AGENDA ITEM DETAILS RECOMMENDATION: City staff recommends the City Council adopt a resolution accepting public improvements. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKGROUND/JUSTIFICATION: There are no City-owned improvements within the public easements and public right-of-way. All project improvements have been completed and the warranty period has ended. Staff recommends that all public improvements be finally accepted, ending the warranty period and releasing the remaining financial securities. SUPPORTING DOCUMENTS ATTACHED: • Resolution 2024-79 POSSIBLE MOTION PLEASE WORD MOTION AS YOU WOULD LIKE IT TO APPEAR IN THE MINUTES: Motion to adopt Resolution 2024-79 accepting all public improvements associated with Autumn Woods Commercial, ending the warranty period and releasing the remaining financial securities. BUDGET INFORMATION FUNDING: BUDGETED: Fund 701 – Development Escrows N/A 1 CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO: 2024-79 ACCEPTING PUBLIC IMPROVEMENTS FOR AUTUMN WOODS COMMERCIAL, LOT 3, BLOCK 1 WHEREAS, the City Council approved the final plan of NCS Headquarters, 5500 Queens Ave NE (the “plan”); and WHEREAS, the City and Developer entered into a Site Improvement Performance Agreement and recorded with Wright County regarding approval of the plan and installation of required public improvements within the Autumn Woods Commercial, Lot 3, Block 1; and WHEREAS, all improvements were constructed in accordance with City standards, Code and approved plans within the plat. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA: 1. The warranty periods have come to an end and completion of all required items are accepted; the improvements shall be finally accepted. 2 ADOPTED by the Otsego City Council this 28th day of October, 2024.
