1. Mayor Larry Fournier will call the meeting to order.
Mayor Fournier called the meeting to order at 6:31 pm.
Roll Call: Mayor Larry Fournier; Councilmembers Vern Heidner, Jerry Struthers,
and Virginia Wendel.
Staff: Judy Hudson, City Clerk/Zoning Administrator; Karee Rowell, Secretary;
Ron Wagner, City Engineer, and Andrew MacArthur, City Attorney.
Absent: Councilmember Suzanne Ackerman, and Michael Robertson, City
Administrator.
Pledge of Allegiance:
Mayor Fournier led in the Pledge of Allegiance.
2. Consider agenda approval.
Mayor Fournier requested to move Item 8. Andrew MacArthur, City Attorney.
after 3.1.
CM Heidner motioned to adopt the agenda as amended. Seconded by CM
Struthers. All in favor. Motion carried.
3. Consider the following minutes:
3.1. September 9, 2002 City Council Meeting.
CM Wendel motioned to approve the minutes with the corrections on page 5,
under 9.C. contract date is 2003 instead of 2004, and 9.E. correct spelling of
last name Croteau. Seconded by CM Heidner. All in favor. Motion carried.
8. Andrew MacArthur City Attorney:
8.1. Consider Reliant/Minnegasco Franchise Renewal.
Andy MacArthur went over the Franchise Agreement. Arnold Hendrickson from
Reliant Energy/Minneagasco - The League of MN Cities has adopted the model
ordinance and the short form. The Council would like to review the franchise and
The right-of-way ordinance. Mayor Fournier suggested coming back in
November after the agreement has been looked at. Council agreed on November
25, 2002.
4. Open Forum: (5 minute limit)
Heritage Hills Resident Dave Larkin, 8420 Obrian Avenue NE - has seen
increased police patrolling and the speed meter. Mayor Fournier had hoped that
putting in the speed meter would help slow down speeders. Ron Wagner said the
traffic counters are coming in this week. Judy Hudson said Sheriff Gary Miller
• wanted to meet with the people of Heritage Hills, but the representatives from
City Council Meeting of September 23, 2002. Page 2
Heritage Hills will wait to see what happens with traffic counters. Deputy Mark
Hoberg was available for questions and did state that extra attention has been
focused on that area. It seems that young people are the ones rolling through stop
signs and they have been stopped.
Brian Madsen, 15615 78`h Court NE - has a drainage problem that is ankle deep in
the Prairie Creek 3`d Addition. Ron Wagner said there is a drainage swale going
through the back yards and should take the water away.
Karl Diekman, 15652 78`h Court NE - brought in a petition to have WH Link
provide their cable services. Also Steve Gilbert, 7088 Quarry Avenue NE - stated
the same of wanting to receive WH Link cable service.
5. Consent Agenda. (non -controversial items)
5.1. Approve Claims List.
5.2. Resolution No. 2002-37 appoint Election Judges for General Election.
CM Heidner motioned to approve the Consent Agenda. Seconded by CM
Wendel. All in favor. Motion carried.
6. Dan Licht, City Planner:
No Planning Items.
7. Ron Wagner, City Engineer:
7.1. Set Workshop for review of 85`h Street Improvement.
A meeting was set on November 7, 2002 at 4:00 pm.
7.2. Pay Estimate #3, Page Avenue.
CM Struthers motioned to approve pay estimate #3 for Page Avenue.
Seconded by CM Wendel. All in favor. Motion carried.
7.3. Heritage Hills Speeding Update.
Ron Wagner stated they ordered the additional speed limit, stop and children at
play signs for Heritage Hills and they will take a couple of months to arrive. CM
Heidner asked the residents if they would like to go over the illustration where the
signs are to be placed and they agreed.
CM Struthers motioned to approve of ordering signs, but not to include the
installation of the signs at this time. Seconded by CM Wendel. All in favor.
Motion carried.
David Chase from Kustom Signals, Inc. - talked about the two brochures on Smart
and Smart -LP radar trailers. The Council discussed the need for one and asked
David Chase to come back to the next council meeting on October 14, 2002 to
discuss quotes.
7.4. Waterfront Street Lighting
Ron Wagner gave his engineering report, he explained the difference between
• Metal Halide and High Pressure Sodium Lighting Ron Wagner suggested to go
L'vith metal lights. No final decision was made.

7.5. Any other Engineering Business.
Burlington Northern Railroad installed a new culvert near Long Haul Trucking
and this should take care of the flooding problem.
9. Council Items:

A. Report on Primary Election.
Low turn out at the polls.
B. Approve Sludge Hauling Bid.
Mayor Fournier motioned to table awarding the Sludge Hauling bid until
they receive more information on where it is going and a contract. Seconded
by CM Struthers. All in favor. Motion carried.
9.3. Other
CM Struthers suggested the City getting involved in National Night out.
10. Adjournment:
CM Struthers motioned to adjourn at 8:30 pm. Seconded by CM Wendel.
