Roll Call: Mayor Jessica Stockamp and Councilmembers: Brittany Moores, Jeff Dahl, and Ryan Dunlap, City Staff: City Administrator/Finance Director Adam Flaherty, Assistant City Administrator/Human Resources Sabrina Hille, Emergency Services Director Daryl Rausch, City Engineer Ron Wagner, City Planner Daniel Licht, City Attorney Dave Kendall, and City Clerk Audra Etzel. Absent: Councilmember Tina Goede. Attended via video conference (*). Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Open Forum: Mayor Stockamp opened the Open Forum at 7*01 PM. Marvin Valerius, 13701 70th Street NE asked to have his address corrected in the December 11cn meeting minutes. Mr. Valerius has questions regarding Item 6.1 Fire & Emergency Services Building — Phase 1 rates. City Administrator/Finance Director Flaherty noted the rates are included in the packet for different staff positions with an amount not to exceed the amount in the contract. Mr. Valerius had concerns regarding the rates proposed. Mayor Stockamp closed the Open Forum at 7:11 PM. 2. Consider Agenda Approval: CM Moores motioned to approve the agenda as written, seconded by CM Dahl. All in favor. Motion carried 4-0. 3. CM Dahl motioned to approve the consent agenda as written, seconded by CM Moores. All in favor. Motion carried 4-0. 4. Public Heari 4.1 Fee Schedule. A. Presentation of the Proposed 2024 Fee Schedule. Be Conduct Public Hearing. C. Consider Ordinance 2024-01 Amending the City Code Regarding the 2024 Fee Schedule, City Administrator/Finance Director Flaherty reviewed the staff report and presentation. Mayor Stockamp opened the Public Hearing at 718 PM. Marvin Valerius, 13701 70th Street NE asked if park dedication fees have been compared to cities to the west? City Planner Licht said the comparison provided in the packet are for reference only, park dedication fees need to be specific to Otsego and clarified these fees are for new development and not to the residents. Or. Valerius asked about franchise fees. Flaherty noted the franchise fees are not part of the fee schedule public hearing. Mr. Valerius would like the City Council to discuss franchise fees as he feels this creates a tax for the residents. Page 2 of 6 MINUTES OF THE CITY OF OTSEGO REGULAR CITY COUNCIL MEETING JANUARY 8, 2024 Mayor Stockamp closed the Public Hearing at 1:24 PM. CM Dahl asked about the rental inspection fee. City Planner Licht said there is a license fee, the building inspector inspects for compliance and if those issues are not corrected, the property owner would be charged a reinspection fee. Mayor Stockamp asked about the rental fee covering costs. City Planner Licht explained the fees for the administrative citation process covers costs. CM Moores asked about those that don't comply with the license. City Planner Licht said cost are covered by the administrative citation process. CM Dunlap asked about the special event cost going from a $500 escrow to a $500 fee. City Planner Licht said there is more coordination and work required by staff to justify the flat fee. CM Dahl asked about the liquor license for special events. City Planner Licht explained and clarified the difference between a special event and outdoor entertainment permit. CM Dunlap asked about other utility fees and franchise fees. Flaherty said the utilities are approved by a separate resolution and the franchise fees are not part of the fee schedule, rather they are specific to each franchise ordinance. CM Dahl motioned to adopt Ordinance 2024-01 amending the City Code regarding the 2024 fee schedule and approve publication in summary form, seconded by CM Moores. All in favor. Motion carried 4-0. 5. Planni 5.1 Villas of Kittredge Crossings 2"d Addition. A. Presentation by City Planner. Be Consider Resolution 2024-11 Vacating Drainage and Utility Easements. C. Consider a PUD, Preliminary Plan, and Final Plat Subject to the Findings of Fact and Decision. City Planner Licht reviewed the staff report and presentation. Paul Tabone (*)with Centra Homes agreed with the Planner's report. CM Dunlap asked why change the housing styles? Mr. Tabone said the housing market has changed in the last six months, seeing a decrease with townhomes/twin homes selling; they feel this product will respond to the market. CM Dunlap asked about the variation of color and trim. City Planner Licht said the only change is the housing style, all other requirements approved in the past apply. Mayor Stockamp said the trail connection is very important to the residents. Mr. Tabone is aware of the trail and will work with the underlying developer to move forward. Mr. Tabone said this will need to be re -platted and they will work with staff to complete this year. City Engineer Wagner said there is letter of credit security if the developer is unable to complete the trail. CM Dunlap asked if any of the homes would be designated as a model. Mr. Tabone said there will not be a designated model home. CM Dahl motioned to adopt Resolution 2024-11 vacating existing drainage and utility easements and approve a PUD Development Stage Plan, preliminary plat, and final plat for Villas at Kittredge Crossings 2nd Addition subject to the conditions as stated on the Findings of Fact and Decision as presented, seconded by CM Dunlap. All in favor. Motion carried 4-0. 6.1 Fire &Emergency Services Building —Phase 1. A. Presentation by Emergency Services Director. B. Consider Accepting Proposal and Approval of Agreement for Architectural Services. Co Consider Accepting Proposal and Approval of Agreement for Construction Management Services. Emergency Services Director Rausch reviewed the staff report. CM Dunlap asked for clarification on who provided the recommendation for Wold. Rausch said the interview panel included City Administrator/Finance Director Flaherty, Assistant City Administrator/Human Resources Hille, himself, and a representative from Kraus -Anderson. CM Dahl asked if Council will have input into the design? Rausch said yes, Council will be included and tours will be scheduled. CM Dunlap does not agree with building the station and will not be supporting a motion, he feels the current contracts are sufficient. CM Dahl asked what will happen if the contracted services decide to terminate the contracts? CM Moores said there is not a plan if the contracted services cancel, this is why the City has moved forward with the creation of the Otsego Fire & Emergency Services Department. Mayor Stockamp said the City has completed fire service studies and this is the direction the City Council has taken. CM Moores is thankful for prior City Council's preparing for an Otsego Department. CM Dunlap said the funds set aside have been spent and the fire study provided other options. CM Dunlap suggested adding performance measures in the contract. Rausch noted performance measures are not required for volunteer fire departments. CM Dunlap said the contracts should require performance standards. Flaherty noted the operations models are outside the scope being considered tonight. Page 4 of 6 MINUTES OF THE CITY OF OTSEGO REGULAR CITY COUNCIL MEETING JANUARY 8, 2024 CM Dahl said it is time to be fiscally responsible and invest into the City of Otsego and move forward with a Fire Department, CM Dahl motioned to approve the agreement between the City of Otsego and Wold Architects and Engineers to perform Phase 1 architectural and engineering consulting services for a sum not to exceed $43,880 pending approval of the final contract by the City Attorney, and motioned to approve the agreement between the City of Otsego and Kraus -Anderson for Phase 1 construction management and cost estimate consulting services for a sum not to exceed $10,000 pending approval of the final contract by the City Attorney, seconded by CM Moores. Voting in favor: Stockamp, Moores and Dahl. Voting against: Dunlap. Motion carried 3-1. 7. Annual Business: 7.1 Appoint Acting Mayor Mayor Stockamp asked for nominations for Acting Mayor. CM Dahl motioned to appoint Brittany Moores as Acting Mayor, seconded by Mayor Stockamp. All in favor. Motion carried 4-0. 7.2 City Council Appointments for 2024 Mayor Stockamp handed out a list of the appointments for 2024 as follows: Planning Commission Liaison: Mayor Stockamp; Alternate CM Dahl. Parks and Recreation Commission Liaison: CM Moores; Alternate CM Dunlap. Heritage Preservation Commission Liaison: CM Moores; Alternate CM Dunlap. Public Safety Commission Liaison: CM Goede; Alternate Mayor Stockamp. Public Works Subcommittee: CM Dahl and CM Dunlap; Alternate CM Goede. Administrative Subcommittee: Mayor Stockamp and CM Moores; Alternate CM Dahl. Otsego Creek Authority: Ton if needed. CM Dahl motioned to approve the Appointments as listed with no change from the previous year, seconded by CM Moores. All in favor. Motion carried 4-0. 8. City Council Reports and Updates: Mayor Stockamp reminded the City Council about the League of Minnesota Cities upcoming trainings. Staff Reports and Updates: 9.1 Consider Scheduling a Special City Council Meeting for Advisory Commission Interviews, City Clerk Etzel is looking to schedule a special meeting to conduct Advisory Commission interviews. Mayor Stockamp motioned to schedule a Special City Council meeting for January 30, 2024 at 5:30 PM, seconded by CM Dunlap. All in favor. Motion carried 4-0. Assistant City Administrator/Human Resources Hille said the new IT Manager started today. City Administrator/Finance Director Flaherty noted City offices will be closed next Monday for the Martin Luther King, Jr. Holiday. City Clerl< Etzel provided updates on the upcoming Presidential Nominating Primary. City Planner Licht said the next Planning Commission meeting is scheduled for February 5th. 7. Adjourn.
