12-08-03 CCITEM 3-1. OTSEGO CITY COUNCIL MEETING OTSEGO CITY HALL DECEMBER 8, 2003 6:30 PM 1. Mayor Larry Fournier will call the meeting to order. Mayor Fournier called the meeting to order at 6:30 PM. Roll Call: Mayor Larry Fournier; Councilmembers: Virginia Wendel, Dan Scharber, Jerry Struthers and Vern Heidner. Staff: Mike Robertson, City Administrator; Judy Hudson, City Clerk, Andrew MacArthur, City Attorney; Ron Wagner, City Engineer and Bill Morris, Assistant City Engineer. Pledge of Alle iance: Mayor Fournier led in the Pledge of Allegiance. 2. Consider agenda approval CM Wendel requested to move the Claims List Item 5.1. to Item 9.3. for discussion. Mayor Fournier requested to move Item 5.2. to Item 10.2., add under 10.3 January 2004 City Hall Hours. CM Struthers requested to add under Item 10.4. Memo of 12-04-03 from City Administrator. Mike Robertson requested to add under Item 10.5. City Council Workshop with Sheriff. CM Scharber requested to add under Item 10.6. Peavey House Update. CM Struthers motioned to adopt agenda as amended. Seconded by CM Scharber. All in favor. Motion carried. 3. Consider the following minutes: 3.1. November 24 2003 City Council Meeting_ CM Struthers requested to delete Otsego Festival Commission Members and insert citizens under Item 4, and under Item 10.2. add that BMX Track be considered. CM Wendel motioned to approve minutes as corrected. Seconded by CM Struthers. All in favor. Motion carried. 3.2. Truth and Taxation Meeting. Under Item 5. strike out and the Comprehensive Schedule. CM Struthers motioned adoption. Seconded by CM Wendel. All in favor. Motion carried. 4. Open Forum: (5 minute limit) Arne Hendrickson, Center Point Energy/Minnegasco, awarded the City a check for $2,500 for the 2004 Tree Planting Project along City Bike Paths. Jim Michael, 15530 88`h Street NE. Mr. Michael stated concern of the population growth, especially in the ISD 728, and asked if there is anything we can do as a City to work with the school and community, to help out on the bond referendums. He feels this is a school, community and taxpayer issue and the City should be able to do something to help with bonding. Mayor Fournier stated he always has supported the School Districts to collect impact fees City Council Meeting of December 8, 2003. Page 2. for new developments the same as the City does, but the State does not currently allow this. Mayor Fournier also feels the school needs to work into a planning mode rather than just reacting to growth. Mike Robertson explained Otsego is only about 15% of the school population. He has been working with the school district to help them select future school sites. CM Heidner stated that all the other communities in the district have doubled in population and Otsego's growth has come well after other cities. 5. Consent Asenda. (non -controversial items 5.1. Approve Claims List. 5.2. Resolution for Calling for the Redemption of the Outstanding GO Improvement Bonds, Series 1996A All items removed. 6. Dan Licht, City Planner: No items 7. Ron Wagner, City Engineer: 7.1. Consider Change Order No. 3 for Pump House No. 3, Bill Morris went over the Change Order, Ron Wagner said Items No. 3, 4, and 6 can be charged to the developers. CM Struthers motioned to approve Change Order No. 3 for $44,220.00. Seconded by CM Heidner. All in favor. Motion carried. 7.2. Any other EngineeringItems. ems. Ron Wagner said that he is meeting with Jerry Kurti on December 15, 2003 to discuss the watermain going across their property. He also needs a motion to get an appraisal on Clem Darkenwald's land for right-of-way acquisition for Quaday Avenue Improvement. Mayor Fournier motioned to order appraisals. Seconded by CM Heidner. All in favor. Motion carried. 8. Andrew MacArthur, City Attorney 8.1. Dog Ordinance. Mayor Fournier set December 18, 2003, 5:00 PM for a Workshop to review this ordinance. 8.2. Ward Information Update. Andy MacArthur in his research couldn't find any way that statutory cities, which Otsego is, could establish wards. Other statutory cities that have wards are Elk River, Hibbing and St. Peter and they typically established them as part of annexation agreements. When Otsego was incorporated, wards could have been set at that time. All other cities with wards are Home Rule Charter Cities. Mike Robertson was directed to contact the League to see if they are interested in supporting that statutory cities can establish wards. 8.3. Any other Legal Items. Approve 2004 Tac Lever CM Struthers motioned to adopt Resolution 2003-88 setting a tax Levy of $1,673,967 for 2004 Budget Appropriations. Seconded by CM Wendel. All in favor. Motion carried. 9.3. Approve 2004 Budget CM Scharber motioned to adopt Resolution 2003-89 setting a Budget of $1,77,332 for 2004. Seconded by CM Heidner. All in favor. Motion carried. 9.4. 5.1. Claims List. CM Wendel asked about the Animal Control spending of $328.00. CM Wendel motioned to approve the Claims List. Seconded by CM Scharber. All in favor. Motion carried. 10 Mike Robertson City Administrator: 10.1. Update Project Priorities Council added under the City Administrator to work with County on road projects as priority 4 and add Island View Erosion Report under Engineer's after Otsego Creek Improvement. 10.2. Resolution for redemption of GO Bonds CM Struthers motioned to approve Resolution calling the GO Bonds. Seconded by CM Heidner. All in favor. Motion carried. 10.3. City Hall Hours for 2004 The new City Hall hours of adding 8:00 AM to Noon on Fridays was explained by Mike Robertson. This will announced in the next Otsego View. 10.4. Letter of December 4, 2004. Officer Mitchell was in attendance and he updated the Council on his service calls and also that he sees more speeding on CSAH 19 than on CS -AH 39. 10.5. Workshop with Sheriff. March 17, 2004, 6 PM was set to meet with the Sheriff. 10.6. Update of Peavey House Check the acreage for Peavey House. 11. Judy Hudson City Clerk 11.1. Consider Monticello Fire Contract CM Wendel motioned to approve the contract. Seconded by CM Struthers. All in favor. Motion carried. CM Scharber said he talked to the Albertville Fire Chief who was wondering when the fire hydrants will have water. Mike Robertson will contact him. City Council Meeting of December 8, 2003. Page 4. 12. Adjourn by 10 PM. Regarding the Resolution from Monticello regarding annexation, the Council feels they need to see both sides of the issues. Mayor Fournier motioned to adjourn.
