I am interested in the second alternate vacancy on the Nanning and Zoning Commission. My community involvement in Otsego is limited to serving as president of the Mississippi Pines Homeowners Association. I have served as a Mayor and Council Member for the City of Freeport Minnesota for forty six months. I am currently a member of the Freeport Economic Development Committee and have been so since January of 2000. While Mayor I served as president of the Freeport EDA. I view the role of the Planning and Zoning Commission as working in concert with the City Council to enforce current zoning laws while using those same zoning laws to promote residential and commercial growth. Y consider the potential growth rate of Otsego as a plus and a minus. The growth is providing excellent opportunities for perspective residents and businesses to find a place to call home. This growth increases the tax revenues to the City of Otsego while increasing the strain on the infrastructure. I consider the current parks, as well as tuture parks, and recreation to be the number one asset of Otsego. I would be honored to serve the City of Otsego in any capacity. I enjoy being involved. As you may recall, NTS and People's Service were present at a recent City Council meeting to present the proposal and answer any questions. At the previous meeting questions were raised about the actual square footage that would be leased by NTS. NTS would essentially be using all of the available laboratory space in the treatment plant facility. Therefore the revised lease simply proposes an amount of $500.00 per month to lease the space. The base amount is that proposed by NTS and is approved entirely at the discretion of the City Council. I have spoken with Kurt Neidemeyer of People's Service relative to the space and use of the lab and he was going to provide me with a drawing of the facilities to attach as an Exhibit as well as a list of City owned equipment. That material should be available at the Council meeting on Monday. The changes that I requested in my memo have generally been made to the Agreement. The lease can be terminated by either party with sixty (60) days written notice so there is a quick out for the City if there are problems with this arrangement. Additional changes beyond the first revised addition provided by NTS have been underlined. I will be available to further discuss the proposed lease at the City Council meeting. URI, MACART UR & RUPPE, PLLP Encl. cc: Ron Wagner, City Engineer Tom Lucas, NTS People's Service . 1 City of Otsego County of Wright State of Minnesota Otsego West Wastewater Treatment Facility Laboratory LEASE AGREEMENT THIS LEASE AGREEMENT, is made and entered into by City of Otsego, a Minnesota Municipal corporation (hereafter referred to as the "Lessor ") and Northeast Technical Services, Inc., a Minnesota corporation (hereafter collectively referred to as the "Lessee "). 1. RENT. Lessee shall pay to Lessor, at Lessor's address, a monthly rent for the Premises of $500.00 (the "Rent "). The Rent shall be payable in advance on the first day 'of each month throughout the term of this Lease. • 2. THE PREMISES In consideration of the rents and covenants provided for herein, Lessor agrees to lease to Lessee, and the Lessee hereby agrees to lease the "Premises ", as designated by Lessor, in Lessor's Wastewater Treatment Plant. The Premises is that area of the Otsego West Wastewater Treatment Facility as outlined on the attached Exhibit A. The Premises shall also include an amount of floor space (150 SF) in a storage area as designated by Lessor. 3. DUTIES 3.1 Lessee shall be responsible for all telephone, internet, cable and other communication- related expenses for the Premises and all other services /utilities not currently available on the Premises which are requested or ordered by Lessee; 3.2 Lessee shall provide own furniture, telephone service, computers, and telephone answering systems. 3.3 Lessor shall be responsible for all utilities for the Premises, including but not limited to gas, electricity, air conditioning, heating, water /plumbing. Interruption of utilities or other services, including without limitation electricity, air conditioning, heating, plumbing, ventilation and other services shall not be a breach of 1 this Lease and Lessor shall not be liable to Lessee for any damages • or costs sustained by Lessee as a result of such interruption. 3.4 Lessee shall provide cleaning of the Premises and will conduct operation so that as nuisances of sight, sound and odor will be eliminated or minimized to the extent reasonably possible. The existence of nuisance conditions will be determined by Lessor. 3.5 Lessee shall coordinate use of the Premises so that People's Services has use of the Premises at all times necessary to complete any and all testing required by its contract with the City. If a conflict arises regarding use of the Premises between NTS and People's Services the terms and conditions of Peoples Service's Contract with Lessor shall govern. In the event that the contract does not clearly address the conflict in use, the conflict shall be resolved by Lessor. 3.6 Lessee shall not conduct at the Premises any testing of any hazardous or other wastes not associated with municipal or private waste water treatment facilities or similar wastes. Lessee shall conduct only tests related to requirements of NPDES permit • holders, both public and private, at the Premises. Any testing other than that described above shall be done at other locations controlled by Lessee. 3.7 Lessee shall be authorized to conduct work on the premises between the hours of 6am to 8pm Monday through Friday. Lessee shall make all reasonable efforts to conduct the majority of its work between 8am to 5pm Monday through Friday. Additional reasonable hours (including 8am to 5pm on weekends) beyond the hours listed above may be approved by the City upon reasonable notice to the City and Peoples Service. Such a request will not be unreasonably denied. 4. CONDITION AND USE Lessee accepts the Premises in their existing condition and Lessor shall not be required to make any alteration or improvement to the Premises. Lessee shall not use or allow the Premises or any part thereof to be used or occupied for any unlawful purpose or in violation of any law or ordinance, and will not permit any act to be done or any condition to exist on the Premises which may make void or vioable any insurance then in force with respect to the Premises. Lessee shall not make any alterations, improvements, additions, or changes to the 2 • Premises, without prior written consent of Lessor. Lessee may use at its own risk that equipment located within the Premises and owned by the City, as set forth on the attached Exhibit B. Lessee shall be responsible for maintenance repair and replacement of any damaged, lost or destroyed City equipment. Lessee may store, maintain and use its own equipment on the Premises at its own risk. 5. HOLD HARMLESS AND INDEMIFY Lessee shall fully indemnify, defend, and hold harmless Lessor from any and all claims, lawsuits, causes of action of any nature and of any kind related to Lessee's operation within or other use of Premises and/or equipment located on the Premises. 6. SURRENDER UPON TERMINATION Lessee shall, on or before the expiration of the Lease term, surrender the Premise in its present condition (reasonable wear and tear and damage by elements excepted) free of personal property. 7. RIGHT OF ENTRY Lessor and its representatives may enter the Premises at • any reasonable time to inspect the Premises or perform any work which Lessor elects or is required to undertake. People's Services may enter the Premises at any time which is necessary to perform tasks related to their contract with the Lessor. Lessor shall undertake to provide advance notice to Lessee of its entry, when possible. In Emergency situations, as determined at the sole discretion of Lessor, Lessor and its representatives (which includes People's Services) are to be provided full and immediate access to the•Premises. In the event that Lessee defaults on any term or condition of this Lease, Lessee shall provide immediate Right of Entry to Lessor to inspect, take control of the Premises, or perform any work necessitated by the breach of this Lease. 8. SECURITY OF PREMISES The Premises is a public facility providing crucial services to the City. In the event that Lessor determines, for whatever reason, that Lessee's operations of use of the Premises or that the presence of any of Lessee's employees or agents on the Premises constitutes a Security problem, said determination being made at the sole discretion of Lessor, Lessor may take any action it deems necessary, including immediate termination of the Lease, to remove the threat to Security of the Premises or any potential or actual threat to public health, safety, or welfare. Lessee shall take all measures to ensure its operations and /or employees do not constitute a Security problem. In the event that there is any damage, claim, or cause of action related to breaches of Security caused by Lessee's actions or failure to act, Lessee shall hold harmless, defend and fully indemnify Lessor from the same. 9. SUBLETTING AND ASSIGNMENT Lessee shall not, without prior written consent of Lessor, assign, mortgage or encumber this Lease, nor sublet or • permit the Premises or any part thereof to be used by others than Lessee. 3 10.INSURANCE Lessee shall have in force and effect at all times relative to this Lease statutory workman's compensation and automobile insurance as well as general liability insurance in an amount acceptable to Lessor. 11.LEASE TERM The Lease term shall be a month -to -month tenancy, commencing on April 2005. In 2005, the budget is for $8000 which will provide for 120 hours of contract sweeping. I estimate that • • will be adequate to sweep all urban designed roads and a few residential rural designed roads this spring. As I wrote in my memo to the council on March 14, the budget would not cover the cost of sweeping the roads in the developments under construction without turf established in the boulevards. In these areas, erosion and construction traffic make spring cleanup sweeping time consuming and more costly. These roads should be considered for periodic sweeping throughout the year as needed to prevent sediment from entering the stormsewer system. Also the city should consider sweeping the fall of the year for the urban designed streets where leaves plug storm sewer grates creating drainage problems. I would estimate a total of 300-400 hours per year of sweeping to provide these services. The current low quote for contract sweeping is $67.00 per hour and includes equipment, operator,fuel, and maintenance. The city will provide a truck for hauling and a truck with a water tank if needed. The benefit of contracting the sweeping is the city does not have to purchase and maintain a street sweeper. The benefit of owning a sweeper is that sweeping can be done as soon as weather permits, can be suspended if other work has to performed, and the equipment will be available throughout the to use as needed. Install more permanent garbage cans, especially near the skate park. 3. Ballfield Benches. Purchase additional benches to provide more room. Install protective screening around the benches. 4. Ballfield Drainage Ditch. Have the City Engineer survey the drainage around the ball fields to see if the drainage ditches could be moved or filled to create more useable land. 5. Soccer Field. My experience is that with many projects such as gravel road maintenance and street sweeping, the longer day is more productive. I recommend the city council consider changing the hours for the Public Works Department during daylight savings time, from April 4, 2005 through October 21, 2005. City Staff indicated that there are no current plans for development of the west portion of the City's property south of 90 Street. City Administrator Mike Robertson said that he and Public Works staff have already discussed that 90 Street cannot be used to access CSAH 39, that all traffic is to be routed out to Nashua Avenue. The Planning Commission had no comments or discussion regarding the project. After closing the public hearing, the Planning Commission voted 7 -0 to recommend approval of the requests as outlined below. The TIGER Project corridor, which encompasses I -94 and two parallel roadways, Highway 10 and Highway 55, is one of the fastest growing regions within the state of Minnesota and has seen a dramatic growth in both traffic volumes and congestion in recent years. This project will enhance safety and efficiency of transportation by integrating the transportation operations, management, and information resources throughout this region, utilizing an innovative intelligent transportation systems (ITS) approach to address the current and growing demands of the corridor. The overall goals and objectives of the project are best summed up in the vision developed by the project stakeholders. The project's vision is: "To create a model corridor between • regional centers that integrates existing and new ITS devices, operations centers, and agency operations. The traffic management and traveler information strategies and tools employed will be used on a daily basis as well as during emergency situations. The corridor will provide a safe and efficient means to transport people and goods." One of the primary objectives of the project is to balance traffic flow along the routes to ensure safe and efficient travel for roadway users. To this end, the project will deploy vehicle detection and surveillance systems to monitor traffic flow and the system will use dynamic message signs to convey traffic condition information to travelers. The project will also include re- tinning traffic signals to handle increased volumes of traffic on arterials and mainlines throughout the corridor. The attached map provides a high -level view of the planned locations of these devices and affected traffic signals. In order to make all of the aforementioned work together efficiently, operators at Mn/DOT's traffic operations centers in St. Cloud and the Twin Cities will monitor and control the devices. This does require a real -time communication system. Mn/DOT and their consultant have been working with Otsego city staff and have determined that the r City of Otsego water tower located near I -94 and County Road 19 would be an ideal site for positioning antennas for the wireless communication system in this area. Therefore, Mn/DOT is requesting the City of Otsego to allow Mn/DOT to install small radio antennas and associated equipment at this site. Several concept drawings of the proposed equipment and the utility cost of this equipment is provided in the attachments. Mn/DOT and consultant staff will present this information and answer any questions at the March 28 Otsego City Council meeting. The TIGER Partnership The partnership between the City and Mn/DOT will be specified in a lease agreement, which will contain terms similar to those below: • • City of Otsego allows for the installation of small radio antennas on the top of the water tower and a small cabinet inside the base pedestal. • Mn/DOT pays for all installation costs, and ensures that the tower's structure is not compromised in any way • Mn/DOT pays (preferably as a lump sum) electrical power costs for the equipment • City of Otsego allows access to the base of the tower for occasional maintenance and upgrades. ..
