No Yes, held by Planning Commission 21 April 2025 BACKGROUND/JUSTIFICATION: Summergate Development has submitted plans for the development of 172 single family lots on 71.87 acres located west of McAllister Avenue and north of 70th Street. The proposed development requires applications for a Zoning Map amendment, Planned Unit Development-Conditional Use Permit and preliminary plat, as well as vacation of existing public right-of-way for portions of Marlowe Avenue and 83rd Street. A public hearing to consider the applications was held by the Planning Commission at their meeting on 21 April 2025. Bryan Tucker of Summergate Development was present as the applicant and agreed with the recommendations of City staff. Property owners John Kolles and Mark Kolles were also present. Two residents spoke during the public hearing. Questions were asked regarding potential wetland impacts and the process for removal of the temporary cul-de-sacs in Martin Farms. City staff addressed these questions. Hearing no other questions or comments, the public hearing was closed. The Planning Commission discussed the planned improvement of McAllister Avenue, the phasing plan for final platting, and the park greenway corridor. No significant questions or concerns regarding the proposed preliminary plat were raised by the Planning Commission. The Planning Commission voted 7-0 to recommend the City Council approve the applications. The subject property is currently zoned A-1, Agriculture Rural Service District and is also within the Shoreland Overlay District of a Natural Environment lake within the City owned property to the north. The developer requesting a Zoning Map amendment to rezone the preliminary plat to R-5, Single and Two Family Residential District. The application also includes 2 a request for a Planned Unit Development-Conditional Use Permit related to lot standards within the Shoreland Overlay District and the recommendations of the 2023 Comprehensive Plan. Consideration of the Zoning Map amendment and Planned Unit Development-Conditional Use Permit is to be based upon, but not limited to, the criteria established by Section 11-3-2.F and Section 11-4-2.F of the Zoning Ordinance, respectively: 1. The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Comment: The Future Land Use Plan of the 2023 Comprehensive Plan guides the subject site for low density residential uses, which is as single family development with a net density of 3.0 dwelling units per acre or less. The subject site is 71.87 acres in area with a net area less wetlands and wetland buffers of 64.63 acres. The net density of the proposed preliminary plat is 2.66 dwelling units per acre. The proposed preliminary plat provides for a range of single family lot widths to encourage diversity in single family housing within the subdivision and overall housing supply within the City. The proposed development is consistent with the policies of the 2023 Comprehensive Plan. 2. The proposed use's compatibility with present and future land uses of the area. Comment: The subject property includes three parcels, one of which is developed with a farmstead. The existing buildings are all to remain as an exception parcel with the development of the balance property. The subject property is surrounded by the existing and planned uses shown in the table below, all of which are guided by the 2023 Comprehensive Plan for low density residential land uses. The proposed preliminary plat will be consistent with the character of the area and compatible with existing and planned surrounding land uses. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. Comment: The proposed preliminary plat will comply with the provisions of the Zoning Ordinance, Subdivision Ordinance, and Engineering Manual. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. 3 Comment: The subject property is to accessed primarily from 70th Street (CSAH 38) via McAllister Avenue, which is to be improved to minor collector street standards. Secondary access will occur at three local street connections planned to be extended from Martin Farms. The streets accessing the proposed preliminary plat have adequate capacity to accommodate traffic generated by the development. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Comment: The proposed preliminary plat is within the West Sewer District and the City has in-place utilities and services planned for as part of the 2023 Comprehensive Plan. The proposed development will not overburden the City’s service capacity. McAllister Avenue. The primary access to the proposed preliminary plat is to be from 70th Street (CSAH 38) via McAllister Avenue. McAllister Avenue is an existing gravel roadway with ditches on either side within a prescriptive 66 foot wide easement. The Transportation Plan designates McAllister Avenue as a Minor Collector street. Minor Collector streets serve to gather traffic from adjacent neighborhoods and carry it to Major Collector or Arterial streets such as 70th Street (CSAH 38). As a condition of preliminary plat approval, the developer will be required to acquire and dedicate 40 feet of right-of-way for the west half of McAllister Avenue from 70th Street (CSAH 38) north to the proposed 73rd Street intersection. The developer will construct a 24 foot wide street with a six foot curb as well as boulevard and 10 foot wide trail on the west side of the improved street. The shoulder and boulevard beyond the northbound travel lane will remain a rural design until the abutting property to the east is subdivided. 4 Local Streets. The layout for local streets internal to the proposed the preliminary plat are logically related to the topography and surrounding physical barriers so as to result in usable lots, reasonable grades, and to discourage through traffic. Local streets will be public and designed with 60 foot rights-of-way as required by Section 10-8-5.B.1 of the Subdivision Ordinance and a 28 foot wide section with five foot sidewalk on one side of through streets. Connections are made to existing temporary cul-de-sacs abutting the subject property within the Martin Farms plat to the west at 71st Street, 72nd Street, 73rd Street, and 76th Street. The developer is required to remove the three temporary cul-de-sacs and restore yards and driveways within the right-of-way and temporary cul-de-sac easement. There is one cul-de-sac street within the preliminary plat at the northwest corner that is necessitated by wetlands within a City owned outlot to the west. The need for the cul-de-sac as part of the subdivision design satisfies the criteria established by Section 11-8-5.C.1 of the Subdivision Ordinance. The proposed cul-de-sac street further complies with the design standards of Section 11-8-5.C.2 of the Subdivision Ordinance for the minimum/maximum depth and required turnaround dimensions. Section 8-8-4 of the City Code specifies installation of street lighting for new subdivisions at the corners of intersecting streets, midblock locations for blocks longer than 900 feet, and the terminus ends of cul-de-sac streets. The number and location of proposed street lights and street signs is to be subject to review and approval of the City Engineer. All street design and construction plans, lighting, and signs are subject to review and approval of the City Engineer. Street names are to be assigned in accordance with the Wright County grid system and Section 10-8-5.B.13 of the Subdivision Ordinance, subject to review and approval of City staff. Blocks. Section 10-8-3.A of the Subdivision Ordinance establishes that blocks within a subdivision are to be a minimum of 300 feet and not more than 1,200 feet in length. The blocks within the preliminary plat comply with these requirements, except Blocks 5 and 6 on the west side of Street 6 between 73rd Street and 76th Street due to wetlands and the design of the Martin Farms plat, which justifies the additional length. Lot Requirements. Section 11-66-6.A of the Zoning Ordinance requires single family lots within the R-5 District to be a minimum of 9,000 square feet in area and 60 feet (90 feet for corner lots) in width. The 2023 Comprehensive Plan encourages development of a range of lot area and widths within a single subdivision to provide for diversity in single family housing options. The developer is requesting approval of a Planned Unit Development-Conditional Use Permit to allow both 55 foot wide and 65 foot wide single family lots. The preliminary plat includes 106 lots that are a minimum of 65 feet wide and 66 lots that are a minimum of 55 feet in width. 5 Consistent with the recommendations of the 2023 Comprehensive Plan, the 9,260 square foot mean lot area and 9,568 square foot median lot area for the single family lots within the preliminary plat exceed the minimum area requirement of the R-5 District. The proposed minimum lot widths of lot fronting a cul-de-sac turnaround are increased 25 percent as required by Section 10-8-5.C.1.c of the Subdivision Ordinance to allow driveway spacing and provide area for snow storage. Corner lots are also increased in width to allow for the same building envelope in consideration of the increased setback requirement for the side yard abutting the public right-of-way. Shoreland Overlay District. Areas of the preliminary plat are also within the Shoreland Overlay District of a Natural Environment lake and subject to lot requirements established by Section 11-92-8 of the Zoning Ordinance. The lot area and widths proposed by the developer within the preliminary plat must comply with the density limits of the Shoreland Overlay District determined through completion of a suitable analysis as outlined by Section 11-92-17.D of the Zoning Ordinance. The analysis as shown on the preliminary plat calculates the maximum allowed density for the net area (less the waterbody and wetlands) of the preliminary plat within the Shoreland Overlay District, which overlays land within 1,000 feet of the Ordinary High Water Level (OHWL) of the Natural Environment lake. The proposed number of lots within the Shoreland Overlay District complies with the provisions of the Zoning Ordinance. Setbacks. The table below specifies the principal building setback requirements of the R-5 District as provided for in Section 11-66-6.C of the Zoning Ordinance and the wetland setback established by Section 11-16-5.F.4.b of the Zoning Ordinance. The setbacks shown on the preliminary plat comply with the minimum requirements of the Zoning Ordinance. ROW Interior Side Interior Rear Wetland Buffer 25ft. house 30ft. garage 7ft. 20ft. 20ft. Landscaping. Section 11-19-2.B.2 of the Zoning Ordinance requires that two shade trees be provided for each lot, one of which must be in the front yard, at the time of house construction. The trees required in the front yard required to be planted be outside of the public right-of- way. Grading. The developer has submitted plans for grading, drainage, and erosion control plans for development of the preliminary plat. The developer has also submitted a wetland delineation and wetland impact plan for the proposed preliminary plat. All grading, drainage, wetland impacts, and erosion control issues are subject to review and approval of the City Engineer. 6 Wetlands to be preserved are required by Section 11-16-5.F of the Zoning Ordinance to be protected by a 20 foot buffer with the wetland and wetland buffer platted within an outlot deeded to the City. The developer will be required to pay a Stormwater Impact Fee for Otsego Creek at the time of final plat approval. Utilities. The subject site is within the West Sewer District with sewer and water utilities available at the west plat line. The developer has submitted plans for extension of sanitary sewer and water utilities for the preliminary plat to serve the proposed lots within the preliminary plat. The City is in the process of expanding the water utility system to include water treatment. This improvement involves future construction of a Water Treatment Plant to be located at the southeast corner of 70th Street (CSAH 38) and McAllister Avenue adjacent to Watertower #4. The City will extend raw water pipes from existing wells to the Water Treatment Plant. There is a well within the City owned outlot to the west of the subject property and a raw water pipe is to be extended through the plat to McAllister Avenue and south to 70th Street (CSAH 38). The installation of the raw water pipe will require the preliminary plat be revised to provide a utility corridor within Block 2 between Outlot A and Street 9. The developer construct the trunk raw water main with development of the plat and l be credited for the costs incurred. All utility plans are subject to review and approval of the City Engineer. Payment of utility availability charges are due at the time of final plat approval and payment of utility connection charges are due at the time a building permit is issued for each lot in accordance with Title 6, Section 1 of the City Code. Easements. Section 10-18-12.A of the Subdivision Ordinance requires 10 foot drainage and utility easements at the perimeter of all lots (overlying side lot lines), as well as over any stormwater management facilities, wetlands, and wetland buffers not platted within outlots deeded to the City. The preliminary plat provides for dedication of required easements, which are to be subject to review and approval of the City Engineer. Outlots. The preliminary plat includes six outlots that encompass wetlands, wetland buffers, and stormwater basins. All of the outlots except Outlot G are to be deeded to the City for stormwater management purposes. Outlot G is to be retained by the property owner. The preliminary plat includes a sketch plan illustrating how Outlot G (and the rural exception parcel) can be subdivided in the future meeting the requirements of the Zoning Ordinance and Subdivision Ordinance. This sketch plan protects the land owner to ensure that the subdivision being considered now does not create difficulty for extension of streets and utilities in the future but does not constitute subdivision approval. 7 Park Dedication. Section 10-8-15.A of the Subdivision Ordinance requires subdividers to dedicate a reasonable portion of the buildable land within a proposed preliminary plat for public use as parks or open space. The City may also choose to accept an equivalent amount in cash for part or all of the land required to be dedicated. The Parks System Master Plan identifies establishment of a greenway corridor along Otsego Creek and around the Natural Environment lake to the north of the subject property. The City will acquire an additional corridor beyond the wetland and wetland buffer of the Natural Environment Lake to accommodate expansion of the greenway corridor. The area to be acquired by the City for the greenway corridor will need to be extended to the east of PID 118- 500-301300 consistent with the conditions of a Conditional Use Permit and Administrative Subdivision approval for that property completed in 2021. Beyond dedication of the land determined necessary by the City for the greenway corridor, the developer will satisfy the balance of the required park dedication requirement by payment of proportional cash fee in lieu of land. These funds are to be used by the City in acquiring land and/or developing the park system as provided for by Section 11-18-15.M of the Subdivision Ordinance. The City will evaluate the need to extend a trail as part of the greenway corridor from Marquette Avenue east to connect to the preliminary plat prior to application for final plat approval and whether the developer will be requested to complete the trail construction for a credit to park dedication fees paid in lieu of land. RECOMMENDATION The proposed Amber Meadows preliminary plat is consistent with the goals and policies of the 2023 Comprehensive Plan and complies with the requirements of the Zoning Ordinance and Subdivision Ordinance. City staff recommends approval of applications as stated on the findings of fact and decision presented for City Council consideration. c. CITY COUNCIL MEETING: 28 April 2025 FINDINGS: Based upon review of the application and evidence received, the Otsego City Council now makes the following findings of fact: A. The legal description of the property is: The Southwest Quarter of the Northeast Quarter of Section 30, Township 121, Range 23, Except the East 550.00 feet of the South 870.98 feet, thereof, as measured at right angles to the south and east line, Wright County, Minnesota. Abstract Property And The North Three-Quarters of the West Half of the Southeast Quarter, Section 30, Township 121, Range 23, Wright County, Minnesota. Abstract Property B. The property lies within the West Sewer District and is guided for Low Density Residential land uses by the 2023 Otsego Comprehensive Plan, as amended. C. The property is zoned A-1, Agriculture Rural Service District. D. The applicant has requested amendment of the Zoning Map rezoning the property to R-5, Residential Single and Two Family District. E. The Planning Commission and City Council must take into consideration the possible effects of the request with their judgment based upon (but not limited to) the criteria outlined in Section 11-3-2.F of the Zoning Ordinance: 2 1. The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Finding: The Future Land Use Plan of the 2023 Comprehensive Plan guides the subject site for low density residential uses, which is as single family development with a net density of 3.0 dwelling units per acre or less. The subject site is 71.87 acres in area with a net area less wetlands and wetland buffers of 64.63 acres. The net density of the proposed preliminary plat is 2.66 dwelling units per acre. The proposed preliminary plat provides for a range of single family lot widths to encourage diversity in single family housing within the subdivision and overall housing supply within the City. The proposed development is consistent with the policies of the 2023 Comprehensive Plan. 2. The proposed use's compatibility with present and future land uses of the area. Finding: The subject property includes three parcels, one of which is developed with a farmstead. The existing buildings are all to remain as an exception parcel with the development of the balance property. The subject property is surrounded by the existing and planned uses shown in the table below, all of which are guided by the 2023 Comprehensive Plan for low density residential land uses. The proposed preliminary plat will be consistent with the character of the area and compatible with existing and planned surrounding land uses. Traffic generation of the proposed use in relation to capabilities of streets serving the property. Finding: The subject property is to accessed primarily from 70th Street (CSAH 38) via McAllister Avenue, which is to be improved to minor collector street standards. Secondary access will occur at three local street connections planned to be extended from Martin Farms. The streets accessing the proposed preliminary plat have adequate capacity to accommodate traffic generated by the development. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Finding: The proposed preliminary plat is within the West Sewer District and the City has in- place utilities and services planned for as part of the 2023 Comprehensive Plan. The proposed development will not overburden the City’s service capacity. 3 F. The Otsego Planning Commission conducted a public hearing at their regular meeting on 21 April 2025 to consider the application, preceded by published and mailed notice; based upon review of the application and evidence received, the public hearing was closed; and the Planning Commission recommended by a 7-0 vote that the City Council approve the request based on the aforementioned findings. G. The planning report dated 22 April 2025 prepared by the City Planner, The Planning Company LLC, is incorporated herein. Approval of the preliminary plat shall not guarantee access to sanitary sewer service. The City shall only allocate sanitary sewer capacity to approved final plats with signed development contracts to assure the City of timely development. 2. All street design and construction plans, street lighting, sidewalks, trails, and street names shall be subject to review and approval of the City Engineer. 3. The developer shall acquire and dedicate 40 feet of right-of-way for the west half of McAllister Avenue from 70th Street (CSAH 38) north to the proposed 73rd Street intersection and improve the street to a minor collector section as determined by the City Engineer; the developer shall be responsible for the cost of easement acquisition and construction for McAllister Avenue. 4. The preliminary plat shall be revised to include Shoreland Density Analysis as and comply with the maximum Shoreland Overlay District density in accordance with Section 11-92-17.E.1 of the Zoning Ordinance, subject to review and approval of the Zoning Administrator. 5. All lots within the preliminary plat shall comply with the following setbacks: ROW Interior Side Interior Rear Wetland Buffer 25ft. house 30ft. garage 7ft. 20ft. 40ft. 6. The landscape plan shall be revised to specify planting only of two shade trees per lot, one of which must be in the front yard, outside of the public right-of-way. 7. All grading, drainage, wetland impacts, and erosion control issues shall be subject to review and approval of the City Engineer. 8. The developer shall pay a Stormwater Impact Fee for Otsego Creek at the time of final plat approval. 9. The preliminary plat shall be revised to provide a utility corridor within Block 2 between Outlot A and Street 9 for location of a trunk raw water main, subject to review and approval of the City Engineer. 10. The utility plans shall be revised to provide for construction of trunk raw water main in accordance with the Water System Master Plan, subject to review and approval of the City Engineer; the developer will receive financial credit for the cost of construction. 11. All drainage and utility easements shall be subject to review and approval of the City Engineer. 4 12. Outlot A, B, C, D, E and F shall be deeded to the City for stormwater management purposes. 13. Park dedication requirements shall be satisfied concurrent with final plat approval as: a. Dedication of land for a greenway corridor between Outlot K, Martin Farms and the east line of 118-500-301300. b. Payment of a proportional cash fee in lieu of land for the remainder of the park dedication requirement not satisfied by dedication of land. c. The developer may receive a credit against the cash fee in lieu of land for park trail construction, as determined by City staff prior to application final plat.
