CITY VEHICLES City vehicles are to be used only by City employees for official business. City vehicles may not be used for personal business. Employees that drive or may be required to drive City vehicles and equipment are responsible for maintaining a safe driving record and observing all traffic laws. Drivers must carry a current, valid driver's license that is adequate for the type of vehicle being driven. Employee must report any changes in the status of their license. An annual check of a driver's motor vehicle record will be conducted and the City `s insurance carrier will review the record for potential liability. If an employee's record indicates a pattern of traffic violations that may increase the City's liability disciplinary action up to and including discharge may be taken. VEHICLE USE Employees and all passengers must wear a seat belt at all times when operating any City vehicle. No smoking is allowed in City vehicles at any time. Employees must ensure that the City vehicle is in good operating condition and that all windows and lights are clean before operating the vehicle. When vehicles are not in use or in a secured area they must have the keys removed. Vehicles must be parked in the City garage after hours. CITY FACILITIES Gasoline for City vehicles must be obtained from the Street Department facility. Mileage and gallons of fuel must be recorded after each refueling. CITY LOGO All City vehicles shall have the City's logo prominently displayed on the side door panels. Pa VEHICLE MAINTENANCE Vehicle maintenance shall be the responsibility of the vehicle operator and performed by the Public Works Department. Employees or their supervisor shall work with the Public Works Department to schedule a mutual agreeable time for routine vehicle maintenance such as oil changes. The Public Works Department shall review all City vehicles monthly and provide written evaluation on a yearly basis. VEHICLE ACCIDENTS Any employee involved in an accident while driving a City vehicle must report the accident at once to their supervisor. In severe accidents the employee must call 911 and wait until the police arrive. NTS has proposed a form lease for such an arrangement. The following changes should be made to the Lease: i 1. Section 3.4 should be rewritten as follows: "Lessee shall provide cleaning of the Premises and will conduct its operations so that nuisances of sight, sound and odor will be eliminated or minimized to the extent reasonably possible. The existence of nuisance conditions will be determined by Lessor." 2. Add Section 3.5, "Lessee shall conduct its operations during normal business hours (8am to 6pm Monday - Friday). Lessee shall coordinate use of the Premises so that People's Service has use of the Premises at all times necessary to complete any and all testing required by its contract with the City. If a conflict arises regarding use of the Premises between NTS and People's Service the terms and conditions of People Services contract with Lessor shall govern. In the event that the contract does not clearly address the conflict in use, the conflict shall be resolved by Lessor." 3. Add Section 3.6, " Lessee shall not conduct at the Premises any testing of any hazardous or other wastes not associated with municipal wastewater treatment facilities. Lessee shall conduct only tests related to requirements of NPDES permit holders, both public and private, at the Premises. Any testing other than that described above shall be done at other locations controlled by Lessee." 4. Add No. 5, "HOLD HARMLESS AND INDEMNIFY. Lessee shall fully indemnify, defend and hold harmless Lessor from any and all claims, lawsuits, causes of action of any nature and of any kind related to Lessee's operations within or other use of the Premises." RIGHT OF ENTRY should be re- written as follows: "Lessor and its representatives�may enter the Premises at any time to inspect the Premises or perform any work which Lessor elects or is required to undertake. (NTS) is a company that has provided laboratory. analysis for municipal and private NPDES permit holders since 1985. NTS has hundreds of customers many located near the City of Otsego. In the last few years, NTS has had a considerable increase in laboratory analysis in the north metro area. In order to meet our clients increasing needs and to comply with changing Minnesota Department of Health certification requirements, NTS has realized we must staff for these demands. NTS would like to lease the laboratory facilities currently being constructed at your new WWTP. NTS would comply with all City and Peoples Services security and safety requirements. NTS is familiar with these issues as we leased the City of Virginia's WWTP laboratory for approximately 10 years. NTS is fully insured (certification attached) 'and would only conduct normal NPDES permit analysis on -site. NTS would not conduct testing of hazardous waste or other wastes not normally associated with municipal WWTP's. NTS does provide RCRA and other types of analysis, however, these tests would not be done at your facilities. This type of work would be sent to our main laboratory where we have appropriate facilities to handle these samples. We feel our work would not interfere with normal plant operations. NTS would be interested in leasing the lab, still allowing access for People's Service staff to conduct any process control analysis necessary and some miscellaneous storage space. Farr Development has submitted a final plat for Pleasant Creek Farms 4th Addition. The subject site is located south of 80 Street and east of CSAH 19. The Comprehensive Plan guides the site for medium -high density residential land uses and the site is zoned R -6, Residential Quadraminium, Townhouse and Low Density Multiple Family District. Portions of the subject development are also within the Shoreland Overlay District of Otsego Creek. A preliminary plat and PUD -CUP was approved for the Pleasant Creek Farms development on 14 April 2003 by the City Council. The proposed final plat consists of 131 dwelling units in 22 buildings and six outlots. Outlots A, B, E and F are used for common open space among the platted units, while Outlots C and D will be reserved for future phases of the Pleasant Creek Farms development. This application for final plat approval is processed in accordance with Section 21 -3 -3 of the Subdivision Ordinance and thus, does not have to be reviewed by the Planning Commission prior to City Council review. Exhibits: A. Site Location B. Preliminary Plat C. Final Plat ANALYSIS Preliminary Plat Consistency. The preceding phases of the Pleasant Creek Farms development occurred within the southwest corner of the plat with the balance of the site platted as outlots for future development. The layout and number of the townhome units is slightly different for the proposed final plat than that which was approved for the preliminary plat, with one additional unit. These changes were necessitated by setback and building spacing requirements. Access. As a part of the first phase of development of this site, the developer was required to construct 77 Street from CSAH 19 to the east line of the subdivision abutting Arbor Creek. Construction of the remaining portion of Lachman Avenue and the northwest portion of Lambert Avenue within the Pleasant Creek Farms development (as well as the connected private drives for the proposed units within this phase) will be completed upon approval of the 4 th Addition final plat. Additionally, a private trail will be constructed which will connect to Lambert Avenue, Lachman Avenue and 77 Street across Outlot B. Landscaping. The applicant will be required to install the landscaping identified on the approved landscape plan for the 4 th Addition. The residential buffer along Beaudry Addition was completed with the 2 nd Addition. A cost estimate for the landscaping to be installed must be submitted for approval by City Staff. Park and Trail Dedication. No land is being dedicated for City parks or trails as a part of the final plat. As such, the applicant is required to pay a cash fee in lieu of land equal to $2,932 per dwelling unit. Based on 131 dwelling units, the required cash fee in lieu of land is $384,092 to be paid at the time the development contract is executed. Sewer Capacity. The west waste water treatment plan currently has 695 RECs available for allocation to residential projects, with anticipated allocation of 108 RECs to Kittredge Crossings 7 th Addition. As such, there is adequate sewer capacity for the proposed final plat. If Pleasant Creek 4 th Addition is approved, the available supply of sewer capacity for residential uses will be 456 RECs. Easements. The final plat indicates drainage and utility easements over all of Outlots A, B, C, D, E and F. No easements should be established over Outlots C and D as these will be replatted with future additions. All easements are subject to the review and approval of the City Engineer. Construction Plans. Construction plans have been submitted for the Pleasant Creek Farms 4 th Addition final plat and reflect prior comments by our office and the City Engineer. All construction plans remain subject to the City Engineer's approval. Homeowners' Association. Documents establishing the homeowners' association must be submitted and recorded with the final plat, subject to the review and approval of the City Attorney. 2 Development Contract. Upon approval of the final plat, the applicant must enter into a development contract with the City. The development contract establishes conditions of plat approval and ensures payment of all fees and securities. RECOMMENDATION The final plat for Pleasant Creek Farms 4 th Addition is consistent with the approved preliminary plat and applicable stipulations, as well as the Zoning Ordinance and Subdivision Ordinances. Representatives of D.R. Horton were present to address questions about their project. There were no comments from the public. The Planning Commission reviewed the proposed changes to the original Zimmer Farms and Martin Farms development plans related to the Phase 3 proposal. The Planning Commission agreed with City staffs conclusion that the net effect of the changes was positive. The other significant issue raised by the Planning Commission was the size of the garages for each of the units. The developer indicated that the garages would be the same as previously proposed for these housing unit types with the Zimmer Farms Phase 1 approvals, which are 506 or 526 square feet for the coach homes and 400 square feet for the villa homes. After closing the public hearing and discussion of the application, the Planning Commission voted 5 -0 to recommend approval of the requested Zoning Map amendment and PUD- CUP /preliminary plat as outlined below. POSSIBLE ACTIONS Decision 1 — Zoning Map Amendment A. Motion to approve a Zoning Map Amendment rezoning the proposed plat from A -1 District to R -6 District based upon a finding that the request is consistent with the Comprehensive Plan. B. The changes in proposed dwelling unit types from the original development plans for both projects results in a decrease in density in the area of Zimmer Farms Phase to 3.6 dwelling units per acre. The proposed decrease in number of dwelling units and overall density is not a negative in evaluating the proposed Zoning Ordinance amendment and PUD- CUP given the overall mix of dwelling units planned or approved within the west sewer district. 2. The proposed use's compatibility with present and future land uses in the area. Finding: The table below illustrates land uses surrounding the subject site. The proposed use's impact upon existing public services and facilities including parks, schools. Streets and utilities and its potential to overburden the City's service capacity. Finding: The intensity of the proposed use is within the parameters established by the Comprehensive Plan and original development plans for Martin Farms and Zimmer Farms 2 upon which infrastructure and service planning has been based. As such, no negative impact to the City's service capacity is anticipated as a result of this project G. The planning report dated 16 February 2005 prepared by the City Planner, Northwest Associated Consultants, Inc., is incorporated herein. H. The Engineering Review dated 16 February prepared by the City Engineer, Hakanson Anderson Associates, Inc. is incorporated herein. The Otsego Planning Commission held a public hearing at their regular meeting on 22 February 2005 to consider the application, preceded by published and mailed notice. Based upon review of the application and evidence received, the Otsego Planning Commission closed the public hearing and recommended by a 5 -0 vote that the City Council approve the request based on the aforementioned findings. The City shall only allocate sanitary sewer capacity to approved final plats with signed development contracts to assure the City of timely development. 2. A phasing plan shall be submitted outlining the anticipated final platting of the proposed subdivision. The phasing plan is subject to approval of the City Council, its schedule shall be made a condition of preliminary plat approval, and it shall be incorporated as part of the terms and conditions of a development contract executed for the initial final plat of a phased development. 3. Five foot wide concrete sidewalks shall be added along the private drives in the area of Blocks 16 to 26 within Outlot C and Outlot D as approved by City Staff. 4. The preliminary plat shall be revised such that the width of Lots 4 -8, Block 46 shall be at least 75 feet wide. 5. The landscape plan shall be revised to provide additional plantings along the north portion of Outlots A and B and future single - family additions of the Martin Farms, to specify irrigation details and specify that areas between driveways of abutting dwelling units are to be grass or asphalt. 6. The exterior materials and colors for the row and back -to -back townhouse buildings shall be consistent with those previously approved as part of phases 1 and 2 of Zimmer Farms. Brick wainscoting at least four feet high shall also be added to the side of any townhouse building within Phase 3 facing a public right -of -way. 7. A guest parking plan for the townhouse portion of the project indicating the a supply of at least 107 guest parking stalls shall be submitted and is subject to approval by City Staff. 8. The applicant shall submit scaled plans for proposed area identification signs to conform to Section 20- 37 -5.2 of the Zoning Ordinance, subject to approval of City Staff. 9. Park and trail dedication requirements are to be satisfied as a cash fee in lieu of land based on the current fee in effect at the time of final plat approval. 10. The preliminary plat shall be revised to provide drainage and utility easements over Outlots A, B, C and D, subject to approval of the City Engineer. 11. INTRODUCTION The purpose of this Feasibility Report is to present the Cit� of Otsego with a preliminary examination of municipal street improvements for 89 Street NE and Parell Avenue NE in Otsego, Minnesota. The report discusses the proposed scope of improvements, preliminary cost estimates and a project schedule. The report has been prepared in compliance with Minnesota State Statutes 429 for projects resulting in special assessments. The costs provided in this report are based on the current Engineering News Record Construction Cost Index. Residents of the Barthel Acres subdivision have petitioned for the bituminous surfacing of 89 Street NE from Page Avenue NE to Parell Avenue NE, and Parell Avenue NE from 89 Street NE to (CSAH 39) 90 Street NE (refer to Exhibit A). The existing roadways consist of a gravel surface approximately 22 feet wide. Both Page Avenue NE and 90 Street NE are existing bituminous streets. Bituminous surfacing of 89 Street NE and Parell Avenue NE will reduce City maintenance where gravel roads cause more severe washboard, rutting and dust problems. The value of the lots is positively benefited by fronting on and being accessed by bituminous paved streets. II. PROPOSED PROJECT The proposed street improvement project consists primarily of additional aggregate base and bituminous surfacing of 89 Street NE, from Parell Avenue NE to Page Avenue NE; and Parell Avenue NE, from 89 Street NE to 90 Street NE. Additional improvement work includes the widening of the surfaces and shoulders for general conformance with City Street Standards. The proposed street section is a 22 foot wide bituminous surface with 1 foot wide aggregate shoulders (refer to Exhibit B). The proposed method of construction for street improvements of this type is to grade the existing surface to provide the minimum width, to examine and evaluate the subgrade, to excavate any soft subgrade with correction by placing granular borrow and to construct a new street structure utilizing imported aggregate base (as necessary) and a 3'/2 inch total thickness of bituminous surfacing. The street shall have a 2 percent crown with 0.6 percent minimum grade and 7 percent maximum grade. Surface water within the project area will be controlled with existing culverts and ditches. III. INITIATION The project was initiated by the petition of adjacent residents (refer to Exhibit C). Currently, 8 of the 11 residents have signed the petition. On February 14, 2005 the Otsego City Council accepted the petition and ordered this feasibility report. IV. FEASIBILITY The project is feasible from a technical standpoint and generally meets all local, regional and state standards for municipal improvements. V. RIGHT -OF -WAY / EASEMENTS The existing streets are located within the existing 66 foot wide right -of -way. Although the right -of -way appears to be sufficient any additional utility and drainage easements that may be required based on the final design, will need to be provided to the City of Otsego. VI. PERMITS At this time, no permits are required for this project. VII. COMPLETION This project is proposed to be completed during the 2005. construction season. We will evaluate the possibility of adding this project to an existing city contract. VIII. ESTIMATED PROJECT COST Included in this report is a detailed estimate of construction costs for the street improvements. The costs quoted herein are estimates only and are not guaranteed prices. The quantities are estimates also. The contractor will be paid only for work completed. The cost estimates are based on 2005 current construction costs. ESTIMATED ASSESSMENT The project could be assessed on a unit basis, by dividing the total estimated project cost by 11, the number of assessable units, an assessment value is obtained. The estimated cost per assessment on a unit basis was determined to be $3,786.38 per unit. . The estimated lineal foot cost was determined by dividing the total estimated project cost by the assessable front foot. The front foot distance is about 2,979.58 feet. The estimated cost per lineal foot of property was determined to be $13.98. As a reference, the 85 Street NE and Page Avenue NE feasibility report dated December 19, 2002, determined a typical urban roadway section estimated cost per front foot of property to be $36.45. CONCLUSION AND RECOMMENDATION This report analyzed the feasibility of reconstructing 89 Street NE (between Page Avenue NE and Parell Avenue NE) and Parell Avenue NE (between 89 Street NE and 90 Street NE). The improvement is technically feasible as described in this report. The project would have to be funded by assessing the benefiting properties. The petition you submitted has no statutory basis and therefore has no binding effect on the City. This matter has been placed on the City Council Agenda for February 28, 2005. The Otsego City Council is under no legal obligation to act on your request. It appears that the basis of the petition may be a misinterpretation of the statutes related to Municipal Liquor. The City of Otsego does not operate a municipal liquor store. Therefore, the City is not required to obtain authorization from the City's voters (via a special election) before issuing new off -sale liquor licenses to a private party. In general, cities have broad discretion in how they regulate the sale of liquor, including the issuance of licenses. Because Otsego is not a charter city, the Otsego City Council also functions as the City of Otsego Local Board of Appeal and Equalization, as provided Eby statute. All members of the Local Board of Appeal and Equalization must be elected members of the City Council. The assessor for the City of Otsego is not a voting member of your governing body and therefore cannot be a member of the Board. (a) The town board of a town, or the council or other governing body of a city, is the board of appeal and equalization except (1) in cities whose charters provide for a board of equalization or (2) in any city or town that has transferred its local board of review power and duties to the county board as provided in subdivision 3. The county assessor shall fix a day and time when the board or the board of equalization shall meet in the assessment districts of the county. Notwithstanding any law or city charter to the contrary, a city board of equalization shall be referred to as a board of appeal and equalization. on or before February 15 of each year the assessor shall give written notice of the time to the city or town clerk. Notwithstanding the provisions of any charter to the contrary, the meetings must be held between April 1 and May 31 each year. The clerk shall give published and posted notice of the meeting at least ten days before the date of the meeting. The board shall meet at the office of the clerk to review the assessment and classification of property in the town or city. No changes in valuation or classification which are intended to correct errors in judgment by the county assessor may be made by the county assessor after the board has adjourned in those cities or towns that hold a local board of review; however, corrections of errors that are merely clerical in nature or changes that extend homestead treatment to property are permitted after adjournment until the tax extension date for that assessment year. The changes must be fully documented and maintained in the assessor's office and must be available for review by any person. The appointing body shall determine the number of members of the board, the compensation and expenses to be paid, and the term of office of each member. The board may not make an individual market value adjustment or classification change that would benefit the property in cases where the owner or other person having control over the property will not permit the assessor to inspect the property and the interior of any buildings or structures. (c) A local board may reduce assessments upon petition of the taxpayer but the total reductions must not reduce the aggregate assessment made by the county assessor by more than one percent. If the total reductions would lower the aggregate assessments made by the county assessor by more than one percent, none of the adjustments may be made. The assessor shall correct any clerical errors or double assessments discovered by the board without regard to the one percent limitation. (d) A local board does not have authority to grant an exemption or to order property removed from the tax rolls. (e) A majority of the members may act at the meeting, and adjourn from day to day until they finish hearing the cases presented. Kramber, Wright County Assessor Subject: Local Board of Appeal and Equalization Training A 2003 law requires that a Local Board of Appeal and Equalization cannot be held in 2006 unless at least one voting member present at the meeting has attended an appeals and equalization course developed or approved by the Minnesota Commissioner of Revenue. The purpose of this training is to assist local board members in conducting their Local Boards of Appeal and Equalization meetings. The law, found in Minnesota Statute 274.014, provides in part that: "By no later than January 1, 2006, and each year thereafter., there must be at least one member at each meeting of a local board of appeal and equalization who has attended an appeals and equalization course developed or approved by the commissioner within the last four years, as certified the commissioner. The course may be offered in conjunction with a meeting of the Minnesota League of Cities or the Minnesota Association of Townships. The course content must include, but need not be limited, to, a review of the handbook developed by the commissioner... WRIGHT COUNTY ISSUES A Wright County City Administrator's organization was formed to try to work with the Wright County Board to encourage greater cooperation between them and cities. A meeting was held between the County Board and the Wright County Mayor's Association. BUILDING DEPARTMENT ESTABLISHED A Building Official was hired as a City employee and a Building Department was established with two additional employees. COMP PLAN UPDATE The Comprehensive Plan has been updated to plan for sewer throughout most of the undeveloped areas of Otsego. PARK PLAN UPDATE The park plan has been updated to comply with the updated comp plan. RECORDS RETENTION SCHEDULE The City has completed all the work necessary to comply with the requirements of the State of Minnesota and the recommendations of the League of Minnesota Cities to maintain our records properly. CITY ORDINANCE CODIFICATION City ordinances have been codified and redundant or obsolete ordinances have been eliminated. ANIMAL ORDINANCE UPDATE The animal ordinance has been updated. PEDDLERS ORDINANCE An updated peddler's ordinance has been completed. METHAMPHETAMINE ORDINANCE The Council decided to let Wright County regulate meth labs and their effects. The improvement will be completed in 2005. ISLAND VIEW EROSION REPORT The City Engineer completed a plan for the erosion occurring in parts of Island View Addition. The Council held a public hearing and based on testimony did not proceed with the improvement. , NE WRIGHT COUNTY TRANSPORTATION PLAN This plan, which will guide future transportation improvements for NE Wright County has been approved. WEST OTSEGO TRANSPORTATION PLAN This was completed and approved as part of the Comp Plan update. PARRISH AVENUE DIKE REVIEW City staff worked with Wright County and the Army Corp of Engineers on this item. Additional work is anticipated in the future. L COMPLETED PROJECTS . 2003 FINANCIAL PLAN The Financial Plan was completed and reviewed by the Council in late 2002. Staff will update this plan on a yearly basis and present it for review early each calendar year. PARK CAPITAL IMPROVEMENTS PLAN This plan was submitted last year and was the legal basis for raising the City's Park & Trail fees. OTSEGO CREEK CULVERTS Costs for these culverts were determined and an Otsego Creek Watershed Fund has been set up and will be updated yearly as part of the Financial Plan. WEST OTSEGO REGIONAL PARK SITES Council and Park Commissioners have reviewed several sites for major community parks. The concepts discussed for these parks can be refined further as part of the Park Plan update. OTSEGO CREEK STORMWATER PLAN Council has approved the Otsego Creek Stormwater Plan.
