RES 2024-11 Vacating Existing Drainage and Utility Easements within the Plat of Villas of Kittredge CrossingsCITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO: 2024-11 A RESOLUTION VACATING EXISTING DRAINAGE AND UTILITY EASEMENTS WITHIN THE PLAT OF VILLAS AT KITTREDGE CROSSINGS WHEREAS, the City Council approved the final plat of Villas at Kittredge Crossings on 3 November 2003; and WHEREAS, the approved plat includes dedication of drainage and utility easements over all of Lot 27, Block 1, as required by the Subdivision Ordinance; and WHEREAS, Otsego Finest Homes, LLC has submitted application for approval of a PUD Development Stage Plan, preliminary plat, final plat for Vills of Kittredge Crossings 2nd Addition; and WHEREAS, the dedication of drainage and utility easements with the proposed final plat supersede and make unnecessary the existing drainage and easements platted over Lot 27, Block 1, Villas at Kittredge Crossings; and WHEREAS, Otsego Finest Homes, LLC has requested vacation of the existing drainage and utility easements; and WHEREAS, the Otsego Planning Commission conducted a public hearing at their regular meeting on 18 December 2023 to consider the application, preceded by published and mailed notice; based upon review of the application and evidence received, the public hearing was closed and the Planning Commission recommended that the City Council approve the request based on the aforementioned findings. WHEREAS, all existing drainage and utility easements as dedicated over Lot 27, Bloc[/ 1, Villas at Kittredge Crossings serve no useful public purpose; and WHEREAS, the City Council having considered all information received related to the proposed vacation finds that vacating the existing drainage and utility easements would be in the public interest. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA THAT: 1. That all drainage and utility easements as dedicated over Lot 27, Blocl< 1, Villas at Kittredge Crossings are hereby vacated. 2. The City Council hereby determines that the vacation of said drainage and utility easement shall cause no damage to any abutting or nearby property owners and therefore no damages are awarded to any such property owners.
