10-25-04 CC-rIEM 5-11 MEMO TO: CITY COUNCIL I' FROM: BRAD BELAIR SUBJECT: REPLACEMENT OF 1981 FORD PLOW TRUCK DATE: 10/20/04 I have located a 1990 Ford L8000 Dump Truck equipped with front plow & wing sander, diesel engine and auto transmission. The truck was traded by the City of Oakdale to Boyer Ford and has 63000 miles. Don Mass inspected,the truck and feels it's in good condition. The price of the truck is $16,500.00 + tax and license. I would expect to invest another $2000.00 for clean up and servicing. A truck of this age and condition should serve the city for at least 5 years with minimal maintenance costs. I recommend the council approve the purchase of this truck and dispose of the 1981 Ford which has an estimated value of $2000-$5000.00. I will be at the October 25, Council Meeting to discuss the budget and finance options. MEMO TO: CITY COUNCIL FROM: BRAD BELAIR SUBJECT: WINTER DE-ICING SALT & SAND DATE: 10/20/04 In the past, the City of Otsego has purchased salt &:sand from Wright County and hauled the material to the maintenance garage as needed. For this winter 2004-05 we have already committed to purchasing salt from Wright County. In the future I recommend purchasing salt on the State contract and haver it delivered directly to Otsego. Salt & sand mix has also been purchased from Wright County in the past. I recommend we contract for the sand to be hauled directly to the maintenance garage for this year. The mixing will be done by the maintenance Staff and equipment. I have attached cost comparison for you to review. The best option would be to construct a covered building which would protect the materials from the weather and will eliminate the environmental concerns. I have attached a quote and plans for a pole structure. The low quote at this time is $34,500 and could be constructed in November. �I The second option is for a 30 x 30 poured wall storage bin where salt would be stored and covered with a tarp. Mr. Brad Pauman was present to represent his project along with his Professional Engineer, Mr. Scott Dahlke. The public hearing was well attended by residents from surrounding neighborhoods. Questions were raised about the impacts of the proposed development.to the Mississippi River, the effects and management of the proposed pond and beach area and extension of the trail along Kadler Avenue, includingthe design of the trail in front of the exception parcel. Staff responded to these questions and the developer added additional information, especially regarding the pond which will likely be downsized to ensure that excavation can be completed this year. City, Staff indicated that they will work with the exception parcel owner on the design and location of the trail along Kadler Avenue. The Planning Commission discussion also focused on the pond, its design and maintenance. The Planning Commission raised concerns that there be sedimentation ponds prior to draining into the recreational pond for long-term maintenance purposes. City Staff emphasized that the City would maintained only to the extent required for stormwater management and not aesthetics. Because of likely changes to the pond and the need to present site and building plans for the beach facilities, the Planning Commission is recommending that the final plat be submitted to them for review and recommendation prior to action by the City Council. The Planning Commission closed the public hearing. In four separate motions, the Planning Commission voted 6-0 to recommend approval of the CUP for mining, the rezoning to R -C District, the PUD-CUP/Preliminary Plat of Norin Landing and a CUP for a private recreation facility. These applications will be considered by the City Council at their meeting on 25 October 2004 at 6:30 PM. Decision 1 — CUP for Mining A. Motion to approve a CUP to allow mining in accordance with the Norin Landing Grading Plan subject to the following conditions: 1. All grading plans shall be subject to review;and approval of the City Engineer. 2. The subject site is guided for low-density residential land uses within the west sanitary sewer service district established by the Comprehensive Plan. The subject property is zoned R-6, Residential Townhouse, Quadraminium and Low Density Multiple Family District per a zoning amendment as a part of preliminary plat approval on 12 April 2004. The R-6 District allows for single family homes as a ,permitted use. Portions of the subject property are within'the Shoreland Overlay District of Otsego Creek. Exhibits: A. Site Location Map B. Although the Shoreland Overlay District is not shown on the revised preliminary plat, by measuring 300 feet out from the centerline of Otsego Creek, it is apparent that several lots are not complaint with the required 75 foot lot width for lots within a Shoreland Overlay District. The lots in question include Lots 9, 10, 16, 19 and 20,,Block 2 and Lots 8 and 17,', Block 1. The preliminary and final plats must be revised to meet applicable Shoreland District lot requirements. A landscape plan has been submitted showing the required two trees per lot. The decision to waive or not to waive the statutory limits has the following effects: If the city does not waive the statutory tort limits, an individual claimant would be able to recover no more than $300,000.on any claim to which the statutory tort limits apply. The total which all claimants would be able to recover for a single occurrence to which the statutory tort limits apply would be limited to $1,000,000. These, statutory tort limits would apply regardless of whether or not the city purchases the optional excess liability coverage. If the city waives the statutory tort limits and does not purchase excess liability coverage, a single claimant could potentially recover up to $1,000,000. on a single occurrence. The total which all claimants would be able to recover for a single occurrence to which the statutory tort limits apply would also be limited to $1,000,000., regardless of the number of claimants.
