City Staff specifically reviewed if development rights from non- contiguous parcels were transferred by CUP to allow for the Rolling Ridge Creek subdivision in 1996. Although the Planning Report reviewing the density transfer CUP and preliminary plat for Rolling Ridge Creek references only contiguous parcels, the public hearing notice and recorded deed restrictions include lands under the same ownership, but which were not contiguous. There are seven lots within Rolling Ridge Creek and at least three dwellings on the other dedicating parcels, so transfers from the non-contiguous parcels would have been necessary. The City Council may take the past transfer from non- contiguous parcels into consideration when acting on the requested text amendment. However, it is important to understand the basic underlying principal is that the resulting number of dwellings between the parcels in a density transfer is never greater than the number allowed by the Comprehensive Plan. In the case of Rolling Ridge Creek, the density for the all of the parcels together involved in the transfer and preliminary plat did not exceed 1 dwelling per 40 acres (the maximum at that time). Likewise, the sum of the dwellings in Grenins Mississippi HillsNintage Golf and the proposed Mississippi Cove cannot be and is not more than 12 dwellings per acre. The basic premise of a density transfer is to cluster development of similar intensity and character in one location as opposed to being spread out. Provided that the proposed subdivisions occurring in conjunction with the transfer of development rights are consistent with all applicable performance standards, there would be no negative impacts expected. This is especially true for subdivisions being requested under R -C District requirements, where the City has greater latitude to approve or deny applications based on subjective guidelines. Given the limited area available for R -C District development, we do not believe that allowance of development rights transfers will result in significantly more development activity, just as it hasn't in other areas of the City where it is currently allowed. To further limit opportunities for density transfers, the City Council may consider changing the draft Ordinance amendment to not provide for density transfers from the Urban Service Area Reserve to the Rural Residential Preserve area, essentially limiting the opportunity to the area planned for cluster subdivisions. The City Council may also consider a restriction that a parcel from which development rights have been transferred may not be further subdivided for a period of five or ten years. Specific to this application, the proposed subdivision meets all of the applicable requirements of the R -C District. Furthermore, the subdivision provides for dedication of land over and above standard requirements of the Subdivision Ordinance. This dedication of land, which is critical to the greenway corridor discussed along Northwest Creek, may be considered as part of the justification for development above four dwellings per 40 acres, and including the transferred development rights. The following are a list of possible actions for the City Council to consider. We have drafted both findings approving and denying the requested Zoning Ordinance text amendment. If the Zoning Ordinance text amendment is denied, then an additional condition must be added to the preliminary plat approval requiring elimination of three lots. This application will be discussed at the City Council meeting on 10 May 2004 at 6:30 PM. Decision 1 — Zoning Text Amendment A. Motion to approve an amendment to the Zoning Ordinance establishing transfer of development rights within the R -C District by conditional use permit. B. Motion to deny the application based on a finding the request is inconsistent with the Comprehensive Plan. C. Motion to table. Decision 2 — Zoning Map Amendment A. Motion to approve a Zoning Map amendment rezoning the subject site from A-1 District to R -C District based on a finding that the request is consistent with the Comprehensive Plan. 2 B. Motion to deny the application based on a finding the request is inconsistent with the Comprehensive Plan. Decision 3 — Preliminary Plat / CUP A. Motion to approve a preliminary plat and CUP for transfer of development rights for Mississippi Cove, subject to the following conditions: 1. The applicant shall provide for acquisition of necessary right-of-way and construction of Mason Avenue at their expense. 2. The applicant shall provide for a second public access to the proposed subdivision, subject to approval by the City Engineer and Wright County. 3. The applicant is to provide a landscape plan for the Mason Avenue median and Outlot A, which is to include seedling clusters for future buffering along CSAH 39. 4. All street, grading, easements and utilities are subject to review and approval of the City Engineer. 5. The applicant shall dedicate 18.48 acres in satisfaction of park and trail dedication requirements at the time of final plat approval. B. Motion to deny the application based on a finding the request is inconsistent with the Comprehensive Plan. Decision 4 — Town Plat Vacation A. CITY COUNCIL MEETING: 26 April 2004 FINDINGS: Based upon review of the application, the recommendation of the Planning Commission, and evidence received, the City Council of the City of Otsego now makes the following findings of fact: A. The requested text amendment is made in conjunction with the proposed Mississippi Cove preliminary plat to allow transfer of three development rights from other properties within the City of Otsego. B. Consideration of the application by the Planning Commission and City Council is to be based upon, but not limited to, the criteria outlined in Section 20-3-2.F of the Zoning Ordinance: 1. The proposed development shall conform to the open space, neighborhood and general development standards of the R -C District. 3. The property from which the development rights are to be transferred shall be located within the rural residential preserve of established by the Comprehensive Plan. 4. Not less than one (1) development right shall be retained by the parcel transferring development rights. 5. A deed restriction is recorded on the parcel transferring development rights to prohibit additional subdivision or development unless allowed by the Comprehensive Plan. 6 The parcel transferring development rights shall be restricted from further subdivision for a period of not less than five (5) years from the date of approval of a conditional use permit under this Section. We have not received storm water calculations at this time, but the storm sewer layout and pond sizes causes no concerns. The developer will be required to drop the storm sewer within piping and manholes down to ordinary high water of the Mississippi. Also, adequate erosion control at this outlet will be required. This will help prevent erosion from the bluff down to river's edge from happening. 4. A 2nd access is required for safety purposes. The County allows City street access along County Highways at spacing of % mile. The submitted final plat illustrates existing improvements on the existing property. Preliminary plat approval was conditioned upon removal of all detached accessory buildings. Lots 2-5 are required to access 79th Lane and a landscape plan for the rear yards of these lots abutting 80th Street has been submitted. Lot 1, Block 1 is the location of the existing dwelling and the construction plans indicate two possible driveways one to 80th Street (existing) and one to 79th Lane. Only one driveway is allowed. It would be preferred if the existing driveway to 80th Street could be closed, but the orientation of the garage makes this problematic. Construction Plans. The applicant has submitted construction plans for the proposed area of the final plat. These plans address grading, street and utility construction and other site improvements. The construction plans are subject to review and approval of the City Engineer. Park and Trail Dedication. There is no land being dedicated for park and trail purposes from the area of the final plat. As such, the applicant must pay a cash fee in lieu of land to satisfy park and trail dedication as per Section 21-7-18 of the Subdivision Ordinance. The current cash fee in lieu of land is $2,820.00 per dwelling or $31,020 for this final plat. Development Contract. The applicant is required to enter into a development agreement with the City and pay all applicable fees and securities upon approval of a final plat. The overflow elevation on the rear lot line of Block 12, Lot 8 does not agree with the contours. 4. The grading shown for Block 5, Lots 30 thru 32 does not work. Please revise. 5. The proposed final plat consists of 176 single family lots. The subject site is currently platted as Outlots B and C of the Arbor Creek final plat. The subject site guided by the Comprehensive Plan for low density residential use and is zoned R-6, Residential Townhouse, Quadraminium and Low Density Multiple Family District. The Arbor Creek preliminary plat was approved by the City Council on 10 March 2003. Exhibits: A. Site Location B. Preliminary Plat C. Final Plat ANALYSIS Preliminary Plat Consistency. The proposed final plat includes the same number of lots over the same area of the subject site, except that there is one less lot in Block 10 and one additional lot in Block 8. All of the proposed lots conform to the requirements of the R-6 District and Shoreland Overlay District. One change from the preliminary plat is the extension of 76th Street to the east plat line. The preliminary plat identified a street connection to the east in the area of Lots 4 and 5 of Block 7. The applicant has cooperated with City Staff to relocate the street connection to provide better access and circulation between the subject site, Martin Farms and future subdivision of the Dale Beaudry property. Feedlot Setback. Section 20-27-9 of the Zoning Ordinance requires a 1,000 foot setback for any new dwelling from a registered feedlot. The 1,000 foot boundary from the Berning feedlot on the north side of 80th Street crosses through Lots 9 and 10, Block 2 and Lots 1-4, Block 3 according to the preliminary plat. The applicant must provide house plans for these lots illustrating compliance with the setback requirement or the lots must be platted as outlots. Construction Plans. The applicant has submitted construction plans for the proposed area of the final plat. These plans address grading, street and utility construction and other site improvements. The construction plans are subject to review and approval of the City Engineer. Park and Trail Dedication. The applicant dedicated land adjacent to the west treatment with the first final plat of Arbor Creek. This land only partially satisfied the applicant's park and trail dedication requirements outlined by Section 21-7-18 of the Subdivision Ordinance. The balance of the required park and trail dedication is to be in the form of a cash fee in lieu of land as shown in the following calculations: Cash Fee x Remaining Dedication = Required Fee/Lot x # of Lots = Payment $2,820.00/dwelling x 69.9% = $1971.18/dwelling x 176 lots = $346,927.68 The park parcel is identified as Outlot B on the final plat. CITY COUNCIL MEETING: 10 May 2004 FINDINGS: Based upon review of the application, the recommendation of the Planning Commission, and evidence received, the City Council of the City of Otsego now makes the following findings of fact: A. The legal description of the property is attached as Exhibit A. B. The property lies within the West Sanitary Sewer Service District and is guided for low density residential land uses by the Otsego Comprehensive Plan, as amended. C. There is a limit to the available funds. Last year we did not reach the limit. But this year demand is up and in particular the Federal Aid fund shortage has many of you turning to advancing to save your projects for this year. Remember advancing is first come, first served. Some of you seem to be basing your capital improvement plans on the assumption you can advance. This is risky. If we run out of money, you will not be allowed to advance. Advancing works well for time shifting projects and balancing workloads. We love to work with you toward that objective. But I would advise against programming too aggressively. You may not get an advance if the money runs out and you need to be prepared for that. We are committed to making every dollar at our disposal available, but the fund has lowered in recent years. ,is year we have $27,000,000 to advance, but based on the resolutions file, there is less than $4 million left if everyone uses the total amount indicated. The resolutions do not reserve the money for you; they are a budget tool for us. We know people send in more resolutions than they need and as money gets tight, we need to improve this communication with you to know who needs money and who doesn't. We need new forms to do this and we will have them at the prescreening meeting. I think we have a good supply of money still. The federal situation is a wild card. If you need an advance this year, remember first come, first served based on actual requests. And understand and use the process to "reserve" your advance while advertising a project for bids so the money is held for you during that time. If you are planning an advance for a future year, just be a little cautious as to promising construction schedule based on "borrowed" money. The good news is we're getting the fund balance down. The fee is presented for two expansion scenarios: 1 Expand the plant to 1.5 MGD capacity with sludge storage facilities of the same capacity. 2. Expand the plant to 1.5 MGD capacity without sludge storage, but instead relying on some other temporary solution for sludge storage and disposal that does not involve construction of large on-site storage, such as hauling to another WWTP Expansion Scenario I (With Storage) Estimated construction cost $ 9,500,000 Bonestroo design fee 476,600 Bonestroo estimated costs for construction phase 610,000 Expansion Scenario II (Without Storage) Estimated construction cost $ 7,500,000 Bonestroo design fee 381,000 Bonestroo estimated costs for construction phase . 488,000 If the Council prefers, we can replace the percentage fee table in our engineering agreement with either one of the lump sum design fee figures above.
