The subject site is guided for low density residential land uses within the west sanitary sewer service district established by the Comprehensive Plan. The subject property is zoned R-6, Residential Townhouse, Quadraminium and Low Density Multiple Family District per a zoning amendment as a part of preliminary plat approval on 12 April 2004. The R- 6 District allows for single family homes as a permitted use. Portions of the subject property are within the Shoreland Overlay District of Otsego Creek. Exhibits: A. Site Location Map B. The preliminary plat has been revised to show 75 single family lots, down slightly from 77 lots approved with the preliminary plat. The reduced number of lots is due to changes to the plat required to minimize wetland impacts. The preliminary plat has been updated to show compliance with the 75 foot lot width requirement for the lots located within the Shoreland Overlay District. However, Lot 38, Block 2 and Lot 1, Block 3 do not have sufficient width to meet the required 65 foot setbacks for lots abutting 70th Street. The final plat must be revised such that the 65 foot setback from the right-of-way along 70th Street NE can be met. Access. The applicant must acquire easement for road night -of -way for construction of the continuation of Lambert Avenue and 'Street B' to 70th ,Street. The applicant has indicated that they have reached an agreement with the adjacent property owner. If the necessary right-of-way cannot be acquired, Lambert Avenue and Street "B" must be temporarily terminated after 500 feet with a cul-de-sac and proposed lots to the east platted as outlots. I Landscape Plan. A landscape plan has been submitted ;showing the required two trees per lot and the required residential buffer along 70th ,Street NE. However, the applicant should move the plantings currently proposed at the rear of Lots 13 and 14, Block 3 out of the right-of-way. The developer should also provide a single row of plantings along the rear of Lots 15-20, Block 3 recognizing that the existing trees will likely be taken out when 70th Street is expanded. An additional row of trees would ensure some level of protection for these homes when the street is widened. Park and Trail Dedication. No land is to be dedicated to the City for parks as part of the final plat. Park and trail dedication requirements are to be satisfied as a cash fee in lieu of land equal to $2,820 per dwelling unit — a total sum of $211,500. Grading and Drainage. Final grading, drainage and erosion control plans are subject to the review and approval of the City Engineer. Utilities. The utility plan is subject to the review and approval of the City Engineer. This final plat was included in the analysis of available sanitary sewer capacity outlined in the memorandum from our office dated 22 September.2004. As such, there is 401 RECs of sewer treatment capacity available for residential development if the final plat is approved. Development Contract. The applicant is required to enter into a development agreement with the City and pay all applicable fees and securities upon approval of a final plat. The development contract is subject to review and approval of the City Attorney. RECOMMENDATION The proposed Duerr Creek Final Plat is consistent with the approved preliminary plat, the Zoning and Subdivision Ordinances. Our office recommends approval of the requested final plat, subject to the conditions below: N A. Motion to approve the final plat for Duerr Creek subject to the following conditions: 1. All rights-of-way, street designs, street names, grading plans, utility plans, easements and construction documents shall be subject to review and approval of the City Engineer. 2. Tailwater shall not be considered when modeling the ponds. 4. The normal water elevation of the creek must be verified. It appears that some of the ponds have NWL's that are lower than the adjacent creek. 5. A Mannings value of 0.013 shall be used for all RCP pipe. 6. Please model the overflow structure grates for each pond with a structure. The front edge of the grate shall be at or above the 2 -year HWL. 7. No flow from Reach 35 is modeled. A permit from the Department of Natural Resources will be required for the proposed creek crossing. 2. It appears that there is an overhead electric utility;line along the east plat line that will have to be moved considering the proposed location of the east entrance road. We assume that there is an easement associated with the overhead electric utility line that will have to be vacated for the proposed development, assuming that the line is moved. 4. The final plat of Phase I was approved in December 2003 and the preliminary plat approval for Phase II was granted in March 2004. The subject site is guided for low-density and medium-high density residential land uses within the west sanitary sewer service district established by the Comprehensive Plan. The preliminary plat approval of Phase II included a Zoning Map amendment rezoning the subject site to R-6, Residential Quadraminium, Townhouse and Low -Density Multiple Family District and a PUD -CUP approval for development of townhouses and development within a Shoreland Overlay District. The proposed final plat; is the same number of lots and design for both single family and townhome units as the 'approved preliminary plat. Park and Trail Dedication. No land is proposed to be; dedicated to the City from the the 4th Addition Final Plat for parks and trails development. ANALYSIS Current Fee. The City's current park and trail fee in lieu of land for residential development is $2,860.00 per dwelling unit. The fee is based on the estimated cost of land acquisition ($1,600.00 per dwelling unit) and construction costs for development of new neighborhood park facilities ($530.00 per dwelling, per square mile) using data generated in 2003 and $690.00 per dwelling for future construction of a community center. No change in residential, commercial or industrial land prices from those cited in our office's 29 January 2004 memorandum has been observed by City Staff during 2004. As such, the land value component of the residential cash fee in lieu of land is not recommended to be changed. We also do not recommend changes to the commercial ($7,000.00 per acre) and industrial fee ($3,500.00 per acre) in lieu of land for the same reason. Construction Cost. The Engineering News -Record establishes a construction cost index that can be applied to project estimates over time to account for changes in labor and materials costs. Based on the year end construction cost index for 2003 and the construction cost index for October 2004, the cost per dwelling unit per square mile for development of a neighborhood park has increased frord'$530.00 to $579.00. Community Center. Research was also done in the 2003 analysis regarding the cost for construction of a community center similar to that built by Monticello, Maple Grove, Becker and Elk River. The assumed cost of a similar facility for Otsego was $14,800,000 based on that data. Under park and trail dedication requirements, the City may include that portion of the cost for a community center to be borne by new residents moving into.the community. The 2000 Census identifies Otsego as having 2,062 households. The City is projected to have a household count of 21,471 by 2040 based on a, growth rate of 400 to 600 new households per year. As such, the cost per household for the proposed community center would be $690.00, which may be added to the park and trail fee in lieu of land. The construction cost index must also be applied to the estimated cost of constructing a future community center to account for inflation. Again using the 2003 year end index and the October 2004 index, the cost per household for construction of a future community center should be increased from $690.00 to $753.00. CONCLUSION Our office recommends that the park and trail fee for residential subdivisions be amended to $2,932.00. The City Council may direct the Planning Commission to consider this issue at a public hearing in December such that the proposed increase is effective 1 January 2005. C. ZIP CODES They said that the criteria for anew zip code was both numbers, because there are only so many nine digit numbers in one zip code, and having more than 50 carrier routes in any one post office. They said that none of the post offices serving Otsego are anywhere close to these criteria. We also discussed whether the number of zip codes serving Otsego could be consolidated. They did indicate that the Dayton post office routes are run out of the Elk River post office so that they would take a look at whether that could be consolidated. We also discussed the problems we have been having when we put Otsego for the city name in the mail going through the Albertville, Monticello, Dayton, and Rogers postal districts. We said that we had not had a problems in the Elk River district. They said we should not be having any problems and seemed disturbed by the idea that,',we were. They offered to run some tests for us to see if mail to those districts was being delivered in the same manner as the other districts. They also said that sometimes the problem is with the -bulk mail companies rather than the post office. I've enclosed their email regarding this test. POST OFFICE The post office representatives stated that the post office is trying to move away from bricks and mortar facilities. They also mentioned the post office in Andover, which was the most recent new post office that they could remember. They said that post office was built because;Andover grew so much they carriers were driving 20; minutes from the post office before they could start their routes. As you are aware some of the ZIP Codes have a limited number of residents. If you would provide us with the names and addresses of five different Otsego residents, one for each Zip Code 55301, 55327, 55330, 55362, and 55374, we would be willing to set up a week long service test. We would contact these residents and inform them as to when to begin expecting the mail. Basically all they would have to do is write the date the on the mail piece indicating when it was delivered. We would also provide them an envelope or a box to return the mail. Some of the test pieces would likely be the more valuable electronic letters we mentioned. I am writing to inform you of the problems that we have had with the house the last few months. In the last several months, I personally have been to the house on 3 different occasions. The first was for a very large juvenile drinking party. A neighbor that could not sleep because of the large number of people making noise called us. That night there was a number of citations issued and the beer was confiscated. One of your tenants was given a stern verbal warning at this time. The second time this house was brought to my attention was when I caught 4 juvenile's walking from this house to their car that they parked 3 blocks away. That time three of the four were drinking and were issued citations. The third time was when a neighbor called because the tenants were having band practice at 1:30 am and woke them up. Again they tenants were given a verbal warning. Deputy Halverson advised me that he has handled noise complaints from this house on different occasions. I am unaware of the actions that he took them times. The last call we had was on 10-31-04 at 12:10 am. We were called because partygoers were jumping out in the middle of the road and being loud. When the first squad arrived there were well over 100 people there. He had to call in back up because the crowd was being loud and aggressive. Because so many people were..:there and being unruly we had to have 4 Deputies, 2 Sergeants, and 4 Reserves respond to take control of the situation. There were multiple arrests for underage drinking, disorderly conduct, drug paraphernalia, and the tenants were cited with having a loud party. The party was so out of control that it was almost a riot. One of your tenants continued to yell and scream even after we left the party at 2:00 am. It was a major strain on us'due to the fact that normally only one Deputy patrols Otsego at this time. This is not the extent of the problems that we are having with this house. Two weeks ago at a meeting with the Otsego Police Commission, this house was one of the main topics that were discussed. At the meeting I was advised that neighbors are having problems with this house on a weekly basis. I asked them to make reports of the incidents and they advised that they are too scared to because they are afraid of retaliation. They cited an incident were people came from that house and attempted to throw eggs at their house because they called in a complaint. Besides the criminal liabilities the tenants hold for continuing to have these loud beer parties they also may assume civil liabilities if someone is+injured as a result of the party. At the party on 10-31-04 there were dozens of cars there and out of the 100 or more people there we could only find three or four of them who' were sober enough to drive. I hope that you are able to assist us in ending the problems at this residence before someone gets hurt as a result of the drinking.
