The 2006 Otsego City Local Board of Review and Equalization Meeting has been tentatively set for April 20, 2006 at 6:30pm. Section 7, Chapter 5 of the Otsego City, Code shall be amended to read as follows: SECTION 7 PROPERTY MAINTENANCE Section: 5 -7 -1 Definition 5 -7 -2 Snow, Ice, Dirt, and Rubbish Removal 5 -7 -3 Weed Elimination 5 -7 -4 Public Health and Safety Hazards 5 -7 -5 Installation and Repair of Water Service Lines 5 -7 -6 Repair of Sidewalks 5 -7 -7 Street Maintenance 5 -7 -8 Tree Care 5 -7 -9 Street Lighting System 5 -7 -10 Personal Liability 5 -7 -11 Penalty 5 -7 -1: DEFINITION: The term current service as used in this ordinance means one or more of the following: snow, ice, or rubbish removal from sidewalks; weed elimination from boulevard grass plots between the back of curb of a public street and the property line or from private property; removal or elimination of public health or safety hazards from private property, excluding any hazardous building included in Minnesota Statutes, Section 463.15 to 463.26; installation or repair of water service lines; street sprinkling, street flushing, light street oiling, or other dust treatment of streets, repair of sidewalks; trimming and care of trees and removal of unsound and insect- infected trees from the public right -of -way or private property the operation of a street lighting system, the operation and maintenance of a fire protection system or pedestrian skyway system. 2 5 -7 -2: SNOW, ICE, DIRT, AND RUBBISH REMOVAL: A. All snow, ice, dirt, and rubbish remaining on a public sidewalk more than twelve (12) hours after its deposit thereon is a public nuisance. The owner and the occupant of any property adjacent to a public sidewalk shall use diligence to keep such walk safe for pedestrians. No such owner or occupant shall allow snow, ice, dirt, or rubbish to remain on the walk longer than twelve (12) hours after its deposit thereon. B. The authority designated by the City Council shall remove from all public sidewalks all snow, ice, dirt, and rubbish as soon as possible beginning twelve (12) hours after any such matter has been deposited thereon or after the snow has ceased to fall. He shall keep a record showing the cost of such removal adjacent to each separate lot and parcel and shall deliver such information to the City Clerk. 5 -7 -3: WEED ELIMINATION: A. Any weeds, whether noxious as defined by law or not, growing upon any lot or parcel of land outside the traveled portion of any street in the City to a greater height than twelve (12) inches or which have gone or are about to go to seed are a nuisance. The owner and the occupant shall abate or prevent such nuisance on such property and on land outside the traveled portion of the street abutting on such property. B. On or before June 1 of each year and at such other times as ordered by resolution of the Council, the City Clerk shall publish once in the official newspaper a notice directing owners and occupants of property within the City to destroy all weeds declared by Section 5 -7 -3.A to be a nuisance and stating that if not so destroyed within ten (10) days after publication of the notice, the weeds will be destroyed by the authority designated by the City Council at the expense of the owner and if not paid, the charges for such work will be made a special assessment against the property concerned. C. If the owner or occupant or any property in the City fails to comply with the notice within ten (10) days after its publication, the authority designated by the City Council shall cut and removal such weeds. He shall keep a record showing the cost of such work attributable to each separate lot. and parcel and shall deliver such information to the City Clerk. 5 -7 -4: PUBLIC HEALTH AND SAFETY HAZARDS,: When the City removes or eliminates public health or safety hazards from private property under Ordinance No. 6- 2, the City's Nuisance Ordinance, the administrative officer responsible for doing the work shall keep a record of the cost of such removal or elimination against each parcel of property affected and annually deliver such information to the City Clerk. This section does not apply to hazardous buildings under the hazardous building law, Minnesota Statutes, Sections 463.15 to 463.26. 5 -7 -5: REPAIR OF SIDEWALKS: A. The owner of any property within the City abutting a public sidewalk shall keep the sidewalk in repair and safe for pedestrians. B. The authority designated by the City Council shall make such inspections as are necessary to determine that public sidewalks within the City are kept in repair and safe for pedestrians. If it is found that any sidewalk abutting on private property is unsafe and in need of repairs, he shall cause a notice to be served, by mail upon the record owner of the property and the occupant, if the owner does not reside within the City or cannot be found therein ordering such owner to have the sidewalk repaired and made safe within fourteen (14) days and stating that if the owner fails to do so, the authority designated by the City Council will do so on behalf of the City, that the expense thereof must be paid by the owner, and that if unpaid it will be made a special assessment against the property concerned. C. If the sidewalk is not repaired within fourteen (14) days after receipt of the notice the authority designated by the City Council shall report the facts to the Council and the Council shall by resolution order said authority to repair the sidewalk and make it safe or order the work done by contract in accordance with the law. The authority designated by the City Council shall keep a record of total cost of the repair attributable to each lot or parcel or property and report such information to the City Clerk. 5 -7 -7: STREET MAINTENANCE: A. The Council shall each year determine by resolution what streets shall be sprinkled or flushed, oiled, or given other dust treatment during the year and the kind of work to be done on each. The Council shall also determine by resolution from time to time the streets and boulevards on which trees shall be trimmed and cared for, the kind of work to be done, and what unsound trees shall be removed. Before any work is done pursuant to either of these resolutions, the Clerk shall, under the Council's direction, publish notice that the Council will meet to consider such projects. Such notice shall be published in the official newspaper at least once no less than two (2) weeks prior to such meeting of the Council and shall state the date, time, and place of such meeting, the streets or boulevards affected and the particular projects proposed, and the estimated cost of each project either in total or on the basis of the proposed assessment per front foot or otherwise. B. At such hearing or at any adjournment thereof, the Council shall hear property owners with reference to the scope and desirability of the proposed projects. The Council shall thereupon adopt a resolution confirming the original projects with 4 such modifications as it considers desirable and shall provide for the doing of the work by day labor through the authority designated, by the City Council or by contract. C. The authority designated by the City Council shall keep a record of the cost and the portion of the cost properly attributable to each lot and parcel of property abutting on the street or boulevard on which the work is done and shall report such information to the City Clerk. 5 -7 -8: TREE CARE: A. Maintenance and care of trees installed within the boulevard of the public right - of -way along local streets shall be the responsibility of the owner of abutting property including, but not limited to, providing adequate water and trimming as necessary to maintain adequate visibility within the traveled portion of the street. B. The Council shall may determine by resolution from time to time the streets and boulevards on which trees shall be trimmed and cared for, the kind of work to be done, and what unsound trees shall be removed. C. The City Clerk shall, under the Council's direction, publish notice that the Council will meet to consider such tree maintenance projects. Such notice shall be published in the official newspaper at least once no less than two (2) weeks prior to such meeting of the Council and shall state the date, time, and place of such meeting, the streets or boulevards affected and the particular projects proposed, and the estimated cost of each project either in total or on the basis of the proposed assessment per front foot or otherwise. 5 -7 -9: STREET LIGHTING SYSTEM: The City Clerk shall keep a record of the cost of operation of the street lighting system for the twelve (12) months preceding September 1 of each year and the portion of the cost properly attributable during that period to each lot and parcel of property abutting on the street in which the system is located. All such costs shall be collected in the manner provided by this ordinance. 5 -7 -10: PERSONAL LIABILITY: The owner of property on which or adjacent to which a current service has been performed shall be personally liable for the cost of such service. As soon as the service has been completed and the cost determined, the City Clerk, or other designated official, shall prepare a bill! and mail it to the owner and thereupon the amount shall be immediately due and payable to the office of the City Clerk. (Ord. 91 -12, July 22, 1991) 5 -7 -11: ASSESSMENT: On or before September 1 of each year, the Clerk shall list the total unpaid charges for each type of current service against each separate lot or parcel to which they are attributable under this ordinance. After notice and hearing as provided in Minnesota Statutes, Section 429.061, the Council may then spread the charges against property benefited as a special assessment under Minnesota Statutes, Section 429.101 and other' pertinent statutes for certification to the County Auditor and collection along with current taxes the following year or in annual installments, not exceeding ten (10), as the Council may determine in each case. (Ord. 91 -12, July 22, 1991) 5 -7 -12: PENALTY: Any person who maintains a nuisance in violation of Section 5 -7 -3 and any person who interferes with a City employee or other authorized person in the performance of any current service under this ordinance is guilty of a misdemeanor, but prosecution shall be brought for such violation only on the direction of the Council. If convicted of such violation, such person shall be subject to a fine or imprisonment, and the costs of prosecution in either case may be added. Section 2. This piece of .equipment was originally recommended for purchase in 2005 to replace the Ford tractors currently used for roadside mowing. The new tractor mower will be more productive and safer for the operators and public. Also equipped with a front mounted broom it will be used for street sweeping and also maintaining paths. I recommend we purchase a John Deere 5425 tractor as equipped in the attached quote. The applicant, John Brickley of LandCor, was present and explained that the reasons for the building's redesign were primarily aesthetics and cost. Mr. Brickley stated that after many discussions with his team of contractors and subcontractors it was determined that the proposed tower should be eliminated. RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS WHEREAS, pursuant to a Motion passed by the council on 10/10/05, Hakanson Anderson Associates, Inc. has prepared plans and specifications for the construction of Improvement Project No. 06 -07, TH 101, CSAH 37 and CSAH 42 Water and Sewer Boring and Jacking. And has presented such plans and specifications to the council for approval; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO MINNESOTA: 1. Such plans and specifications, dated January 19, 2006, a copy of which is attached hereto and made a part hereof, are hereby approved.. 2. The City Engineer shall prepare and cause to be inserted in the official paper and in the Construction Bulletin, an advertisement for bids upon the making of such improvement under such approved plans and specifications. The advertisement shall specify the work to be done, shall state that bids will be opened at 10:00 a.m. on February 21, 2006, in the council chambers of the city hall, 8899 Nashua Avenue, Otsego, Minnesota, 55330. This Addendum is a result of recent events surrounding Mr. Bulow's failure to commence construction of the wastewater treatment facility that was required under the terms and conditions of the Development Agreement. On Thursday, January 12` City Staff met with Mr. Bulow. At that meeting, the City proposed to construct a forcemain from the City's WWTP in order to provide sanitary sewer services to the Plat. The attached Addendum reflects constructing the forcemain as a city project and reflects the conditions Mr. Bulow must agree to in order for the City to take that action. The City Engineer is currently working on the exact dollar amounts for the cash escrow and security that will be incorporated into the Addendum. ( "Developer"), a corporation under the Laws of the State of Minnesota. The Addendum affects the following described real property located in Wright County, Minnesota: All of the Plat of RIVERWOOD NATIONAL as recorded in the office of the County Recorder, Wright County, Minnesota. WHEREAS, the City has determined that further agreement, is necessary related to the proposed construction of a wastewater treatment facility as required under previous agreements between the parties; and WHEREAS, Developer has not yet commenced construction of a wastewater treatment plant as required under said previous agreements between the parties and on January 12, 2006 the City notified Developer that Developer has defaulted on its obligations under the previous agreements; and WHEREAS, City has determined to require certain changes to the previous Agreement and Addendum regarding RIVERWOOD NATIONAL, including but not limited to construction of a forcemain rather than a wastewater treatment plant to provide wastewater treatment to the Plat, as well as issuance of building permits for lots contained in the Plat; and 01/18/2006 10 :40 763 -497 -2599 COURIMACARTHURRUPPE PAGE 05/09 WHEREAS, City has decided to undertake construction of a forcemain to the Flat, as a City project. STOW, 'THEREFORE the parties hereby agree: The Addendum is in addition to the Terms and Conditions of the original Development Agreement dated March 25, 2004, and First Addendum dated January 2005. Only terms and conditions which are specifically modified are changed. All other terms and conditions remain as previously agreed and all other security requirements (except for those related to the wastewater treatment facility) remain in effect. 2. Developer shall immediately convey, by warranty deed, Lot 1, Block 15 (wastewater treatment plant site) and Outlot N (lift station site) to the City of Otsego. 3. No. 9 of the Development Agreement and No. ' 1 of the First Addendum are deleted in their entirety. 4. No. 20 of the Development Agreement and No. 2 of the First Addendum are amended as follows: Security. A. Cash. 1. Cash amount for forcemain and contingencies. 2. Sanitary► .Sewer Fees Fees for the provision of sanitary sewer (SAC) to remaining lots and buildings in the Plat areas follows: _ REC units at $6,200.00 / unit = $ B. Irrevocable Standby Letter of Credit. To ensure compliance with the terms of this Agreement and construction of all public improvements, the Developers shall furnish the City with "security" in the following amounts and type: Letter of Credit of $ The letter of Credit is calculated as follows: [to be provided by City ,Engineer] The issuer and form of the security shall be subject to City approval, and security shall be an Irrevocable Standby Letter of Credit. The security shall be for a term ending February 1, 2007. The City may draw down the 01/18/2006 10:40 763- 497 -2599 COURIMACARTHURRUPPE PAGE 06/09 security for any violation of the terms of this Agreement, or upon receiving notice of the pending expiration of the security. It shall be the responsibility of the Developers to inform the City at least thirty (30) days prior to expiration of the security of the impending expiration and the status of the project relative to the security and this Agreement. If, for whatever reason, the security lapses prior to complete compliance with this Agreement, the Developers shall immediately provide the City with either an extension of the security or an irrevocable letter of credit, of the same amount upon notification of the expiration. If the requiured improvements are not completed at least thirty (30) days prior to the expiration of the security, the City may also may draw down the security. If the security is drawn down the proceeds shall be used to cure any default. Upon receipt of proof satisfactory to the City that work has been completed and financial obligations to the City have been satisfied, with City approval, the security may be reduced from time to time down to S. , the amount of warranty security required by the Development Agreement. It shall not be reduced below this amount until such time as an Irrevocable Letter of Credit in the amount of $ shall be posted with the City as set forth in paragraph 22 of the Development Agreement. Notwithstanding the posting of warranty security, the security shall not be reduced below twenty five percent (25 %) of the posted security. Said twenty five percent (25 %) shall be retained until all improvements have been completed, all financial obligations to the City satisfied (which includes posting of warranty security), and the required "as built" plans have'been received by the City. This security amount shall be submitted to the City prior to execution and recording of this Addendum. 5. Developer shall pay City any and all sums it currently owes City prior to the City signing this Addendum, whether related to this project or previous projects. 6. No. 8.G. of the Development Agreement is deleted. City shall undertake construction of the forcemain as a city project. All of City's project costs related to construction of the forcemain after the date of this Addendum are the sole responsibility of Developer. Such costs include, but are not limited to, costs related to obtaining any additional easements (temporary or permanent), change orders, costs that may become known only after the project begins, such as removal of physical obstructions or unfavorable soil quality, all Engineering costs, and any and all related City administration costs, legal fees, planning fees, and any other cost incurred by the City as a result of undertaking the project. 7. Any funds previously expended by Developer in anticipation of its construction of the wastewater treatment facility shall be absorbed by Developer and City shall not reimburse or credit Developer for such expenses. 01/18/2006 10 :40 763- 497 -2599 COURIMACARTHURRUPPE PAGE 07/09 8. City's provision of sanitary sewer services to RIVERWOOD NATIONAL is limited to 155 single family lots and the clubhouse. Any further expansion to service in the area will only occur at the sole discretion of the City and no future reimbursement will be due Developer for costs related to the project which may ultimately benefit other parties. 9. No. 20A of the Development Agreement and No. 3 of the First Addendum are deleted in their entirety. City will not issue any fivrther building permits or certificates of occupancy for properties in RIVERWOOD NATIONAL. Issuance - of such permits will resume only when sufficient progress is made on the project. The determination of when sufficient progress has been made on the project will be made by the Otsego City Council. 10. Developer shall refund any prior payments made by City to Developer for SAC fees collected on its behalf by City. All such funds will be applied against SAC fees owed for access to the City wastewater treatment facility. Developer shall be responsible for any shortfall in SAC fees resulting from previous hookups. Any new residences or other structures shall pay current City SAC fee rates at the time of building permit. Any provisions in prior agreements which provide for any SAC fee reimbursement to Developer are null and void. 11. It shall be Developer's responsibility to disclose to all builders, real estate agents, or purchasers the provisions of the Development Agreement and A.ddendumas to fully inform them of the unique circumstances related'to delivery of sanitary sewer to homes within this Plat_ If consent to this addendum is required by any mortgage or other Agreement, or is necessary due to subsequent transfer of portions of the Plat, it shall be Developer's responsibility to obtain any and all consents deemed necessary by the City. Any and all permits or limited permits issued by the City will be issued based upon Developer's representations and Agreements as set forth in the Development Agreement and Addendumas, and Developer agrees to defend and hold the City harmless and fully indemnify it from any claim or cause of action of any nature relative to Developer's obligations under the Development Agreement or Addendums. 12. This Addendum shall run with the land, shall be recorded against title to the property, and shall be binding on all parties having any right, title or interest in the Plat or any part thereof, their heirs, successors and assigns. This agreement shall be recorded against the property above described all at the Developer's cost. 13. Developer understands and agrees that it has a continuing obligation to keep all security required under this and any prior agreements in place. Failure to do so will be deemed a material breach of any prior Agreement as well as this Addendum. 14. Developer herein agrees to restrict the use of the golf course Outlots or Riverwood National and the Plat of Crrenins Mississippi Hills for use only as a 01/18/2006 10:40 763 -497 -2599 COURIMACARTHURRUPPE PAGE 08/09 golf course and related recreation or as permanent open space. Any conveyance of these Outlots shall contain a deed restriction indicating that the Outlots may only be used for the above - mentioned purposes forever, or until such time as the City of Otsego approves any other use of the property through an amendment to the existing PUD District. This restriction runs with the land and is binding upon the Developer, its assigns or successors in title. 15. In the event of default by Developer as to any of the conditions hereunder, the City may, at its option, draw down the security established in No. 4 of this Addendum to pay for any work, or recover any funds or security owed City under the terms of this Addendum or any previous agreement. When the City does any such work, or when Developer does not pay City any funds it owes, City may, in addition to its other remedies, assess the cost in whole or in part against any property within the Plat pursuant to applicable statutes or ordinances. 16. All fees and costs related to the drafting, enforcement and recording of this Addendum, and recording of any other documents related to the project, are the sole responsibility of Developer. Developer is responsible for all costs incurred by City, of any nature, for enforcement of this Addendum.
