No No (unless assessment set above waived amount) BACKGROUND/JUSTIFICATION The Jalger Avenue and 100th Street Improvement project is complete. The project went very well and we received several positive comments from the residents on how the project turned out. City staff has reviewed the overall project costs versus the feasibility estimated costs, which were $128,331.00 and $142,785.09, respectively. The costs for the paving portion of the project were very close to the estimate included with the feasibility report as were project administration and overhead costs for (including the efforts to obtain the assessment waivers) the project and the right-of-way vacation. Storm water improvements that were not included in the feasibility report did result in the project exceeding the feasibility estimate. During the project design, we found that improving the storm sewer facilities would be critical to having a successful project. The existing storm sewer directed water from City right-of-way down toward the river unabated and it was our opinion paving the street may exasperate the issues. The new storm sewer includes infiltration areas and includes energy dissipating design and devices to mitigate storm water issues. We have had some significant rainfalls since installation and the new storm sewer has performed well. It was not possible to estimate the extent of the storm sewer work as part of the feasibility report without the survey work that was done after the project was approved. With the addition of a 10th assessed parcel to the project for which the owner waived the same $14,259, the total amount of waived assessments is $142,590 rather than the feasibility amount of $128,331.00. The completed project costs are $142,785.09, which exceed the current waived amount by $195.09 or 0.14%. A Project Cost Summary Sheet is shown depicting all on the overhead costs for the project. For small assessment projects such as these it is not uncommon to see overhead costs near 33% and on future projects we will include 33% as the overhead in the feasibility report rather than 25%. Due to the overage being storm water related and a fairly insignificant amount in comparison to the cost to hold a public hearing, staff is recommending the $195.09 should be paid out of the "Out District" Storm Sewer fund. The City Attorney has stated reopening the assessment hearing may allow parcel owners an opportunity to contest the entire assessed amount including the waived portion which constitutes 99.86% of the project costs. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included in hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 15 years, the first of the installments to be payable on or before the first Monday in January, 2015 shall bear interest at the rate of 3.4 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2014. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certifications of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city clerk, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and the owner may, at any time thereafter, pay to the city clerk the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. Such assessments shall be collected and paid over in the same manner as other municipal taxes. Adopted by the council this 13th day of October, 2014.
