Please be advised that the Planning Commission held a public hearing on 3 August 2002
to consider the rezoning and preliminary/final plat request of Dale Valerius and Allen
Valerius.
No comments were received from the public during the hearing. The Planning
Commission asked about the location of the two lots respective of future subdivision if
sewer and water becomes available. Staff responded that although the lots are not
clustered, there is sufficient space to allow a logical resubdivision of the parent parcel.
The lots have been located to take advantage of existing topography on the site.
The Planning Commission closed the public hearing and voted 6-0 in separate motions to
approve the rezoning and preliminary/final plat applications as outlined below. This
request will be considered at the City Council meeting on 9 September 2002 at 6:30 PM.
Decision I - Zoning Map Amendment
A. Motion to approve a Zoning Map amendment rezoning the subject site from A-1
District to A-2 District based upon a finding that the request is consistent with the
policies of the Comprehensive Plan.
B. Motion to deny the application based upon a finding that the request is inconsistent
with the policies of the Comprehensive Plan.
C. Motion to table the request.
Decision 2 - Preliminary/Final Plat
A. Motion to approve a preliminary and final plat for two lots, subject to the following
conditions:

TO PROVIDE FOR A CHANGE IN ZONING CLASSIFICATION FOR APPROXIMATELY

THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN:
Section 1. The official Zoning Map of the Otsego Zoning Ordinance is hereby
amended to change the zoning classification of the property legally described by Exhibit
A (the "property").
Section 2. The property is hereby rezoned from an A-1, Agricultural Rural Service
District designation to an A-2, Agriculture Long Range Urban Service District designation.
Section 3. The Zoning Administrator is hereby directed to make appropriate
changes to the official Zoning Map of the City of Otsego to reflect the change in zoning

the purpose of subdividing two lots as allowed by the Comprehensive Plan.

FINDINGS: Based upon review of the application, the recommendation of the Planning Commission, and
evidence received, the City Council of the City of Otsego now makes the follovAng findings of fact:
A. The legal description of the property is attached as Exhibit A.
B. The 54.0 acre property lies within the Urban Service Area Reserve and is guided for agriculture land
uses by the Otsego Comprehensive Plan, as amended.
C. The property is zoned A-1, Agiriculture Rural Service District, which allows single family dwellings
at a density of one unit per forty acres; The applicant has requested a Zoning Map amendment to
include the property within the A-2, Long Range Urban Service Area Reserve, which allows single
family dwellings at a density of four units per forty acres.
D. Two development rights have previously been divided from the property.
E. The Planning Commission and City Council must take into consideration the possible effects of the
Zoning Map amendment with their judgement based upon (but not limited to) the criteria outlined
in Section 20-3-2.F of the Zoning Ordinance:
The proposed action's consistency with the specific policies and provisions of the
official City Comprehensive Plan.
Finding: The Comprehensive Plan outlines a limited density allowance intended to
provide opportunities for rural character development in areas not planned for
sanitary sewer service. The 2002 Comprehensive Plan update specifies that non-
farm subdivisions in the Urban Service Reserve Area are to be limited to a minimum
lot size of or a maximum 2.5 acre lot size if less than 20 acres. Each of the proposed
lots are to be 2.5 acres in size and the overall density is consistent with that allowed
by the Comprehensive Plan.
2. The proposed use's compatibility with present and future land uses of the area.
Finding. The area surrounding the intersection of 70h Street and Oakwood Avenue
has developed with several large rural lot parcels and single family homes. The
proposed lot division is consistent with this character
3. The proposed use's conformity with all performance standards contained in the
Zoning Ordinance (i.e., parking, loading, noise, etc.).
Finding.- The proposed preliminary plat will conform to all applicable requirements.
4. The proposed use's effect upon the area in which it is proposed.
Finding: The proposed division and keeping horses is not expected to cause any
negative effects as it is consistent with the framework of the 1998 Comprehensive
Plan under which application was made and character of the area.
5. The proposed use's impact upon property values of the area in which it is proposed.
Finding: Although no study has been completed, the proposed use is not anticipated
to negatively impact area property values.
6. Traffic generation by the proposed use in relation to the capabilities of streets
serving the property.
Finding: 70' Street has necessary capacity for any additional traffic created by the
property division and construction of two single family homes.
7. The proposed use's impact upon existing public services and facilities including
parks, schools, streets, and utilities and its potential to overburden the City's service
capacity.
Finding: The proposed use is not anticipated to have a negative impact to the City's
service capacity.
F. The planning report dated 27 August 2002 prepared by the City Planner, Northwest Associated
Consultants, Inc., is incorporated herein.
G. The Otsego Planning Commission conducted a public hearing at their regular meeting on 3 August
2002 to consider the application, preceded by published and mailed notice. Upon review of the
application and evidence received, the Otsego Planning Commission closed the public hearing and
recommended by a 6-0 vote that the City Council approve the request based on the aforementioned
findings.
DECISION: Based on the foregoing information and applicable ordinances, the request for a Zoning Map
amendment is hereby approved based on the most current plan and information received to date.

We have reviewed the Proposed Preliminary and Final Plat and have the following comments:
70th Street may become a state aid coHector steet for the City or become the rerouted
CSAH 37, We suggest the City require 50, South of the north line of Section 32
T121 R23 across this property be dedicated right-of-way.
2. A corridor connection from Nashua Avenue to a possible Nabor Avenue interchange
has been slated as a Riture state aid collector street. A portion of this is shown to run
along the West side of the Valerius property on Otsego's State Aid Map. We
reviewed the topographic maps of the area and the best route for this Nashua/Nabor
corridor connection ends up a few hundred feet to the west of the west property line
of this property, due to numerous w4dands north and south of this property.
Therefore, we do not see the need for reserving right-of-way for a north -south
corridor across any portion of this property.
We recomm nd approval of the Preliminary and Final Plat with the dedication of 50' of right-of-
way for 70th Street.

Please be advised that the Planning Commission held a public hearing on 3 September
2002 to consider the above referenced applications. No comments were received from the
public.
The applicant was present to describe their project. They said that the first phase of the
development will likely be the three lots adjacent to TH 101 with access from CSAH 42 and
a temporary cul-de-sac at the end of the private driveway. The applicant also raised three
issues with the recommended conditions of approval:
The recommendation from our office included a condition that sanitary sewer
capacity not be guaranteed with the preliminary plat approval. This condition is
taken directly from the Comprehensive Plan and imposed on all preliminary plats
within the sanitary sewer service district, including the Waterfront and Mary Dare
commercial plats.
The basis of this policy is to ensure the City timely use of infrastructure that has
been constructed and financed. More importantly, the City is guaranteed that sewer
service is only allocated to those properties that have paid to receive such service
ensuring payment. The City could address the applicant's concerns with a
preliminary development agreement in which they pay SACNVAC fees in advance
to reserve capacity. Such an agreement would be complicated by the fact that no
specific users have been identified at this time. City staff and the applicant will
need to discuss this issue further.
2. The applicant objected to the condition requiring that the private driveway be
constructed to City standards with sidewalks on each side based on their expected
traffic volumes. City staff agrees with their position that this roadway will not carry
the same traffic as a public through street. The condition was intended to address
construction standards for the roadway as well as agreement on the section design
which has not been presented. This issue was subject to further review and
approval of the City Staff and was not intended to require a 46 foot street section
which the City requires for public commercial or industrial streets.
3. We had recommended that the applicant be responsible for construction of the
Quaday Avenue segment within the plat as part of their first phase. Construction
of Quaday in the area south of 88t' Street and north of CSAH 42 is an important
factor in encouraging development of this area. City staff can discuss other options
for construction of the roadway with the applicant prior to a final plat application and
make an appropriate recommendation at that time. The Planning Commission
revised this conditions to state that construction and cost responsibility for Quaday
Avenue will be determined by the City Council.
There was no additional discussion. After closing the public hearing, the Planning
Commission voted 6-0 in two separate motions to recommend approval of the request as
outlined below. This application will be considered at the City Council meeting on 9
September 2002 at 6:30 PM.
Decision 1 - Zoning Map Amendment
A. Motion to approve a Zoning Map amendment rezoning portions of the subject site
from A-1 District to B-3 District based on a finding that the action is consistent with
the Comprehensive Plan.
B. Motion to deny the application based on a finding that the request is inconsistent
with the Comprehensive Plan.
C. Motion to table the request.
Decision 2 - PUD -CUP and Preliminary Plat
A. Motion to approve a PUD -CUP and Preliminary Plat for the Quaday Addition,
subject to the following conditions:

Approval of a preliminary plat does not guarantee access to sanitary sewer
service capacity. Only those projects with approved final plats and executed
development contracts that include payment to receive such services shall
be allocated sanitary sewer service capacity.
2. The existing non -conforming wood building is removed with the first phase
of the development.
3. Development of each individual lot will be subject to site and building plan
review.
4. Construction and cost responsibility for Quaday Avenue shall be determined
by the City Council. The design of the Quaday Avenue segment must be
revised to align with existing Quaday Avenue south of CSAH 42. Design
and construction of Quaday Avenue is subject to review and approval of the
City Engineer and Wright County.
5. Only one access will be allowed to Lot 1, Block 2 from Quaday Avenue at an
alignment with the access to Block 1. No direct access to CSAH 42 is
allowed.
6. The private driveway within Block 1 is to be designed to City commercial
street standards with sidewalks to be provided on both sides, subject to
approval of the City Engineer. The intersection of the private driveway with
CSAH 42 must be revised to be a 90 -degree angle and is subject to review
and approval of Wright County.
7. The concept plan and preliminary plat are revised to illustrate the correct
setback requirements, as defined by the Zoning Ordinance. Within Block 1,
buildings and off-street parking/drive aisles shall be setback from the private
driveway 35 feet and 15 feet respectively.
8. The preliminary plat is revised to show all easements required by Section
21-7-15 of the Subdivision Ordinance and all shared utility lines must be
overlaid by drainage and utility easements. All easements are subject to
review and approval of the City Engineer.
9. All utility plans are subject to review and approval of the City Engineer.
10. Grading and drainage plans as required by Section 21-6-2.0 of the
Subdivision Ordinance are submitted for review and approval of the City
Engineer.
11. Park and trail dedication shall be in the form of cash fee in lieu of land equal
to ten (10) percent of the pre -development value of the subject site. Credits
will be given for the cost of trails to be constructed along Quaday Avenue.
Park and trail dedication requirements are subject to review by the Parks
and Recreation Commission and approval of the City Council.
12. Upon approval of a final plat, the applicant shall enter into a development
contract and pay all required fees and securities, subject to review and
approval of the City Attorney.
13. Comments of other City Staff.

2. The existing non -conforming wood building is removed with the first phase of the
development.
3. Development of each individual lot will be subject to site and building plan review.
4. The scheduling and financing of Quaday Avenue shall be determined by the City Council.
The design of the Quaday Avenue segment must be revised to align with existing Quaday
Avenue south of CSAH 42. Design and construction of Quaday Avenue is subject to review
and approval of the City Engineer and Wright County.
5. Only one access will be allowed to Lot 1, Block 2 from Quaday Avenue at an alignment with
the access to Block 1. No direct access to CSAH 42 is allowed.
6. The private driveway within Block 1 is to be designed to City commercial street standards
with sidewalks to be provided on both sides, subject to approval of the City Engineer. The
intersection of the private driveway with CSAH 42 must be revised to be a 90 -degree angle
and is subject to review and approval of Wright County.
7. The concept plan and preliminary plat are revised to illustrate the correct setback

requirements, as defined by the Zoning Ordinance. Within Block 1, buildings and off-street
parking/drive aisles shall be setback from the private driveway 35 feet and 15 feet
respectively.
8. The preliminary plat is revised to show all easements required by Section 21-7-15 of the
Subdivision Ordinance and all shared utility lines must be overlaid by drainage and utility
easements. All easements are subject to review and approval of the City Engineer.
9. All utility plans are subject to review and approval of the City Engineer.
10. Grading and drainage plans as required by Section 21-6-2.0 of the Subdivision Ordinance
are submitted for review and approval of the City Engineer.
11. Park and trail dedication shall be in the form of cash fee in lieu of land equal to ten (10)
percent of the pre -development value of the subject site. Credits will be given for the cost
of trails to be constructed along Quaday Avenue. Park and trail dedication requirements
are subject to review by the Parks and Recreation Commission and approval of the City
Council.
12. Upon approval of a final plat, the applicant shall enter into a development contract and pay
all required fees and securities, subject to review and approval of the City Attorney.

The Planning Commission held a public hearing on 3 August 2002 to consider the request
of Quest Development, Inc. to change the land use designation on the Land Use Plan from
industrial to low density residential for 200 acres located in the western portion of the City.
The applicant was present and said that their request was based in part to try and initiate
a discussion of the land uses for this parcel. They also undertake commercial/industrial
development and would be able to develop the property under such a scenario. As
outlined in the Planning Report, it may be an option for the City in the future to reconsider
the land uses west of CSAH 19 and north of 1-94. But, such a review needs to be done
more broadly and only in consideration of the level of industrial development that occurs
to the south, potential new industrial opportunity areas (i.e., Nabor Avenue corridor), area
transportation improvements, and available sanitary sewer service in terms of MPCA
permits, actual plant capacity, and gravity flow boundaries.
There was no additional public comment. City Administrator Mike Robertson added that
his contacts with first -ring suburb communities suggest that designation of a large
industrial area for long-term development is a wise decision. We would also add that such
an industrial reserve area is not inconsistent with the practices of other large suburban
communities such as Maple Grove within their gravel mine area or Lakeville on their
southern most boundary with Scott County.
The Planning Commission generally concurred with the recommendations of the City Staff
saying that the request is inconsistent with the Comprehensive Plan and premature based
on existing conditions. As such the Planning Commission voted 6-0 to recommend the
application be denied based on a finding that the reqest was inconsistent with the following
policies of the Comprehensive Plan:
Once established, geographic land use designations and related zoning classifications
shall be changed only when it can be demonstrated that such modifications are in the best
interest of the community. Such changes shall occur only when they will promote land use
compatibility and pre -determined goals and policies of the Comprehensive Plan. (Policy
Plan, p. 38)
2. Immediate, short range market potential and demand of activities which are not suggested
for a site or area by the Comprehensive Plan or allowed by the Zoning Ordinance shall not
be the sole justification for a change in activity. (Policy Plan, p. 38)
3. Industrial (and commercial) development shall be strongly encouraged to create newjob
opportunities and expand the local tax base to assist in paying for needed service and
reduce tax impacts on housing costs. (Policy Plan, p. 49)
4. Industrial development which maximizes the return on City investments in public facilities
and service shall be promoted. (Policy Plan, p. 49)
5. Transitions between distinctly differing types of land uses shall be accomplished in an
orderly fashion which does not create a negative impact (economic, social, or physical) on

BACKGROUND
Arcon Development, Inc. has submitted a request for final plat approval of 36 townhouse
dwelling units included within the Pheasant Ridge 6th Addition Final Plat. The subject
parcel is the second phase of the detached townhomes and townhome uses being
developed on the south side of 78th Street near the intersection with Page Avenue.
The subject parcel is guided by the Comprehensive Plan for low density residential uses
and is zoned R-5, Residential - Single and Two Family District. The preliminary plat for
this parcel was approved by the City Council on May 29, 2001.

ANALYSIS
Preliminary Plat Consistency. The proposed final plat is generally consistent with the
approved preliminary plat and conditions of approval thereof. The final plat includes the
same number of lots/units within the given area.
The final plat is being platted out of the area of Outlot A of Pheasant Ridge 5t" Addition.
The final plat is mislabeled and includes both a lot/block designation and outlot
designation for the remaining area outside of this 6th Addition final plat. The Lot 38, Block
1 designation applies to the common area between the proposed units and is overlaid by
a drainage and utility easement. Outlot A is meant to include the area reserved for future
phases. A revised final plat will need to be submitted with the labels in the appropriate
locations.
Landscape Plan. The landscape plan approved with the preliminary plat included a
bufferyard planting area along 78' Street at the north side of the development. The
bufferyard consists of a dense mix of shade trees, ornamental trees and conifer trees. A
four foot tall berm was also incorporated in the bufferyard, with the conifer trees and
ornamental trees planted on its sides and top.
The builder of the development removed the berm during site grading and used the dirt for
the building pads because of a lack of fill on site. Replacement of the berm would require
fill to be brought into the site. City Staff initially responded that the berm would have to be
replaced. As an alternative, the applicant has proposed increasing the size of the
plantings within the planting area to provide a more mature screen. The specific size
increase for the plants has not been identified. Additional plantings would not likely
provide additional screening at maturation because of the density of the plants on the
approved plan.
City Staff is referring the issue to the City Council for a decision. The berm and
landscaping were specifically discussed at the public hearing for the preliminary plat in
response to concerns voiced from residents north of 78th Street or west of Page Avenue
about the type of dwellings within this project. The density of the plantings and the berm
will provide a near complete screen of the development. The plantings and berm will also
benefit residents of the development from traffic impacts along 78' Street.
The revised landscaping raises two issues. Aesthetically, the berm provides some
variation in topography along the roadway and increases the effective height of the
plantings. The larger plantings may provide height and additional horizontal screening,
but the topographic variation is lost. Second, larger plants are more difficult to transplant
and reestablish in a new location. For this reason, the applicant should provide a two year
security for the health of the plantings as part of the development contract versus the
standard one year. If approved, the applicant will need to provide a revised landscape
plan subject to City Staff review. Alternatively, the City Council may require the applicant
to restore the berm in accordance with the original plans.
Development Moratorium. The proposed final plat will be served by municipal sanitary
sewer and water services. This parcel was specifically exempted from the current
subdivision moratorium based upon available capacity to service the anticipated

development approved with the preliminary plat. The City is nearing its available 400,000
gpd. capacity based upon approved final plats. The City Engineer will need to verify that
sufficient capacity is available at the east waste water treatment plant to serve the project.
Construction Plans. Construction plans have been previously submitted and reviewed.
All construction plans are subject to review and approval of the City Engineer.
Park and Trail Dedication. No land is proposed to be dedicated for park and trail
facilities as part of the final plat. As such, the applicant must pay a cash fee in lieu of land
equal to $1,075 per unit. Based upon 36 units, a total fee of $38,700 is to be provided for
this phase of the development.
Development Contract. The applicant must enter into a development contract with the
City and pay all required securities and fees, upon approval of the 6 th Addition final plat.
The development contract is subject to review and approval of the City Attorney.
CONCLUSION
The proposed final plat is consistent with the approved preliminary plat and conditions of
approval. The plat is also consistent with the Comprehensive Plan, Zoning Ordinance,
and Subdivision Ordinance.
In addition to the final plat, the City Council is asked to consider the applicant's request
to forgo replacement of the berm along 78th Street with larger plant materials. This is
largely an aesthetic issue with the berm approved with the preliminary plat being a
preferred alternative. The proposed increased plant sizes will provide a similar effect.
Allowance of the larger plantings should be made subject to an extended security terms
as part of the development contract.
Based on these considerations, our office recommends approval of the final plat subject
to the following conditions:
A revised final plat is submitted with the correct designation of Outlot A for the area
reserved for future phases.
2. The applicant shall restore the berm along 78th Street or shall increase the size of
plantings along the street, subject to approval of the City Council. If increased
plantings sizes are approved in lieu of a berm, the applicant shall provide a revised
landscape plan that is subject to review and approval of City Staff. The applicant
shall also provide a warranty the plants to remain alive, of good quality, and
disease free for 24 months after planting.

3. The City Engineer is to confirm that sufficient sanitary sewer service capacity exists
within the east waste water treatment plant to serve the final plat.
4. Temporary cul-de-sacs are provided at the terminus of all public or private streets
constructed as part of this phase, which will eventually be extended as through
streets.
5. All grading, utilities, easements, and other construction plans are subject to review
and approval of the City Engineer.
6. The applicant pay a cash fee in lieu of land of $38,700 in satisfaction of park and
trail dedication requirements.
7. The applicant enter into a development contract with the City and pay all required
securities and fees, subject to review and approval of the City Attorney.

SANITARY SEWER & WATERMAIN PLANS (SHEETS 3 TO 4)
Verify wye station for Lot 33, Block 1.
2. Chimney seals shall be required on all sanitary sewer manholes.
3. It appears that additional watermain valves will be necessary. There shall be "x -l"
number of valves for an intersection with 'Y' number of legs (see redlines).
4. Note if any hydrants must be plugged.
5. Verify horizontal & vertical clearance (12" minimum) of watermain near CBMH 79.
Insulation will be required.
6. The water service connection for Lot 9, Block 1 is shown coming out of the center of
the adjacent hydrant valve. Plan shall clearly depict the service connection to the
west of the hydrant valve. It appears that the sanitary sewer wye station may have to
be adjusted to maintain 3' of horizontal separation.
7. The invert elevation for MH -6 is incorrect. Please revise.

GRADING PLAN REVIEW
Garage floor elevations have been reviewed and, although several are less than the
minimum of 18" above the adjacent curb, we have determined these adequate due to
non -low point locations, emergency overflow provisions, and all garage floors are at
least 1' above adjacent curb.
2. West top of curb elevation at approximate station 15+15 on Palisades Avenue NE
appears to be incorrect. Please revise.
3. Please label profiles on sheet 2 with corresponding street names.

FINAL PLAT
It appears that the designation of Lot 38, Block 1 is not in the correct location. We
are assuming that Lot 38, Block 1 is the lot (common area) that abuts the other 37
lots within the plat.
2. We have some concerns about the rededication of Pheasant Ridge 5t" Addition,
Outlot A, easements as Pheasant Ridge 6 th Addition, Outlot A, easements.
3. All utilities constructed as part of Pheasant Ridge 6 th Addition must be within a
drainage & utility easement,

AMENDMENT #1 TO
COOPERATIVE AGREEMENT 02-02 BETWEEN THE
COUNTY OF WRIGHT AND THE CITY OF OTSEGO
THIS AMENDMENT #1 TO THE AGREEMENT, made and entered into by and
between the County of Wright, Minnesota, acting by and through its County Board of
Commissioners, hereinafter referred to as the "County" and the City of Otsego,
Minnesota, acting by and through its City Council, hereinafter referred to as the "City".
5. The proposed access at Park Street onto CSAH 42 will be allowed to be a full acc'ess
initially. The possibility exists that as traffic volumes increase on CSAH 42 and on 91st
Street/Park Avenue in the future, certain traffic operational or traffic safety issues may
arise at that intersection or at the CSAH#42/CSAH#39 intersection which would
necessitate corrective actions to be taken or implemented at the CSAH#42/9 I st
Street/Park Avenue intersection. The County agrees that prior to limiting the Park
Avenue/91s' Street access along CSAH#42 to right -in and right -out only, they will notify
the City of the of the specific traffic operational and/or safety problems and the City will
be given full opportunity to suggest and implement (with County approval) alternative
improvements to address the specific safety and/or operational issues raised. If, after
sufficient time needed to determine if the field -implemented improvements have not
improved the specific safety and/or operational issue the County reserves the right to
modify this access in the future (to right -in, right -out only, etc.) for safety and/or
operational purposes, or the City may request that CSAH#42 north of CSAH#39 be

BACKGROUND
Mr. Bob Cederberg and Mr. Guy Rowe have petitioned the City to vacate the existing right-
of-way for 87' Street, west of O'Brian Avenue which lies between their two properties.
This request follows establishment of 88th Street north of the Cederberg property, which
provides access to the Meadowlands plat.
The City Council opened a public hearing at their meeting on 12 August 2002 to consider
the vacation request. Mr. Stan Schuster, Mr. Mike Gregerson, and Mr. Jeff Bartheld
opposed the City Council vacating the right-of-way. The City Council requested that City
Staff review the vacation request and provide additional information. The City Council will
continue the public hearing on the vacation request at their meeting on 9 September 2002.

ANALYSIS
87 1h Street. Mr. Cederberg and Mr. Rowe have requested vacation of the public right-of-
way west of O'Brian Avenue. The right-of-way is 66 feet wide. The 87 th Street right-of-way
has not been maintained by the City and no surfaced roadway exists within it. There are
no municipal utilities or drainageways within the right-of-way. The driveway to the Rowe
property is within the right-of-way, while Cederberg maintains a lawn on the north side.
The right-of-way abuts the Cederberg and Rowe properties, as well as ending at the
property owned by Mr. Schuster. However, no parcel of land is solely dependent on the
right-of-way for access. Mr. Schuster stated that vehicle access to the north portion of his
property is dependent upon the 87th Street right-of-way because of a ridge of steep slope
crossing his property. However, primary access to this property is provided off of 851h
Street.
Vacation of existing right-of-way typically divides the parcel down its centerline and turns
back the land equally to the abutting property owners. If 87 th Street is vacated, a 33 foot
by 340 foot parcel would be conveyed each to the Cederberg and Rowe properties.
Meadowlands. The issue of vacating 87th Street originated during the preliminary and
final plat reviews of the Meadowlands. The Meadowlands preliminary plat was approved
on 14 May 2002 subject to the following condition:
3. Secondary access to the subdivision is provided as approved by the
City Council based upon the recommendations of the City Engineer.
This condition was intended to allow the Meadowlands developer to negociate with
property owners to the south (Robert and Jodi Gearou and Mr. Schuster) regarding a
street extension from the Meadowlands plat that would connect to the 87 th Street right-of-
way existing on the west side of O'Brian Avenue (See Exhibit C).
The developer was unable to obtain the necessary land to provide for a street connection
between the Meadowlands plat and 87'h Street right-of-way. To satisfy the condition of
preliminary plat approval, the developer acquired the necessary land from Mr. Cederberg
to provide a street connection from Meadowlands to O'Brian Avenue approximately 350
feet north of 87th Street. The final plat and dedication of right-of-way for 88 1h Street as it
is now designated was approved 9 July 2001.
Development Potential. The primary reason stated by those opposed to the vacation is
that this right-of-way may be used in the future to allow resubdivision of the lots fronting
onto 85th Street. The 871h Street right-of-way abuts only the Cederberg, Rowe, and
Schuster properties. Mr. Bartheld's property has frontage to 85h Street as well as frontage
to O'Brian Avenue being a corner lot. Mr. Gregerson's property is a 2.9 acre parcel with
frontage only to O'Brian Avenue.

These other properties all have sufficient frontage to existing public streets to allow the lots
to be split. Use of the 87th Street right-of-way for additional subdivision would depend on
redevelopment of the Schuster property. These properties are all within the Long Range
Urban Service area designated by the Comprehensive Plan and guided for low density
residential use. Further development of unsewered residential uses in this area is not to
be allowed unless one of the following criteria are met:
a. Completion of an unfinished street network.
b. The correction or improvement of a demonstrated area drainage problem.
C. The dedication of lands to a legitimate public purpose (i.e., desired parks, public
facility structures, right-of-way dedication, etc.).
The Meadowlands plat provided for correction of a known area drainage problem from
overflow of the natural environment lake on that site. No other issues are known to exist
in this area that would allow for further subdivision of the existing lots until such time as
sanitary sewer and water service is made available. The nearest trunk sewer line is over
one mile from this area and there are no schedules for making the utilities available. As
such, any request to subdivide the existing lots in this area may be considered inconsistent
with the Comprehensive Plan.
One reason the vacation has been requested is that the addition of Outlot B from the
Meadowlands plat and the right-of-way turn back to the Cederberg property allows
potential resubdivision of the property into three lots without sanitary sewer and water
service. An application to divide the Cederberg property in advance of sanitary sewer
service would be subject to the policies outlined above.
As noted during consideration of the Meadowlands final plat, the City may view the
Cederberg's participation in the Meadowlands project as contributing to correction of the
area drainage problem as well as providing lands for a legitimate public purpose to
complete the street network. Alternatively, the provision of the right-of-way may be
considered an obligation of the Meadowlands developer that does not confer the
Cederberg's any development rights under the Comprehensive Plan. This is ultimately a
policy issue that would need to be decided in review of an actual development application
to subdivide the Cederberg property.
Sketch Plan. The proposed street extension from the Meadowlands plat to the 87' Street
right-of-way would have only benefitted the Gearou and Schuster properties. A line of
steep slope extending east -west across the north portions of the lots south of the
Meadowlands Plan limited exertion of this roadway to the west or south. The City
Engineer has provided topography data for this section of the City in order reexamine how
the area could potentially be subdivided with an extension of 87 th Street. This sketch plan
will be presented at the City Council meeting on 9 September 2002.

Easement. Mr. Schuster said at the Council meeting on 12 August 2002 that he would not
be opposed to vacation of the right-of-way if it were divided in thirds or that he be granted
an easement to allow access to the north portion of his property. Such an easement would
not allow the property to be divided as all lots must have minimum frontage directly to a
City Street.
The City has no obligation to divide the right-of-way into thirds or require an easement as
part of the vacation as the Schuster property has more than the minimum frontage to a
public street with is adequate to provide access to the maximum number of dwellings on
the property allowed by the current Comprehensive Plan and Zoning Ordinance.
Provision of an easement to allow access to the north side of the Schuster property should
be an agreement between two or more of private parties involved. Both Mr. Cederberg
and Mr. Rowe indicated a willingness to provide such an easement. At most, the City
could delay vacation of the right-of-way until an agreement to provide such an easement
is reached between the land owners.
CONCLUSION
The existing right-of-way for 87t" Street west of O'Brian Avenue currently serves no public
purpose. The City does not maintain a roadway and there are no municipal utilities or
drainageways within the right-of-way. The right-of-way does not provide the only access
to any single parcel meaning no land -locked parcels will be created if it is vacated.
The primary reason for maintaining the right-of-way would be to accommodate future
resubdivision. The current policies of the Comprehensive Plan would not allow for
subdivision of any additional unsewered lots benefitting from access to the 87 1h Street
right-of-way. Extension of sanitary sewer service to the area is not currently planned and
no schedule can be anticipated.
The use of the 87th Street right-of-way was explored with the Meadowlands plat and found
to benefit only two properties due to steep slopes that prevent a west or south extension
of a public through street. An updated sketch plan will be provided to confirm if this
previous analysis is correct. The developer of the Meadowlands plat tried to acquire the
land necessary for a street that would have also served the Gearou and Schuster
properties, but was unsuccessful. Without the street connection from the Meadowlands
plat, constructing 87th Street to allow resubdivision Gearou properties would contingent on
Schuster property developing for the street to be extended. However, it appears that there
is limited public benefit in maintaining a right-of-way for future development which is
uncertain at this time.

The only potential issue is access to " the north portion of the Schuster property. Again,
the City's obligation to this access is limited because the property has the minimum
required frontage to a public street necessary to serve the maximum number of
development rights allowed by the Comprehensive Plan and Zoning Ordinance. A private
easement, which all the parties seem agreeable to, would provide the desired access.
On the basis of the policies of the Comprehensive Plan, area conditions, and a finding that
the existing 87th Street right-of-way west of O'Brian Avenue serves no public purpose as
outlined in the resolution prepared by the City Attorney, our office recommends vacation
of the right-of-way with equal parcels turned back to the Cederberg and Rowe properties.
