ISSUE;
Water from adjacent property(ies) directed and running though our
backyard. Between the house and the mound septic system.
FACTS AS I SEE IT;
1) Ochoa and 82nd street have been resurfaced recently...Not sure how many
years ago.
2) The development to the north, including storm sewer, curbs, and gutters
are fairly recent vintage.
3) The culvert under Ochoa is 24"diameter.
4) The culvert under our driveway is 24" diameter.
5) Drainage of water from one property onto another property is unlawful.
6) The council decides how to "spend the money". And likewise, how not to
spend the money. In my case the mayor has taken it upon herself to decide
how "not to spend the money". This is a problem in and of itself.
DISCUSSION;
I think that we all know that this culvert in question is an illegal culvert. And
the city council has an obligation to address it and fix it.
The "city", ie; the city engineer has had at least two opportunities to
address this drainage issue. The first time was when the development to the
north was created. The second time was when the resurfacing was done on
Ochoa and 82nd street. Certainly, the engineer would have been aware of the
issue at both occasions, but for reasons unknown to me, it was not resolved.
Drainage is an issue for probably every plat, or development. It is a real
concern. And it is always considered and dealt with. The laws and guidelines
that are followed is for water to maintain original flow and direction. It can be
directed around things, like a house for example, but ultimately it must flow
and continue on its' original pathway. Nobody is allowed to direct their water
onto other folks backyards, or anywhere onto other people's properties.
There is a method and a standard which civil engineers follow, almost
universally. And that is for the all plats to have drainage and utility easements
at the borders of the properties. Around the edges of properties!
In my situation the culverts under Ochoa and my driveway (which is on
82nd) are both 2411d4
ameter. My guess is that when my driveway culvert was to
be installed, the city engineer specified it to be 24" because the intent was for
the water from the culvert under Ochoa to flow south along Ochoa and then
west to and through my driveway culvert) Currently my driveway culvert
carries very little water. Only about 200' of %Z of the roadwayl None of my lawn
water flows to our culvert. A 6" pipe would suffice. I am not sure how or what
happened, but the culvert invert on Ochoa is lower than the invert on my
culvert. So, no flow from there.
So what is the best option to correct the drainage issue?
1) Connect to the storm sewer to the north?
2) Blaze a trail and ditch straight west along the back of my property and
then south along the west of my property? Cut down many trees.
3) Excavate a proper ditch along Ochoa to 82nd and then west to my
driveway culvert. Increase the depth of my driveway culvert?
I have another thought....as shown on my sketch.
• Abandon and remove the culvert under Ochoa.
• Fill in with dirt the area north of Humpherys driveway and east side
of Ochoa.
• Reverse the slope of Humpherys driveway culvert.
• Install a new culvert across Ochoa, starting at about 10 to 20 south
of Humphreys driveway at about a 45 degree angle spilling into the
ditch on the west side %J Ochoa.
