2024.08.26 City Council Meeting MinutesOTSEGO CITY COUNCIL MEETING MONDAY, AUGUST 26, 2024 7:00 PM OTSEGO PRAIRIE CENTER Call to Order: Mayor Stockamp called the meeting to order at 7:00 PM. Roll Call: Mayor Jessica Stoclamp and Councilmembers: Brittany Moores, Tina Goede, Jeff Dahl, and Ryan Dunlap. City Staff: City Administrator/Finance Director Adam Flaherty, Assistant City Administrator/Human Resources Sabrina Hille, Parks and Recreation Director Nick Jacobs, City Engineer Ron Wagner, City Planner Daniel Licht, City Attorney Dave Kendall, and City Clerk Audra Etzel. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Open Forum: Mayor Stockamp opened the Open Forum at 7*03 PM. Kenny Raisanen, 14248 82"d Street NE provided a handout regarding storm water drainage on his property. Mr. Raisanen feels the issue could have been addressed with the recent road construction and the drainage going across his property is illegal; he thinks the Council has an obligation to fix and provided options for consideration. City Attorney Kendall said the City Council reviewed the City Engineer update at the last City Council meeting, confirming this has been an existing drainage pattern and is not illegal. City Engineer Wagner reviewed the drainage flows presented from the previous meeting. City Engineer Wagner said Heritage Hills was repaved in 2022 and no issues were addressed at that time. Staff had been on site following a recent rain fall and the culverts were dry, therefore draining. CM Moores asked Mr. Raisanen what happens when it rains. Mr. Raisanen said a stream will flow between his house and the septic system, which he feels is not allowed. City Engineer Wagner said this was platted over 52 years ago in 1972 when Wright County would have reviewed, if reviewed today a drainage and utility easement would be added. City Attorney Kendall said he would speak to Mr. Raisanen's attorney if needed. Mayor Stockamp closed the Open Forum at 7:17 PM. 2. Consider Agenda Approval: CM Dunlap requested that items 3.3 and 3.7 be removed from the consent agenda for discussion adding items 6.1 and 6.2 to the agenda. All in favor. Motion carried 5-0. 4. Planning: 4.1 Michels: A. Presentation by City Planner. B. Consider Approval of Site and Building Plans. City Planner Licht presented the Request for Council Action. Representative Jacl< Grotl<in from R.J. Ryan Construction, agreed with the staff report and was present to answer questions. CM Dahl motioned to approve site and building plans for an office expansion on Lot 1, Block 1, Michels Addition subject to the conditions as stated by the Findings %J Fact and Decision as presented, seconded by CM Goede. Voting in favors Stockamp, Dahl, Dunlap, Goede, and Moores. Voting against, none. Motion carried 5-0. 4.2 Prairie Parl< Estates: A. Presentation by City Planner. B. Consider Approval of a Preliminary Plat and Conditionals Use Permit. City Planner Licht presented the Request for Council Action. Georgia Begin, representative, agreed with the staff report and was present to answer questions. CM Dunlap asked about the type of private drive requirements regarding curb and gutter. Mayor Stockamp agreed with CM Dunlap on the flexibility of the driveways. City Planner Licht said it would be an advantage to make the area look less like a city street to temper expectations. City Engineer said private streets are marked differently and the development would have the option to place a sign stating private drive. CM Goede motioned to approve a Preliminary Plat and Conditional Use Permit for Prairie Park Estates subject to the conditions stated on the Findings of Fact and Decision as presented, seconded by CM Dunlap. Voting in favor; Stockamp, Dahl, Dunlap, Goede, and Moores. Voting against; none. Motion carried 5-0. 4.3 Xcel Energy: A. Presentation by City Planner. Be Consider Ordinance 2024-09 Amending the Zonin C. Consider Approval of a Conditional Use Permit and Interim Use Permit. City Planner Licht presented the Request for Council Action. Scott Johnson, Xcel Relations Manager, agreed with the staff report and was present to answer questions. CM Dunlap noticed transmission lines above and local lines below. Mr. Johnson said not all the wires on the lines belong to Xcel as they are shared with other electrical providers. Drew Beardsley, Xcel Project Manager, said there is a distribution pole that runs north and south along Kadler Avenue, the other pole is the transmission line that runs east and west is Xcel's line. The only change will be along the road, and will remain in the right-of-way. CM Dunlap motioned to adopt Ordinance 2024-63 amending the Zoning Map and approve a Conditional Use Permit and Interim Use Permit for Lot 21 Block 11 Otsego Industrial Park Second Addition, subject to the conditions state on the Finding of Fact and Decision as presented, seconded by CM Dahl. City Administrator/Finance Director Flaherty noted the Ordinance should be 2024-09, not 2024- 63. CM Dunlap and CM Dahl accepted the correction to Ordinance 2024-09. Voting in favor; Stockamp, Dahl, Dunlap, Goede, and Moores. Voting against; none. Motion carried 5-0. 5. Engineering: 5.1 Otsego Creel< Rehabilitation: A. Presentation by City Engineer. B. Consider Approval of Plans and Specifications and Authorize Advertisement for Bids. City Engineer Wagner reviewed the staff report and power point presentation. City Engineer Wagner said it will start at the point of the road crossing starting up stream, and the remaining area needed is in the easement to allow for a trail. City Planner Licht said the wetland to the east of the creek is also planned to have a natural Greenway Corridor. CM Dahl motioned to approve the Plans and Specifications and order Advertisement for Bids for the Otsego Creek Rehabilitation Project, City Project No. 24-07, seconded by CM Goede. All in favor. Motion carried 5-0. 6. City Council Reports and Updates: 6.1 Approve a Joint Powers Agreement for Enforcement and Regulations of Cannabis. CM Dunlap stated he is not in favor of the City delegating cannabis responsibility to Wright County. Flaherty said the authority is for the issuance of licenses, renewals, and compliance checks; the city will still have local zoning authority. City Attorney Kendall said Wright County is contracted and this agreement would make sense to be consistent, similar to liquor license and tobacco license compliance checks. CM Dunlap thinks Wright County has the authority to pool the licenses and potentially issue zero licenses to Otsego. City Planner Licht said the City must issue one license per 12,500 of population in accordance with Statute; the JPA is a separate issue from limiting licensing. Mayor Stockamp said a big component is the compliance checks and inspection of products. City Planner Licht said compliance checks and inspections of products would be a burden on staff. CM Dahl motioned to approve a Joint Powers Agreement between Wrigth County and the City of Otsego for the enforcement and regulation of cannabis, seconded by CM Moores. Voting in favor: Stockamp, Dahl, Goede, and Moores. Voting against: Dunlap. Motion carried 44. 6.2 Adopt the Otsego Prairie Parl< Master Plan. CM Dunlap feels the Prairie Parl< Master Plan is too much and would like to see a reduction in the scope of work, and include private investment. Parks and Recreation Director Jacobs stated there have been countless meetings with community input starting in August of 2023, and advisory , . commissionand inclusion of ADA standards and safetyMayor Stockamp said the bottom number looks significant, this is the main park in the community and she is concerned with being out of compliance with ADA standards, noting this is a 20-year plan; and that she is open to private investors. City Planner Licht said this is a communication tool to prioritize the focus for Prairie Park, taking into consideration funding and requests from the community, the document gives staff a guide for capital improvements and funding. Jacobs said a guiding document is necessary to apply for grant funding and alternative funding. CM Moores said the Prairie Park Advisory Committee was a diverse group and they spent a lot of time and thought into the Master Plan CM Moores motioned to adopt the Otsego Prairie Park Master Plan, dated August 8, 2024, seconded by CM Dahl. Heritage Preservation Commission CM Moores said the Commission is working on the Friedrich Park sign, attending the SHPO conference, and the Prairie Festival. B. Parks and Recreation Commission Liaison CM Moores said the Commission did not meet this month. C. Planning Commission Liaison Mayor Stocl<amp said the Commission reviewed applications for Michels, Prairie Park Estates, and Xcel Energy. D. Public Safety Commission Liaison CM Goede said the Commission discussed the opening of CSAH 36 and the Prairie Festival. Mayor Stocl<amp and CM Dunlap attended the 194 Expansion Ribbon Cutting event. CM Moores attend the ISD 728 meeting, there are 90 new teachers within the district. 7. Staff Reports and Updates: Assistant City Administrator/Human Resources Hille said the newsletter will be mailed next week. City Administrator/Finance Director Flaherty said City offices will be closed Monday and he requested a special meeting on September 9th at 5*30 PM. Mayor Stockamp motioned to schedule a special meeting on September 9, 2024, at 5:30 PM, seconded by CM Goede. All in favor. Motion carried 5"0. City Engineer Wagner provided updates: mill and overlay project, and reconstruction project. Wright County Sheriff's Office has received traffic complaints for 85th Street NE and anticipate fewer issues with juveniles starting school next week. 8. Ad'lourn.
