AGENDA ITEM DETAILS RECOMMENDATION: City staff recommends the City Council approve a grading permit. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKGROUND/JUSTIFICATION: Darkenwald Holdings, LLC has submitted plans for grading work to be undertaken on property located at 15815 70th Street, south of the 70th Street (CSAH 38) and Quaday Avenue intersection. The grading work involves approximately 10 acres of the subject site and will include removal of material from the property in preparation for eventual development. The extent of the work is limited at this time to the corridor for future extension of Quaday Avenue south of 70th Street (CSAH 38) to the east property line. The proposed grading is not defined as gravel mining under the Zoning Ordinance. Section 11-24-1 of the Zoning Ordinance requires approval of a Grading Permit for excavations not defined as mining but also not occurring as part of an approved development plan or subdivision. Applications for Grading Permits are subject to review by the City Engineer and approval of the City Council. The City Engineer has approved the proposed grading plans. The developer will be required to enter into an administrative grading agreement with the City and provide a security of $3,000.00 per disturbed acre.
