Daniel Licht, AICP REPORT DATE: 28 February 2024 ACTION DATE: 7 May 2024 RE: Otsego – Kurtti Property; Zoning Map/Preliminary Plat/PUD-CUP TPC FILE: 101.02 BACKGROUND Tamarack Land Development has submitted plans for development of 185 single family lots from 77.62 acres located north of 70th Street (CSAH 38) between Labeaux Avenue (CSAH 19) and MacIver Avenue. The proposed development requires applications for a Zoning Map amendment, Planned Unit Development-Conditional Use Permit, and preliminary plat. The application also includes vacation of public right-of-way and drainage and utilities to replat the Meyer Addition as part of the proposed development. A public hearing to consider the applications has been noticed for the Planning Commission meeting on 6 March 2024. Exhibits: Site location map Preliminary Plans dated 02/26/2024 (30 sheets) ANALYSIS Existing Conditions. The 77.62 acre subject site consists of a 59.85 acre parcel that includes a former farmstead and cultivated fields. The remaining 17.77 acres of the subject site is comprised of 16 rural single family lots and public right-of-way platted on 19 November 1970 as the Meyer Addition. There is one single family home built in 1994 on Lot 1, Block 1 with the other lots being undeveloped and cultivated with the abutting 55.85 acres. The existing buildings on the property will be demolished and the lots, easements, and right-of-way platted with the Meyer Addition are to be vacated. Item 4.2 2 The images below show the subject site and surrounding area in 2005 (left) and 2023 (right). In 2005, the West Wastewater Treatment Facility was just completed and the plats of Arbor Cree, Martin Farms, SunRay Farms, and Dueer Creek were just being developed. Zoning. The 59.85 acre parcel is zoned A-1, Agriculture Rural Service District and the lots of the Meyer Addition are zoned R-3, Residential Long Range Urban Service Area. Portions of the preliminary plat also are within the Shoreland Overlay District of a Natural Environment lake located south of 70th Street (CSAH 38), the boundaries of which is shown on the submitted plans. The developer requesting a Zoning Map amendment to rezone the preliminary plat to R- 5, Residential Single and Two Family District. The preliminary plat application also includes a request for a PUD-CUP related to lot requirements. Consideration of the Zoning Map amendment and PUD-CUP are to be based upon, but not limited to, the criteria established by Section 11-3-2.F and Section 11-4-2.F of the Zoning Ordinance, respectively: 1. The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Comment: The Future Land Use Plan of the 2023 Comprehensive Plan guides the subject site for low density residential uses, which is as single family development with a net density of 3.0 dwelling units per acre or less. The subject site has a net area of 69.3. The resulting net density of the proposed preliminary plat with 185 single family lots is 2.67 dwelling units per acre. The proposed preliminary plat is consistent with the policies of the 2023 Comprehensive Plan. 3 2. The proposed use's compatibility with present and future land uses of the area. Comment: The subject site is in infill development surrounded by existing urban subdivisions summarized in the table below. The subject site is likely to have developed prior to now but for limitations on sewer capacity in 2006 and 2018 as well as the effects of the Great Recession. The proposed single family subdivision will be compatible with the surrounding area. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. Comment: The proposed preliminary plat will comply with the provisions of the Zoning Ordinance, Subdivision Ordinance, and Engineering Manual. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. Comment: The subject site is accessed via 70th Street (CSAH 38), which is designated by the Wright County Long Range Transportation Plan as a Major Collector road and by the City’s Transportation Plan as a Minor Arterial street. This roadway has been improved to urban standards and has adequate capacity to accommodate traffic generated by the proposed subdivision. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Comment: The proposed preliminary plat is within the West Sewer District and the City has in-place utilities and services planned for as part of the Comprehensive Plan such that the proposed subdivision will not overburden the City’s service capacity. Access. The subject site is accessed from 70th Street (CSAH 38) via an existing private driveway and Lannon Avenue accessing the lots within the Meyer Addition. The private driveway is to be removed as is existing Lannon Avenue as part of the subdivision of the subject site. Access to the proposed subdivision will be provided via Large Avenue at the west line of the preliminary plat abutting the Duerr Creek plat and a new local street at approximately the same location as existing Lannon Avenue. 4 The existing right-of-way dedicated for Lannon Avenue with the Meyer Addition is to be vacated and new right-of-way dedicated for Street 1 with the final plat for the proposed development. The preliminary plat also provides for dedication of right-of-way for the north half of 70th Street (CSAH 38). Right-of-way dedication and access to 70th Street (CSAH 38), including requirements to construct turn lanes at intersections, is subject to review and approval of Wright County. Street connections between the proposed plat and Sunray Farms is provided at 73rd Street and 74th Streets and to Martin Farms at 71st Street and 73 Street. There are also street connections available to the subject site from Arbor Creek via Lannon Avenue and from Martin Farms via 74th Street at the northeast corner of the subject site. The preliminary plat does not propose connections to Arbor Creek via Lannon Avenue and to Martin Farms via 74th Street to avoid wetland impacts. The existing terminus of Lannon Avenue within Arbor Creek and 74th Street within Martin Farms are temporary cul-de-sacs that are to be removed with development of the subject site. The developer is required by Section 10-8-2.C and Section 10-8-5.C of the Subdivision Ordinance to remove the temporary cul-de-sacs, restore the boulevard and adjacent yards, and extend the streets with construction of permanent cul-de-sacs within the subject site. Streets. The street layout for the preliminary plat is logically related to the topography and surrounding subdivisions so as to result in usable lots and reasonable grades and to discourage through traffic. Streets within the preliminary plat are planned to be public designed with 60 foot rights-of-way as required by Section 10-8-5.B.1 of the Subdivision Ordinance. Section 10-8- 5.B.4 of the Zoning Ordinance requires a minimum 200 foot off-set for street intersections, measured centerline to centerline, which the preliminary plat complies with. There are two cul-de-sac streets within the preliminary plat (in addition to the permanent cul- de-sacs required at Lannon Avenue and 74th Street discussed above. Section 11-8-5.C.1 of the Subdivision Ordinance establishes criteria that cul-de-sac streets are only to be allowed where necessitated by existing natural conditions. The alignment of 74th Street is influenced by the wetlands within Outlot A together with the location of 74th Street at the west plat line result in insufficient length on Lannon Avenue between 74rd Street and 73rd to allow 74th Street to be extended as a through street. The cul-de-sac labelled as Lannon Court is warranted by the wetland within Outlot B to the north and the existing platted lots in Martin Farms to the east. The proposed cul-de-sac streets also comply with the design standards of Section 11-8-5.C.2 of the Subdivision Ordinance for the minimum/maximum depth and required turnaround dimensions. 5 Section 8-8-4 of the City Code specifies installation of street lighting for new subdivisions at the corners of intersecting streets, midblock locations for blocks longer than 900 feet, and the terminus ends of cul-de-sac streets. The developer is to provide plan sheet with application for final plat showing proposed street lighting and street signs for the preliminary plat. The number and location of proposed street lights and street signs is to be subject to review and approval of the City Engineer. All street design and construction plans, lighting, and signs are subject to review and approval of the City Engineer. Street names are to be assigned in accordance with the Wright County grid system and Section 10-8-5.B.13 of the Subdivision Ordinance, subject to review and approval of City staff. Sidewalks/Trails. There is an existing trail on the north side of 70th Street between Labeaux Avenue (CSAH 19) to MacIver Avenue abutting the subject site. The is also to be a five foot wide concrete sidewalk on one side all public streets (not including cul-de-sacs) as required by Section 10-5-8.D of the Subdivision Ordinance. The sidewalk on the west side of Lannon Avenue should be shifted to the east side of the right- of-way. Locating the sidewalk on the east side of the street will minimize street crossings. This location will also avoid maintenance issues for the section of the sidewalk shown on the preliminary plat abutting Outlot D, which would need to be maintained by the City. A trail is proposed on the east side of Large Avenue between 70th Street (CSAH 38) and 71st Street. The trail along Large Avenue provides connectivity to the trail on 70th Street (CSAH 38). Because Large Avenue is a local street and there is a sidewalk on the west side of the roadway consistent with Subdivision Ordinance standards, the developer will receive a credit from park dedication fees for the cost of this trail segment. The preliminary plat illustrates construction of trails through Outlot A providing pedestrian connection between the subject site and Arbor Creek and Martin Farms. This connection is important, especially to from Martin Farms to allow for access to Beaudry Meadows Park. The trail segment between 74th Street and Lannon Avenue includes a boardwalk section to avoid impacting wetlands. This trail segment is to be routed to the west side of the Lannon Avenue cul-de-sac to provide connectivity with a trail section added along the north side of the 74th Street cul-de-sac to connect to the existing sidewalk. The mid-block access between Blocks 1 and 2 and between Block 2 and Block 4, Marin Farms 4th Addition are to proposed to be 20 feet in width and are subject to review and approval of the City Engineer to ensure adequate area for maintenance and replacement of the trails in the future. The cost of construction for off- street trails, including the boardwalk, are credited towards park dedication fees. All sidewalk and trail design and construction plans are subject to review and approval of the City Engineer. 6 Blocks. Section 10-8-3.A of the Subdivision Ordinance establishes that blocks within a subdivision are to be a minimum of 300 feet and not more than 1,200 feet in length. The blocks within the preliminary plat except Block 4, which is due to the existing pattern of development for Martin Farms 4th Addition. Lot Requirements. Section 11-66-6.A.1 of the Zoning Ordinance requires single family lots within the R5 District to be a minimum of 9,000 square feet in area. Not all of the lots comply with the minimum area requirements of the R-5 District with the smallest being 7,580 square feet. The mean area of the proposed lots is 10,623 square feet and the median lot area is 9,790 square feet. The 2023 Comprehensive Plan Update allows through approval of a Conditional Use Permit flexibility from the lot area and width requirements provided that both the mean and median areas exceed the minimum requirements of the specific zoning district. The proposed lot areas are consistent with the provisions of the Comprehensive Plan to encourage a range of lot types within individual subdivisions and the overall supply of lots in the City. Section 11-66-6.A.2 and 3 of the Zoning Ordinance requires lots within the R-5 District to be a minimum of 60 feet for interior lots and 90 feet for corner lots. All of the interior lots are at least 60 feet in width and the lots within Blocks 1, 6, and 10 at the west edge of the preliminary plat having a minimum width of 75 feet. Lots 11-14, Block 4 and Lots 26-30, Block 5 fronting cul-de-sac turnarounds are also a minimum of 75 feet in width as required by Section 10-8- 5.C.1.c of the Subdivision Ordinance. The corner lots are designed with a 78 foot width and not the 90 feet required by the Zoning Ordinance. The City previously amended the Zoning Ordinance to reduce the required setback of the side yard for a corner lot within the R5 District from 35 feet to 25 feet but did not make a corresponding amendment to the minimum lot width requirement. Based on the required side yard setbacks of seven feet from interior lot lines and 25 feet from the side lot line abutting a public right-of-way, the same 46 foot wide building pad is achieved with a minimum lot width of 78 feet. Flexibility with as a conditional use to allow a lot width less than 90 feet for corner lots is acceptable as all corner lots have a minimum width of 78 feet. The preliminary plat complies with the lot requirements of the R5 District. Shoreland Density. There are areas of the preliminary plat within the Shoreland Overlay District of a Natural Environment lake, which are subject to lot requirements established by Section 11-92-8 of the Zoning Ordinance. The developer is requesting approval of a Conditional Use Permit to allow for the application of the R-5 District lot requirements to the subject site as allowed by Section 11-92-17 of the Zoning Ordinance. Flexibility from the lot area requirements of the Shoreland Overlay District through a Conditional Use Permit requires a Site Suitable Area Analysis as outlined by Section 11-92-17.D of the Zoning Ordinance, which is shown on Sheet 3 of the submitted plans. 7 The analysis calculates the maximum allowed density for the net area (less the waterbody and wetlands) of the preliminary plat within the Shoreland Overlay District, which overlays land within 1,000 feet of the Ordinary High Water Level (OHWL) of the Natural Environment lake in 320 foot wide tiers radiating away from the OHWL of the waterbody. The preliminary plat may be allowed up to 94 single family lots within the Shoreland Overlay District in accordance with the Site Suitable Area Analysis. The proposed preliminary plat complies with the density limitations of the Shoreland Overlay District. Setbacks. The table below specifies the principal building setback requirements of the R-5 District as provided for in Section 11-66-6.C of the Zoning Ordinance, the wetland setback established by Section 11-16-5.F.4.b of the Zoning Ordinance. All of the setbacks as shown on the preliminary plat comply with the provisions of the Zoning Ordinance. 70th Street Local Street Interior Side Interior Rear Wetland Buffer 65ft. 25ft. house 30ft. garage 7ft. 20ft. 20ft. Landscaping. The developer has submitted a landscape plan for the proposed preliminary plat. Section 11-19-2.B.2 of the Zoning Ordinance requires that two shade trees be provided per lot (one of which must be in the front yard) at the time of house construction. The landscape plan is to be revised to indicate trees required in the front yard must be planted outside of the public right-of-way. The landscape plan also illustrates trees to be planted within outlots to be deeded to the City, which are to be removed from the landscape plan. Plantings shown to meet the requirements of Section 11-19-3.B of the Zoning Ordinance for a landscape buffer yard in the yards of the lots in Block 13 abutting 70th Street (CSAH 38) are in addition to the two trees required for each lot. The types and sizes of proposed plantings are appropriate, but the size of the evergreen trees planted in Block 12 to for the required buffer yard must be increased to eight feet in height in accordance with Section 11-19-3.A.2 of the Zoning Ordinance. Grading. The developer has submitted plans for grading, drainage, and erosion control for development of the preliminary plat. The developer has also submitted a wetland delineation and wetland impact plan for the proposed preliminary plat. Wetlands to be preserved are required by Section 11-16-5.F of the Zoning Ordinance to be protected by an averaged 20 foot buffer with the wetland and wetland buffer platted within an outlot deeded to the City. The proposed wetland buffer is to be averaged with a minimum buffer width of 10 feet. All grading, drainage, wetland impacts, and erosion control issues are subject to review and approval of the City Engineer. 8 Easements. Section 10-18-12.A of the Subdivision Ordinance requires 10 foot drainage and utility easements at the perimeter of all lots (overlying side lot lines), as well as over any stormwater management facilities, wetlands, and wetland buffers not platted within the outlots to be deeded to the City. The preliminary plat provides for dedication of required easements. Existing drainage and utility easements dedicated with the plat of the Meyer Addition are to be vacated with new drainage and utility easement dedicated with the proposed development at the time of final plat approval. All drainage and utility easements are subject to review and approval of the City Engineer. Utilities. The developer has submitted plans for extension of sanitary sewer and water utilities for the preliminary plat. All utility plans are subject to review and approval of the City Engineer. Payment of utility availability charges are due at the time of final plat approval and payment of utility connection charges are due at the time a building permit is issued for each lot in accordance with Title 6, Section 1 of the City Code. Outlots. The preliminary plat includes four outlots that encompass wetlands, wetland buffers, and stormwater basins. Outlots A, B, C, and D are to be deeded to the City for stormwater management purposes. Park Dedication. The Parks System Master Plan does not identify acquisition of park land from the area of the subject site. Beaudry Meadows Park is located to the northwest of the subject site to serve this area and access to this park is provided via streets, sidewalks, and trails. Park dedication requirements are to be satisfied then as a cash fee in lieu of land dedication at the time of final plat approval. Park dedication funds are to be used by the City in acquiring land and/or developing the park system as provided for by Section 11-18-15.M of the Subdivision Ordinance. The developer will be provided credits towards park dedication fees for the 16 existing lots within the Meyer Addition being replatted with the proposed development. The developer will also be credited for the construction cost of the trails proposed within Outlot A and D. RECOMMENDATION The proposed preliminary plat for development of the Kurtti property and redevelopment of the Meyer Addition is consistent with the land uses guided by the 2023 Comprehensive Plan. The preliminary plat also complies with the Zoning Ordinance and Subdivision Ordinance. Our office recommends approval of the applications subject to the conditions below. 9 POSSIBLE ACTIONS A. Motion to recommend approval of a Zoning Map amendment rezoning the subject site to R-5 District based on a finding that the criteria established by Section 11-3-2.F of the Zoning Ordinance are satisfied and approve a Conditional Use Permit and preliminary plat subject to the following conditions: 1. Approval of the preliminary plat shall not guarantee access to sanitary sewer service. The City shall only allocate sanitary sewer capacity to approved final plats with signed development contracts to assure the City of timely development. 2. Right-of-way dedication and access to 70th Street shall be subject to review and approval of the Wright County Engineer. 3. The width of the mid-block access to Outlot A between Blocks 1 and 2 and between Block 2 and Block 4, Marin Farms 4th Addition shall be subject to review and approval of the City Engnineer. 4. All street, sidewalk, and trail design and construction plans, street lighting, and street signs shall be subject to review and approval of the City Engineer. 5. Street names shall be assigned in accordance with the Wright County grid system and Section 10-8-5.B.13 of the Subdivision Ordinance, subject to review and approval of City staff. 6. Lots within the preliminary plat shall comply with the following minimum setbacks: 70th Street Local Street Interior Side Interior Rear Wetland Buffer 65ft. 25ft. house 30ft. garage 7ft. 20ft. 20ft. 7. Landscape Plan: a. A minimum of two shade trees shall be planted within each lot (with at least one in the front yard). b. No plantings shall be installed within the public right-of-way or outlots to be deeded to the City. c. Trees planted within the rear yards of lots abutting 70th Street (CSAH 38) as a required buffer yard shall be in addition to the required two shade trees per lot. 10 8. All grading, drainage, wetland impacts, and erosion control issues shall be subject to review and approval of the City Engineer. 9. A stormwater impact fee for Otsego Creek as established by Section 8-4-1 of the City Code shall be paid the time of final plat approval in accordance with the fee schedule then in effect; the developer shall be credited for the cost of improvements to Otsego Creek. 10. All utility plans shall be subject to review and approval of the City Engineer. 11. Utility Availability Charges shall be paid at the time of final plat approval in accordance with the fee schedule then in effect. 12. All easements shall be subject to review and approval of the City Engineer. 13. Outlots A, B, C, and D shall be deeded to the City for stormwater management purposes. 14. Park dedication requirements for the preliminary plat shall be satisfied as payment of a cash fee in lieu of land as provided for by Section 11-18-15.I and M of the Subdivision Ordinance with credit for: a. Each of the existing 16 lots of the Meyer Addition. b. Construction of trails and sidewalk within Outlot A and Outlot D. 15. The preliminary plat shall be valid for one year from the date of approval in accordance with Minnesota Statutes 462.356, Subd. 3c unless extended by the City Council. B. Motion to recommend the application be denied based on a finding that the request is inconsistent with the Comprehensive Plan and does not comply with the requirements of the Zoning Ordinance and Subdivision Ordinance. C. Motion to table. c.
