AGENDA ITEM DETAILS RECOMMENDATION: City staff recommends the City Council adopt a resolution rejecting bids, rescinding a previously adopted resolution accepting bids and awarding contract, and to authorize a competitive bid process for the improvement of Carrick’s Landing Park. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKGROUND/JUSTIFICATION: The Carrick Landing Park Improvements project is partially funded by a DNR grant. Bids were opened on May 22, 2024, but the project specifications and contract documents did not have prevailing wages included. The DNR grant agreement is explicit that the bidding documents contain these requirements. City staff are recommending that the City Council reject the previously received bids and to rescind Resolution 2024-39 Accepting Bids and Awarding Contract. City staff also recommend the City Council re-authorize the project be rebid with the bidding documents containing prevailing wages to meet the DNR requirement. Cost Estimate: The attached cost estimate remains unchanged and has the estimated bid portion of the project costs and the direct purchase costs, which show a total of $768,376. This is within the budget of $775,000 identified in the 2024 Capital Improvement Plan. The Outdoor Recreation Grant will offset an approximate amount of $350,000 of project costs. BUDGET INFORMATION FUNDING: BUDGETED: Fund 203 – Park Development Yes 1 CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO: 2024-42 REJECTING BIDS, RESCINDING BID ACCEPTANCE AND CONTRACT AWARD AND TO AUTHORIZE A COMPETIVE BID PROCESS WHEREAS, bids were received and accepted for the Carrick Landing Park Improvements project, City Project No. 24-06; and WHEREAS, the project is required to contain and meet prevailing wages to be in compliance with a DNR grant; and WHEREAS, the City will reject all bids that were opened on May 22, 2024, and rescind Resolution 2024-39 Accepting Bids and Awarding Contract; and AND WHEREAS, the City Council will authorize the Carrick Landing Park Improvements project be rebid with the bidding and contract documents containing prevailing wage requirements. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA: 1. That all bids received and opened on May 22, 2024, for the Carrick Landing Park Improvements Project, City Project No. 24-06 are rejected. 2. That Resolution 2024-39 Accepting Bids and Awarding Contract, adopted by the City Council on May 28, 2024 is rescinded. 3. The City Clerk is hereby authorized and directed to return forthwith to all bidders the bid bond made with their bids. 4. The City Council authorizes a second competitive bid process for the Carrick Landing Park Improvements Project. 2 ADOPTED by the Otsego City Council this 10th day of June, 2024.
