Mr. Raisanen,
City staff from Engineering, Public Works, and Finance along with Mayor Stockamp met this morning to
discuss your drainage concerns. After review of drainage patterns, potential options, and review that
existing conditions have not been changed since the platting of this development in 1972, there was
consensus amongst the group that a City project was not warranted at this time.
This email will also be extended to all other City council members for their knowledge after you
addressed the City Council on July 22.

The culvert was installed in 1972 and set the historic drainage pattern that still exists today.

G. Drainage System Repairs Once a public drainage system is established, the owners of the land who
have been assessed for benefits or have recovered damages for its construction have a vested property
right to have the ditch maintained in the same condition as it was when originally established.347 This
vested property right cannot be divested without due process of law.348 The drainage authority has an
affirmative duty to maintain the drainage systems located in its jurisdiction, including the permanent
strips of perennial vegetation required under Minn. Stat. § 103E.021, and to provide the repairs
necessary to make the drainage system efficient.349
