The project was represented by the developer, site designer and architect. There were no comments from the public and the public hearing was closed. The Planning Commission was very favorable to the overall site design and concept. They discussed with the site designer and architect the floorplans, orientation and location of the proposed "bayhome" dwelling units related to viewsheds and building setbacks. The Planning Commission concurred with City Staff that the combination of architecture and site design specific to these dwellings would allow for a reduction in the setback between buildings to 10 feet. Because of a number of outstanding engineering issues, the Planning Commission tabled action on the request to their meeting on 20 September 2004. The applicant met several times with the City Engineer on project issues to the point that approval of a preliminary plat is appropriate. There was no additional significant discussion about the project at the Planning Commission's 20 September 2004 meeting. The Planning Commission voted 6-0 in two separate motions to recommend approval of the rezoning and PUD-CUP/Preliminary Plat application. The applicant has also requested final plat approval. City Staff did not have the Planning Commission make a recommendation on the final plat as it is not required by the Subdivision Ordinance. City Staff believes that the required revisions to the site design and preliminary plat make approval of a final plat premature at this time. We recommend that the City Council approve the rezoning and PUD-CUP/Preliminary Plat, while tabling the final plat application. The proposed development will be considered at the City Council meeting on 27 September 2004 at 6:30 PM. Decision 1 - Zoning Map Amendment A. The proposed storm water discharge from Remington Coves at this apron is 3.21 cfs for the 10 -year storm. We need to look at upsizing the storm sewer in Martin Farms. The city will account for this flow in the 701h Street NE storm sewer. 4. Pond 1 is shown to discharge to an existing storm sewer catch basin at the north end of Otsego Preserve. The addition of 1,41 cfs for the 10 -year storm and 1,98 cfs for the 100 -year was not designed for in Otsego Preserve storm sewer. A storm sewer system must be routed along the south side of Remington Coves and the east side of Otsego Preserve (within drainage and utility easements) to the storm water pond in Otsego Preserve, 5 A minimum time of concentration (Tc) shall be 10 minutes for the hydrology and storm sewer sizing calculations. 6 Storm sewer pipe must be a minimum of 15". 7 Minimum cover over storm sewer pipe is 2' for pipe in the R,O.W and 1.5' of cover in green areas. 8 Minimum velocity through storm sewer pipe shall be 3.0 fps. 9 Provide 0.8 diameter points fall through storm sewer manholes when increasing pipe size. 10. Call out the class of each RCP storm sewer pipe in the profiles in the construction plans. 11. Label the catch basins and manholes in the plan view, in the construction plans, 12, The outlet structures for the sedimentation ponds must be revised to Standard Plate #403. The various sized orifices shall be located in the weir within the structure. 13. There appears to be some differences in the storm sewer layout between the plan drawing vs the profile drawing. Depict the sanitary and water services to each lot in the construction plans as shown on the preliminary plat, 3. The first 20' of the upstream pipe out of a drop manhole must be DIP, 4. Label the inverts of sanitary manholes with the direction of the inverts. 5. Include the storm sewer crossings, with a lighter shade, -in the sanitary sewer and watermain profile to help prevent conflicts between pipes. 6. Mr. Chris Bulow was present to represent the project. The only issue of discussion related to the color packages for the buildings. The City has required a variety of colors be used within townhouse developments to avoid a monotonous appearance. Mr. Bulow pointed out that this project will have smaller clusters of townhouse units (ranging from 4 to 21 dwellings) each with different buiders and that requiring each builder to provide four distinct color options would be problematic and not like have the desired effect. The Planning Commission concurred and will allow the same exterior color for the dwellings within each individual detached block. The City Council will consider the proposed building plans at their meeting on 27 September 2004 at 6:30 PM. The Planning Commission voted unanimously to recommend approval of the building plans subject to the following modified conditions. 1. Brick (or stone) wainscoting is to be provided: a. Along the side elevation between the main entry and front line of the garage. b. A minimum of four feet on the side elevation opposite the main entry. C. On the rear elevation of the building where the building faces the golf course. 2. Vinyl shake siding is to be used within the peaks of all gables. 3. Shutters shall be provided for windows on the rear elevation of the dwelling. 4. At least four color packages shall be identified with no single color package use for more than 50 percent of all the detached townhouse dwellings within the fina plat. 5. Our office undertook this effort as part of the recodification of the City Code and presented draft language to the City Council on 22 March 2004. The draft language includes a general limit of 18 hours for on -street parking, a prohibition of parking between 2:00 AM and 6:00 AM, establishes provisions for snow emergencies and designation of parking zones. Language from previous ordinances addressing on -street parking of semi-tractor/trailers is also included in the new ordinance and updated to be consistent greater weight allowance specified within the Zoning Ordinance. City Staff recommends approval of the proposed ordinance in the form attached hereto. The City Council referred the on -street parking ordinance to the Police Commission for review and recommendations at their meeting on 22 March 2004. No comments or recommendations have been received from the Police Commission regarding the draft parking ordinance as of this date. If the parking ordinance is to be established in advance of this upcoming snow season, the City Council needs to take action soon so that information regarding the parking limits can be distributed via the Otsego View, Elk River Star News and City's web site. Mike Robertson Judy Hudson Andy MacArthur Ron Wagner SECTION 3 ON -STREET PARKING Section 8-3-1 Purpose 8-3-2 General Parking Prohibitions 8-3-3 Exceptions 8-3-4 Parked Vehicles Impounded 8-3-5 Penalties 8-3-1: PURPOSE: The City Council finds that it is necessary to promote the health, safety, and welfare of the citizens of Otsego, and to promote traffic flow, that restrictions be placed upon the parking of certain vehicles upon City streets. (Ord. 95- 28, Nov. 13, 1995) 8-3-2: GENERAL PARKING PROHIBITIONS: A. General Limit. Parking of vehicles is hereby prohibited for more than eighteen (18) hours continuously on all streets within the corporate limits of the City, with the exception of those streets or highways otherwise provided time limitations in Section 8-3-2.0 of this City Code. B. Trucks and Semi -Tractors and Trailers. Commercial vehicles, semi -tractors, trailers or trucks exceeding a gross vehicle capacity of twelve thousand (12,000) pounds or an overall length of twenty-five (25) feet may not be parked or stored on streets or highways within the City. C. Designation of Parking Zones and Fire Lanes. 1. The Council may, by resolution, designate streets, blocks or alleys, or portions thereof, as no parking zones, as fire lanes, or as five (5) minute, ten (10) minute, fifteen (15) minute, thirty (30) minute, one (1) hour, two (2) hour, or three (3) hour parking zones. 2. The Council may also upon application by the Fire Marshal or an owner, lessee or operator of any building, which building generally attracts numerous numbers of the public, designate and thus establish a fire lane upon private property. The application shall be reviewed and approved or disapproved by the Fire Marshal prior to being presented to the City Council for approval. The designated area, when approved by the City Council, shall effectively become a fire lane. 8-13 3. All designated zones pursuant to this section shall be appropriately marked at the direction of the City, at the property owner's expense when on private property, and the City's expense when on public property. Unless otherwise provided within the resolution or application approval, such restrictions shall apply every day of the week, including Saturdays, Sundays, and holidays. D. Night Parking. No vehicle shall be parked upon any public street in the City between the hours of two o'clock (2:00) AM and six o'clock (6:00) AM inclusive, on any day of the year, including, but not limited to, Saturdays, Sundays and holidays. E. Snow Emergency. After a snowfall of at least two and one-half (2-1/2) inches in the City, parking is prohibited on any public street or alley until and after that particular street or alley has been plowed and the snow removed to the curb line. It is unlawful to deposit snow or ice, plowed or removed from private property, onto the traveled portion of a street, alley or public way. F. Immobile Vehicles and Trailers. Vehicles and trailers incapable of movement under their own propulsion shall not be parked or stored on streets within the City. G. Access. No vehicle shall be parked so as to obstruct a public sidewalk or trail or block access to a driveway or block access to a mailbox. The vehicle will be surrendered to the duly identified owner thereof upon payment of the required fees for such towing and storage. The current and draft Comprehensive Plan would limit the amount of capacity available for residential development to 70 percent of the total available capacity, or 420,000 gpd. This capacity is sufficient to serve 1,680 residential dwellings at 250gpd per dwelling (REC). The current total of final platted residential dwellings for which sanitary sewer service has been allocated is 1,099. No final plats have been approved for the Duerr property or Remington Coves, which would add an additional 180 dwelling units if both projects are final platted in one phase as intended by the developers. This means there are only 401 RECs available for residential use in accordance with the Comprehensive Plan policy and 1,121 RECs of actual total capacity remaining to be allocated. We believe it is prudent that the City not accept any new applications for preliminary plats within the west sanitary sewer district. Final plats should continue to be processed up to the point when the capacity for residential development has been allocated. At that time, we would recommend that the City Council initiate efforts to expand available capacity of the west waste water treatment plant. C. Attorneys at Law 705 Central Avenue East PO Box 369 St. Michael, MN 55376-0369 (763) 497-1930 (763) 497-2599 (FAA) courimacarthur@earthlink. net RE: Waterfront East Developer's Agreement Dear Council Members: City staff has recently met with representatives of Landcor and Waterfront East, LLC, including Bob Fields, relative to incentives being requested for the proposed development of the Waterfront East, as well as donation of land for construction of the interchange at County Road 39 and Highway 101. It is Landcor's goal to have a Developer's Agreement approved at the October 11, 2004 City Council meeting. Landcor is requesting various incentives, which are outlined below. 1. Landcor is requesting that the City pay the value of land required for the proposed Highway 101 interchange upfront at the time of transfer and that the amount paid then be assessed against the Waterfront East property. At this time the value of that land has not been calculated. Normally land acquisition can be included as an assessable portion of a project if that land is a part of the project being assessed. In this case, the land is actually being donated for the State project. Normally, if a property owner contractually agrees to an assessment it theoretically does not matter what the assessment is for, however if any payment from the City would come from money received as part of a bond the City may want to inquire of bond counsel as to their opinion on the matter. If I understood Mr. Field's correctly he is contemplating that a Developer's Letter of Credit would cover this amount until paid off. Letter to Otsego City Council September 23, 2004 Page 2 2. Landcor is requesting that park fees for the property be waived as it will be donating an easement to the City over that portion of the property abutting the Mississippi River which has been shown as Outlot A. This portion of the plat remains in the Wild and Scenic District and will only be used for ponding and recreational purposes. 3. Landcor is requesting that the City consider abatement of all or a portion of the City share of taxes up to an established amount, and that the abatement be assignable on a pro -rated basis to certain portions of the Plat as users buy lots. The City authority for tax abatement comes from Minnesota Statute 469.1813 and requires that the City determine a basis for the abatement based upon benefits to the City at least equal to the costs of the proposed agreement. The City must also determine that tax abatement would be in the public interest because it will "increase or preserve tax base" or "provide employment opportunities in the political subdivision." Abatement requires a City Council resolution specifying ing the terms of the abatement. The abatement may reduce all or a portion of the City's share of taxes on the parcel. The abatement requires a noticed public hearing and, unless special conditions are met, cannot last longer than 10 years. The City has done a tax abatement once previously for the Apex Building site. It would not be possible to put any more of a commitment into a Developer's Agreement than that the City would consider an application for tax abatement. Any abatement granted would be included in a separate agreement between the City and the property owner. 4. Landcor has previously requested that the City construct infra -structure, including sanitary sewer and water utilities, storm -water pipes and retention ponds and public streets within the Waterfront East plat, as a City project and then assess the project costs back to the lots within the plat.. The overall project costs would be covered by a Developer's Letter of Credit which would be reduced at the time that parcels were sold and developed and that parcel paid a portion of the assessment. This is the same procedure used on the Waterfront West project except that Mr. Fields is in this case requesting that the assessment be extended over a term of twenty years and that actual assessment not to occur until 2007. In the previous agreement with Waterfront West the project was assessed back to the property with a similar delayed assessment over a seven year period. Mr. Fields has requested that the compensation appearing above be included within the Developer's Agreement for Waterfront East. I have previously submitted a draft Developer's Agreement for the Plat which the Council has not yet approved. I have gone over that Agreement with the Mr. Field's attorney and only minor changes have been requested. In order to be able to draft the Letter to Otsego City Council September 23, 2004 Page 3 Agreement I need to have some input from the Council as to what is and is not acceptable. The basis for providing compensation to the Developer for this project should be related to the value of property being donated for City benefit as a portion of the City share of interchange costs. The City could also agree that certain incentives are appropriate due to the type of commercial development proposed and its overall benefit to the City. Any decision to provide incentive to the Developer must not be based upon delays to the project caused by rejection of the initial Plat by DNR, nor on any alleged loss of development potential for properties within the Plat that still remain within the Wild and Scenic. The Developer was notified up front and repeatedly during the initial platting process that final City approval was subject to DNR approval. I think that the issues raised by the Developer are probably best discussed at a workshop meeting. The meeting would have to be held as soon as possible in order to be placed on the October 11 City Council agenda.
