2024.02.26 City Council MinutesOTSEGO CITY COUNCIL MEETING MONDAY, FEBRUARY 26, 2024 7:00 PM OTSEGO PRAIRIE CENTER Call to Order: Mayor Stockamp called the meeting to order at 7*00 PM, Roll Call: Mayor Jessica Stockamp and Councilmembers: Tina Goede, Jeff Dahl, and Ryan Dunlap. City Staff: City Administrator/Finance Director Adam Flaherty, Assistant City Administrator/Human Resources Sabrina Hille, Parks and Recreation Director Nick Jacobs, Street Operations Manager Kevin Lamson, Emergency Services Director Daryl Rausch, City Engineer Ron Wagner (*), City Planner Daniel Licht, City Attorney Dave Kendall, and City Clerk Audra Etzel. Absent: Councilmember Brittany Moores. Attended via video conference (*) Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Open Forum: Special Presentation — Bank of Elk River Parks and Recreation Director Jacobs said the Banl< of EII< River continues to promote health and wellness in the Otsego Community. The Bank of EII< River would again like to partner with the Parks and Recreation Department by donating $8,000 to provide free and reduced cost recreation opportunities throughout the year. This is their 11th year partnering with the Parks and Recreation Department, donating over $68,000 and hundreds of volunteer hours. LeRoy Lindenfelser, Julia Schreifels, and Alex Safe from the Banl< of EII< River thanked the City for their partnership and presented the City of Otsego with a check for $8,000. The City Council thanked the Banl< of EII< River for their contribution and commitment to the Otsego community and look forward to continuing this partnership into 2024 and beyond. Mayor Stoclamp opened the Open Forum at 7:06 PM. Senator Eric Lucero provided a legislative recap from 2023 and a preview of the 2024 session. CM Dunlap commented that residential homes over $500,000 are impacted by the higher tax capacity rate and that is impactful to taxpayers. Senator Lucero noted he was not in support of that legislation. CM Dahl invited Senator Lucero to the Local Board of Appeal and Equalization meeting on Tuesday, April 23rd. Senator Lucero noted that the legislative session will still be ongoing, and his availability is unknown at this time. Mary Valerius, 1370170th Street NE would like to comment on Item 4.1. City Planner Licht said the public hearing was held at the Planning Commission meeting and has been closed. Mr. Valerious is on the St. Albert's Cemetery Board and would like to comment regarding the road and safety. City Planner Licht noted staff is working with Wright County regarding the County Road 137 design and approval for Costco is contingent upon approval of the road. Mayor Stockamp closed the Open Forum at 7:23 PM. 2. Consider Agenda Approval: City Administrator Finance Director Flaherty noted that updated materials for Items 5.1 were distributed to the Council, noting the public hearing date changed from March 11 to March 25. CM Dunlap motioned to approve the agenda as written, seconded by CM Dahl. All in favor. Motion carried 4-0. 3. Consent Agenda. 3.1 Approve Claims List. 3.2 Approve City Council Meeting Minutes. A. February 12, 2024 Meeting. Be February 12, 2024 Special Meeting. 3.3 Adopt Resolution 2024-20 Accepting a Donation. 3.4 Parkview Retail 4th Addition. A. Adopt Resolution 2024-21 Approving a Development Contract. B. Adopt Resolution 2024-22 Aborovine Vacation of Sidewalk and Trail Easements 3.5 Approve the Purchase of a Fleet Vehicle —Water Tanker Trucl<, 3.6 Accept Quotes and Authorize the Well #5 Maintenance Project. 3.7 Adopt Resolution 2024-23 Establishing Procedures for Reimbursement Regulations. 3.8 Adopt Resolution 2024-24 Modifying Water and Sanitary Sewer Utility Rates for 2024. 3.9 Approve Pay Application #1 (Final) for the Well #10 Site Work Project. 3.10 Adopt Resolution 2024-25 Accepting Bids and Awarding Contract — 2024 Mill & Overlay Project. 3.11 Approve an Agreement for Professional Services — Well 11 & Wellhouse 3 Improvements. CM Dunlap motioned to approve the consent agenda as written, seconded by CM Goede. All in favor. Motion carried 4-0. Page 2 of 5 MINUTES OF THE CITY OF OTSEGO REGULAR CITY COUNCIL MEETING FEBRUARY 26, 2024 4. Planning: 4.1 Costco: A. Presentation by City Planner. Be Consider Ordinance 2024-03 Amending the Zoning Map. C. Consider Approval of a Preliminary Plat and Conditional Use Permit. City Planner Licht reviewed the staff report and presentation. Costco representative Stephen Cross agreed with the staff report and was present to answer questions. Also, in attendance representing Costco were Mike Stratis, Larry Dziurdzik, Adam Burghdorr, and Tom Meyer. Mayor Stoclamp said traffic was a concern and asked about the process. City Planner Licht said the traffic has been addressed as a condition of approval. The final plat approval would not be given until the conditions of the preliminary plat have been met. If the Planning Commission and City Council do not believe the traffic conditions have been met, that would be a factor in the decision of a future application. CM Dunlap asked about tabling the application. Licht said the application meets all the requirements to rezone and move forward with the preliminary plat. Licht noted a previous business looking at the same site could not accommodate all the semitruck traffic. Any concerns related to traffic can be addressed by the conditional use permit. CM Dunlap wants to make sure the development meets the comprehensive plan and City Code and Ordinances. CM Dunlap said the packet does not include any traffic information and he finds it hard to approve without this information and is concerned the traffic will impact the infrastructure, requiring more maintenance. City Planner Licht said the report in the packet does generally address the traffic to be generated and noted the Planning Commission had more details, noting Wright County did not require an updated traffic study as they will complete as part of the CR137 update. City Planner Licht said the traffic impacts are 80% coming from I-94/CR137 and the remainder off of Maciver Avenue, which is built to handle 10- ton traffic. Mayor Stockamp said this is no different than the traffic visiting at the Albertville Mall just a half a mile away. City Planner Licht said if Wright County has concerns regarding traffic, they will have the ability to require more roadways to meet the capacity. CM Dahl motioned to adopt Ordinance 2024-03 amending the Zoning Map and approve a preliminary plat and Conditional Use Permit for Costco, subject to the stipulations listed by the Findings of Fact and Decision as presented, seconded by CM Goede. Voting in favor: Stocka'mp, Dahl and Goede. Voting against: Dunlap. Motion carried 3-1. 5. Engineering: 5.1 2024 Street Reconstruction Protect: A. Presentation by City Engineer. City Engineer Wagner reviewed the staff report and presentation. The 2024 Street Reconstruction Project includes the residential developments of Vasseur's Oal< Grover 3rd and 4tn Additions and Halls 1st, 2nd, and 3rd Additions, Mayor Stockamp asked about scheduling an open house. City Engineer Wagner is working with staff to schedule the open house. Flaherty said the open house information will be included in the improvement hearing notice sent to the residents. CM Dunlap noted he has no concerns with the project but still is not in favor of the funding mechanisms and will address those concerns at a future meeting. CM Goede motioned to adopt Resolution 2024-26 Receiving Feasibility Report and Calling Hearing on Improvements, seconded by CM Dahl. All in favor. Motion carri Hed 4-0. 6. City Council Reports and Updates: A. Heritage Preservation Commission Mavor Stockamp said the HPC collection has been relocated from Prairie Center to City Hall due to space needs, and the commission will meet at City Hall starting in March. B. Parks and Recreation Commission Liaison Mayor Stockamp said HKGi is updating the Master Park Plan. Flaherty noted and the Commission will be reviewing the Ashwood Park concept before being reviewed by City Council. C. Planning Commission Liaison CM Dahl said the Commission recommended approval of both applications for Everbrook Daycare and the Wellhouse 4 expansion. D. Public Safetv Commission Liaison CM Goede said the Commission discussed the engine breaking on Queens Avenue. Also, Allina Ambulance has improved their response time, looking to increase their staff, and looking to have three ambulances in the area. 7. Staff Reports and Updates: City Administrator/Finance Director Flaherty clarified the Local Board of Appeal date is Tuesday, April 23rd at 6pm. City Clerk Etzel said voting for Presidential Nomination Primary Election is available during office hours, with extended hours this Saturday gam-3pm, and the Tuesday, March 5 at your polling precinct from 7am-8pm. City Planner Licht said there will be a Planning Commission meeting March 6th to review several applications. Daryl Rausch, Emergency Services Direct mentioned the Burnsville tragedy, and to Keep all emergency services personnel in your thoughts.
