Staff recommends approval of Ordinance No. 2014-14 adding language to the City Code allowing
inspection of sump pump discharge, a time allotment for compliance of non-compliant discharges and a
monthly surcharge for continuing non-compliant connection.

BACKGROUND/JUSTIFICATION:
Dan Licht, City Planner has drafted an ordinance amending the current City Code related to the
inspection of sump pumps within the sewer districts. The amendment incorporates the inspections, time
to correct and the surcharge if the errant connection is not fixed.
Procedures are being developed and will be instituted next spring to have all of the City's west
connections inspected prior to September of 2015. We anticipate this amendment and subsequent
inspection and code enforcement to result in a significant reduction of unwanted flow from entering the
treatment facility during and after heavy rain events.

ORDINANCE NO.: 2014-14
CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
AN ORDINANCE AMENDING THE CITY CODE RELATED TO INSPECTION OF
SUMP PUMPS WITHIN THE SEWER DISTRICTS.
THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN:
Section 1. Chapter 2-4-2.J.1 of the City Code is hereby amended to add the
following provisions:
e. Sump Pump Surcharge: $100.00/month
Section 2. Section 6-3-7.D.4 of the City Code is hereby amended to read as
follows:
4. Inspections:
a. The Building Official, Public Utilities Supervisor, City Engineer or
other authorized City staff shall at reasonable times be permitted to
enter upon all properties connected to the sanitary sewer system
for the purpose of an inspection and observation, to determine
whether the requirements of this subchapter are being complied
with.
b. A utility surcharge shall be established in Section 2-4-2.J of the City
Code and charged to properties in accordance with Section 6-2-3 of
the City Code for the following reasons:
(1) Non-compliance with the requirements of this subchapter not
corrected within thirty (30) days after the date of an
inspection by the City.
(2) Properties that have not complied with a request for an
inspection within thirty (30) days of mailed notice by the City.
C. The City further reserves its rights to all criminal, civil or
administrative actions necessary for the administration and

enforcement of this subsection.
Section 3. This Ordinance shall become effective immediately upon its passage
and publication.
