs, provided that any repainting, cleaning, and other normal maintenance or repair of the sign or sign structure shall not modify the sign structure or copy in any way which makes it more non - conforming or the sign shall lose its legal non - conforming status. Illegal, non - conforming signs shall be removed by the property owner within ten (10) days of notice from the City. 2. Prohibited Alterations. A non - conforming sign may not be: a. Structurally altered except to bring it into compliance with the provisions of this Section. b. Enlarged. c. Re- established after its removal or discontinuance. d. Repaired or otherwise restored, unless the damage is to less than fifty (50) percent of sign structure value as determined by the Zoning Administrator. e. Replaced (Applies to structure only and not message). B. Non - Conforming Uses. When the principal use of land is legally non - conforming under this Chapter, all existing or proposed signs in conjunction with that land, unless otherwise provided for by this Chapter or the City Code, shall be considered conforming if they are in compliance with the sign provisions for the zoning district in which the principal use is allowed. City staff responded that the development of parks within a given area typically proceeds construction of most of the homes. In that the City pays for park development directly from park and trail dedication funds (and not with bonds repaid over time), the need for the having the funds collected upfront is more important. The fowl must be housed within an enclosed accessory building and fenced outdoor yard that conforms to the accessory building provisions applicable to the district in which they are kept. 4. The accessory building containing the fowl must be within a rear yard and shall be subject to the required setbacks for principal buildings within the respective zoning district with the additional stipulation that the side yard setbacks must be double those required for principal buildings. 5. The keeping and care of such fowl is provided as regulated by the City Code. 6. The owner /keeper of the fowl shall control the animal manure and dispose of it properly. 7. If eggs are harvested, they shall not be offered for sale from the premises. 8. The fowl keeping license shall apply only to the named applicant, shall not run with the land, and may not be transferred. In addition, major disasters such as train wrecks, plane crashes, explosions, accidental releases of hazardous materials, pipeline leaks, and enemy attack pose a potential threat to public health and safety in Otsego. In recognition of these threats, it is necessary to ensure that preparations of the City will be adequate to deal with the disasters and to provide for basic health and security, and preserve the lives and property of the people of this City, it is declared necessary A. To establish a City emergency management organization, whose responsibility it is to plan and prepare for emergency government operations in time of disaster. B. To provide for the exercise of necessary powers during emergencies and disaster. C. To provide for the exercise of mutual aid between the City and other political subdivisions with the goal of carrying out of emergency preparedness functions. D. To comply with the provisions of M.S. Chapter 12 E. To participate as policing district of Wright County and a fire protection jurisdiction of the cities of Albertville, Monticello, Elk River, and Rogers, and review and accept their emergency plans as the City's basic plan for responses to emergencies, disasters, mutual aid, and other projects, as prescribed with this ordinance and M.S. Chapter 12. 5 - 9 - 2: Definitions: Disaster. A situation that creates an actual or imminent serious threat to the health and safety of persons, or a situation that has resulted or is likely to result in catastrophic loss to property or the environment, and for which traditional sources of relief and assistance within the affected area are unable to repair or prevent the injury or loss. Emergency. An unforeseen combination of circumstances that calls for immediate action to prevent a disaster from developing or occurring. Emergency Management. The preparation for and the carrying out of emergency functions, other than functions for which military forces are primarily responsible, to prevent, minimize and repair injury and damage resulting from disasters, from acute shortages of energy, or from incidents that pose radiological or other health hazards. These functions include, without limitation, fire - fighting services, police services, medical and health services, rescue, engineering, warning services, communications, radiological, chemical and other special weapons defense, evacuation of persons from stricken areas, emergency human services, emergency transportation, existing or properly assigned functions of plant protection, temporary restoration of public utility services, implementation of energy supply emergency conservation and allocation measures, and other functions related to civilian protection, together with all other activities necessary or incidental to preparing for and carrying out these functions. Emergency Response Personnel. An individual, organization, or team authorized by the state to supplement state or local resources for emergency response in a stricken area. Emergency Management Mutual Aid. Any disaster which requires the dispatching of City personnel, equipment or other necessary resources within or without the City limits. Emergency Management Organization. The staff element responsible for coordinating city - level planning and preparation for disaster response. This organization provides coordination with federal, state and local jurisdictions relative to disaster preparedness activities, disasters, mutual aid and other projects consistent with M.S Chapter 12 and assures implementation of federal, state, county and other program requirements. Political Subdivision. A county, city, town, or commission organized and existing under M.S. Sections 473.601 to 473.679. 5 - 9 - 3: Establishing an Emergency Management Organization: There is created with the City government an emergency management organization which shall be under the supervision of the Emergency Management Director, herein referred to as the Director. The Director shall be appointed to this position by the City Council for an indefinite term and may be removed by the Mayor and City Council at any time. The Director shall have, in addition to his/her other position responsibilities, direct responsibility for the organization, administration, and operation of the emergency management organization. Membership of the emergency management organization shall consist of any and all whom the Director, Mayor and City Council deem necessary. It shall include, but not be limited to: employees of the City, representatives from each of the contracted fire departments, representatives from the Wright County Sheriff's Office, representatives of related emergency management organizations or entities, and at least one at -large community member. 5 -9 -4: Powers & Duties of the Emergency Management Director: A. The City Administrator, in his/her role as supervisor of the emergency management organization, shall serve as Emergency Management Director B. The Director shall represent the City at regional or state conferences for emergency management. The Director may develop additional mutual aid agreements with other political subdivisions of the state for reciprocal emergency management aid and assistance in an emergency too great to be dealt with unassisted and shall present an agreement to the City Council for its action. The arrangements shall be consistent with the Emergency Operations Plan. The Director shall also be the City's representative to emergency management committees in which the City has a current contract for services. C. The Director shall make assessments of personnel, business and industries, resources and facilities of the City as deemed necessary to determine their adequacy for emergency management and to plan for their most efficient use in time of an emergency or disaster. D. The Director shall work with the City Clerk and department heads in preparing a comprehensive emergency plan for the emergency management of the city hall and shall present the plan to the City Council for its approval. When the council has approved the plan by resolution, it shall be the duty of all city departments and emergency management forces of the City to perform the duties and functions assigned by the plan as approved. The plan may be modified in like manner when necessary. The Director shall coordinate the basic emergency management activities of the City to the end that they shall be consistent and complimentary with the emergency operations plans of participating political subdivisions and state and federal governments. E. In accordance with state and city emergency plans, the Director shall institute training programs, public information programs, and conduct practice warning alerts and emergency exercises as may be necessary to assure prompt and effective operation of the emergency plan when a disaster or mutual aid occurs (M.S. Chapter 12, Sec. 12.25) F. During an emergency, disaster, or mutual aid, the Director shall utilize the personnel, services, equipment, supplies and facilities of existing departments of the City to the maximum extent practicable. The officers and personnel of every department shall be cooperative with and extend services and facilities to the emergency management organization. The head of every department in cooperation with the Director shall be responsible for the planning and programming of the emergency activities as will involve the utilization of the facilities of the department. G. The Director shall, in cooperation with existing City departments affected, assist in the organizing, recruiting, and training of such emergency management personnel that may be required on a volunteer basis to carry out the emergency plans of the City and state. To the extent that such emergency personnel are recruited to augment a regular City department for emergencies, they shall be assigned to such departments and shall be under the administration and control of said department. H. The Director shall carry out all orders, rules, and regulations issued by the City Council pertaining to emergency management I. The Mayor shall authorize, and the Director shall carry out, all orders, rules and regulations issued by the Governor with reference to emergency management. J. The Director shall direct and control general operations of all local emergency management forces during an emergency in conformity with controlling regulations and instructions of state emergency management authorities. The heads of departments shall be governed by the Director's orders in respect to hereto. K. The Director shall prepare and submit such reports on emergency management activities as may be requested by the City Council. L. If, during time of a declared emergency, the Director shall find that civil courts within the police jurisdiction of the city are unable to perform their lawful duties, he shall inform the City Mayor, and the Mayor shall inform the Governor of his findings and may recommend to him that a state of martial law be proclaimed within the police jurisdiction of the city (M.S. 12.23 and M.S. 12.33 Sub. 1). 5 - - 5: Local Emergencies: A local emergency may be declared only by the Mayor of the City or their legal successor(s). It shall not be continued for a period in excess of three days except by or with consent of the City Council. Any order or proclamation declaring, continuing, or terminating a local emergency shall be given prompt and general publicity and shall be filed promptly by the City Clerk. The declaration shall invoke the City emergency operations plan and other interjurisdictional emergency plans, and may authorize the request for aid and assistance from surrounding political subdivisions. No other city official or agency may declare a local emergency unless expressly authorized by the agreement under which the agency functions (i.e. mutual aid agreement or contract). However, an inter jurisdictional disaster agency shall provide aid and services in accordance with the agreement under which it functions. 5 - 9 - 6: Emergency Regulations: A. Whenever necessary to meet a declared emergency or to prepare for such an emergency for which adequate regulations have not been adopted by the State or the City Council, the Council may, by resolution, promulgate regulations, consistent with applicable federal and state law or regulation, respecting: the conduct of persons and the use of property during emergencies; the repair, maintenance, and safeguarding of essential public services, emergency health, fire, and safety regulation, drills, or practice periods required for preliminary training, and all other matters which are required to protect public safety, health, and welfare in declared emergencies. B. Every resolution of emergency regulations shall be in writing: shall be dated, shall refer to the particular emergency to which it pertains, if so limited, and shall be filed with the City Clerk, and shall be kept posted and available for public inspection during business hours. Notice of the existence of such regulations and its availability for inspection shall be conspicuously posted at the front of the city hall or other headquarters of the City or at other places in the affected area as the Council shall designate in the resolution. By like resolution, the Council may modify or rescind any such regulation. C. The City Council may rescind any such regulation by resolution at any time. If not sooner rescinded, every such regulation shall expire at the end of 30 days after its effective date or at the end of the emergency, whichever comes first. Any resolution, rule, or regulation inconsistent with an emergency regulation promulgated by the Council shall be suspended during the period of time and to the extent such conflict exists. D. During a declared emergency, the City is, not withstanding any statutory or charter provision to the contrary, empowered, through the City Council acting within or without the corporate limits of the City, to enter into contracts and incur obligations necessary to combat such disaster by protecting the health and safety of persons and property and providing emergency assistance to the victims of such disaster. The City may exercise such powers in the light of exigencies of the disaster without compliance with the time - consuming procedures and formalities prescribed by law pertaining to the performance of public work, entering rental equipment agreements, purchase of supplies and materials, limitations upon tax levies, and the appropriation and expenditure of public funds including, but not limited to, publication of resolutions, publication of call for bids, provisions of personnel laws and rules, provisions relating to low bids, and requirement for budgets. 5 - 9 - 7: Emergency Management A Government Function: All functions thereunder and all other activities relating to emergency management are hereby declared to be City governmental functions. The provisions of this section shall not affect the right of any person to receive benefits to which he would otherwise be entitled under this resolution or under the worker's compensation law, or under any pension law, nor the right of such person to receive any benefits or compensation under any act of Congress. 5 - 9 - 8: Conformity and Cooperation with Federal and State Authority: A. Every officer and agency of the city shall cooperate with federal and state authorities and with authorized agencies engaged in emergency management and emergency measures to the fullest possible extent consistent with the performance of their other duties. The provisions of this ordinance and of all regulations made thereunder shall be subject to all applicable and controlling provisions of federal and state laws and of regulations and orders issued thereunder and shall be deemed to be suspended and inoperative so far as there is any conflict therewith. A. The county Sheriff may appoint any qualified person holding a position in any agency created under federal or state authority for emergency management purposes as a special policing officer of the city, with such powers and duties within the city incident to the functions of the Sheriffs or Deputy's position, not exceeding those of a regular Sheriff or Deputy, as may be prescribed in the appointment. Every such police officer shall be subject to the supervision and control of the Sheriff and such other deputies of the county as the Sheriff may designate. 5 -9 -8: Participation in Labor Disputes or Political Action: The emergency management organization shall not participate in any form of political activity, nor shall it be employed directly or indirectly for political purposes, nor shall it be employed in a labor dispute. 5 - - 9: Enforcement Authority: The members of the Wright County Sheriff's Department, Elk River Fire Department, Monticello Fire Department, Albertville Fire Department, Rogers Fire Department, and all other law enforcement agencies having jurisdiction in the City, and other people authorized by the Mayor, City Council, or Director are authorized and directed to enforce this section and the orders and regulations made pursuant to this ordinance. 5 - - 10: Prohibited Conduct: During the period of a declared local emergency, no person may: A. Enter or remain on the premises of an establishment that is not open for business to the general public, unless the person is the owner of the establishment or the owner's agent; B. Violate an order or regulation properly issued by the Mayor or the City Council, or a directive issued by the Director or the Director's authorized agent; or C. Willfully obstruct, hinder, or delay a person who is authorized to enforce this section while that person is exercising those duties or enforcing an order or regulation issued under authority of this section. D. A person who violates this section is guilty of a misdemeanor. A violation of this ordinance is subject to the penalties and provisions of Chapter 2, Section 5 of the Otsego City Code. 5 - - 11: City Code: This Ordinance shall be incorporated into the Otsego City Code as Chapter 5, Section 9 Emergency Management Section 2. The subject site is currently platted as Outlots A and B of the original Otsego 1 -94 West Industrial Park plat. The subject site is guided for industrial use by the Comprehensive Plan and is zoned 1 -2, General Industrial District. Exhibits: A. Site Location B. Preliminary Plat C. Final Plat ANALYSIS Preliminary Plat Consistency. The proposed final plat is generally consistent with the preliminary plat approved on 14 August 2000. The only deviation from the approved preliminary plat design is that three lots were anticipated to be final platted in the area of Lot 1, Block 2 of the proposed final plat. The change to the final plat from the approved preliminary plat is not an issue. Lot Requirements. Lots within the 1 -2 District are subject to minimum lot area and lot width requirements of 2.0 acres and 200 feet. All three proposed lots exceed the minimum 1 -2 District lot requirements and have sufficient area within required setbacks to allow reasonable use of the property. Access. Access to all three lots will be required to come off of 71 Street for which right -of -way was dedicated and the street constructed with the first final plat of the Otsego 1 -94 West Industrial Park. The final plat provides for only 33 feet of right -of -way for Kadler Avenue, whereas the NEWC Transportation Plan would require dedication of 75 feet for the west half of the right -of -way. In that more than two years has passed since the approval of the preliminary plat and execution of the initial development contract in 2001, the City can require the dedication of the additional right -of -way and the final plat must be revised. Utilities. No utility plan has been submitted for the proposed final plat. With approval of the final plat for Kittredge Crossings 10 Addition pending, sanitary sewer and water services will be within one - quarter mile of the subject site. Consideration should be given to extending sanitary sewer and water services to the subject site. Easements. The proposed final plat illustrates perimeter drainage and utility easements for each lot and over ponding areas and wetlands. All easements are subject to review and approval of the City Engineer. Park and Trail Dedication. The subject site is subject to park and trail dedication requirements as a condition of final plat approval, to be satisfied as a cash fee in lieu of land as set forth below: • Gross Area Outlots A and B x $3,500.00 per acre = cash fee (24.68ac. + 11.27ac.) x $3,500.00 = $125,825.00 Development Contract. Prior to approval of a final plat, the applicant shall enter into a development contract with the City and pay all fees and securities, subject to review and approval by the City Attorney. RECOMMENDATION The proposed final plat of the Otsego 1 -94 West Industrial Park 3 Addition is consistent with the requirements of the Subdivision Ordinance and Zoning Ordinance. We recommend approval of the application as outlined below. POSSIBLE ACTIONS A. Motion to approve the Otsego 1 -94 West Industrial Park 3` Addition Final Plat subject to the following conditions: 1. THIS AGREEMENT, made and entered into by and between the City of Otsego, having an office at 8899 NE Nashua Avenue, Otsego, Minnesota 55330 hereinafter referred to as "CITY" and SRF Consulting Group, Inc having an office at Suite 150, One Carlson Parkway North, Plymouth, Minnesota 55447, hereinafter referred to as "SRF ". WITNESSETH: WHEREAS, CITY requires services in connection with the design of three neighborhood parks (Arbor Creek, Otsego Preserve and Kittredge); hereinafter referred to as the "Project ", and WHEREAS, SRF can provide those services needed in such a project. NOW, THEREFORE, in consideration of the mutual covenants and considerations hereinafter contained, it is agreed by and between CITY and SRF as follows: 1. Scope of Services The services to be performed by SRF are described in Exhibit "A" attached hereto and made a part of this Agreement. This amount will be increased at a rate of 8 percent of the construction value for any construction value that exceeds $1,000,000 and is work requested from the City. 2. Rate of Compensation Compensation to SRF for work listed in Exhibit "A" shall be on an hourly basis plus expenses, not to exceed $87,500. SRF's hourly rates are outlined in Exhibit "B ". SRF retains the right to amend its hourly rates coinciding with the start of the calendar year. Reimbursable expenses shall be billed at actual cost and include, but are not limited to, the costs of travel, materials, printing and reproduction, supplies and other project - specific costs. Mileage shall be billed at a rate not to exceed the current IRS allowable rate for business miles For any "Additional Services' ordered by CITY and performed by SRF, CITY will pay SRF in accordance with the rates listed in the attached Exhibit "B ". Reimbursable expenses shall be invoiced at actual cost. An amendment to this Agreement covering the Additional Services will be executed by both parties prior to the delivery of additional services and the payment of any fee over and above the stated not to exceed amount. City of Otsego Invoices will be submitted on a monthly basis for work performed. 3. General Considerations SRF will perform the Project in a timely manner, but it is hereby agreed that SRF cannot be held responsible for delays occasioned by factors which are beyond its control, or by factors which could not reasonably have been foreseen at the time this Agreement was prepared and executed. Terms of this Agreement may be changed by mutual agreement of CITY and SRF. Such changes shall be approved by both parties and incorporated in written amendments to this Agreement. 4. Independent Contractor SRF is an Independent Contractor. Nothing contained in this Agreement is intended or should be construed as creating the relationship of co- partners or joint venturers with CITY. No tenure or any rights or benefits, including workers' compensation, unemployment insurance, medical care, sick leave, vacation leave, severance pay, or other benefits available to CITY employees, shall accrue to SRF or employees of SRF performing services under this Agreement. SRF shall comply with Federal, State and local laws, together with ordinances and regulations applicable to the work. 5. Records SRF will maintain accounting records in accordance with generally accepted accounting principles and practices. Such records with respect to the Project will be available for examination by CITY during SRF's normal business hours for a period of seven years after SRF'S final invoice to CITY. 6. Termination of the Agreement Either party may terminate this Agreement (or arty part thereof), at any time, upon written notice to the other party, effective upon delivery (including delivery by facsimile or electronic mail). In such event, SRF will be entitled to compensation for work performed up to the date of termination based upon the payment terms of this Agreement. Such payment will not exceed the maximum amount provided for by the terms of this Agreement. 7. Controlling Law The Law of the State of Minnesota shall govern all questions and interpretations concerning the validity and construction of this Agreement and the legal relations between the herein parties and performance under it. If any provision of the Agreement is held invalid, illegal or unenforceable, the remaining provisions will not be affected. City of Otsego Page 2 8. Ownership of Instruments of Service All reports, plans, specifications, field data and notes and other documents, including all documents on electronic media, prepared by SRF, as instruments of service shall remain the property of CITY. SRF is not responsible or liable for the reuse of the plans or specifications for any application other than the identified project. 9. Indemnification SRF agrees, to the fullest extent permitted by law, to indemnify and hold CITY harmless from any damage, liability or cost (including reasonable attorneys' fees and costs of defense) to the extent caused by SRF's negligent acts, errors or omissions in the performance of professional services under this Agreement and those of its subcontractors or anyone for whom SRF is legally liable. CITY agrees, to the fullest extent permitted by law, to indemnify and hold SRF harmless from any damage, liability or cost (including reasonable attorneys' fees and costs of defense) to the extent caused by CITY's incorrect information provided to SRF and upon which SRF relies to its detriment. 10. Insurance SRF will furnish satisfactory evidence of insurance if requested by CITY. SRF will at all times during the term of this Agreement have and keep in force: A. Comprehensive General Liability B. Comprehensive Automobile Liability (Owned, Non - Owned, Hired) C. Professional Liability D. Workers' Compensation E. Auto Liability 11. Subcontracting and Assignment SRF shall not enter into any subcontract for performance of any services contemplated under this contract nor assign any interest in this Contract without the prior written approval of CITY. 12. Nondiscrimination During the performance of its responsibilities under this Agreement, SRF agrees to the following: No person shall, on the ground of race, color, religion, age, sex, disability, marital status, public assistance status, affectionnal preference, familial status, ancestry, creed, or national origin be excluded from full employment rights in, participation in, be denied the benefits of or be otherwise subjected to discrimination under any and all applicable Federal and State laws against discrimination. City of Otsego Page 3 13. Approvals Before this Agreement shall become binding and effective, it shall receive the approval of such authorized officials as the law may provide. 14. Merger and Modification It is understood and agreed that the entire Agreement between the parties is contained herein and that this Agreement supersedes all oral agreements and negotiations between the parties relating to the subject matter hereof. All items referred to in this Agreement are incorporated or attached and are deemed to be part of this Agreement. Any material alternations, variations, modifications or waivers of provisions of this Agreement shall only be valid when they have been reduced to writing as an amendment to this Agreement and signed by the parties hereto. Provision of all baseline information including 1 -inch to 100 -feet contour mapping. 2. Notice and host neighborhood public information meetings. It is assumed that the Park and Recreation Commission will host all meetings. 3. Provide formal liaison with other agencies as needed. 4. Complete formal agreement with contractor for construction. 5. The value of construction improvements that SRF will provide construction documents for will not exceed $1,000,000 unless otherwise directed by the City. 6. On site survey work and geotechnical analysis, if needed, is beyond the project scope. 7. Material testing and project staking are the responsibility of others. 8. One (1) plan set will be proved that encompasses construction drawings for all three parks. 9. The construction sequence for each park will occur as one project. 10. Construction sequence is assumed to be 14 weeks. CONSULTANT SCOPE OF SERVICES 1.0 PROJECT INITIATION A. Two (2) meetings with city staff to discuss the project: • Intent and development program • Intended schedule • Other agency coordination • Previous studies or related projects • Available budget • Identify neighborhoods to be served B. Establish base mapping from City's existing 1- inch:100 -foot mapping. Field verify existing conditions with on -site visit. C. Review and examine the following characteristics: • Vegetation • Steep slopes • Access City of Otsego Page 5 • Wetland edge • Property lines /Ownership • Planned abutting land use • Existing /Proposed trails • Other infrastructure 2.0 SITE DEVELOPMENT CONCEPT A. Prepare up to two (2) alternative site plans for each of three park sites that graphically portray park layout and related improvement. Identify: • Pedestrian access • Vehicle access and parking • Trail layout • Hard surface play areas • Play apparatus • Support facilities • Special design features • Landscaping B. Prepare final schematic plan that identifies park design, improvements and any project phrasing. Input from the community, the affected agencies and the Park and Recreation Commission should be reflected in the final plan. A preliminary estimate of construction cost will be provided. C. The Consultant will attend three (3) meetings with the City to approve concepts. 3.0 CONSTRUCTION DOCUMENTS The consultant will prepare construction drawings, specifications and estimated construction cost for portions of the approved plans. Drawings and specifications will be completed in a reproducible format suitable for contractor bids and construction. One (1) plan set will be produced that encompasses all three park improvements. Construction plans will likely include: A. Site grading and drainage plan B. Utility plans, if required C. Dimensioned site layout plans D. Landscape plans: seeding or sodding and site restoration City of Otsego Page 6 E. Detailed drawings for each element, including recreation fields, hard surface courts and parking F. Technical specifications for proposed improvements Revised cost estimates will then be completed and tabulated for the bid package. Plans, specifications and estimates will be reviewed with City staff and revisions made as necessary. The City's engineer will review the construction documents for consistency with the City policy. 4.0 PERMITS The consultant will obtain the following permits prior to construction. A. MPCA grading permit, if required B. Watershed District grading permit 5.0 BIDDING ASSISTANCE The consultant will assist the City through the construction bidding process by providing the following support: A. Provide construction documents for contractor bidding purposes B. Assist city in preparing advertisement for bids C. Respond to bidders' questions about design or specifications D. Prepare plan addendum, if necessary E. Review contractor bids and make recommendation to City Contract preparation is the City's responsibility 6.0 CONSTRUCTION OBSERVATION The consultant will provide periodic construction observation (a minimum of one visit per week) during the construction sequence, assumed to be 14 weeks. These services are intended to minimize conflicts during construction and ensure compliance with the contract documents. Construction observation services will include: A. Conduct pre - construction conference with general contractor and subcontractors B. Provide weekly periodic observation and document (15 - 20 site visits) C.
