Daniel Licht REPORT DATE: 30 January 2024 60-DAY DATE: 9 March 2024 RE: Otsego – Parkview Retail 4th Addition TPC FILE: 101.02 BACKGROUND Coborn Realty Company LP has submitted development plans for Outlot C, Parkview Retail, which is located at the northwest corner of Parrish Avenue (CSAH 42) and 88th Street. The proposed development consists of a 15,034 square foot building designed for two retail tenants identified as Ace Hardware and Pet Supply Plus. The preliminary plat of Parkview Retail and a Conditional Use Permit allowing for shared access to public streets was approved by the City Council on 22 July 2019. The proposed development requires consideration of vacating existing drainage and utility easements, approval of a final plat, and approval of site/building plans. A public hearing to consider the application has been noticed for the Planning Commission meeting on 5 February 2024 at 7:00PM. The 2023 Comprehensive Plan guides the subject site for commercial uses within Otsego’s primary retail, service, and office district located in the area of the TH 101 and CSAH 39 interchange. The building will provide space for two tenants identified as a hardware store and pet supply store, which will expand the range of goods and services available in the market area. The proposed land use is consistent with the Future Land Use Plan and the economic development policies of the Comprehensive Plan. Zoning. The subject site is B1, Retail Business District. Retail goods and services, such as hardware and pet supply stores, are a permitted use with the B1 District. Surrounding Uses. The subject site is at the southeast corner of Block 1, Parkview Retail with Lot 1, Block 1 already developed with the Coborn’s Marketplace grocery store and motor fuel facility to the west. To the south is Dunkin/medical dental office and southwest is the Parkview Grand apartments. East of Parrish Avenue (CSAH 42) is the Bank of Elk River, Starbucks, and Target. The proposed retail building will be compatible with the existing and planned land uses in the area. Building Height. Buildings within the B1 District are allowed by Section 11-75-8.A of the Zoning Ordinance to be up to 35 feet in height. The proposed building is a single story structure with a height of 18 feet measured to the roofline and 22 feet measured to the highest parapet. The height of the proposed building complies with the Zoning Ordinance. Building Materials. The proposed exterior finish materials for the principal building are consistent with those used for the Coborn’s Marketplace building allowing for a commonality between that building and the proposed building within the block. The building elevations include varied materials, building sections, roof elevations, and windows for an attractive and contemporary retail building design. The east and south elevations, which face to Parrish Avenue (CSAH 42) and 88th Street respectively, are solid walls but include faux windows to provide a “front” appearance. The exterior finish of the proposed building is required by Section 11-17-4.D.1 of the Zoning Ordinance to be comprised of a minimum 65 percent Grade A materials, and not more than 35 percent Grade B materials, or not more than 10 percent Grade C materials. The submitted building plans include a schedule for the exterior elevation materials that complies with the requirements of the Zoning Ordinance. Landscaping. The submitted plans include a landscape plan for the subject site that also illustrates the landscaping installed on Lot 1, Block 1 Parkview Retail. The health of the existing trees that are to be preserved will need to be field verified by City staff and replaced if needed. The proposed landscaping of the subject site is limited to the parking lot islands. The site and building plans for Outlot D approved by the City Council on 22 January 2024 includes a condition to install landscaping consistent with the landscaping installed on Lot 1, Block 1 Parkview Retail at the north and east perimeter of the outlot to screen the off-street 3 parking being constructed in lieu of a building. The landscape plan provides for more significant plantings both visually and in quantity at the northeast corner of Outlot D incorporating design elements and plantings from the center of the roundabout. The sizes and types of proposed plantings shown on the landscape plan comply with the provisions of Section 11-19-2.B.2 of the Zoning Ordinance. Irrigation is required to be installed in all yards and planting areas in accordance with Section 5- 2-3.C.2 of the City Code. Lot Requirements. Section 11-75-7.A and B of the Zoning Ordinance establishes minimum lot area and lot width requirements for lots within the B1 District of one acre and 200 feet, respectively. The proposed lot is 1.162 acres in area and is 289 feet in width abutting 88th Street. The proposed lot complies with the minimum lot requirements of the B1 District. Setbacks. Section 11-75-7.C of the Zoning Ordinance establishes minimum setback requirements applicable to the proposed lot as shown in the table below. Off-street parking areas for the subject site are to be setback 15 feet from public rights-of-way as required by Section 11-21-5.B.1 of the Zoning Ordinance. NA Access. The subject site abuts Parrish Avenue (CSAH 42) and 88th Street. The final plat is subject to review and approval of Wright County as it abuts Parrish Avenue (CSAH 42). Access to the subject site is shared with Lot 1, Block 1 via 90th Street (CSAH 39) and 88th Street. Section 11-21-6.A of the Zoning Ordinance allows shared accesses for two or more lots as a conditional use; a Conditional Use Permit for use of shared accesses for Block 1, Parkview Retail was approved by the City Council on 22 July 2019. Approval of the Conditional Use Permit for shared access to public streets included a stipulation that an ingress/egress and cross parking easement must be recorded over Lot 1, Block 1, Outlot C (subject site), and Outlot D, Parkview Retail to allow for the shared access and parking of the uses shown on the site plan. The required ingress/egress and cross parking easement must be executed and recorded with the proposed final plat. 4 Off-Street Parking. Section 11-21-8 of the Zoning Ordinance requires retail uses to provide one off-street parking stall for each 200 square feet of net floor area calculated as follows: Gross Area Net Area Required Stalls Retail Building 15,034sf. 13,530sf. 68 Grocery Store 50,528sf. 45,372sf. 228 Total 296 There are 30 off-street parking stalls provided within the area of the subject site plus 300 parking stalls within Lot 1, Block 1 Parkview Retail and Outlot D, Parkview Retail accessible with the required ingress/egress and shared parking easement. The total of 330 off-street parking stalls exceeds the number required by the Zoning Ordinance for two principal buildings. Parking stalls are designed as 9 feet by 18 feet accessed by drive aisles that are a minimum of 24 feet wide. The dimensions of the parking area complies with the provisions of Section 11- 21-7.B of the Zoning Ordinance. The parking area is surfaced with concrete and surrounded by concrete curb as required by Section 11-21-7.C and Section 11-21-7.D of the Zoning Ordinance, respectively. Construction plans for the off-street parking area are to be subject to review and approval of the City Engineer. Loading. The proposed building provides for an overhead door on the west and east elevations of the proposed building for loading purposes. The west loading door is accessed from the off- street parking area. The east loading door is accessed via an eight-foot wide concrete sidewalk. Pedestrians. There is a trail abutting Parrish Avenue (CSAH 42) along the east side of the subject site and a sidewalk abutting 88th Street along the south side of the subject site. A trail easement must be recorded over portions of the trail within the subject site as well as Lot 1, Block 1, and Outlot D, Parkview Retail, along 90th Street (CSAH 39) and Parrish Avenue (CSAH 42) that are outside of the public right-of-way. The sidewalk along the front of the building must be extended east to intersect the trail abutting Parrish Avenue (CSAH 42). A sidewalk is also to be added to the site plan from the southwest corner of the building along the parking drive aisle to provide connection to the sidewalk on 88th Street. 5 Exterior Lighting. Section 11-16-6 of the Zoning Ordinance establishes performance standards for exterior lighting. All exterior light fixtures are to have a 90 degree horizontal cut-off and not cast more than 0.4 foot-candles of light at the property lines. An exterior lighting plan including photometric measurements of light intensity and indicating the type, location, and height of all exterior light fixtures must be submitted prior to issuance of a building permit and is subject to review and approval of the Zoning Administrator. Waste Storage. The submitted plans do not show locations for exterior waste storage containers. Any outdoor storage of waste containers requires an enclosure meeting the requirements of Section 11-18-4.C of the Zoning Ordinance for screening purposes, subject to review and approval of the Zoning Administrator. Signs. The there is an existing freestanding sign at the southeast corner of the proposed lot that is an area identification sign for Block 1, Parkview Retail The submitted plans to not identify any additional proposed signs. Section 11-23-5.C of the Zoning Ordinance allows the following signs for the subject site:  Wall signs up to 15 percent of the wall area on two elevations with the area of individual signs not to exceed 100 square feet.  One freestanding sign not to exceed 20 feet in height and 100 square feet in area setback a minimum of 10 feet from property lines. A sign permit issued by the Zoning Administrator is required prior to installation of any signs upon the subject site. Stormwater. Plans for grading, erosion control, and storm water management have been submitted for proposed lot and development. All grading, drainage, and erosion control plans are subject to review and approval of the City Engineer. Utilities. The subject site is within the East Sewer District established by the 2023 Comprehensive Plan and services are available to the proposed lot. The developer has submitted a utility plan for connection of the proposed building to City sewer and water utilities, which are subject to review and approval of the City Engineer The developer will pay Utility Availability Charges for the proposed lot at the time of final plat approval in accordance with the Fee Schedule in effect. Utility Connection Charges will be collected at the time a building permit is issued for build out of the tenant spaces within the Phase 1 building based on the proposed occupancy and Fee Schedule in effect at that time. Easements. Section 10-8-12 of the Subdivision Ordinance requires establishment of drainage and utility easements at the perimeter of each lot, over public utility lines, and regional stormwater drainage facilities. Existing drainage and utility easements dedicated with the final plat of Parkview Retail are to be vacated. The proposed final plat illustrates proposed 6 perimeter easements and those required for stormwater and utility purposes. All drainage and utility easements are subject to review and approval of the City Engineer. Park Dedication. Section 10-8-15 of the Subdivision Ordinance establishes park dedication requirements for new subdivisions. The Park System Master Plan does not identify acquisition of land for parks within the area of Parkview Retail. Park dedication requirements are to be satisfied as a cash fee in lieu of land dedication based on the area of the subject site in accordance with the current fee schedule. Development Contact. A Development Contract is required with final plat approval by Section 10-10-4.A of the Subdivision Ordinance to provide for completion of public improvements, establishment of required securities, and payment of applicable fees related to the subdivision of the subject site. Section 11-9-7 of the Zoning Ordinance also requires that the developer enter into a performance agreement with the City to provide for construction of the project improvements within the subject site. The City Attorney will draft the required Development Contract and it is subject to approval of the City Council. RECOMMENDATION The submitted plans for development of Parkview Retail 4th Addition are consistent with the policies of the Comprehensive Plan and comply with the requirements of the Zoning Ordinance and Subdivision Ordinance. Our office recommends approval of the applications as outlined below under possible actions for the Planning Commission to consider. POSSIBLE ACTIONS A. Motion to recommend vacation of existing drainage and utility easements within Outlot C, Parkview Retail; approval of the Parkview Retail 4th Addition final plat; and approval of Site and Building Plans for Lot 1, Block 1, Parkview Retail 4th Addition, subject to the following conditions: 1. The site and building shall be developed in accordance with the plans on file with the City as provided for by Section 11-9-4 of the Zoning Ordinance. 2. Landscaping: a. All Existing plantings within the subject site; Lot 1, Block 1 Parkview Retail; and Outlot D, Parkview Retail abutting 90th Street (CSAH 39), Parrish Avenue (CSAH 42), and 88th Street to be preserved shall be in good health and condition or be replaced with similar species, as determined by the Zoning Administrator. b. Irrigation shall be installed in all yards and planting areas in accordance with Section 5-2-3.C.2 of the City Code. 7 3. The final plat shall be subject to review and approval of the Wright County Highway Engineer. 4. An ingress/egress and cross parking easement shall be recorded over Lot 1, Block 2, and Outlot D, Parkview Retail and Lot 1, Block 1 Parkview Retail 4th Addition, subject to review and approval of the Zoning Administrator. 5. The construction specifications for the off-street parking area shall be subject to review and approval of the City Engineer. 6. A trail easement shall be dedicated for that portion of the trails along 90th Street (CSAH 39) and Parrish Avenue (CSAH 42) encroaching upon Lot 1, Block 1, Parkview Retail; Outlot D, Parkview Retail; and Lot 1, Block 1, Parkview Retail 4th Addition. 7. An exterior lighting plan including photometric measurements of light intensity and indicating the type, location, and height of all exterior light fixtures shall be submitted prior to issuance of a building permit and is subject to review and approval of the Zoning Administrator. 8. Any outdoor storage of waste containers shall require an enclosure meeting the requirements of Section 11-18-4.C of the Zoning Ordinance, subject to review and approval of the Zoning Administrator. 9. All signs shall comply with the provisions of Chapter 37 of the Zoning Ordinance, including issuance of a sign permit approved by the Zoning Administrator prior to installation. 10. All grading, drainage, and erosion control plans shall be subject to review and approval of the City Engineer. 11. All utility plans shall be subject to review and approval of the City Engineer. 12. The developer shall pay Utility Availability Charges for Lot 1, Block 1 in accordance with the City Code and current fee schedule in effect at the time of final plat approval. 13. All drainage and utility easements shall be subject to review and approval of the City Engineer. 14. The developer shall satisfy park dedication requirements as a cash fee in lieu of land paid at the time of final plat approval in accordance with the City fee schedule then in effect. 8 15. The developer shall execute a Development Contract as required by Section 10- 10-4.A of the Subdivision Ordinance and Section 11-9-7 of the Zoning Ordinance, subject to review by the City Attorney and approval of the City Council.
