04-26-04 PHITEM 3.3 PUBLIC HEARING QUADAY AVENUE APRIL 26, 2004 6 PM 1. Mayor Fournier will open the Public Hearing. Mayor Fournier opened the meeting at 6:00 PM. Roll Call: Mayor Larry Fournier; Councilmembers: Vern Heidner, Virginia Wendel, Jerry Struthers and Dan Scharber. Staff: Mike Robertson, City Administrator; Judy Hudson, City Clerk/Zoning Administrator; Ron Wagner, City Engineer and Jeff Elliott, Assistant City Engineer; Andrew MacArthur, City Attorney and Dan Licht, City Planner. 2. City Attorney comments. Mr. MacArthur explained the purpose and legal process of the Improvement Hearing. Mr. MacArthur talked to John Jackels today. He is the project manager for Emmerich Development. Mr. Jackels did question the benefit to his property but if everything is appraised he feels everything could be worked out with the City. 3. Project presentation by City Engineer. Jeff Elliott presented the Feasibility Report for the Quaday Avenue Project dated April 2004. The project cost is $2,153,708 million dollars. Quaday will be a 46 foot wide Collector Road with curb and gutter. The City will assess $615,000, with $186,086 collected up front and defer the balance until the land is developed. Mr. Elliott feels this project is feasible and a benefit to the abutting properties. Ron Wagner stated the Council has looked at what other projects have been assessed. The city has assessed 100% for residential streets in the past. Judy Hudson attested all proper noticing and publishing was done. 4. Public Comments. Mayor Fournier opened the Pubic Hearing for comments at 6:15 PM. George Yankoupe, D & Y Family, River Road, asked about the Storm Water Shed. Mr. Wagner explained the east side of Quaday Avenue runs towards the east under Highway 101. On the west side there is a storm sewer in the road and goes down to Lefebvre Creek. Storm ponds would still need to be put in. Tom Nichols, VFW, Elk River, 7350 Quaday. When they did the road he thought water and sewer was installed then. Ron Wagner explained the water and sewer charges are the trunk charges and he would only being charged for a portion of the road. Quaday Avenue Public Hearing of April 26, 2004. Page 2. 5. Close the Public Hearing. Hearing no further public comments Mayor Fournier closed the Public Hearing at 6:21 PM. Mr. MacArthur explained the easements would be appraised next month. The appraiser has been given everyone's phone numbers and he will be in touch with everyone. Mayor Fournier asked if everyone likes the project. No one objected to the improvement. CM Heidner noted that if the easement costs come in higher than estimates, the assessments could go up. 6. City Council Discussion. CM Heidner motioned to adjourn. Seconded by CM Wendel.
