Ken and Julie Nathe were present to represent the request. There were no public comments. The Planning Commission discussed access to the three proposed lots during construction of the TH 101 / CSAH 39 interchange. MNDoT will be utilizing a portion of the Quantrelle Avenue right -of -way for bypass lanes for northbound TH 101. However, a temporary street to provide continued access to the seasonal RV park at the south end of Quantrelle Avenue will be constructed, that could also serve the proposed Tots. The Planning Commission preferred approval of the plat provided that access to the lots would be provided through the existing 101 Market lot until the TH 101 project is complete. We have added this as a condition of approval. With no further discussion, the Planning Commission closed the public hearing and voted 6 -0 to recommend approval of the application. The application will be considered at the City Council meeting on 8 May 2006 at 6:30 PM. POSSIBLE ACTIONS A. Motion to approve the Nathe 2nd Addition Preliminary and!'Final Plat subject to the following conditions: 1. All drainage and utility easement issues are subject to the review and approval of the City Engineer. 2. John Jackels of Emmerich Development and Mike Gair of MFRA were present to represent the application. Comments at the public hearing focused on the compatibility of the 'development with surrounding uses. Residents from Pheasant Ridge or neighborhoods north of 78 Street were pleased that mainly single family units were to be constructed in the north - northwest portion of the project. Residents of the exception parcels along the north side of CSAH 37 were concerned about immediate compatibility with adjacent townhomes and future development options for their properties in terms of access and right -of- way /setback requirements for CSAH 37. The Planning Commission discussion focused on the overall balance of housing types within the project, the site design for the Hans Hagen row townhomes with unique alley access and other issues raised by City staff. The applications were tabled at the Planning Commission meetings on 10 April 2006 and again at the 17 April 2006 meeting to allow the developer to provide revised plans. A revised site plan dated 24 April 2006 was submitted and found by City staff and the Planning Commission to address all of the significant issues. The Planning Commission voted 6 -0 to recommend approval of the Zoning Map amendment and PUD- CUP /preliminary plat for Boulder Creek as set forth below. The City Council will consider the applications at their meeting on 8 May 2006 at 6:30PM. POSSIBLE ACTIONS Decision 1 - Zoning Map Amendment A. Motion to approve a Zoning Map amendment rezoning the subject site from A -1 District to R -6 District and R -7 District based on a finding that;the action is consistent with the Comprehensive Plan. B. Motion to deny the application based on a finding that the request is inconsistent with the following provisions of the Comprehensive Plan, Zoning Ordinance and Subdivision Ordinance. C. Motion to table. Decision 2 — PUD- CUP /Preliminary Plat A. Motion to approve a PUD- CUP /Preliminary Plat for Boulder Creek, subject to the following conditions: 1. Approval of the preliminary plat shall not guarantee access to sanitary sewer service. The City shall only allocate sanitary sewer capacity to approved final plats with signed development contracts and payment of applicable SAC and WAC fees to assure the City of timely development. 2. The preliminary plat shall be developed in phases not to exceed final platting of more than 140 Tots or unit Tots within a calendar year. When Tess than the allowed number of Tots or unit Tots are final platted within a calendar year, the unallocated Tots or unit lots may be rolled forward into subsequent years. The phasing plan shall be incorporated as part of the terms and conditions of a development contract executed for the initial final plat of a phased development. 3. All single family Tots shall conform to the lot area and width requirements standard requirements of the R -5 District except: a. Lots 404 to 438 and 700 to 727 shall be exempt from the lot area and width requirements of the R -5 District. b. Lots 524 to 565 and 591 to 596 shall be exempt from the lot area requirements of the R -5 District. 4. Park and trail dedication shall be satisfied by dedication to the City of Outlots D, E, F, and G with the only the net area of these parcels credited towards the required land dedication. Any unment portion of the required land dedication shall be satisfied as a proportional cash fee in lieu of land, minus any credits due for construction of trails or other improvements, paid at final plat approval for each phase based on the current fee in effect at that time. The developer shall identify the net area of the land proposed to be dedicated to the City and provide a cost estimate for improvements to be installed or constructed within the parcels to be dedicated. 12. Outlots A, B and C shall be dedicated to the City for stormwater area charge credits as approved by the City Council. 3 13. The grading plan, erosion control issues, drainage and utility easements and utility plans shall be subject to review and approval by the City Engineer. 14. D. Consideration of the application is to be based upon (but not limited to) the criteria established by Section 20 -3 -2.F of the Zoning Ordinance: 1. The proposed action's consistency with the specific policies and provisions of the official City Comprehensive Plan. Finding: The subject site is within the east sanitary sewer service district and urban services are accessible to the property. The Comprehensive Plan guides approximately 155 acres of west and north portions of the subject site for low to medium density residential uses, which is defined to be primarily small urban sized single family lots with opportunity for townhouse units limited to those dwellings having not more than two common walls per unit. The uses shown within the area designated for low to medium density uses are consistent with this definition. Approximately 67 acres of the eastern portion of the subject site is guided for medium to high density residential land used to consist of row and quad -type townhouse buildings. Based on three to six dwelling units per acre allowed areas guided for low to medium density land use and up to 12 dwelling unit per acre allowed in areas guided for medium to high density residential land use, a total of 1,731 dwelling units could be proposed within the preliminary plat, subject to further limitation by physical conditions and the City's development regulations. With approximately 670 dwellings on 221 gross acres of land, the density of the proposed preliminary plat is a relatively !ow 3.0 dwelling units per acre and well within the allowances of the Comprehensive Plan. 1 The ratio of single family to townhouse units is approximately 43 percent to 57 percent. Although townhouse units are the majority of the housing proposed within the preliminary plat, these numbers are off -set by lands guided exclusively for single family neighborhoods to the west of the subject site and in the Southeast Area of the City towards meeting the City's goal of 70 percent of the overall housing stock within the sewer districts being single family dwellings. 2. The proposed use's compatibility with present and future land uses of the area. Finding. The subject site is surrounded by the following existing/planned uses: Direction Land Use Plan Zoning Map Existing Use North LD Residential R -6 District Detached townhomes R -4 District Single Family, East L -MD Residential A -1 District Undeveloped; South LD Residential A -1 District Agriculture LD -LL Residential West LD Residential A -1 District Rural Residential Undeveloped,. • Urban uses are generally to the north- northwest of the subject site within the first subdivisions developed in the City with sewer and water services. We anticipate potential concerns about the compatibility of the quad townhouse units in the northwest corner of the preliminary plat in relation to the detached townhomes to the north within Pheasant Ridge. First, the buildings within the abutting subdivisions are more than 70 feet apart across a protected wetland. Second, the layout of the two abutting subdivisions is such that there is one fewer dwelling unit within the preliminary plat across from the lots in Pheasant Ridge. Third„ the separation between the quad buildings due to the private driveways is such that there is more visual open space between buildings than looking at the rear of the detached; townhomes. As such, City staff recommends that the preliminary plat is compatible with existing and future land uses surrounding the subject site, including specifically the detached townhouse uses within Pheasant Ridge. 3. The proposed use's conformity with all performance standards contained in the Zoning Ordinance (i.e., parking, loading, noise, etc.). Finding: The proposed preliminary plat will conform to all applicable performance standards established by the Zoning Ordinance, Subdivision Ordinance and Engineering Manual, except for those flexibilities specifically approved as part of the requested PUD -CUP. 4. The proposed use's effect upon the area in which it is proposed. Finding: The proposed preliminary plat represents ongoing development of the designated urban service area occurring consistent with established growth' management policies and development regulations meaning that no negative impacts resulting from the project are anticipated. 5. The proposed use's impact upon property values of the area in which it is proposed. Finding: Although no study has been completed, the proposed use is not anticipated to negatively impact area property values. 6. Traffic generation by the proposed use in relation to the capabilities of streets serving the property. Finding: A traffic analysis prepared as part of the mandatory EAW finds that adequate capacity exists in the planned major collector and minor arteriarstreets abutting the subject site to accommodate traffic generated. The preliminary plat must be revised to provide for75 feet of right -of -way for the north half of CSAH 37as required by the Northeast Wright County Transportation Plan, which has been adopted by reference as part of the City's 2 Comprehensive Plan. Without dedication of the right -of -way necessary for future upgrade of CSAH 37 to accommodate regional traffic and traffic generated by local development including the proposed preliminary plat, approval of the applications is premature. 7. The proposed use's impact upon existing public services and facilities including parks, schools, streets, and utilities and its potential to overburden the City's service capacity. Finding: The proposed use is within the designated urban service area and will be developed in phases in accordance with the City's established growth management policies such that necessary services and facilities can be provided in an efficient and fiscally responsible manner in accordance with the Comprehensive Plan and applicable development regulations. E. The planning reports dated 29 March 2006, 12 April 2006 and 26 April 2006 prepared by the City Planner, Northwest Associated Consultants, Inc., are incorporated herein. F. The engineering reviews 15 March 2006, 29 March 2006 and 26 April 2006 prepared by the City Engineer, Hakanson Anderson Associates, Inc., is incorporated herein. G. The Otsego Planning Commission opened a public hearing at their regular meeting on 20 March 2006 February 2006 to consider the application, preceded by published and mailed notice; upon review of the application, and other evidence, the public hearing was continued to 3 April 2006. Upon review of additional information and public corn ments, the public hearing was closed on 3 April 2006 and the Planni ng Commission tabled the request to receive additional information at a future meeting. H. The Planning Commission considered the application again at their, meeting 17 April 2006 and 1 May 2006 and after conti nued discussion recommended by a∎6 -0 vote that the City Council approve the request based on the aforementi oned findings, DECISION: Based on the foregoing information and applicable ordinances, the requested application is hereby APPROVED. There is a low area to the west of Lot 533 that currently has a natural overland outlet to the creek that will be cut off by this development. An outlet for this low area shall be provided. 2. The 100 -year HWL of the ponds and wetland along the creek shall be no less than the 100 -year HWL of the creek. 3. The hydrology and storm sewer design is still under review. WETLANDS 1. The proposed second phase will include 56 single family lots within the middle portion of the 95 acre parcel. The remaining western section of the development will be platted as an outlot. The subject site is guided for low density residential ' development by the Comprehensive Plan within the East Sanitary Sewer District. A rezoning from A -1, Agricultural District to R -4, Residential -Urban Single Family District was approved by the City Council on 9 May 2005 in conjunction with approval of the preliminary plat. Exhibits: A. Site Location B. Preliminary Plat C. Final Plat ANALYSIS Zoning. The subject site is zoned R -4, Residential Urban Single Family District to allow for the proposed single family homes at urban densities, served by sanitary sewer and water utilities. The Comprehensive Plan calls for a maximum density of 3.0 units per acres for the subject site. The proposed plat will have a density of 1.9 dwelling units per acre at total build out, therefore being consistent with the future land use plan for the area. Access. The subject site abuts Odean Avenue on its west line and 78 / 75 Street extends east -west along the southern plat line. Odean Avenue and 78 Street (to be extended as 75 Street west of Padget Avenue) are both designated collector streets by the Transportation Plan, subject to direct lot access prohibitions and intersection spacing requirements. All intersections to these roadways are placed at least 500 feet apart as required by Section 21 -7 -7.N of the Subdivision Ordinance. Streets. Extension of 75 78 Street will be designed as an MSA collector street consistent with existing 78 Street having an 80 foot right -of -way and 46 foot wide surface with an eight foot wide bituminous trail along the north side. Local streets within the neighborhood will be within a 60 foot right -of -way and have a 28 foot wide section and shall have a five foot concrete sidewalk on one side, which has been located as to minimize pedestrian street crossings. Sidewalks have been provided along one side of all interior local streets within the proposed subdivision, as required. All street designs and street names are subject to review and approval by the City Engineer. Blocks. Section 21 -7 -3 of the Subdivision Ordinance limits block length to not more than 1,200 feet unless dictated by natural features or the design of adjacent subdivisions to encourage circulation and access within and between neighborhoods. The proposed final plat does not contain any blocks in excess of 1,200 feet in length. Lot Requirements. The following table illustrates the lot requirements of the R -4 District. Section 20- 16 -7.D of the Zoning Ordinance requires installation of a landscape bufferyard in the side or rear yard of lots abutting a designated collector street such as 75 /78 Street. The applicant submitted a landscape plan compliant with the design requirements of Section 20- 16 -91D.3 and Section 20- 16 -7.D of the Zoning Ordinance as a part of the phase one final plat. Park and Trail Dedication. Section 21 -7 -18.1 establishes that.the City may require up to 10 percent of the gross area of a parcel proposed for development at less than four 2 dwelling units per acre. Based on the 97.5 acre area of the subject site, the City may require dedication of up to 9.7 acres of land for park purposes. The developer dedicated a 4.1 acre parcel for a neighborhood park as a part of the phase one final plat. Unmet portion of the park dedication requirements must be satisfied as a proportional cash fee in lieu of land paid at the time of final plat approval. Since the applicant is proposing to final plat another 56 units (or approximately 30 percent) of the proposed total development of 182 single family lots, the park dedication fee in lieu of land is equivalent to 30 percent of the total dedication`remaining after subtracting the 4.1 acres of land and cash fee in lieu of land dedicated with the phase one final plat. The grading, drainage and utility plans were submitted with the preliminary plat and are subject to the review and approval of the City Engineer. Utilities must be extended through the subject site to provide for future connections for lands to the north, west and south as determined by the City Engineer. Sewer Capacity. There is currently no available sewer capacity in the East Waste Water Treatment Plant to serve additional residential dwellings (RECs), however, the City Council has authorized an expansion of the plant that will provide additional capacity to serve new residential developments including the subject development. Development Contract. The applicant is required to enter into a development agreement with the City and pay all applicable fees and securities upon approval of a final plat. The development contract is subject to review and approval of the City Attorney. CONCLUSIONS /RECOMMENDATION The proposed plans for Crimson Ponds West 2nd Addition final plat are consistent with the approved preliminary plat, thus our office recommends approval, subject to the conditions as follows. 1. All construction plans (grading, streets, utilities, etc.) are subject to the review and approval of the City Engineer. 3 2. The applicant shall pay a cash fee of $94,738.56 to satisfy park and trail dedication requirements for the Crimson Ponds West 2nd Addition final plat. 4. Outlot A shall be overlaid with a drainage and utility easement, subject to approval of the City Engineer. 5. The applicant shall execute a development contract with the City prior to consideration of a final plat by the City Council specifying all conditions of approval, applicable fees and required securities, subject to review and approval of the City Attorney. 6. Sheet C5 -1 & C5 -2, the centerline of 75 Street NE is not depicted in the plan view. 4. Sheet C5 -1 & C5 -4, the centerline- centerline elevation at the intersection of 75 Street and 76 Lane does not agree between the separate sheets. The elevation is 885.43 on Sheet C5 - and Sheet C5 -4 has an elevation of 885.11. 5. Sheet C5 -1 & C5 -6, the centerline- centerline elevation at the intersection of 75 Street and Ogren Avenue NE does not agree between the separate sheets. The elevation is 917.87 on Sheet C5 -1 and Sheet C5 -6 has an elevation of 917.97. 6. All Sheets, many of the storm sewer rim elevations do not agree with the centerline elevations found in sheets C5 -1 through C5 -7. Including the 2" required sump from the flow line of the gutter, the rim elevations shall be approximately 0.68' below the adjacent centerline elevation for catch basins along 75 Street NE and approximately 0.59' below the adjacent centerline elevation for catch basins along all other streets. Please review and revise all catch basin rim elevations. 2. Sheet C6 -1 & C6 -2, 75 Street NE, west of 76 Lane NE, is going to be constructed by the City of Otsego at a later date. Storm sewer CB 44 to CBMH 46 will have to be installed by the city when the remainder of 75 Street NE is constructed. 3. Sheet C6 -1, the proposed finished ground profile over the storm sewer pipe from CBMH 38 to Ex. CBMH 34 does not appear to be correct. The minimum 2.0' of cover over the storm sewer is currently not being provided over the 21" pipe from CBMH 41 to Ex. CBMH 34. 4110 We suggest that CBMH 34 (1 Addition) be revised to lower the north invert of the 30" pipe out of the structure to 875.40. The west invert of the 21" pipe shall be lowered to 876.00. The east invert of the 21" pipe out of CBMH 41 should also be lowered to provide 2' of cover \ \Ha01 \Shared Docs\ Municipal \Aotsego23xx\2313 \ot23133Rg 3 .d of 6 over the pipe from CBMH 41 to CBMH 34. This should solve any cover problems and the lack of 0.8 diameter points fall across CBMH 34 from the 21" pipe to the pipe. 4. Sheet C6 -2, the invert and location of the watermain crossing between CB 48 and CBMH 49 is incorrect. The invert of the watermain crossing is approximately'908.8 and should be shown closer to CB 48. 5. Sheet C6 -2, the invert and location of the watermain crossing between CBMH 47 and STMH 220 is incorrect. The invert of the watermain crossing is approximately 909.5 and should be located above the stone sewer. 6. Sheet C6 -2, the casting for STMH 220 shall be NEENAH type R- 1642. 7. Sheet C6 -2, the rim elevation of OCS 50 should be 913.96 and the length of the inlet pipe should be 29' in order to agree with the detail on Sheet C9 -2. 8. Sheet C6 -3, all flared end sections shall 24" and larger shall have trash guards. (Example FES 74 & FES Q) 9. Sheet C6 -3, STMH 59A shall have a NEENAH type R -1642 type casting. Remove CBMH 44 from the storm sewer schedule, as it is not shown on this sheet. I . 10. Sheet C6 -3, many of the watermain and sanitary sewer crossing inverts called out are incorrect. Please clean up the grading plans and remove or move the overtyping. Currently removed much of the inormation is difficult to read. The horizontal curve information may grading plans to help remove the clutter. 2. A legend is needed for the different line types. 3. Depict the required drainage and utility easement over the storm sewer through the rear yards of Lots 4 -1, Block 1. line or cover this swale Block 2 on the rear lot 4. Center the swale in the rear yard of Lot 14, with a drainage and utility easement. 5. The contours along the southeast end of 76 Lane NE do not agree with the alignment of the street. Please revise and verify the centerline elevations. 6. We have previously asked the contours around CBMH 22B and CBMH 36C in the rear yards of Block 1 and 2 be revised to "catch" the runoff around the catch basins. This has been done but the contours further down the swale continue to depict a ridge'in the middle of the swale. Please revise. 7. The front lot corner between Lots 1 & 2, Block 6 is incorrect and is higher than the E.O.F. of 917.0 between these lots. Please revise. 8. The front lot corner elevations of Lot 5, Block 3 are incorrect. These elevations have been corrected with the Crimson Ponds West 1 Addition grading plans. 9. The elevation at the northwest corner of Lot 6, Block 4 does not agree with the contours. Please revise. 10. The rear lot corner elevation between Lots 11 & 12, Block 2 does not agree with the contours. 11. The both front lot corner elevations of Lot 3, Block 4 do not agree with the contours. 12. The rear lot corner elevation between Lots 12 & 13, Block 4 does not agree with the contours. 13. The garage and lowest opening elevations for Lot 15, Block 4 do not agree with the contours. STORM SEWER AND INLET SPREAD CALCULATIONS 1. The areas depicted for each catch basin on the drainage area map varies from the areas used in the calculations for many structures. Please submit a revised drainage area map. The Planning Commission has increased its' amount of on -site inspections, typically reviewing a proposed developer's similar housing in other cities. The Park & Recreation Commission's recreational events have become increasingly popular, resulting in their picking up a lot of supplies. Both of these situations involve a lot of driving. If a commissioner were injured while driving it would currently be considered a volunteer act without any compensation. To cover these two commissions would cost around $25- 50. The cost of Council coverage is $123. Last year's total cost of Workers Comp coverage was $9,617. While I think this issue should be discussed for the above Commissions, I don't have any concerns about the other City commissions. ITEM 11_1 MEMO Date: May 4, 2006 To: Mayor & Council From: City Administrator Mike Robertson Re: Final 2005 Budget Figures In 2005, the City budgeted $2,189,572 in expenditures and spent $2,172,321 for an expenditure surplus of $17,251. In 2005 the City budgeted $2,189,572 in revenues and received $2,354,008 for a revenue surplus of $164,436. The total budget surplus for 2005 is $181,687. Only $36,000 needs to be added to the Cash Flow Reserve. This leaves $145,687 available to the City Council. Gary Groen and I recommend that these funds be added to the Capital Improvement Fund, the Capital Equipment Fund, or the City Campus Fund, as all of these Funds are used for general City projects. ITEM 77_2 MEMO Date: May 4, 2006 To: Mayor & Council From: City Administrator Mike Robertson Re: Final Personnel Manual Changes • The Administrative Subcommittee discussed the following changes to the Personnel Manual. Comp Time would be capped at ten (10) hours. Comp Time would still have to be used up by the end of the year. Overtime would be calculated on a weekly rather than daily basis. The revised language is listed below. If these changes are acceptable to the Council, the revised Personnel Manual will be put on the next Council agenda, and the changes will go into effect as of June 1, 2006. • Sec. 1 -10.4 Employees to whom the Fair Labor Standards . Act applies shall he compensated for overtime work at one and one -half times their regular rate of pay. . Compensatory time off shall be taken as approved by the department head for periods of not less than four hours at a time. Employees may accumulate accrue up to forty (40) ten (10) hours per calendar year of compensatory time at which time it must be used before any additional hours may he accrued. Hours of compensatory time not taken by December 31 shall he paid to the employee as hours worked. Sec. 1 -8.5 "Overtime Pay" means payment to employees for services performed in excess of eight (8) hours per day forty hours per week, and when the payments are required by applicable state and federal overtime laws, by an applicable collective bargaining agreement, or by written personnel policies.
