RES 2024-66 Vacating Existing Drainage and Utility Easements for 5861 Queens AvenueCITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO: 2024-66 VACATING EXISTING DRAINAGE AND UTILITY EASEMENTS FOR 5861 QUEENS AVENUE WHEREAS, the City of Otsego has initiated vacation of existing drainage and utility easements dedicated over a portion of the property legally described as follows; The South 317.00 feet of the North 874.00 feet, of as measured at right angles, of all that part of the East Half of the Northwest Quarter, Section 2, Township 120, Range 23, Wright County, Minnesota lying Northerly and Easterly of the Easterly line of the right-of-way of TruOk Highway No. 101. Excepting therefrom all that part thereof lying Easterly of the centerline of the following described roadway; Commencing at the Northeast corner of said East Half of the Northwest Quarter; thence South 00 degrees 09 minutes 12 seconds East, assumed bearing, along the East line of the East Half of the Northwest Quarter for a distance of 874.05 feet, more or less, to intersect the south line of said North 874.00 feet; thence return North 00 degrees 09 minutes 12 seconds West along said East line, also being the centerline of said roadway to be hereby described for a distance of 529.24 feet; thence Northerly along said centerline being a tangential curve to the left, radius 324.07 feet, central angle 18 degrees 49 minutes 55 seconds for a length of 106.51 feet, more or less, to intersect the North line of the South 634.00 feet of said North 874.00 feet and there terminating. Wright County, Minnesota. WHEREAS, the portion of the existing drainage and utility easement to be vacated is described by Exhibit A.; and WHEREAS, the City Engineer has reviewed request and determined that the existing drainage and utility easements described by Exhibit Aare unnecessary for public purposes; and, WHEREAS, the City Council held a public hearing at their regular meeting on 23 September 2024 to consider the vacation, preceded by required published and mailed legal notice; and, WHEREAS, the Request for Council Action dated 23 September 2024 prepared by the City Planner, The Planning Company LLC, is incorporated herein; and, WHEREAS, the City Council having considered all information received finds that the existing drainage and utility easements serve no useful public purpose and vacating the existing drainage and utility easements would be in the public interest. NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Otsego hereby orders; 1. That the existing drainage and utility easements dedicated over the property described herein is hereby vacated. 2. The vacation shall be effective upon dedication of permanent drainage and utility easements along the south line and completion of a public improvement project. 1 3. The City Council hereby determines that the vacation of said drainage and utility easements shall cause no damage to any abutting or nearby property owners and therefore no damages are awarded to any such property owners.
