Daniel Licht REPORT DATE: 27 August 2025 120-DAY DATE: 16 December 2025 RE: Otsego – Stillwild; Conditional Use Permit/Preliminary Plat TPC FILE: 101.02 BACKGROUND Thomas and Ashley Smith acquired the 30.90 acre property at the terminus end of Kalland Avenue, south of 95th Street (CSAH 39) on 12 December 2024. The property owners have submitted a preliminary plat to subdivide the property into three lots. The proposed subdivision requires consideration of a Zoning Map amendment rezoning the property from A- 1, Agriculture Rural Service District to A-2, Long Range Urban Service District and a Conditional Use Permit to allow lots within the plat to be less than 20 acres in area and 450 feet in width. A public hearing to consider the applications has been noticed for the Planning Commission meeting on 15 September 2025 at 7:00PM. Exhibits: Site Location Map Preliminary Plat dated 08/01/2025 (2 sheets) Preliminary Plans dated 08/01/2025 (14 sheets) ANALYSIS Zoning. The subdividers have requested a Zoning Map amendment to change the zoning classification of the subject property from A-1 District to A-2 District to enable additional development rights allowed by the 2023 Comprehensive Plan. The Planning Commission and City Council evaluate such requests based on the criteria outlined in Section 11-3-2.F of the Zoning Ordinance: Item 3.2 2 1. The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Comment: The 2023 Comprehensive Plan establishes a limited density of one dwelling unit per 10 acres allowance intended to provide opportunities for rural character development in areas not planned for sewer and water utilities. The subject property is allowed three development rights based on its area of 30.90 acres. A deed restriction will be required to be recorded with each proposed lot to prohibit further subdivision until allowed in accordance with the Comprehensive Plan and Zoning Ordinance. 2. The proposed use’s compatibility with present and future land uses of the area. Comment: The subject property abuts rural residential lots to the north, the Riverwood National Golf Course and subdivision to the west, and large agricultural parcels to the east and south. The proposed subdivision is consistent with the character of the area and will provide for compatible land uses. 3. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. Comment: The proposed preliminary plat will conform to all applicable requirements of the Zoning Ordinance, Subdivision Ordinance, and Engineer Manual. 5. Traffic generation by the proposed use in relation to the capabilities of streets serving the property. Comment: The subject property is accessed from Kalland Avenue via 95th Street (CSAH 39), which is designated by the Comprehensive Plan as a minor arterial roadway. There is capacity on 95th Street (CSAH 39) to accommodate additional traffic created by the proposed subdivision and construction of three single family dwellings. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Comment: The proposed subdivision is within the scope of development guided by the 2023 Comprehensive Plan and will not have a negative impact to the City’s service capacity. Lot Requirements. Lots within the A-2 District must have a minimum area of 20 acres and minimum width of 450 feet. Section 11-52-5.H of the Zoning Ordinance allows for the creation of lots less than 20 acres in area and/or less than 450 feet in width within the A-2 District by Conditional Use Permit based on compliance with the following criteria: 3 1. All other applicable requirements of Section 11-52-6 of this Chapter are complied with. 2. A concept plan utilizing all development rights allowed by Section 11-52- 6.B of this Chapter is submitted and recorded with the subdivision. 3. Lots are to be clustered and the overall subdivision designed in such a manner so as to provide for logical future street and utility extensions. 4. No lot shall be less than one (1) acre in size or 150 feet in width. 5. The maximum lot size for clustered lots in the Urban Service Reserve Area shall be two and one-half (2.5) acres except if one of the following conditions is met: a. Topography, soils, wetlands, or other natural features dictate a larger minimum lot area. b. The location of existing buildings cannot be fully accommodated in compliance with applicable setback requirements of Section 20- 52-6.C of this Chapter. c. One (1) development right as allowed by Section 11-52-6.B of this Chapter is used for a dwelling located on the present parcel outside of the residential cluster. 6. A resubdivision plan for future division of each lot with availability of municipal sanitary sewer service is submitted and recorded on the deed for each lot. Principal and accessory buildings shall be located on each lot in conformance with all present and future setback requirements based on the resubdivision plan. 7. A deed restriction is placed on the parcel exercising development rights and all subdivided lots to prohibit additional subdivision unless is conforms to applicable zoning district requirements. 8. Each lot is capable of accommodating a private well and septic system. The proposed lots range in area from 3.78 acres to 21.30 acres in area. All three lots comply with the minimum 150 foot width requirement. 4 Lots 1 and 2, Block 1 are more than 2.5 acres in area and less than 10 acres in area due to the depth of the existing parcels to the north, the location at which Kalland Avenue terminates at the north line of the subject property, and extensive wetlands and topography changes within the subject property. The area of Lots 1 and 2, Block 1 satisfy the intent of the conditions for allowing lots between 2.5 acres and 10.0 acres in area. The preliminary plat illustrates the potential for extension of future public streets from the terminus end of Kalland Avenue to the east and south plat lines. The potential rights-of-way are entirely within the boundaries of Lot 3, Block 1. Dedication of right-of-way and construction of public streets would only be expected to occur if 1) sewer and water utilities are available at the east or south plat lines and 2) the owner of Lot 3, Block 1 chooses to subdivide. Setbacks. The table below provides the required setbacks applicable to the proposed preliminary plat established in Section 11-52-6.C of the Zoning Ordinance. The setbacks are illustrated on the preliminary plat with potential principal building locations identified to comply with the minimum setbacks required by the Zoning Ordinance. Kalland Ave. Side Rear Wetland 65ft. 35ft. 10ft. 40 ft. 20ft. 35ft. 10ft. 10ft. Kalland Avenue. Access to the subject property is from 95th Street (CSAH 39) via Kalland Avenue, which terminates at the north plat line. Kalland Avenue is a rural section gravel roadway that dead-ends approximately 2,100 feet south of 95th Street (CSAH 39). The cul-de- sac at the end of Kalland Avenue does not comply with the diameter and its existing length exceeds the 500 foot limit for permanent cul-de-sacs required by Section 10-8-5.C of the Subdivision Ordinance. The proposed subdivision involves extension of Kalland Avenue approximately 230 feet and construction of a properly dimensioned cul-de-sac to provide access to the proposed lots. The new section and cul-de-sac of Kalland Avenue will remain a rural section with gravel surface consistent with the existing roadway. The preliminary plat illustrates potential future subdivision of Lot 3, Block 1 to allow removal of the cul-de-sac to provide for through streets. Section 8-8-4 of the City Code specifies installation of street lighting for new subdivisions at the corners of intersecting streets, midblock locations for blocks longer than 900, and the terminus of cul-de-sac streets. A street light will be required to be installed at the terminus end of Kalland Avenue subject to review and approval of the City Engineer. Construction plans for Kalland Avenue are to be subject to review and approval of the City Engineer. 5 Landscaping. Section 11-19-2.B of the Zoning Ordinance requires installation of two shade trees per lot. The builder for the house on each lot will install the required landscaping. A security for the landscaping will be collected at the time of building permit for each lot. Utilities. The subject property is within Urban Service Expansion Area W2. Sewer and water utilities are not available to this area. The proposed lots are to be served by individual on-site septic systems and wells. The preliminary plat identifies a primary and secondary septic drain field site for each of the proposed lots. The on-site utilities will subject to review and approval by the Building Official at time a building permit is requested. Stormwater. The subdivider has submitted grading and drainage plan and stormwater calculations for the proposed preliminary plat and final plat. Wetlands within the property are to be protected by drainage and utility easements that include the 20 foot buffer zone required by Section 11-16-5.F of the Zoning Ordinance. All grading, drainage, and erosion control plans are subject to review and approval by the City Engineer. Easements. Section 10-8-12 of the Subdivision Ordinance requires 10 foot wide drainage and utility easements at the perimeter of the proposed lot. As noted above, drainage and utility easements are also to be dedicated over required stormwater basins, wetlands, and wetland buffers. All easements are to be subject to review and approval by the City Engineer. Park and Trail Dedication. The proposed subdivision is subject to park dedication requirements outlined in Section 10-8-15 of the Subdivision Ordinance. The Parks System Master Plan does not identify acquisition of land from the subject property for City parks. City staff recommends that park dedication requirements for proposed the subdivision be satisfied by payment of a cash fee in lieu of land. Development Contact. Section 10-10-4.A of the Subdivision Ordinance requires that the developer enter into a development contract with the City to provide for construction of public improvements, establishment of required securities, and payment of applicable fees. The development contract will be drafted by the City Attorney for approval by resolution of the City Council. RECOMMENDATION The proposed Stillwild preliminary plat is consistent with the policies of the Comprehensive Plan and complies with the Zoning Ordinance and Subdivision Ordinance. City staff recommends approval of the applications as set forth below. 6 POSSIBLE ACTIONS A. Motion to recommend approval of a Zoning Map amendment, Conditional Use Permit, and preliminary plat for Stillwild, subject to the following conditions: 1. A deed restriction shall be recorded with each lot prohibiting further subdivision except as allowed by the Comprehensive Plan and Zoning Ordinance. 2. Development of Lots 1-3, Block 1 shall be subject to the following setback requirements: Kalland Ave. Side Rear Wetland 65ft. 35ft. 10ft. 40 ft. 20ft. 35ft. 10ft. 10ft. 3. Design and construction plans for Kalland Avenue, including street lighting, shall be subject to review and approval of the City Engineer. 4. Two shade trees shall be planted on each lot at the time when a single family dwelling is constructed. 5. All grading, drainage, wetland, erosion control, and stormwater management plans shall be subject to review and approval of the City Engineer. 6. All utility issues shall be subject to review and approval of the City Engineer and Building Official. 7. All drainage and utility easements shall be subject to review and approval by the City Engineer. 8. Park dedication requirements shall be satisfied as a cash fee in lieu of land to be paid prior to recording of the final plat. 9. The subdivider shall execute a development contract as drafted by the City Attorney and approved by resolution of the City Council. B. Motion to recommend the application be denied based on a finding that the request is inconsistent with the Comprehensive Plan and does not comply with the requirements of the Zoning Ordinance and Subdivision Ordinance.
