07-26-04 CCITEM 3_1 OTSEGO CITY COUNCIL MEETING OTSEGO CITY HALL JULY 26, 2004 6:30 PM 1. Manor Larry Fournier will call the meeting to order. Mayor Fournier called the meeting to order at 6:30 PM. Roll Call: Mayor Larry Fournier; Councilrnembers: Vern Heidner, Virginia Wendel, Dan Scharber and Jerry Struthers. Staff. Mike Robertson, City Administrator; Judy Hudson, City Clerk/Zoning Administrator; Dan Licht, City ' Planner; Ron Wagner, City Engineer; and Andrew MacArthur, City Attorney. Pledge of Allegiance: Mayor Fournier led in the Pledge of Allegiance. 2. Consider agenda approval. CM Wendel requested to add under Item 9.2. Heritage Commission Update. CM Struthers requested to add under Item 6.3. Odean Avenue and CSAH 37. Mayor Fournier requested to add under Item 7.2. Set a Workshop date for Island View Mississippi Ravine, under Item 8.2. One Day Liquor License approval, under Item 7.3. Discussion of Speed Limit Sign on 83rd Street. Mike Robertson requested to add under Item 10.3. Joint Meeting with St. Michael. CM Struthers motioned to adopt the Agenda as amended. Seconded by CM Wendel. All in favor. Motion carried. 3. _ Consider the following minutes 3.1. City Council Minuies of July 12, 2004 CM Heidner motioned adoption;. Seconded by CM Scharber. Voting For the Motion: Mayor Fournier, CM Heidner, CM Wendel, CM Scharber. Abstained: CM Struthers as he was absent. Motion carried. 3.2. Council Workshop Minutes of July 19 2004 CM Heidner motioned adoption. Seconded by CM Scharber. Voting For the Motion: Mayor Fournier, CM Heidner, CM Wendel, CM Scharber. Abstained: CM Struthers as he was absent. Motion carried. 4. Open Forum: (5 minute limit) 4.1. Special Presentation: Gary Groen 2004 Half Year Budget Report Gary Groen briefly reviewed the, expenditures through June 30, 2004. He noted that revenues and expenditures are within budget. He also noted the Building Revenues of $324,000 and Park and Trail Fees' of $1,247,000 through June 30, 2004. The first 2005 Budget Workshop will be August 4, 2004 7 PM. Open Forum Vincent Peterson, 6620 Oakwood Avenue, stated concern that Midwest Tree Farm may be diverting water flow and causing more runoff on to his side of the street. City Council Meeting of July 26,, 2004. Page 2. Ron Wagner said that Midwest Landscape is putting in ponds to hold the stormwater runoff and he will check into this. 5. Consent Agenda. (Non -controversial items). 5.1. Approve Claims List. 5.2. Approve Off -Sale Liquor License for Riverview Liquorette (New Owner) CM Heidner motioned adoption of the Claims List. Seconded by CM Struthers. All in favor. Motion carried. 6. Dan Licht, City Planner. 6.1. Final Plat for Prairie Creek 6th Addition. Dan Licht presented the Planner's Report. Ron Wagner presented the Engineering Report. CM Scharber motioned to approve the Prairie Creek 6th Addition Final Plat, subject to the 5 conditions listed in the Findings of Fact. Seconded by CM Heidner. All in favor. Motion carried. 6.2. Any other planning business A. Intersection at CSAH 37 and Odean Avenue The Council directed both Dan Licht and Ron Wagner to write to Charter regarding the removal of the poles and the site issues at this intersection. Mayor Fournier said he has been contacted by Russ Martie, developer of Hidden Creek Trails, about his escrow account and Park and Trail Fees. Dan Licht will write him a letter explaining the Park and Trail Fees and Judy Hudson said a letter will go to Mr. Martie regarding his escrow. 7. Ron Wagner. Citv Engineer. 7.1. Set Public Hearing for Island View Mississippi Ravine Erosion. A City Council Workshop was set ;for August 4, 2004 following the Budget Workshop at 8 PM. 7.2. Any other Engineering Business A. Residents hooking up to sewer There are several residents who want to consider hooking up to sewer and water in the Arbor Creek and Martin Farms area. Staff has gone over the costs with them. B. Speed signs on 83rd Street. There has been a request for a speed sign for lower than 55 mph on 83rd Street between Nashua Avenue and Mason Avenue. Ron Wagner explained that since there are only three residences on this section of 83rd Street it doesn't meet the criteria for anything other 55 mph. He stated that if the City paid the cost for the State to do the required speed study, the study would not be likely to recommend any reduction in the speed limits. Waterfront East Development Agreement Mr. MacArthur hasn't received any further information from the developer. 8.2. Any other attorney business A. One Day Liquor License CM Struthers motioned to approve the license subject to the verification of the required insurance. Seconded by CM Scharber. All in favor. Motion carried. City Council directed the City Attorney to place a petition on the next Council Agenda to have the Monticello Big Lake Hospital removed from the City of Otsego's taxes. 9. Council Items: 9.1. Consider Approving Street Supervisor Job Description and Ordering Advertisement for the Position The City Council changed the deadline date to August 23, 2004. Mayor Fournier motioned to approve the job description and to start the advertisement. Seconded by CM Scharber. All in favor. Motion carried. 9.2. Peavey House Historical Site. CM Wendel went over the recent Heritage Preservation Meeting where they reviewed the draft of the McDonald -Peavey House Evaluation. Mayor Fournier directed staff to have this on the next City Council Agenda. 10. Mike Robertson, City Administrator. 10. 1. Consider Budget Transfers CM Heidner motioned to adopt Resolution 2004-48 transferring monies between City Funds. Seconded by CM Scharber. All in favor. Motion carried. 10.2. Consider Change Order Reducing Lily Pond Park Construction by $5,620 CM Scharber motioned to approve Change Order No. 1 reducing Lily Pond Park Construction by $5,620. Seconded by Mayor Fournier. All in favor. Motion carried. 10.3. Joint meeting with St. Michael and Otsego. Mike Robertson reported that he and Ron Wagner met with the St. Michael City Administrator and their City Engineer today and they discussed Highway 101, Nabor Avenue Interchange on Highway ,94, and sewer service. A joint meeting with the two City Councils` was recommended., The Council set September 22, 2004, 7 PM at Otsego for a joint meeting at Otsego City Hall. City Council Meeting of July 26; 2004.
