04-25-11 CCrrEKA 3-2 OTSEGO CITY COUNCIL MEETING OTSEGO CITY HALL APRIL 25, 2011 7:00 PM 1. Mayor Jessica Stockamp will call the meeting to order. Mayor Stockamp called the meeting to order at 7:00 PM. Roll Call: Mayor Stockamp; Councilmembers: Vern Heidner, Dan Scharber, Tom Darkenwald and Doug Schroeder Staff: Gary Groen, Finance Director; Tami Loff, City Clerk; Daniel Licht, City Planner; Ron Wagner, City Engineer; and Andy MacArthur, City Attorney and Brad Belair, Public Works Supervisor. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 2. Consider agenda approval. CM Heidner requested to move item 5.4 to 11.1. CM Heidner motioned to approve as amended. Seconded by CM Scharber. All in favor. Motion carried. 3. Consider the following minutes. 3.1. April 11, 2011 City Council Meeting. CM Scharber motioned to approve as written. Seconded by CM Heidner. All in favor. Motion carried. 3.2. April 11, 2011 Workshop. CM Heidner motioned to approve as written. Seconded by CM Schroeder. All in favor. Motion carried. 4. Open Forum: (5 minute limit) 4.1. Special Presentation: Otsego Easter Egg Hunt Volunteers. Mayor Stockamp and the Council presented Certificates of Appreciation to the Boy Scouts Pack 90 for their assistance at the Parks & Recreation Commissions Easter Egg Hunt. 5. Consent Agenda. (Non -controversial items). 5.1. Approve Claims List. 5.2. Duerr Creek escrow. 5.3. Girl Scout project cost estimate. 5.4. Riverwood National utility refund -REMOVED to Item 11.1 5.5. Approve Resolution 2011-19 accepting donation from Target. CM Scharber motioned to approve with the removal of item 5.4. Seconded by CM Heidner. All in favor. Motion carried. 6. Unfinished Business. No items. 7. Public Works. 7.1. Seasonal Employee's. Public Works Supervisor Belair reviewed his request to hire seasonal employees. He is recommending to hire two returning from last year and to advertise for additional on the City website until Friday April 29, 2011 and bring back recommendations to the City Council at the May 9, 2011 City Council meeting. Public Works Supervisor Belair is estimating a total of 2000 City Council Meeting April 25, 2011. Page 2. hours of summer seasonal help. CM Heidner asked if that is the same number of hours as last year. Finance Director Groen said probably about 20% more hours. Public Works Supervisor Belair said does not intend to use full amount. Public Works Supervisor Belair also said that the direct costs to Public Works will be reduced by payments for park services and reimbursements from the Stormwater Fund, Otsego Creek Fund, Community Park Fund or other sources. CM Scharber motioned to approve Summer Seasonal help. Seconded by CM Schroeder. All in favor. Motion carried. CM Heidner said at the last meeting it was noted that City staff would bring back an annual cost estimate for the Jet/VAC to the City Council for review. City Engineer Wagner said that he and Public Works Supervisor Belair will be working with PeopleService Inc Supervisor Kurt Neidermeier on this but he was on vacation last week. Public Works Supervisor Belair said this will be on the Public Works Subcommittee agenda for discussion. 8. Daniel Licht, City Planner. No items. 9. Ron Wagner, City Engineer. 9.1. 85th Street EAW estimate. City Engineer Wagner said that an EAW would be needed because the length of the roadway will exceed one mile and that the State Statue is any new road over one mile long must have an EAW completed. CM Scharber asked if the not to exceed $7,500 is for time and materials. City Engineer Wagner said correct. City Engineer Wagner said there are no time lines with EAW. Mayor Stockamp said by doing the EAW doesn't mean we have a project date. City Planner Licht said it is environmental improvements. CM Darkenwald asked if this will come out of MSA funds. City Planner Licht said correct. CM Darkenwald motioned to approve EAW not to exceed $7,500 to be paid for out of MSA funds. Seconded by CM Schroeder. All in favor. Motion carried. 9.2. Island View Estates update. City Engineer Wagner reviewed the Neighborhood meeting that was held April 18 regarding the stormwater drainage issues in that area. City Engineer Wagner said the options and estimate of costs were presented. City Staff let the property owners know that a letter of request would be the next step. City Clerk Loff said a letter has not been received at this time. CM Darkenwald asked if just option 3 would require easements. City Engineer Wagner said no all would require easements. City Planner Licht said it was left at the meeting that City staff would send letter to the property owners with an update City Councils direction. Mayor Stockamp asked if the property owners have seen the $6,500 amount. City Planner Licht said yes. City Planner Licht said one of the property owners has been operating a pump at his own effort and cost to protect their septic system from flooding making this a public health safety issue. CM Schroeder the swale is maintenance cost for the future. City Engineer Wagner said correct but that it is the least expensive long-term cost option. CM Darkenwald asked when you looked at this drainage issue have you discovered why this happened? City Engineer Wagner said the clay drain tile is 30 years old has started to fail. The City Council directed City staff to contact the property owners that they would support a project for Option 1 and to continue to work with the property owners. 9.3. US Hwy 10/169 Construction. City Engineer Wagner said he has been in contact with Elk River City Engineer Justin Femrite to review the construction project on US HWY 10/169. The detour around the interchange at City Council Meeting April 25, 2011. Page 3. Highway 10 and Highway 169 will start June 1st and last about a month. The detour route in Otsego runs down Parrish Avenue and back onto CSAH 39. City Engineer Wagner said staff is looking for direction to meet with the Wright County Sherriff Department and Highway Department. Mayor Stockamp said ER is requesting to get reimbursed for some of their police protection because of this project. City Engineer Wagner said can look into. CM Scharber asked if this is a formal detour. City Engineer Wagner said yes it will be completely closed; everything going south will be detoured through Parrish Avenue. Elk River City Administrator Lori Johnson said South bound will be completely closed and there will be single lane traffic both north and south on the north bound bridge. Ms. Johnson said that the City of Elk River has asked for detours signs and reimbursement for police service but it is just a request at this point; if Otsego has an amount to request for reimbursement Elk River can bring the issue back to MNDot. The City Council directed City staff to meet with Wright County Sheriff and Wright County Highway Department. 10. Andrew MacArthur, City Attorney. 10.1. Great River Centre extension request. City Attorney MacArthur reviewed the extension request and the Resolution drawing the LOC that will give them until July 15, 2011 to complete or to come to an agreement. CM Heidner motioned to approve Resolution 2011-20 declaring default in terms and conditions of escrow agreement and underlying Developers Agreement for required improvements of roads and public improvements and payment of assessments within Great River Centre. Seconded by CM Scharber. All in favor. Motion carried. 11. Council Items. 11.1. Riverwood National utility refund. CM Heidner said he pulled this item because it didn't have cover sheet with recommended actions. CM Heidner asked in the future requests for City Council action included a cover sheet or memo explaining. CM Heidner said the refund would be in the amount of $2,592. 64? Finance Director Groen said yes that is correct. CM Heidner motioned to approve a refund of $2,592.64. Seconded by CM Scharber. All in favor. Motion carried. 12. Gary Groen, Finance Director. No items. 13. Tami Loff, City Clerk. City Clerk Loff reminded the City Council that the Board of Review meeting is scheduled for May 3 at 6:30 PM. 14. Adjourn by 10 PM.
