The subject site was rezoned to R-3, Residential' Long Range Urban Service District and given preliminary plat approval on 24 May 2004. Exhibits: A. Site Location B. Final Plat ANALYSIS Preliminary Plat Consistency. The.final plat includes the same number of lots in the same configuration as the approved preliminary plat. Right-of-way for a.future street to the east plat line has been provided between Lots 3 and 4, Block 1 to provide potential access to adjacent parcels. The future right-of-way is shown as an outlot, but should be revised as public right-of-way as that is the purpose for which it will be dedicated to the City. A "future street' sign should be placed at the intersection location so that residents and potential buyers are aware of the potential street extension. Engineering Plans. The applicant has submitted required engineering plans for review. All grading, street construction, easements and utility issues are subject to review and approval of the City Engineer. Park Dedication. The proposed final plat creates 10 new lots triggering park and trail dedication requirements. As no land is proposed to be dedicated with the final plat, park and trail dedication is to be satisfied as a cash fee in lieu of land equal to $2,820.00 per dwelling, or $28,200.00. Development Contract. The applicant is required to enter into a development contract with the City and pay all applicable fees and securities. The development contract is subject to review and approval of the City Attorney. Also, the driveway on the south side of the temporary cul-de-sac will need to be reconstructed. 3. The invert of the storm sewer at CBMH 101 shall be lowered to provide future flexibility for an outlet to a sedimentation basin. Because of the natural topography, it would be necessary to construct a sedimentation basin in the low area of Block 1, Lot 3 at the time that 91St Street NE is constructed. Because easement is only provided to the approximate elevation of 882.3, the storm sewer must be lowered to provide a minimum 1.5' of "bounce" from the outlet elevation at CBMH 101 to the easement boundary. We recommend revising the storm sewer to 15" RCP at minimum grade from CBMH 102. DETAIL SHEETS The grate depicted in the skimmer structure detail is no longer used. Please remove the grate detail. 2. The storm sewer lid detail shall be revised to show pickholes as depicted in Standard Plate No. 311. 3. The street section detail shall call out the class 5 aggregate base as 100% Crushed". 4. The invert of the inlet pipe for the north skimmer structure must be lowered to 877.8 to provide a minimum of 12" separation from the top of the pipe to the NWL elevation. We recommend also lowering the pipe at the skimmer structure such that the inlet pipe is at a 0.00% grade. 5. The invert of the inlet pipe for the south skimmer must be lowered to 875.8 to provide a minimum of 12" separation from the top of the pipe to the normal water level elevation. Again, we recommend also lowering the pipe at the skimmer structure such that the inlet pipe is at a 0.00% grade. WETLANDS A wetland determination for the site has been submitted. It has been determined that there are no jurisdictional wetlands on the site. SURFACE WATER MANAGEMENT The outlet for Pond 4 is modeled as a 15" RCP at 0.54%. We anticipate that the construction of the driveway to Block 3, Lot 3 will reduce the live storage available for the south pond. The computations shall take this into consideration. Subsurface conditions showing that the proposed development is suitable for on-site sewage disposal systems must be submitted. (21-6-2.B.8) 2. The proposed project requires that the driveway to the existing house south of the plat (Hall's Addition Block 4, Lot 4) be sawcut, removed and replaced to lower an existing driveway culvert. Although the work is within the Ogden Avenue NE right-of-way, it has always been the council's directive to minimize impact to adjacent property owners. Should the City and the Consultant decide that Option A (Architectural Integrity Analysis) is appropriate for assessing architectural integrity as a key element in determining significance for the house, Steven Buetow AIA will conduct a site visit and his analysis will be part of the final report. Mr. Buetow is a registered St. Paul/Minneapolis architect specializing in preservation with over 20 years of experience in working on historic structures. Specific job tasks have ranged from working for a developer as a general contractor for the conversion of a 100 -year-old luxury apartment building into an office condominium to reconstructing a porch design for a Queen Ann style Victorian house from period photographs. Commissions have included the remodeling/or restoration of numerous mansions in the Twin Cities (including four that were designed by the nationally renowned architect of the Minnesota State Capitol, Cass Gilbert), a new in -fill home on St. Paul's Summit Avenue, changes and additions to many old residences, commercial work, feasibility studies of historic buildings, and numerous consultations on preservation. These buildings range stylistically from the elaborate and highly decorated Victorian designs of James H. Coxhead to the sublime and careful Prairie School compositions of Purcell and Elmsie. In addition, Mr. Buetow has long been active in the preservation community. He has been a member of the Historic Resources Committee of the American Institute of Architects Minnesota Chapter for over a decade and is a former chairman. General Terms and Conditions For Engineering, Architectural, or Consulting Services Mead & Hunt, Inc., will begin services upon written authorization to proceed. Receiptof a signed contract (the "Contract") will be considered written authorization, which shall be incorporated herein by reference. If the terms or conditions of this agreement conflict with those in the Contract or any other agreement, this agreement shall control. For projects requiring phased services a written authorization of approval of the prior phase and notice to proceed on the subsequent phase must be received prior to commencement of services. Phases, when applicable, shall be divided into study and report phase, preliminary design phase, final design phase, bidding or negotiating phase. and construction phase, as set forth in the Contract. 2. Mead & Hunt, Inc., will bill the Owner monthly, according to the payment method set forth in the Contract, with net payment due in thirty (30) days. Past due balances shall be subject to an interest charge at a rate of l-1/2% per month. In addition, Mead & Hunt, Inc., may, after giving seven (7) days' written notice, suspend service under any agreement until the Owner has paid in full all amounts due for services rendered and expenses incurred, including the interest charge on past due invoices. The quoted fees and scope of services constitute the best estimate of the fees and tasks required to perform the services as defined. This agreement, upon execution by both parties hereto, may be amended only by written instrument signed by both parties. For those projects involving conceptual or process development service, activities often cannot be fully defined during initial planning. As the project progresses, facts uncovered may reveal a change in direction which may alter the scope. Mead & Hunt, Inc., will promptly inform the Owner in writing of such situations so that changes in this agreement may be made as required. In addition, if the Owner requesssignificant modifications or changes in the scope of the project, the time of performance of Mead & Hunt, Inc.'s services and rates of compensation shall be adjusted. The Owner shall be liable for all costs and damages incurred by Mead & Hunt, Inc., for delays caused in whole or in part by the Owner's interference with Mead & Hunt's ability to provide services, including, but not limited to, the Owner's failure to provide specified facilities or information, or if Mead & Hunt, Inc.'s services are extended by Owner's actions or inactions for more than ninety (90) days. The Owner agrees to indemnify and hold Mead & Hunt, Inc., harmless for any delays caused by the Owner. If delays are caused by unpredictable occurrences including, without limitation, terrorism, fires, floods, riots, strikes, unavailability of labor or materials, delays or defaults by suppliers of materials or services, process shutdowns, acts of God or the public enemy, or acs or regulations of any governmental agency, the costs for services and schedule commitments shall be subject to change. 5. Mead & Hunt, Inc., will maintain insurance coverage for: Worker's Compensation, General Liability, Automobile Liability, Aviation Liability, and Professional Liability. Mead & Hunt, Inc., will provide information as to specific limits upon written request. If the Owner requires coverages or limits in addition to those in effect as of the date of the agreement, premiums for additional insurance shall be paid by the Owner. 6. The liability of Mead & Hunt, Inc., to the owner for any indemnity commitments or for any damages arising in any way out of performance of this agreement is limited to a period of twelve months from the date of the last bill from Mead & Hunt, Inc., to the OWNER, whether paid or not paid by the OWNER; such liability is limited to the amount of the fees paid by the OWNER to Mead & Hunt, Inc., for performance under this agreement. Mead & Hunt, Inc., and the Owner agree that the ultimate liability for mold or mildew regardless of its source, and for the actual, alleged, or threatened discharge, dispersal, release, or escape of pollutants, mycotoxins, spores, smoke, vapors, soot, fumes, acids, alkalis, toxic chemicals, liquids or gases, waste materials or other irritants, contaminants or pollutants into or upon land, buildings, the atmosphere, or body of water shall remain with Owner; and the responsibility and/or liability for any of the foregoing, and for the ownership and maintenance of any toxic, hazardous, or asbestos materials relating to the project, shall remain with the Owner. Mead & Hunt, Inc., and the Owner acknowledges that Mead & Hunt, Inc.'s, professional liability and general liability policies do not apply to claims arising out of the aforegoing. Therefore, the Owner agrees not to bring a claim against Mead & Hunt, Inc., relating to the uninsured liability referenced above. Use of any documents and/or services pertaining to this project by the Owner or extensions of this project or on any other project shall be at the Owners sole risk. Owner agrees to hold Mead & Hunt, Inc., harmless for any claim arising out of or related in any way to project or construction costs even if such claims arise out of and/or have been caused in whole or in pan by negligence on the part of Mead & Hunt, Inc. 13. If the Owner is a municipality or state authority, the Owner agrees to indemnify and hold harmless Mead & Hunt, Inc., for all claims arising out of or related in any way to acts done by Mead & Hunt, Inc., in the exercise of legislative or quasi -legislative functions. In the event Mead & Hunt, Inc., shall be made a party to any suit or litigation on account of an injury or damage to person, life, or property as a result of such acts done by Mead & Hunt, Inc. in the exercise of legislative or quasi -legislative functions, the Owner shall, at Owner's sole expense, defend such actions on behalf of Mead & Hunt, Inc., including claims and causes of action at common law, arising under any statute, or arising out of any governmental demand or request, and if judgment shall be obtained or claim allowed in any proceedings against Mead & Hunt, Inc., the Owner shall pay and satisfy such judgment or claim in full. 14. This agreement shall not be construed as giving Mead & Hunt, Inc., the responsibility or authority to direct or supervise construction means, methods, techniques, sequence, or procedures of construction selected by the contractors or subcontractors or the safety precautions and programs incident to the work of the contractors or subcontractors. 15. Mead & Hunt is not liable, in contract or tort or otherwise, for any special, indirect, consequential, or liquidated damages including specifically, but without limitation, loss of profit or revenue, loss of capital, delay damages, loss of goodwill, claim of third parties, or similar damages. 16. This agreement shall be construed and interpreted in accordance with the laws of the state of Wisconsin. No action may be brought except in the state of Wisconsin. 17. This agreement cannot be changed or terminated orally. Mr. Gardner meets the Secretary of the Interior's requirements for architectural historians. Mr. Gardner has completed many cultural resource studies, including National Register of Historic Places nominations, Historic American Engineering Record (HAER) documentations, Determinations of Eligibility (DOE), reconnaissance -level cultural resource surveys, and contextual studies. METHODOLOGY I understand that the project includes one property, a residence in Otsego, Wright County, Minnesota, a short distance northwest of the community of Rogers. The residence was constructed in the mid- I800s by John McDonald, who is believed the earliest white settler in the region that ultimately formed Wright County. This project's goal is to determine whether or not the residence qualifies as a "historically significant" property and is thus eligible for listing in the National Register of Historic Places. This determination will be made employing evaluation criteria established by the National Park Service. To complete the documentation I will undertake the following: Project Initiation I will start the project by contacting staff at the Minnesota State Historic Preservation Office (SHPO). I expect the SHPO will have preliminary information on the Otsego residence. I will also establish a project schedule with the client, setting up a time when I may survey the property and view historical records in the owner's possession. Repositories in the Wright County area will be contacted as well. Literature Search I expect the owner of the residence will make available any historical records from the proprietor's files. Archival research will be conducted at the Wright County Historical Society in Buffalo, as well as the local library. Additionally, the archives of the Minnesota Historical Society will be searched. Other repositories may also be visited. Sources which will likely prove helpful include newspaper articles, local histories, historic photographs, and plat maps. I expect some with knowledge of the Otsego residence will offer historical insights of the property. I anticipate focusing on the property's historical importance (Criterion A), as well as its appearance (Criterion C), and whether or not it is associated with a significant individual (Criterion B). Fieldwork I will visit the Otsego residence, taking detailed notes of the property's appearance and construction. I will also record the residence through digital images. Since this documentation is not a formal National Register of Historic Places nomination, digital images incorporated within the body of the report should be sufficient. Even so, I will shoot some 35mm color prints should the SHPO prefer that format. Report A copy of the final report will be submitted to the client. The client may choose to send a copy to the Review and Compliance Officer at the SHPO or request that the historian submit a copy to the agency. Assuming a start date about mid-June, I anticipate the report will be completed by mid-July. "Otsego In the Beginning" (1852-1880) and other relevant publications will be borrowed or purchased, reviewed and used to develop an understanding of the historic context. Initial observations of the McDonald / Peavy House on 6 / 15 / 2004 suggest that the limited removal of some wall coverings, and other materials would yield significant information on the chronology of changes to the building. It will describe the building's material integrity and recommend appropriate preservation, restoration or rehabilitation treatments. Subsequently, the Planning Commission voted 7-0 to recommend denial of the Zoning Map amendment and preliminary plat. The applications were to be considered by the City Council at their meeting on 26 April 2004. The applicant requested that the City Council table action on their request to allow them the opportunity to address the. issues raised by City Staff and the Planning Commission. The applicant has made one contact with City Staff since the 26 April 2004 meeting indicating that they were intending to discuss the site with DNR Staff. No new information has been received. City Staff does not see any option to address the potential bluff impacts related to the proposed subdivision. Furthermore,. the. City's allowed time to review the application expires on 14 July 2004. As such, we recommend that the City Council act to deny the requested applications at their meeting on 28 June 2004 at 6:30 PM, consistent with the recommendation of the Planning Commission. (1) Special conditions may include exceptional topographic or water conditions or, in the case of an existing lot or parcel of record, narrowness, shallowness, insufficient area or shape of the property. (2) Undue hardship caused by the special conditions and circumstances may not be solely economic in nature, if a reasonable use of the property exists under the terms of [the Zoning Ordinance]. (3) Special conditions and circumstances causing the undue hardship shall not be a result of lot or building size, or building location when the lot qualifies as a buildable parcel. b. The term "peddler" shall mean the same as the term "hawker". PERSON: Any natural individual, group, organization, corporation, partnership, or association. As applied to groups, organizations, corporations, partnerships, and associations, the term shall include each member, officer, partner, associate, agent, or employee. SOLICITOR: A person who goes from dwelling to dwelling, business to business, street to street, or any other type of place to place, for the purpose of obtaining or attempting to obtain orders for goods, wares, products, merchandise, other personal property, or services, of which he or she may be carrying or transporting samples, or that may be described in a catalog or by other means, and for which delivery or performance shall occur at a later time. The absence of samples or catalogs shall not remove a person from the scope of this provision if the actual purpose of the person's activity is to obtain or attempt to obtain orders as discussed above. The term "solicitor" shall mean the same as the term "canvasser". TRANSIENT MERCHANT: Any person who engages in any temporary and transient business in this state, either in one locality, or in traveling from place to place in this state, selling goods, wares, and merchandise; and who, for the purpose of carrying on such business, hires, leases, occupies, or uses a building, structure, vacant lot, or railroad car for the exhibition and sale of such goods, wares, and merchandise. The term transient merchant does not include a seller or exhibitor in a firearms collector show involving two (2) or more sellers or exhibitors. 7-10-2: LICENSING OF PEDDLERS AND TRANSIENT MERCHANTS: A. County License Required: No person shall conduct business as a peddler or transient merchant within the City limits without first having obtained any license required by the county pursuant to Minnesota statutes chapter 329, as amended. B. City License Required: Except as otherwise provided for by this chapter, no person shall conduct business as either a peddler or a transient merchant without first having obtained a license from the city. Within seven (7) days after the expiration of a license the license must be returned to the City. C. City License Application: Application for a license to conduct business as a peddler or transient merchant shall be made at least fourteen (14) regular business days before the applicant desires to begin conducting business within city limits. Application for a license shall be made on a form provided by the City Clerk. All applications shall be signed by the applicant. Any fraud, misrepresentation, or false statement on the application shall constitute a violation of this Section. All applications shall include the following information: 1. Applicant's full legal name, and any other names used or known by in the past; 2. All other names under which the applicant conducts business or to which applicant officially answers; 3. A physical description of the applicant (hair color, eye color, height, weight, distinguishing marks and features, etc.); 4. Full address of applicant's permanent residence; 5. Telephone number of applicant's permanent residence; 6. Full legal name of any and all business operation(s) owned, managed, or operated by applicant, or for which the applicant is an employee or agent; 7. Full address of applicant's regular place of business (if any); 8. Any and all business related telephone number(s) of the applicant; 9. The type of business for which the applicant is applying for a license; 10. The dates during which the applicant intends to conduct business and the number of days he or she will be conducting business in the city; 11. Any and all address(es) and telephone number(s) where the applicant can be reached while conducting business within the city, including the location where a transient merchant intends to set up business; 12. A statement as to whether or not the applicant has been convicted within the last five (5) years of any felony, gross misdemeanor or misdemeanor, for violation of any state or federal statute or any local ordinance, other than traffic offenses; 13. A list of the five (5) most recent locations where the applicant has conducted business as a peddler or transient merchant; 14. Proof of any required county license; 15. Written permission of the property owner or the property owner's agent for any property to be used by a transient merchant; 16. A general description of the items to be sold or services to be provided; 17. All additional information deemed necessary by the city council; 18. A list of all individuals to be covered by a group license; 19. Source of items sold and the item's location at the time of licensing and time of sale; 20. License plate and registration information for any vehicle to be used in conjunction with the licensed business and a description of the vehicle; 21. Applicant's driver's license number or other acceptable form of identification; 22. Recent passport style photograph of applicant; 23. Applicant's social security number. D. License Fees: All applications for a license under this chapter shall be accompanied by the fee established in the city's fee schedule as adopted from time to time by resolution of the City Council. E. Procedure: An application shall be determined to be complete only if all required information is provided. If the City Clerk determines that an application is incomplete, it shall inform the applicant of the information required to be provided prior to issuance of a license. The City Clerk shall review the application and order any investigation, including background checks, necessary to verify the information provided with the application. The City Clerk shall either approve or deny the license within seven (7) regular business days. If the application is approved the license shall be issued. If the application is rejected, the applicant shall be notified in writing of the decision, the reason for the denial, and the applicant's right to appeal the denial by requesting, within twenty (20) days of the date of the denial, a public hearing to be heard by the city council within twenty (20) days of the date of the request. The final decision of the city council following the public hearing shall be appealed by petitioning the Minnesota court of appeals for a writ of certiorari. F. Duration: A license granted under this chapter shall be valid for up to ninety (90) days in a calendar year. 7-10-3: LICENSE EXEMPTIONS: The licensing requirements of this chapter shall not apply to: A. Any person selling or attempting to sell, or to take or attempt to take orders for, any product grown, produced, cultivated, or raised on any farm or garden. Such person must comply with the City's zoning ordinance and other applicable ordinances; B. Persons exercising that person's state or federal constitutional rights, except if that person's exercise of constitutional rights is merely incidental to a commercial activity; C. Persons selling personal property at wholesale to retailers; D. Daily newspaper sales; or E. Merchants or their employees delivering goods in the regular course of business. F. The sale of goods by a nonprofit group. 7-10-4: INELIGIBILITY FOR LICENSE: The following shall be grounds for denying a license or registration under this chapter: A. The failure of the applicant to obtain and show proof of having obtained any required county license; B. The failure of the applicant to truthfully provide any of the information requested by the City as a part of the application, or the failure to sign the application, or the failure to pay the required fee at the time of application; C. The conviction of the applicant within the past five (5) years from the date of application, for any violation of any federal or state statute or regulation, or of any local ordinance, which adversely reflects on the person's ability to conduct the business for which the license is being sought in an honest and legal manner that will not adversely affect the health, safety, and welfare of the residents of the City. Such violations shall include, but not be limited to: burglary, theft, larceny, swindling, fraud, unlawful business practices, and any form of actual or threatened physical harm against another person; or D. The revocation within the past five (5) years of any license issued to the applicant for the purpose of conducting business as a peddler, solicitor, or transient merchant. E. The failure of the applicant to return a prior license or registration to the City within seven (7) days after its expiration. 7-10-5: SUSPENSION AND REVOCATION: A. City Council Action: Any license or registration issued under this chapter may be suspended or revoked at the discretion of the City Council for violation of any of the following: 1. Fraud, misrepresentation, or incorrect statements on the application form; 2. Fraud, misrepresentation, or false statements made during the course of the license activity; 3. Conviction of any offense for which granting of a license could have been denied under this chapter; 4. Violation of any provision of this chapter; or 5. Conducting the business in an unlawful manner or in such a manner as to constitute a breach of the peace or to constitute a menace to the health, safety, or general welfare of the public. B. Notice: Prior to revoking or suspending any license issued under this chapter, the City shall provide the license holder with written notice of the alleged violation(s) and inform the licensee of the licensee's right to a hearing on the alleged violation. Notice shall be delivered in person or by mail to the permanent residential address listed on the license application, or if no residential address is listed, the business address provided on the license application. C. Public Hearing: Upon receiving the notice provided in subsection B of this section, the licensee shall have the right to request a public hearing. If no request for a public hearing is received by the city within ten (10) regular business days following the service of the notice, the city may proceed with the suspension or revocation. For the purpose of mailed notices, service shall be considered complete as of the date the notice is placed in the mail. If a public hearing is requested within the stated time frame, a hearing shall be scheduled within twenty (20) days from the date of the request. Within three (3) regular business days of the hearing, the city council shall notify the licensee of its decision. D. Emergency: If, in the discretion of the City Clerk, imminent harm to the health or safety of the public may occur because of the actions of a peddler, solicitor, or transient merchant licensed or registered under this chapter, the City Clerk may immediately suspend the person's license or registration and provide notice of the right to hold a subsequent public hearing as prescribed in subsection B of this section. E. Appeals: Any person whose license is suspended or revoked under this section shall have the right to appeal that decision in court. 7-10-6: TRANSFERABILITY: No license issued under this chapter shall be transferred to any person other than the person to whom the license was issued. 7-10-7: REGISTRATION REQUIRED: All solicitors shall be required to register with the City. Registration shall be made on the same form provided by the City, but no fee shall be required. Immediately upon completion of the registration form, the City shall issue to the registrant a certificate of registration as proof of the registration. Certificates of registration shall be nontransferable. Registration shall be valid for a period of up to ninety (90) days. Within seven (7) days after the expiration of a registration the registration must be returned to the City. 7-10-8: TRANSIENT MERCHANTS PROHIBITED; EXCEPTIONS: Transient merchants are specifically prohibited within the City except in the following circumstances: A. Transient merchants operating within a building; B. The sale of plants, flowers or Christmas trees; and C. Persons selling farm or garden products. D. This chapter does not apply to persons selling personal property at wholesale to retailers, to daily newspaper sales, to merchants or their employees delivering goods in the regular course of business, or to a person selling or peddling the products of the farm or garden. E. Transient merchants that are not prohibited must comply with City's zoning ordinance and any other applicable ordinances. 7-10-9: EXCLUSION BY PLACARD: No peddler, solicitor, or transient merchant, unless invited to do so by the property owner or tenant, shall enter the property of another for the purpose of conducting business as a peddler, solicitor, or transient merchant when the property is marked with a sign or placard at least three and three-quarter inches (3 3/4") long and three and three-quarter inches (3 3/4") wide with print of at least 48 -point in size stating "No Peddlers, Solicitors, or Transient Merchants", or "Peddlers, Solicitors, and Transient Merchants Prohibited", or other comparable statement. No person other than the property owner or tenant shall remove, deface, or otherwise tamper with any sign or placard under this section. 7-10-10: PROHIBITED ACTIVITIES: No peddler, solicitor, or transient merchant shall conduct business in any of the following manners: A. Obstructing the free flow of either vehicular or pedestrian traffic on any street, alley, sidewalk, or other public right of way. B. Conducting business in such a way as to create a threat to the health, safety, or welfare of any individual or the general public. C. Entering upon any residential premises for the purpose of carrying on the licensee's or registrant's trade or business between the hours of eight o'clock (8:00) P.M. and nine o'clock (9:00) A.M. of the following day, unless such person has been expressly invited to do so by the owner or occupant thereof. D. Failing to provide proof of license or registration and identification when requested or using the license or registration of another person. E. Failing to wear or display the certificate of registration or licensure provided by the City on the licensed or registered individual's outermost clothing or to return the certificate to the City in accordance with the requirements of this chapter. F. Making any false or misleading statements about the product or service being sold, including untrue statements of endorsement. No peddler, solicitor, or transient merchant shall claim to have the endorsement of the City solely based on the city having issued a license or certificate of registration to that person. G. Remaining on the property of another when requested to leave, or to otherwise conduct business in a manner a reasonable person would find obscene, threatening, intimidating, or abusive. H. Entering upon any premises or attempting to enter in or upon any premises wherein a sign or placard bearing the notice "peddlers or solicitors prohibited" or language similar thereto, is located. I. Selling or soliciting sales by transient merchants from public property or right of way or from private property unless they own the property or have written permission from the owner. 7-10-11: IDENTIFICATION: A. All solicitors, peddlers and transient merchants must wear some type of identification conspicuously showing their name and the organization for which they are soliciting or peddling, must carry their City and/or County issued license or registration certificate when conducting the business or activity required to be licensed or registered under this chapter, and must wear or display on their outermost clothing the certificate of registration or licensure provided by the City. B. The certificate of registration or licensure issued by the City is the property of the City of Otsego and must be returned to the City within seven (7) days after the expiration date of the registration or license. Failure to do so may result in prosecution and will result in the denial of any future license or registration application for twelve (12) months. 7-10-12: PENALTY: Violation of any provision of this chapter shall be a misdemeanor. STPX 8606(062) This agreement is entered into by and between City of Otsego ("City") and the State of Minnesota acting through its Commissioner of Transportation ("Mn/DOT"), Agency Agreement No. 86208 which has been executed between the City and Mn/DOT, appoints Mn/DOT as the City's agent to receive and disburse transportation related federal funds, and sets forth duties and responsibilities for letting, payment, and other procedures for a federally funded contract let by the City; and Pursuant to Minnesota Statutes Section 161.36, the City desires Mn/DOT to act as the City's agent to accept and disburse federal funds for the construction, improvement, or enhancement of transportation financed in whole or in part by federal funds; and The City is proposing a federal aid project to construct a new urban collector between Northeast 78th Street to Wright County CSAH 37 in Otsego; includes intersection construction, hereinafter referred to as the "Project"; and The Project has been determined to be eligible for the expenditure of federal aid funds and is programmed in the approved federally approved STIP for the fiscal year 2006; and the project is identified in Mn/DOT records as State Project 217-107-04, and in Federal Highway Administration ("FHWA") records as Minnesota Project STPX 8606(062); and. The City desires to proceed with the construction of the project in advance of the year it is programmed for the federal funds; and FHWA procedures permit advance construction of eligible projects with non-federal funds, with the intent to request federal funding for the federally eligible costs in a subsequent federal fiscal year, if sufficient funding and obligation authority are available; and The City desires to temporarily provide City State Aid and/or other local funds in lieu of the federal funds so that the project may proceed. Mn/DOT requires that the terms and conditions of this agency be set forth in an agreement. THE PARTIES AGREE AS FOLLOWS: Agreement no. xxxxx I. DUTIES OF THE CITY. A. The City will let a contract and construct the Project in accordance with Agency Agreement No. 86208. Payment provisions for federally eligible costs will be as stated herein. B. It is estimated that the total cost of the Project is $ 662,500 and that the anticipated federal funding will be capped at $ 530,000. The remaining share will be paid by the City. C. The City will pay any part of the cost or expense of the Project that is not paid by federal funds. D. Request for reimbursement of the federal aid share of the federally eligible costs will be made after October 1, 2005, or earlier if funding and obligation authority are available (subject to the Area Transportation Partnership ("ATP") policy). E. If the project is converted to federal funding before completion and final acceptance, requests for reimbursement will occur as partial estimates in accordance with Agency Agreement No. 86208. II. DUTIES OF Mn/DOT. A. Mn/DOT will make the necessary requests to the FHWA for authorization to use federal funds for the Project and designation as an Advance Construction project. B. Mn/DOT will request the conversion of the Project to federal funding of eligible costs, between October 1, 2005 and January 31, 2006, or earlier if funding and obligation authority are available. C. At such time that the project is converted to federal funding and such funding is received by Mn/DOT, Mn/DOT will reimburse the City the federal aid share of the federally eligible costs, previously provided by the City. Reimbursement for City State Aid funds used in lieu of federal funds, will be deposited in the City's State Aid Account. Reimbursement for other City funds used in lieu of federal funds will be forwarded to the City. III. AUTHORIZED REPRESENTATIVES. Each authorized representative will have responsibility to administer this agreement and to ensure that all payments due to the other party are paid pursuant to the terms of this agreement. A. This agreement will be effective upon execution by the City and by appropriate State officials, pursuant to Minnesota Statutes Section 16C.05, and will remain in effect for three (3) years from the effective date or until all obligations set forth in this agreement have been satisfactorily fulfilled, whichever occurs first. VIII. TERMINATION. This agreement may be terminated by the City or Mn/DOT at any time, with or without cause, upon ninety (90) days written notice to the other party. Such termination will not remove any unfulfilled financial obligations of the City as set forth in this Agreement. In the event of such a termination the City will be entitled to reimbursement for Mn/DOT-approved federally eligible expenses incurred for work satisfactorily performed on the Project to the date of termination subject to the terms of this agreement.
