Yes No BACKGROUND/JUSTIFICATION: Modern Construction of Minnesota, Inc. had submitted zoning and subdivision applications for a mixed-use development of 13.80 acres located east of TH 101 and south of 90th Street. The development was to be known initially as Mississippi Landing, but the developer updated the project name to Otsego Waterfront District. The proposed development was to include 150 multiple family dwellings and retail, office, and service commercial uses, as well as an open space planned for future improved open space and docks on the Mississippi River. The Planning Commission conducted a public hearing to consider the zoning and subdivision applications on 3 June 2024 and voted to recommend approval. The City Council, at its meeting on 22 July 2024, failed to approve a motion to approve the applications. The City Council members cited the following factors for their individual votes not to approve the motion: • The proposed seven story height of the building was not compatible with the character of the surrounding area or the community and not consistent with the intent of the Zoning Ordinance. • The supply of off-street parking does not comply with the requirements of the Zoning Ordinance and would not be sufficient to meet demand. • The floor area of 29 of the one-bedroom dwelling units do not comply with the minimum floor area requirements established by the Zoning Ordinance. Section 11-3-2.P of the Zoning Ordinance provides that after an application has been denied by the City Council, an another application for substantially the same development cannot be resubmitted for one year, unless: 1. If the applicant or property owner can clearly demonstrate that the circumstances surrounding the previous application have changed significantly. 2. If the City Council determines that the circumstances surrounding a previous application have changed significantly. 3. If the City Council decides to reconsider such matter by a four- fifths vote of the entire City Council. The developer has submitted a request that the City Council allow application to be submitted to reconsider the proposed development. The request from the developer outlines that if the application is allowed to be reconsidered, he would be agreeable to the following additional conditions of approval and would submit revised plans concurrent with application for final plat: • The building plans shall be revised to reduce the height of the structure to five stories above parking. • The building plans shall be revised such that the floor area of each dwelling unit complies with the minimum requirements of the Zoning Ordinance. • The site plan shall be revised to provide the minimum number of parking spaces on-site as determined by the Zoning Administrator. The City Council is asked to determine if the additional conditions outlined by City staff and agreed to by the developer alter the circumstances surrounding the proposed development sufficiently to warrant allowing reconsideration of the applications. This process would be the same as followed for the previous applications, including a public hearing to be held by the Planning Commission, a recommendation from the Planning Commission regarding the proposed development, and a decision to approve or deny the applications by the City Council. DANIEL LICHT Subject:reconsideration request Date:Tuesday, September 24, 2024 2:15:37 PM I would like to request from City Council that my project be reconsidered with the understanding that the building plans shall be revised to reduce the height of the structure by one floor. That the building plans shall be revised such that the floor area of each dwelling unit complies with the minimum requirements of the Zoning Ordinance. That the site plan shall be revised to provide the minimum number of parking spaces on-site as determined by the Zoning Administrator. As a local business owner and Otsego property owner I have invested years of time and over $500K into this project which will bring wonderful new business to the City, increase the availability of quality housing, open up new recreational activities, and increase the tax base substantially. I am fully committed to Otsego and have been for years and hope that City council will recognize the work I have completed and reconsider the project with the proposed updates.
