ANALYSIS The Firearms Ordinance was adopted in 1995 and has been interpreted and enforced to include archery equipment within the definition of firearms subject to the regulations. Furthermore, the listing of permitted discharges within the No Discharge Zone specifically references bow/arrow target practice and archery hunting by administrative permit in Sections 5-2-3.1 and L, respectively. Use of archery equipment may also be allowed as part of a special hunting season approved by the City Council as provided for by Section 5-2-3.J of the City Code. In order to provide further clarity as to the intent of the Firearms Ordinance, City staff is recommending the following amendment of the definition of a "firearm" to include specific reference to archery equipment, which is separately defined in Section 5-2-2 of the City Code: Firearm: Any device from which may be fired or ejected, one (1) or more solid projectiles by means of a cartridge or shell or by the action of an explosive substance; or for which the propelling force is a spring, elastic band, carbon dioxide, air or other gas or vapor and including archery equipment. So as to limit the potential liability of the City for these costs, City staff was directed to prepare an ordinance that would enable these costs to be passed through to the property. Exhibits: A. Draft Ordinance Amendment B. Ordinance 2011 — 05 ANALYSIS Fire/FOG Inspections. The Department of Building Safety has completed fire inspections for businesses and institutions outside of the Albertville Fire District. The Albertville Fire Department is initiating fire inspections within its service district. The Department of Building Safety is finding that most of the inspections are being completed within one hour and that only minor issues are being found. The City has received three complaints that the fire inspections are unnecessary and that the costs are either unjustified or an unnecessary burden to the commercial property owners. Fire protection is not a service funded by property taxes within Otsego but is paid on a per parcel basis. A commercial property such as a large retail store, warehouse or restaurant pays the same for fire service protection as does a single family home. As such, the intent of the Fire Ordinance inspections is to minimize potential risk of fire at these larger commercial, industrial and institutional buildings to protect life and property and minimize fire protection costs with the expense of the inspection program passed through to the individual users. The Fire Inspection Ordinance was originally established with a fee of $150.00 for the first inspection and $75.00 for any reinsertion based on the recommendation of the City Building Official at the time. Metro West Inspections has assumed responsibility for the inspection program outside of the Albertville Fire District as the current building official and is billing the City an hourly rate for its services. The Administrative Subcommittee discussed the issue and recommended City staff draft an amendment to the fee schedule establishing an hourly rate of $50.00 hour for fire inspections with a minimum one hour charge for the cost of the fire inspection and administration by the Department of Building Safety. If approved, the City Council must provide direction as to whether those properties that have already paid the inspection fee should be refunded based on the revised schedule. The City also adopted an ordinance requiring inspection of Fats, Oils Grease interceptor/separators for commercial properties. As these inspections are being done in coordination with the Fire Inspections, the Administrative Subcommittee recommended that the FOG Inspection Fee be included in the revised Fire Inspection Fee. False Alarm Charges. The Fire Service Agreement between the City of Otsego and City of Elk River requires Otsego pay Elk River for any false alarm calls based on the Elk River Fee Schedule. Elk River's schedule is different than Otsego's in that the fee for the fourth false alarm within a calendar year is $200.00 versus $150.00 in Otsego. Also, Elk River adds $50.00 to the base $200.00 fee for the fifth and each successive false alarm within a calendar year. City staff recommends revising the Otsego fee schedule to reflect the charges imposed by Elk River. City staff also recommends revising the false alarm charges for non -fire calls to change the number of allowed false alarms from four to three before a fee is charged to be consistent. Fire Service Charges. The contacts between Otsego and it's various Fire Departments serving the City include provisions that would require Otsego to reimburse the fire departments for costs incurred through Mutual Aid. City staff has drafted an amendment to Chapter 5, Section 6 of the City Code to enable costs incurred for fire services in response to specific calls be passed through to the property owner. At this time, the proposed ordinance would pass through only mutual aid expenses with all other costs assumed to be part of the City's basic fire protection services funded by the flat per parcel fee. The specific schedule of fees would allow for separation of pass through costs on the basis of property type on the assumption that agriculture, residential and vacant properties would be less likely to incur significant charges compared to commercial, industrial or institutional properties. The current proposal is that all properties would be responsible for any mutual aid costs incurred by the City. The proposed ordinance also includes provisions by which a property owner may appeal incurred charges for fire services and gives the City Council discretion to consider relief. 2 RECOMMENDATION City staff recommends approval of Ordinance 2011-05 as presented. Any deployment of fire fighting personnel and/or equipment to extinguish a fire or perform any preventative measure in an effort to protect equipment, life, or property in an area threatened by fire and also including the deployment of fire fighting personnel and/or equipment to provide fire suppression, rescue, extrication, or any other services related to fire and rescue as may occasionally occur; deployment as defined herein constitutes fire service regardless of whether these services are actually performed. Randolph Avenue and a small stretch of 65th Street were removed from the MSA Needs in order to use the mileage from these routes to add or revise several other routes. The portion of 70th Street from future Nashua Avenue to CSAH 37 was added to the MSA Needs so that if the City decides to fill the gap and connect the existing 70th Street near Marlowe Avenue to CSAH 37, the entire project would be eligible for State Aid funding. The alignment of Naber/Nashua Avenue was discussed and revised by both Otsego and St. Michael to work with the planned Naber Avenue Intersection. 60th Street from Jaber Avenue to Jason Avenue in the southwest corner of the city is shared with the City of St. Michael and was added per their request. They potentially would like to improve this road in the near future. Since it is a shared road both the City of Otsego and the City of St. Michael must include this road in their MSA Needs to make it eligible for State Aid assistance. Even though the unused MSA Needs mileage increases from 0.06 miles to 0.15 miles we believe the routes selected are more beneficial to the City. Randolph Avenue has been, and will most likely be, constructed by developers when the need to extend it arises whereas the new routes will most likely be constructed by the City. In monetary terms the actually dollar amount collected may actually increase since some of the mileage was moved from a completely improved (i.e. paved with curb and storm sewer) to either non -existing routes or existing gravel roads, both would collect more money than a fully improved road. City staff understands from talking with Otsego Hospital District Board of Directors member Rob VanDenBerg that several options are under consideration including two that would create a 501 3C (non-profit) corporation: ■ The district can remain and "sell" to an existing 501c3 (North, Allina, Fairview), and lease the property. This option could include a condition of the sale be to pay off the outstanding $25M debt of the Hospital District . ■ The Hospital District can remain and allow the existing hospital management to create a new 501c3, and lease the state hospital license and hospital property and facilities. A decision regarding the legal status of the Hospital District rests with it's Board of Directors. Mr. VanDenBerg indicates that there is no "deadline" for a decision regarding the Hospital District's legal status. Silver Creek Township has scheduled an information meeting for 1 March 2011 at 7:OOPM and invited representatives of the Hospital District Board of Directors, communities and public to attend. Attendance at this meeting would provide Otsego the opportunity to update the other member communities regarding its' special legislation efforts and solicit support as a dual track to the legal status review of the Hospital Districts. RECOMMENDATION City staff requests approval to attend the March 1 information meeting at Silver Creek Township. POSSIBLE ACTIONS A. New River Medical Center (formally known as Monticello -Big Lake Community Hospital) is considering three (3) options in regards to a change in its legal structure and ownership as follows: 1. To remain in the same legal structure (no change). 2. To sell the hospital to a larger hospital system (such as Centracare, Allina, or Sanford Health). This would be a complete change in ownership. 3. Setting up a separate legal hospital entity (not-for-profit referred to as a 501-c- 3). This entity would in essence lease the current Hospital from the Hospital District. As a taxing, government entity, the Hospital District would become the landlord to the new Hospital entity. The Hospital District would be releasing the control of the operations but the current debt of $25 million and the taxing authority of the Hospital District would remain in place (with the landlord being the taxpayers of the District). At the present time we are informed that July 1, 2011 will be the time to end discussions and make a decision as to the Hospital's future. At the same time, the Hospital Management (many of whom are not residents or taxpayers of the Hospital District) is stating that the decision will be made by the Hospital District Board. As residents and taxpayers who have supported the Hospital through property taxes, we are being told that we will have no voice in the final decision process (not even an opportunity to vote). If the Hospital establishes a :new ;legal structure, we will depend �on a new organization to operate the Hospital, while our citizens will continue to be taxed and will be financially liable for its debt (currently at $25 million), with no control over it's operations. As residents and taxpayers of the Hospital District, we feel that it is imperative that we have the opportunity to not only meet with the Hospital District Board, but to express our concerns and to inform them that this is a serious issue that should be decided by a full vote of the residents and taxpayers of the Hospital District. Due to the short time frame and the seriousness of this issue we suggest that a group consisting of the Hospital District Board of Directors meet with representatives from the City and Township Boards of Monticello, Monticello Township, Big Lake, Big Lake Township, Ostego, Becker Township and Silver Creek Township, as well as concerned citizens from each of the Cities and Townships. Our suggestion is to hold such an event at one of the Community Centers as we are sure this event would be of great concern to many people. We will be holding an informational meeting at Silver Creek Township Hall on March 1, 2011 at 7:00 p.m. and ask that at least one representative from each City or Township Board attends before the individual Annual Meetings held on March 8, 2011, to inform your citizens of this issue. The bylaws of the HPC establish the commission with five members. Ms. Issacson's resignation leaves the HPC with four members. At the 2010 Otsego Festival, the HPC received names from several individuals that may be interested in joining the commission. The process would be for any potential applicants to interview with the HPC with a recommendation to the City Council. RECOMMENDATION City staff recommends that the City Council accept Ms. Issacson's resignation and authorize City staff to advertise the opening to solicit potential new member(s). POSSIBLE ACTIONS A.
