Daniel Licht REPORT DATE: 14 August 2024 60-DAY DATE: 11 October 2024 RE: Otsego – Michels; Expansion Site and Building Plan Review TPC FILE: 101.02 BACKGROUND Michels Corporation received City Council approval on 29 June 2020 for construction of an office building, shop/service building, storage building, and contractor outdoor storage yard located on Lot 1, Block 1 Michels Otsego Addition. The subject property at 9950 73rd Street NE is west of Kadler Avenue and north of 70th Street. The property owner has submitted plans for expansion of the 23,000 square foot office building by 23,745 square feet for a total of 46,745 square feet. The proposed expansion of the office building requires consideration of an application for Site and Building Plan Review in accordance with Section 9 of the Zoning Ordinance. Site and Building Plan review applications are subject to review by the Planning Commission and approval of the City Council, but do not require a public hearing. The Planning Commission will consider the application at their meeting on 19 August 2024 at 7:00PM. The 2023 Comprehensive Plan guides the subject property for Industrial land uses within the West Sewer District. The existing use of the subject property as a contractor business is consistent with the guided land use of the subject property. The City’s economic development goals further encourage in-place expansion of existing industrial business to create employment opportunities, expand tax base within Otsego, and utilize land efficiently. The proposed office building expansion is consistent with the 2023 Comprehensive Plan. Zoning. The subject property is zoned I-2, General Industrial District. The office component of the construction contractor facility is a permitted use within the I-2 District. Surrounding Uses. The table below summarizes existing and planned land uses surrounding the subject property. The proposed expansion of the office use within the subject property will be compatible with existing and planned land uses in the area. Principal buildings within the I-2 District must have exterior finishes using materials required Section 11-17-4.E.1 of the Zoning Ordinance. The submitted information includes floor plans and building elevations for the office building expansion. The office building expansion to be constructed of precast concrete panels with grooved sections and painted surfaces consistent with the existing office building. The proposed exterior materials comply with the requirements of the Zoning Ordinance. Building Height. Principal buildings within the I-2 District are limited to a height of four stories or 48 feet as required by Section 11-86-9 of the Zoning Ordinance. The proposed office building expansion is two stories and 28 feet in height consistent with the height of the existing office building. The height of the office building expansion complies with the allowances of the I-2 District. Building Coverage. Section 11-86-8 of the Zoning Ordinance limits building coverage to 50 percent of the lot area. With the proposed office building expansion, buildings will cover 65,615 square feet of the 45.81 acre subject property. The proposed 32.9 percent building coverage of the subject property complies with the Zoning Ordinance. Lot Requirements. Lots within the I-2 District must have a minimum area of 2.0 acres and minimum width of 200 feet to a public street. The subject property is 45.81 acres in area and has 1,230 feet of frontage to 73rd Street measured at the front setback line. The subject property complies with the minimum requirements of the I-2 District. 3 Setbacks. The table below summarizes relevant setbacks applicable to the proposed office building expansion. The proposed site plan complies with required setbacks. 73rd St. Kadler Ave. North West Required 30ft. 30ft. 25ft. 20ft. Proposed 154ft. 150ft. 265ft. NA Access. Access to the existing office building and proposed expansion is provided via two accesses to 73rd Street. The location of the existing accesses comply with Section 11-21-6.B of the Zoning Ordinance. The accesses are not proposed to be altered as part of the office building expansion. Off-Street Parking. No modification in the number of parking stalls is proposed as part of the proposed office building expansion. Parking stalls are shown to be 9.0 feet wide by 18.5 feet deep (with available 2.0 foot overhang) accessed by 30 foot wide drive aisles. The dimensions of the off-street parking comply with the provisions of Section 11-21-7.A and B of the Zoning Ordinance. The off-street parking area is surfaced with asphalt and surrounded by perimeter concrete curb as required by Section 11-21-7.C.3 and D of the Zoning Ordinance. Only 1,050 square feet of the 7,674 square foot basement of the office building expansion is finished space, which would reduce the number of required parking stalls by 29 spaces. The number of existing off-street parking stalls complies with the requirements of the Zoning Ordinance with any additional build out of the office building expansion subject to additional review as provided for by Section 11- 21-4.D of the Zoning Ordinance. Landscaping. The original site and building plan approval included a landscape plan. The approved landscape plan anticipated future expansion of the office building in the general area where the proposed expansion is to be constructed. As a result of the pre-planning for the expansion by the property owner, there is no removal of trees installed with the initial site development. No landscape plan has been submitted related to the proposed office expansion, but is not required based on no change to the approved landscape plan. 4 Exterior Lighting. The submitted plans do not include an updated exterior lighting plan. Any additional exterior lighting to be installed with the office building expansion must comply with the provisions of Section 20-16-6 of the Zoning Ordinance. All exterior lighting is subject to review and approval of the Zoning Administrator prior to issuance of a building permit. Trash. Section 20-18-4.C of the Zoning Ordinance requires trash and recycling containers stored outside must be within an enclosure at least six feet in height and constructed of materials consistent with that used for the principal building. If outdoor storage of trash and recycling containers occurs, plans for an enclosure must be submitted prior to issuance of a building permit and are subject to review of the Zoning Administrator. Signs. The submitted plans indicate only an additional wall sign above the entrance to the office building expansion within the subject property. All signs are to comply with Section 37 of the Zoning Ordinance and a sign permit is required prior to placement of signs upon the subject property. Grading Plan. The developer has submitted a grading plan related to the proposed office building expansion. All grading, drainage, and erosion control issues are subject to review and approval of the City Engineer. Utilities. City sewer and water utilities available to the subject property within the 73rd Street right-of-way and the existing office building is connected. The submitted plans include a utility plan for alteration of the existing utility connections necessary for the proposed office building expansion. All utility plans are subject to review and approval of the City Engineer. Utility Availability Charges were paid with the plat approval for the subject property. Utility connection charges for the proposed office building expansion will be collected at the time a building permit is issued in accordance with Title 8, Chapter 1 of the City Code. Performance Agreement. Section 11-9-4 of the Zoning Ordinance provides that the site and building plan approval and the stipulations, limitations, and conditions therein be applied to the subject property. All written and graphic materials officially submitted to the City are deemed to be a formal agreement between the property owner and the City. Once approved, no changes, modifications or alterations may be made to any plan detail, standard, or specifications without prior submission of a plan modification request to the Zoning Administrator for review and approval. It is not necessary for the property owner to enter into a separate Site Improvement Performance Agreement with the City for the proposed office building expansion. RECOMMENDATION The proposed expansion of an office building for Michels Construction is consistent with the goals and policies of the Comprehensive Plan and complies with the provisions of the Zoning Ordinance. Our office recommends approval of the applications as outlined below. 5 POSSIBLE ACTIONS A. Motion to recommend approval of site and building plans for Lot 1, Block 1 Michels Otsego Addition subject to the following conditions: 1. The subject property shall be developed in accordance with the site and building plans submitted to the City subject to the stipulations, limitations, and conditions as approved by the City Council in accordance with Section 11-9-4 of the Zoning Ordinance. 2. Any change in occupancy within the office building shall be subject to review for the required number of off-street parking spaces in accordance with Section 11- 21-4.D of the Zoning Ordinance. 3. Any addition of exterior lighting shall comply with Section 20-16-6 of the Zoning Ordinance, subject to review and approval of the Zoning Administrator. 4. Any exterior storage of trash and recycling containers shall comply with Section 20-18-4.C of the Zoning Ordinance subject to review of the Zoning Administrator. 5. All signs shall comply with Section 37 of the Zoning Ordinance and a sign permit is required prior to placement of signs upon the subject property, subject to review and approval of the Zoning Administrator. 6. All grading, drainage, and erosion control plans shall be subject to review and approval of the City Engineer. 7. All utility plans shall be subject to review and approval of the City Engineer. B. Motion to recommend the application be denied based on a finding that the request is inconsistent with the Comprehensive Plan and intent of the Zoning Ordinance. C. Motion to table. c.
