Daniel Licht DATE: 15 February 2024 60 DAY DATE: 19 March 2024 RE: Otsego – Everbrook Academy TPC FILE: 101.02 BACKGROUND Oppidan Holdings, LLC has submitted plans for Outlot A, Shoppes at Great River Centre Second Addition, which is located south of 87th Street and West of Parson Avenue. The development consists of a proposed Everbrook Academy day care facility with opportunity for a future second use. The proposed development requires consideration of a preliminary plat, final plat and vacation of drainage and utility easements for subdivision of the outlot and approval of a PUD Development Stage Plan for the day care subject to performance standards established by Chapter 30 of the Zoning Ordinance. A public hearing to consider the application has been noticed for the Planning Commission meeting on TUESDAY, 20 February 2024 at 7:00PM. The subject site is zoned PUD, Planned Unit Development District. The PUD District established a Village Commercial District for the purpose of developing smaller scale, retail, service, and office businesses oriented to the Parson Avenue corridor between 85th Street and 87th Street. The initial PUD District was established on 13 March 2006 and amened on 23 March 2023 to allow those permitted, conditional, and interim uses as provided for in the B1, Retail Business District. Day care uses are allowed as a conditional use within the B1 District subject to the performance standards established by Chapter 30 of the Zoning Ordinance. The proposed use is consistent with the PUD District. Future Phase. The proposed day care facility is located on the southern portion of the subject site. There is opportunity to develop a second use within the north portion of the subject site. Section 11-16-3 of the Zoning Ordinance allows development of more than one principal building upon a lot within PUD Districts, which would require approval of a PUD Development Stage Plan. Lot 1, Block 1 could also be subdivided to allow for development of a second future use subject to approval of a preliminary plat, final plat, and PUD Development Stage Plan Subdivision. The developer has submitted a preliminary and final plat to establish Outlot A, Shoppes of Great River Center Second Addition as one lot and block. The following paragraphs address the proposed platting of the property.  Lot Requirements. There are no minimum lot area or width requirements for subdivision of lots within the PUD District. Lot 1, Block 1 is proposed to be 2.3 acres in acres in area and is 264 feet in width as measured at the front setback line parallel to 87th Street. The necessary area and width of a specific lot is to be based on the lot standards of the B1 District, which requires a minimum area of one acre in area and minimum width of 200 feet. The proposed lot complies with the minimum lot requirements of the PUD District.  Right-of-Way. The subject site abuts 87th Street and Parson Avenue. Right-of-way for these streets (and abutting sidewalks) was previously dedicated. No additional right-of- way dedication is required for the proposed final plat. 3  Sidewalks/Trails. There is an existing sidewalk along the north line of the subject site abutting 87th Street. The submitted plans indicate construction of a five-foot wide concrete sidewalk along the east side of the subject site abutting Parson Avenue. The plans must be revised to extend the sidewalk south to intersect the public trail constructed with the Great River Centre of Otsego Seventh Addition (Due North). All sidewalk plans are subject to review and approval of the City Engineer.  Utilities. The subject site is within the East Sewer District established by the 2023 Comprehensive Plan and services are available to the proposed lot. The developer has submitted a utility plan for connection of the proposed building to City sewer and water utilities, which are subject to review and approval of the City Engineer The developer will pay Utility Availability Charges for the proposed lot at the time of final plat approval in accordance with the Fee Schedule in effect. Utility Connection Charges will be collected at the time a building permit is issued for build out of proposed day care building based on the proposed occupancy and Fee Schedule in effect at that time.  Easements. Section 10-8-12 of the Subdivision Ordinance requires establishment of drainage and utility easements at the perimeter of each lot, over public utility lines, and regional stormwater drainage facilities. Existing drainage and utility easements dedicated over the outlot with the final plat of the Shoppes at Great River Centre Second Addition are to be vacated. The proposed final plat illustrates proposed perimeter easements and those required for stormwater and utility purposes. All drainage and utility easements are subject to review and approval of the City Engineer.  Park Dedication. Section 10-8-15 of the Subdivision Ordinance establishes park dedication requirements for new subdivisions. Park dedication requirements for the Great River Centre of Otsego plat, which includes the Shoppes of Great River Centre Second Addition plat, were satisfied by the initial subdivision approval. No additional park dedication requirements need to be met for platting of the subject site. PUD Development Stage Plan. Lot 1, Block 1 is proposed to be developed with a day care facility. The following paragraphs address the PUD Development Stage Plan for Lot 1, Block 1.  Building Finish. The submitted plans include elevations for the proposed building that includes a schedule of proposed materials for exterior finishes that complies with Section 11-17-4.D.1 of the Zoning Ordinance. The exterior finish of brick, glass, CMU, and stucco creates a substantial looking building. To enhance the building appearance consistent with the PUD Design Guidelines and consistent with other buildings in the area, the developer will incorporate a row of CMU at the base of the east elevation and utilize standing seam metal roof sections to be shown on revised building elevations. 4  Building Height. Principal buildings on the subject are allowed to be up to three stories or 40 feet in height as regulated by the PUD District Design Guidelines that were established as part of the PUD District to maintain view sheds of Target. The proposed building is a single-story structure that complies with the PUD District.  Setbacks. The table below shows the setbacks required within the PUD District. The site plan complies with applicable setback requirements. Note that there is no parking setback from the west lot line based on the shared accesses. The subject site has accesses to 87th Street and Parson Avenue shared with Lot 1, Block 1 Shoppes at Great River Centre (Wings Financial) and Lot 1, Block 1 Shoppes at Great River Centre 2nd Addition (Tires Plus) to 87th Street. The developer is not proposing to modify the access or drive aisle to 87th Street. The east-west drive aisle and access to 87th Street will be modified to install curb along the south side of the existing drive aisle as part of the parking improvements for the day care facility. The north side of the drive aisle would be improved when the future phase is developed.  Off-Street Parking. Section 11-21-8 of the Zoning Ordinance requires daycare uses provide one off-street parking stall for each 4 persons of licensed capacity. The developer states that the licensed capacity of the proposed use is to be 156 children. The proposed licensed capacity of the day care use requires 39 off-street parking stalls. The site plan provides for 29 off-street parking stalls north and west of the day care building with its front entrance at the northwest corner. There are 12 on-street parking stalls, which are limited to two-hour parking, on the west side of Parson Avenue that would be available to the day care use. The site plan also illustrates potential for 2 proof-of-parking stalls that could be constructed through a proof of parking agreement on the north side of the east-west drive aisle prior to a future phase of development on the north portion of the subject site. The supply of parking will be adequate for the proposed use and subject to further review with development of the north portion of the subject site. Angled 60-degree stalls are designed as nine feet width by 21 feet deep and 90-degree stalls are shown on the site plan as nine feet wide by 18 feet in depth. There are concrete bollards at the front of the stalls to protect the sidewalk. Measuring from the curb at the front of the 60-degree stalls to the curb line at the rear of the stalls, the required 20 foot depth is provided. The 60-degree stalls are accessed by an 18 foot wide drive aisle and the 90 degree stalls are accessed by a 28 foot wide drive aisle shared with Tires Plus. The dimensions of the off-street parking area complies with Section 11-21-7.B of the Zoning Ordinance. 5 The off-street parking area is shown to be surfaced with asphalt and surrounded by perimeter concrete curb as required by Section 11-21-7.C and D of the Zoning Ordinance. The design and construction specifications for the off-street parking area are to be subject to review and approval of the City Engineer.  Landscaping. A landscape plan has been submitted that provides plantings in the perimeter yards and the building foundation. We recommend adding one additional shade tree to the north end of the line along Parson Avenue and to consider substituting low maintenance grasses and shrubs for the sod in the curb island north of the building. The sizes of proposed plantings comply with the provisions of Section 11-19-2.B of the Zoning Ordinance, except that the evergreen trees must be changed to eight feet in height. Section 5-2-3.C.2 of the City Code requires installation of in-ground irrigation for the yards and planting areas within the property and Parson Avenue boulevard, which is indicated on the landscape plan.  Fence. The outdoor play areas are surrounded by fencing shown site plan. At the northeast corner of the building is a seven-foot white vinyl privacy fence (shown on building elevation). The remainder of the outdoor play area to the east and south of the building is enclosed by a six foot vinyl coated chain link fence and a 4 foot vinyl coated chain link fence as an interior divider between outdoor play areas. The City has required the two other approved day care facilities within this area to utilize ornamental metal rod fencing for the outdoor play areas, which is appropriate for this location as well given visibility from Parson Avenue. The Planning Commission should also review the color of the proposed privacy fence as white is more typical of a residential installation. The fencing as shown on the site plan will require a fence permit subject to review and approval of the Zoning Administrator.  Signs. The submitted plans illustrate wall signs on the north and east elevations at the entry section of the building. The signs will be visible to some extent from 87th Street, Parson Avenue, and Parrish Avenue (CSAH 42) identifying the building location as well as the entry. The individual wall signs are allowed to be up to 100 square feet in area. The PUD District design guidelines allows the subject site one 64 square foot free standing monument sign that is anticipated to be located at the 87th Street Parson Avenue intersection that would be required to be shared with a potential future use on the north portion of the subject site. 6 The site plan illustrates a free standing sign located at the 87th Street right-in/right-out access at the northwest corner of the subject site. City staff does not see an issue with the proposed sign location. The proposed free standing sign is setback 10 feet from the public right-of-way as required by Section 11-37-3.B of the Zoning Ordinance. No plans for the height or area of the proposed free standing sign have been provided, although it is indicated on the site plan to be a monument design. A sign permit subject to review and approval of the Zoning Administrator is required prior to placement of any signs upon the property.  Exterior Lighting. An exterior lighting plan including photometric measurements of light intensity and indicating the type, location, and height of all exterior light fixtures has been submitted and complies with Section 11-16-6 of the Zoning Ordinance.  Waste Storage. The submitted plans show a location for waste storage containers within an enclosure at the southwest corner of the proposed building. Plans for construction of the enclosure are to be submitted with application for a building permit for review by the Zoning Administrator for compliance with requirements of Section 11- 18-4.C of the Zoning Ordinance.  Grading. The developer has submitted plans for grading, drainage, and erosion control for development the subject site. All stormwater management issues are subject to review and approval of the City Engineer. Development Contact. Section 10-10-4.A of the Subdivision Ordinance requires execution of a Development Contract with final plat approval by to provide for completion of public improvements, establishment of required securities, and payment of applicable fees related to the subdivision of the subject site. Section 11-9-7 of the Zoning Ordinance further requires that the developer enter into a Site Improvement Performance Agreement with the City to provide for construction of the project improvements within the subject site. The City Attorney will draft the Development Contract addressing both the subdivision and site improvements for approval by the City Council. Criteria. The Planning Commission’s consideration of the PUD Development Stage Plan for Lot 1, Block 1 is to be based upon, but not limited to, the criteria established by Section 11-3-2.F of the Zoning Ordinance: 1. The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Comment: The subject site is within the City’s primary retail, service, and office development center surrounding the TH 101 and CSAH 39 interchange, which the 2023 Comprehensive plan. The proposed business expands daycare options within Otsego and is consistent with the land uses guided by the Future Land Use Plan. 7 2. The proposed use's compatibility with present and future land uses of the area. Comment: The table below summarizes existing and planned land uses surrounding the subject site. The proposed day care is appropriately located within the Village Centre portion of the Great River Centre of Otsego development, which includes smaller scale service businesses as outlined below. The proposed use will be compatible with the surrounding area. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. Comment: The proposed use will comply with all requirements of the Zoning Ordinance, Subdivision Ordinance, and Engineering Manual. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. Comment: The Great River Centre of Otsego development is accessed via Parrish Avenue (CSAH 42), which is designated as minor arterial roadways with capacity to accommodate local and regional traffic. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Comment: The subject site is within the East Sewer District established by the Comprehensive Plan where the City has planned for delivery of services for urban development. The proposed use will not overburden the City’s capacity. RECOMMENDATION The proposed Shoppes at Great River Centre Third Addition plat and development of Everbrook Academy are consistent with the policies of the Comprehensive Plan and complies with the requirements of the Zoning Ordinance and Subdivision Ordinance. Our office recommends approval of the applications as outlined below. 8 POSSIBLE ACTIONS A. Motion to recommend approval of vacation of drainage and utility easements; a preliminary plat for Shoppes at Great River Centre Third Addition; and a PUD Development Stage Plan for Lot 1, Block 1, Shoppes at Great River Centre Third Addition, subject to the following conditions: 1. Approval of the preliminary plat shall not guarantee access to sanitary sewer service. The City shall only allocate sanitary sewer capacity to approved final plats with signed development contracts to assure the City of timely development. 2. The submitted plans shall be revised to extend a 5-foot wide concrete sidewalk adjacent to Parson Avenue south to intersect the public trail constructed with the Great River Centre of Otsego Seventh Addition (Due North), subject to review and approval of the City Engineer. 3. All utility plans shall be subject to review and approval of the City Engineer. 4. The developer shall will pay Utility Availability Charges at the time of final plat approval in accordance with the Fee Schedule in effect. 5. All drainage and utility easements shall be subject to review and approval of the City Engineer. 6. The site and building plan approval and the stipulations, limitations, and conditions therein shall be applied to the property in question. All written and graphic materials officially submitted to the City shall be treated as a formal agreement between the applicant and the City. Once approved, no changes, modifications or alterations shall be made to any plan detail, standard, or specifications without prior submission of a plan modification request to the Zoning Administrator for review and approval. 7. The construction specifications for the off-street parking area shall be subject to review and approval of the City Engineer. 8. Landscaping: a. The landscape plan shall be revised to: (1) Add one shade tree to the north end of the line along Parson Avenue (2) Substitute low maintenance grasses and shrubs for the sod in the curb island north of the building. 9 b. In-ground irrigation shall be installed in all yards, planting areas, and Parson Avenue boulevard as required by Section 5-2-3.C.2 of the City Code. 9. Proposed chain link fence shall be replaced with metal rod and comply with Section 11-19-4.H of the Zoning Ordinance. 10. The color of the proposed privacy fencing shall be subject to review and approval of the Planning Commission. 11. All signs shall comply with the PUD District Design Guidelines and Chapter 37 of the Zoning Ordinance and require issuance of a sign permit approved by the Zoning Administrator. 12. The enclosure for exterior storage of waste containers shall comply with Section 11-18-4.C of the Zoning Ordinance, subject to review and approval of the Zoning Administrator. 13. All stormwater management, grading, drainage, and erosion control plans shall be subject to review and approval of the City Engineer. 14. The property owner shall execute a Development Contract as drafted by the City Attorney, subject to approval of the City Council. B. This lot is part of the larger shopping area which includes Target. The property is currently vacant, and the uses were intended to be retail, restaurant and other commercial and office uses. The current proposal for this property is to develop it into an Everbrook Daycare building of 11,700 s.f. and the adjoining playground area. The site plan will include 29 parking stalls on-site, south of the shared driveway. We have identified potential additional stalls on the north side of the driveway if required. Utility services are currently available with stubs on the site for water and sanitary sewer. In addition, the pond on the south was designed to accommodate development of this area. We have provided the stormwater drainage information with this submittal. The building design includes the use of materials to meet the standards of the City. This includes a mix brick, stone and glass to meet the Class 1 Material requirements and stucco and cement board panels for the balance of the building. The roof is a pitched roof with asphalt shingles. The trash area for each building is included to the southwest, adjacent to the parking areas. The enclosure will be masonry materials, in compatible colors, and will have gates for access. Signage will include building signs for the user. Additionally, we have indicated a potential location for a monument sign along 87th Street. We understand that all signs will require separate submittals for review, approval and permitting to construct. This application includes the platting of the property from an Outlot (its current designation) to Lot-Block. In doing this, we are also requesting a vacation of the current platted Drainage & Utility Easements, which are replaced by new Drainage & Utility Easement on the Final Plat. Lastly, we will be modifying the existing Roadway Easement within this development. The main reason is that the access road that exists today was not built within the easement that was recorded. It is slightly north of the easement area recorded. Secondarily, there is a shared stormwater line that is on the leg of the driveway easement that runs North/South from 87th Street that is right at the eastern edge of the easement. We are expanding that by 7 feet to provide some area to work in, within the easement, should that be required in the future.
