09-26-05 CC September 26, 2005 Rain issues at 8925 Mason Ave. NE, Otsego The creek used to dry up during the summers BEFORE: • The Outlet Mall • The housing developments south of Mason Avenue (Towne Lakes, Martin Farms, etc.) • Approximately 6 -7 years ago, some culverts were changed at key points to accommodate the flow of water in Otsego creek. In June 2003, with the 10" rain, our yard was flooded, as were some neighbors. • We sand bagged the perimeter of our house with sand bags from the City of Champlin due to the lack of preparedness from the City of Otsego. After the 2003 event, the city engineer contacted us at our request, and we spoke about the future of Otsego creek. • He stated that the new development would be equipped with holding ponds to accommodate a 6" rainfall. • I asked a hypothetical question: "What happens when the holding ponds are full and the rain continues to fall ?" He didn't have an answer. • He also stated that the DNR is very restrictive on the amount of water flow and how fast it can be dispensed into the Mississippi. Now, summer 2005 the average summer depth of Otsego creek was 12 " -18" With the 6 -8 " rain on 9- 13 -05: • The creek rose to approximately 50" in depth. (or 27" from the top of the culvert) With the 2.5" rain on 9 -21 -05 • The creek rose to approximately 52" in depth, or 25" from the top of the culvert. As of today, it remains at 42" deep and not dropping very fast. Larry Fornier stated, last week during a phone conversation, that Albertville's water flow amounts that are dispensed into the creek are being monitored or controlled. • By whom is it monitored? • Where is the documentation? • Is there an agreement between the Cities of Albertville and Otsego about water flow? • There will be future development. The roads, storm sewers and homes are established in Martin Farms. What happens when roofs, driveways and final yard grading are done? More water? How good is the future planning on your computer generated model? • What happens when we get a heavy winter snow fall, rapid thawing, and frozen ground? • How many council members are aware of the local creek flooding? • Should we as citizens of Otsego lie awake every time it rains for fear that my property will be damaged because of a creek? How do you plan on addressing this issue? Are you willing to pay for property damage which will occur if the creek rises too high and too fast because of authorized development? It is important to note that the applicant has taken immediate action to rectify the second access situation upon receipt of an Administrative Notice for violation of the Zoning Ordinance. Their cooperation and attention to resolving this issue has been greatly appreciated by City staff. Additionally, as a condition of approval the applicant is required to pave the second access and has up to one year to do so. The applicant was present at the public hearing and there were no comments from the public. The proposed use's conform ity with all performance standards contained in the Zoning Ordinance (i.e., parking, loading, noise, etc.). Comment: The design and location of the second dr iveway shall conform to all 1 applicable Zoning Ordinance and Engineering Manual performance standards. 4. Mr. Tom Brown of Terra Development, Inc. and Mr. Daniel Green of Miller Dunwiddie Architects, Inc. were present to represent the project. A representative of Christ Lutheran Church, which is located north of the subject site, spoke at the public hearing with questions regarding the potential relocation of their driveway to 88 Street. The developer presented a revised site plan illustrating how the Church driveway would be relocated to align with accesses proposed with the project. City staff emphasized that the recommended condition of approval is that the developer revise their site plan to match the Church access or the developer pay to relocate the Church access through agreement with the Church. There were no other public comments. The only significant issue discussed by the Planning Commission related to the proposed architecture of the two retail buildings. Mr. Green explained the origin of the proposed forms and indicated that a major goal was to create buildings unique to this development. Mr. Brown and Mr. Green responded to the primary critique of the roof line of Building B indicating that they would explore some revisions to address the concerns raised by the Planning Commission. The Planning Commission closed the public hearing and voted 6 -0 to recommend approval of the applications as shown below. The applications will be considered by the City Council at their meeting on 26 September 2005 at 6:30 PM. POSSIBLE ACTIONS Decision 1 — Zoning Map Amendment A. PRELIMINARY UTILITY PLAN SANITARY SEWER SYSTEM 1. A sanitary sewer stub has been provided on the south side of 88 Street NE. Removal of the existing street is not required. The 8" sanitary sewer has been stubbed out approximately 74' @ 0.40% (to the R.O.W.) to the south of existing MH #20 -1. The stub has an approximate elevation of 845.49. 2. Connecting to the existing sanitary sewer manhole at the southwest corner of the Lot 1 building with a sanitary sewer service will not be allowed. Instead, extending the sanitary sewer line around from the connection at 88th Street NE shall provide the service to Lot 1's building. 3. Connecting sanitary sewer services directly to manholes is not allowed. 8 "x 6" wyes shall be used for all service connections. 4. There appears to there is less than the minimum 18" required separation between the sanitary sewer and watermain crossing north of San MH B. Currently there is only approximately 0.5'. 5. Please note that SDR 26 PVC pipe is required for all sanitary sewer services and fittings. Removal of the existing street is not required. The 8" watermain with a plug has been stubbed out approximately 84' (to the R.O.W) to the south of the existing 12 "x 8" cross. An 8" gate valve has already been placed on this stub. Connection with another valve in not needed. 2. Hydrant coverage is insufficient. Maximum hydrant spacing shall be 300 ft. in commercial, industrial or high- density residential areas. 3. The 16" DIP watermain is incorrectly called out a 12" DIP in the note "connect to existing 12" DIP..." at the northwest corner of Lot 2 building along C.S.A.H. 42. Please revise. 4. The method of connecting to the existing 16" and 12" watermain shall called out. For both connections a wet tap connection shall be made. 5. Two additional gate valves are required. Please locate one on each side of the 8 "x 6" tee to Lot 2 building. SURFACE WATER MANAGEMENT 1. Provide storm water runoff calculations. The 100 -yr flood must not peak within 1.5' of any buildings FFE. Storage of storm water up to 2' deep, with in the parking lots, is allowed. 2. Label the class of all storm sewer pipes. 3. Label the pipe grade and invert at CBMH 320 for Stub 321. 4. The minimum storm sewer pipe size shall be 15" diameter. 12" diameter pipe will be allowed for catch basin lead and on skimmer structure inlet pipe if necessary. Please revise the storm sewer from CBMH 311 to CBMH 310 and from CBMH 220 to CBMH 210. 5. Maintain a minimum velocity of 3 fps for a 10 -yr event. 6. Maintain a minimum cover of 2 feet from the top of pipe to top of casting or flow line elevation for RCP. HDPE pipe is not allowed in vehicle traffic areas. The cover at CB 230, CBMH 170, and CBMH 160 appear to have less than the required minimum. 7. The pipe grade from STMH 100 to the existing 30" stub does not agree with the existing pipe grade from the existing 30" stub to the existing manhole. Please revise. STREETS 1. There were no comments from the public. Rudy Thibodeau, John Brickley and Tim Phillips were present to represent four of the five property owners. Each indicated that the necessary agreements between the property owners agreeing to implement the proposed PUD District are in process of being reviewed by legal counsel before being forwarded to the City Attorney for review. Approval of the PUD District will require execution of these agreements prior to any use of the public right -of -way will be allowed for private uses. The Planning Commission raised no significant issues and closed the public hearing. The Planning Commission voted 6 -0 to recommend approval of the proposed PUD District. The City Council will consider the application at their meeting on 26 September 2005 at 6:30 PM. POSSIBLE ACTIONS A. The original development was Mississippi Shores 6 Subsequent re -plats have produced the 7 and 8 additions. The title should reference 6 th , 7th & 8th subdivision. 2. The business lighting should be equivalent to the lighting fixtures and materials currently used on the adjacent commercial development. The proposed lighting should match the existing lighting for the commercial development in the area. 3. Street crossings where pedestrians cross should utilize colored stamped concrete. The use of paver bricks in the roadway should be discouraged. 4. A 2 foot clear zone behind the curb should be maintained for safety and snow storage. 5. Revise the easements and include the correct exhibit layouts to correctly show the areas required for the sewer services, water services and storm sewer routes with adequate work zones. Remove the reference to Otsego Goodyear from the plans and easement exhibits. 6. These plans are intended to respond to the comments of the City Council regarding the appearance of the proposed subdivision (in particular the number of homes visible) from CSAH 39. In support of the revised plans, the developer has staked flags in the field to identify the location of an existing ridgeline and the proposed location of the first tier of houses. The developer has also provided cross - section illustrations to demonstrate the line -of -sight view from CSAH 39 of the proposed development. Exhibits: A. Revised Site Plan B. Cross Section Drawings ANALYSIS The major change between the original site plan and the revised submission is that 16 lots have been shifted away from areas immediately adjacent to or visible from CSAH 39. The overall number of lots (117) has not changed divided between 105 one -acre single family lots and 12 two -acre plus lots that would allow the keeping of horses. We would recommend that the "Dancing Branch" area be revised to located all of the two -acre lots to front the circular public street, eliminate the proposed cul -de -sac and maintain the center area for a common horse exercise area. Based on discussions with the developer, they are agreeable to this change. The critical aspect of the revised plans is the visibility of the development from CSAH 39. The developer has provided cross section drawings illustrating the line -of -signt view of a passenger vehicle from three locations along CSAH 39. From View A, the homes will be setback 475 feet from CSAH 39 and screened by a landscaped berm close to CSAH 39 and trees planted on both sides of the cul -de -sac street accessing the 10 lots within the "Plum Creek" neighborhood. Perspective B shows a view of the western edge of the property where the proposed home sites will be 500 feet back from CSAH 39 and 200 feet beyond an existing ridgeline (which has been flagged in the field). Existing trees south of the ridgeline and proposed trees on both sides of streets within the development will be adequate to screen the view of homes in this area. Perspective C is slightly east of the B section drawing at the low point of the ridgeline north of CSAH 39. Again, the closest home sites will be 425 feet back from CSAH 39 and this is a side view of that lot. The developer proposes to install trees within the open space outlot south of the proposed homes to provide the necessary visual buffer. In our opinion, the changes to the site plan will minimize the visibility of the development from CSAH 39. Revised landscape plans must be submitted to correspond with the changes to the site plan. The revised plan also modified the separation between private open space and land dedicated to the City for the Northwest Creek Greenway. Some additional modifications to this plan to shift more of the open space into private open space are recommended by City staff and shown on the attached exhibit. We would recommend that the developer construct the trail within the greenway corridor as part of their project. A revised calculation of park dedication requirements will have to be made upon submission of a revised preliminary plat. 2 RECOMMENDATION Whether the revisions to the plans on the western portion of the development satisfy the issues raised by the City Council is a question for the City Council to answer. The opinion of our office is that the changes to the site plan will minimize the visibility of the development from CSAH 39. Aside from this issue, the revised site plan is generally consistent with the intent of the Comprehensive Plan and R -C District for development in this area. We do recommend further revisions to the "Dancing Branch" area of the project as detailed herein and require a full -set of revised preliminary plat, grading and landscape plans to fully evaluate compliance with applicable performance standards. The City Council may either take action to approve the application subject to conditions or again table the requests until revised plans have been submitted and reviewed by City staff. POSSIBLE ACTIONS Decision 1 — Zoning Map Amendment A. Motion to approve a Zoning Map amendment rezoning the subject site from A -1 District to R -C District based on a finding that the request is consistent with the Comprehensive Plan. B. Motion to deny the request based on a finding that the application is inconsistent with the Comprehensive Plan. C. Motion to table the application. Decision 2 — Preliminary Plat/PUD -CUP A. Motion to approve the preliminary plat and PUD -CUP for Featherwind Farms, subject to the following conditions: 1. The submitted plans shall be modified in accordance with the site plan presented to the City Council on 26 September 2005, subject to City staff review and approval. 2. Approval of the preliminary plat is subject to a decision by the City Council in response to the submitted EAW that the project does not have the potential for significant environmental effects and that an EIS is not required. 3. The number of allowed dwelling units shall not exceed the number identified on the submitted preliminary plat and compliance with any and all conditions that result in a decrease in the number of lots. 3 4. The developer shall identify the net area of the parcels set aside as permanent open space. These areas shall be restricted by conservation easement as permanent open space to be regulated by Section 20 -60 -7 of the Zoning Ordinance and subordinate to City drainage and utility easement rights. 5. The developer shall construct a 10 foot wide trail utilizing asphalt material through the greenway corridor dedicated to the City. Those trails constructed to be maintained by the homeowners association shall be at least six feet wide utilizing asphalt material. 6. The keeping of horses shall be an allowed accessory use of lots with a minimum area of two acres within the "Dancing Branch" area subject to the following conditions: a The density of horses does not exceed one (1) horse per acre. b. A shelter or stable facility shall provide a minimum of one hundred (100) square feet of enclosed area per horse. c. Detached accessory buildings used to shelter or stable horses shall conform to the accessory building limits of the R -C District, except that such buildings are not required to be within 150 feet of the principal building on the same lot. d. A manure management plan to be implemented by the HOA to include provisions addressing horses within outlots deeded to the City and compliance with Chapter 27 of the Zoning Ordinance shall be submitted. 7. The outlot conveyed to the owner of the abutting exception property at the north line of the plat shall be overlaid by an ingress /egress easement in favor of the Featherwind Farms HOA. 8. All public street and shared private drive designs shall be subject to approval by the City Engineer. 9. Any shared private drives shall be overlaid by drainage and utility easements, subject to approval by the City Engineer. 10. Street names illustrated on the preliminary plat shall be revised to conform to the Wright County grid. 11. The parcels identified on the exhibit to the Planner's memorandum of 22 September 2005 shall be dedicated to the City for park purposes. A determination as to full satisfaction of park dedication and trail improvement requirements shall be made prior to final plat approval. 4 12. The developer will be responsible for determining the 100 -year water elevation. The City will review this report. STREETS 1. The bituminous, base and subbase thicknesses shall be shown in the typical sections on plans. 2. A detail shall be included in the plans for the walking path and horse trail. TRAFFIC /ACCESS ISSUES 1. The County will have to evaluate the necessity for right turn lanes, by -pass lanes and left turn lanes along CSAH 39. WETLANDS 1. Avoidance of wetlands must be attempted. If wetlands must be disturbed or filled they must be mitigated as per WCA requirements (Section 20- 16- 9.E.2). 2. A protective buffer of natural vegetation at least 20' wide from the delineated edge shall surround all wetlands. A principal building setback of 40' from the delineated edge of all wetlands or 20' from the protective buffer easement, whichever is greater, shall be provided. SANITARY SEWER COLLECTION SYSTEM 1. It appears that the proposed location of the sanitary drain fields for Lots 4 and 5, Block 2, and Lot 2, Block 3, may conflict with the driveway. Please verify. 2. Date: September 22, 2005 Re: 62 "d Street — Street and Drainage Correction Upon reviewing the 62 " Street and Drainage conditions, I have the following comments and recommendations: The existing 1100 feet of roadway is breaking up and eroding down the hill. Gravel surfacing exists from Quam Avenue to Quale Avenue (500 feet). 62 " Street west of Quale Avenue is very steep and has had some bituminous patch surfacing placed in the past. The culvert located at Quale Avenue is unable to handle the flows from the east. The water pools east of Quale Avenue and flows over the road. The ditches and roadway edges erode down the hill into resident's yards. The roadway is located along the south side of right -of -way for 800 feet west of Quam Avenue. The remaining 300 feet has the road located along the north side of the right -of -way. OPTION A: Constructed 62 Street to City Standards To re- construct 62 " Street to City of Otsego Standards some additional right -of -way along the south side and at the west end would be needed. Easements for utilities, drainage and grading would be required for the storm sewer outfall. The street would be constructed as a rural street section with a cul -de -sac at the west end and storm sewer. The houses located west of Quale Avenue are placed close to the right -of -way and would have some of their front yards reduced with the street reconstruction. The estimated cost for construction, engineering, inspection and surveys would amount to $145,000. The existing property owners would be assessed the cost of the project on an equal share for each parcel owner who has frontage within the construction limits. Currently 12 owners exist and equally dividing the $145,000 between them amounts to assessment of $12,100 each for the street and storm sewer improvement. Ot901assessmentmemo09 -21 -05 Page 1 OPTION B: Constructed Quale Avenue north of 62 Street to City Standards Currently the road is located along the east side of the right -of -way. A field low spot 500 feet north of 62 Street was the original drainage route for the surface waters. Water pools at this location and slow infiltrates the ground and discharges west though a drain tile system. Re- constructing 500 feet of Quale Avenue north of 62 Street would locate the roadway closer to the center of the right -of -way. A rural street section with the standard 2 foot deep ditches would provide adequate drainage. A culvert would be placed under Quale Avenue from the east to the west along the existing drainage route. The costs for construction grading, installing the culvert, 6" gravel surfacing, site restoration and engineering are estimated to cost $24,000. Five property owners would be affected with this option with only one receiving a real benefit. OPTION C: Quale Avenue Ditch Correction Currently no ditch exists along the east side of Quale Avenue to direct the water to the field low spot. If additional drainage easement was obtained from the property owner on the east side of Quale Avenue to grade a ditch section along the road. The water would be routed thru the ditch across Quale Avenue into an existing drainage route. The costs for grading the ditch, installing the culvert, site restoration and engineering are estimated to cost $16,000. City Engineer Ron Wagner called Chris on Monday, September 19, 2005 and told him to stop pumping. Chris continued to pump and as of today Thursday, September 22, 2005 he is still pumping. Both Ron and I recall that Chris was told in the meeting last fall regarding ravine erosion on the Mississippi River that he was not to pump out his stormwater ponds. I have received several calls from downstream residents asking what the City is going to do about Chris ignoring our order to stop pumping. The City Council should discuss with the City Attorney our ability to cite Chris and fine him. Southeastern Section Feasibility Report The southeastern section of the City that lies east of TH101 from CSAH 42 to CSAH 36 is one of the sections for the City that is already under pressure from developers to open for water and sewer services. The sub - districts included in the specific area of interest are listed in the table below according to the three primary developers names. This would give the expected development several years to begin construction and gradually over the next ten years reach full development. As shown in the table above, the expected WAC and SAC fees generated just by these three developments will easily meet the bond payment requirements. 27 The trunk facilities constructed under this project will benefit all of the expected developments throughout the eastern service area. As shown in Table No. 13, Recommended Capital Improvement Program, the cash flow balance is projected to exceed the project cost before 2010. This means that the bonds that would be sold for this project could be paid off early. It is therefore recommended that the City Council find that this trunk infrastructure project for the Southeastern Section of Otsego is feasible. It is also recommended that the City Engineer be authorized to prepare the plans and specifications for this project in coordination with the MnDOT 2006 TH101 project and the site development plans of the three developers. B. Upgrade of Quaday Avenue Lift Station No. 1 From Table No. 4, the projected potential number of REC's served by the Quaday Lift Station No. 1 by 2010 is 5,728. However, the population projection indicates that only 59 percent (3,380) of those potential REC's will be developed by 2010. Therefore, the expected flow to this major lift station should be around 592,000 GPD. The peak pump rate required for that average daily flow would be about 1,200 GPM. This is the maximum capacity of the three 40 HP pumps. Therefore, it is recommended that the replacement with three 100 HP pumps occur in 2010. The estimated cost for the three 100 HP pumps and a new control panel is about $ 200,000. RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS WHEREAS, pursuant to a request by City staff Hakanson Anderson Associates, Inc. has prepared plans and specifications for the Prairie Park Trail Improvements connecting the trail along 85 Street and Prairie Park. And has presented such plans and specifications to the council for approval; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO MINNESOTA: 1. Such plans and specifications, dated 9/23/05 a copy of which is attached hereto and made a part hereof, are hereby approved. 2. The City Engineer shall prepare and cause to be inserted in the official paper and in the Construction Bulletin, an advertisement for bids upon the making of such improvement under such approved plans and specifications. The advertisement shall specify the work to be done, shall state that bids will be opened at 2:00 p.m. on October 6, 2005, in the council chambers of the City Hall, 8899 Nashua Avenue, Otsego, Minnesota, 55330. No bids will be considered unless sealed and filed with the clerk and accompanied by a cash deposit, cashier's check, bid bond or certified check payable to the clerk for 5.0 per cent of the amount of such bid.
