MINUTES OF DECEMBER 2, 2002 6:30PM
2003 TRUTH -IN -TAXATION PUBLIC HEARING
Roll Call : Mayor Larry Fournier, Councilmembers Vern
Heidner and Virginia Wendel were present. Absent: Council
members Jerry Struthers and Suzanne Ackerman. City Staff:
Michael Robertson, City Administrator was present.
Mayor Fournier called the meeting to order at 6:30 p.m.
There was no one from the public present to comment on the
proposed 2003 tax levy or budget. While waiting to see if
any public would attend, Council informally discussed the
budget and other policy issues.
With no one from the public attending, the Mayor informed
all present that there would be another Truth -in -Taxation
public hearing at 6:30 p.m., Monday, December 9, 2002 at
Otsego City Hall.
With no further business, the meeting adjourned at 7:45 p.m.

Roll Call : Mayor Larry Fournier, Councilmembers Jerry
Struthers, Vern Heidner and Virginia Wendel were present.
Absent: Councilmember Suzanne Ackerman. City Staff:
Michael Robertson, City Administrator; and Judy Hudson, City
Clerk/Zoning Administrator, were present.
Councilmember-elect Dan Scharber was present.
Mayor Fournier called the Truth -in -Taxation meeting to order
at 6:30 p.m.
There was no one from the public present to comment on the
proposed 2003 tax levy or budget. Administrator Robertson
summarized the proposed 2003 budget and tax levy.
Hearing no public comment, Mayor Fournier noted that
approval of the proposed 2003 Tax Levy and 2003 Budget was
on the agenda for the Council meeting immediately following
the Truth -in -Taxation public hearing and adjourned the
hearing at 6:33 p.m.

BACKGROUND
Landcor Construction, Inc. has submitted an application . for final plat approval for Outlots
A, B and G of the Waterfront Addition. The final plat also includes a replat of Lot 2, Block
1 of the first addition (bank building) to adjust the lot area. The subject site is guided for
commercial development by the Comprehensive Plan. Development of the project is
subject to the requirements of a PUD District and development stage plan approved by the
City Council on April 8, 2002.

ANALYSIS
Preliminary Plat Consistency. The layout of the final plat, with two buildable lots and
seven outlots for future phases, is generally consistent with that of the preliminary plat.
The final plat must include documentation of easements allowing cross access and parking
between the various lots within the subdivision as approved with the PUD District. The
easements are subject to review and approval of the City Attorney and will be recorded
with the final plat.
The replat of the bank site involves shifting the lot line shared with Outlot G 20 feet to the
east in order to reduce the lot by approximately 0.2 acres for financing purposes. Under
the PUD District, lots within the project are not subject to a minimum lot area or width
requirements. Moreover, the lot line adjustment does not impact setbacks or the way
either site functions. As such, we have no issue with the proposed replat.
Engineering Review. The City Engineer addressed applicable grading, utility and
easement issues as part of the various site plan review memorandums. These comments
will be addressed as a condition of final plat approval.
Park and Trail Dedication. Park and trail dedication for commercial subdivisions is to be
in the form of a cash fee in lieu Of land equal to 10 percent of the pre -development
estimated market value of the property. A schedule for the park dedication requirement for
each of the lots within the waterfront project has been prepared and will be included in the
development contract. These numbers have been adjusted for the replat of the bank site:
Lot 1, Block 1 (retail store) = $8,078.00
Lot 2, Block 1 (convenience store) $11,228.00
Lot 1 , Block 2 (restaurant) $ 9,958.00
Lot 2, Block 2 (bank) -$ 858.00 (credit)
TOTAL $28,406.00
Development Contract. A development agreement will be required as part of each of the
site development stage plans to address issue pertaining to the special assessment of
costs related to street and utility improvements, grading and drainage improvements, park
dedication, and other fees and securities. The development contract is subject to review
and approval by the City Attorney.
CONCLUSION
The proposed final plat is consistent with the approved preliminary plat. The replat of the
bank site will not impact compliance with setbacks or the way each site is to be
constructed. As such, we are recommending approval of the final plat subject to the
conditions outlined below:
The applicant is to provide appropriate documents establishing cross
ingress/egress and parking easements over all lots and outlots within the final plat,
subject to review and approval of the City Attorney.
2. All utilities, grading, drainage, and easements are subject to review and approval
of the City Engineer.

FINDINGS: Based upon review of the application, the recommendation of the Planning Commission, and
evidence received, the City Council of the City of Otsego now makes the following findings of fact:
1. The legal description of the property is Outlot G of Otsego Waterfront.
2. The property lies within the Sanitary Sewer Service District and is guided for commercial land uses
by the Otsego Comprehensive Plan, as amended.
3. The property is zoned PUD, Planned Unit Development District as approved on April 8, 2002. The
PUD District is subject to the uses and performance standards allowed in the B-3 District, except as
expressly modified. The PUD District is further subject to the PUD Development Plan and PUD
Development Standards incorporated as part of said District.
4. The Planning Commission and City Council must take into consideration the possible effects of the
PUD District and PUD Development Plan with theirjudgement based upon (but not limited to) the
criteria outlined in Section 20-3-2.F of the Zoning Ordinance. -
A. The proposed action's consistency with the specific policies and provisions of the official City
Comprehensive Plan.
Finding: The Comprehensive Plan describes this area as the City's primary commercial area
to be developed with uses that serve local and regional markets. The opportunity for a retail
use at this location is consistent with the City's goals for this area of the community and is

Finding. The subject site is located at the intersection of CSAH42 and 91't Street.andis

capacity. The project will contribute to the City's tax base to support its service capabilities
and utilize available infrastructure improvements.
7. The planning report dated 12 November 2002 prepared by the City Planner, Northwest Associated
Consultants, Inc., is incorporated herein.
The memorandum dated 14 November 2002 prepared by the City Engineer, Hakanson Anderson
Associates, Inc., is incorporated herein.
9. The Otsego Planning Commission conducted a public hearing at their regular meeting on 18 November
2002 to consider the application, preceded by published and mailed notice. Upon review of the
application and evidence received, the Otsego Planning Commission closed the public hearing and
recommended by a 7-0 vote that the City Council approve the request based on the aforementioned
findings.
DECISION: Based on the foregoing information and applicable ordinances, the requested PUD Development

The Planning Commission held a public hearing on 18 November 2002 to consider a PUD
development stage plan for a 7,200 square foot building on Outlot B of the Waterfront
Addition.
The applicant was present to clarify that they have not secured a tenant for the building
at this time. Under the PUD District, any use allowed in the B-3 District could be a
possible use of the proposed building. An off -sale liquor store use would require
subsequent application for a business license. Questions from the public were limited to
the liquor license issue.
The applicant discussed proposed changes to the building exterior that included adding
articulation to the facade to match the convenience store to the south and Staff's
recommendation for false first story windows across the front facade and portions of the
building sides. The Planning Commission asked about turning the building to front
Quaday Avenue, but the applicant state that the proposed design provides visibility to
CSAH 39 and CSAH 42 and is preferred.
After closing the Public hearing, the Planning Commission voted 7-0 to recommend
approval of the request subject to the conditions outlined below. The City Council will
consider the application at their meeting on 25 November 2002 at 6-30 PM.

City staff met with Allen Kuemper, 8477 Obrian Avenue, at the Staff meeting on 7
November 2002 to discuss the recent amendments to the Zoning Ordinance for fences in
side or rear yards adjacent to collector streets.
Mr. Kuemper's lot is at the corner of Obrian Avenue and 85"' Street and is one of the cased
that led to the recent Ordinance changes. Mr. Kuemper had started to put in a privacy
fence along 85hStreet that was in violation of the previous requirements that fences along
roadways not exceed 42 inches in height or be a minimum of 75 percent open for visability
purposes.
The amendments adopted 14 October 2002 would allow for construction of a fence upto
six feet tall to be constructed in the side and rear yards of lots abutting collector or arterial
streets. In addition to other requirements outlined in Section 20-16-6.J.5.b of the Zoning
Ordinance, these fences must be setback 10 feet from the property line and can not extend
past the rear line of the principal building,. The intent of the requirement that these be
setback 10 feet and that the fences not extend forward of the rear building line of the
building was to maintain an open appearance along these roadways and at intersections.
Mr. Kuemper wishes to be able to construct the fence to the front line of the principal
building such that a vehicle or trailer parked along side the garage is behind the fence and
screened from view. Mr. Kuemper's garage also has a service door on the side, of the
building that would be behind the fence if it were allowed to be constructed to the front line
of the building. Mr. Kuemper does not take issue with the 10 foot setback requirement.
The only options to address this situation are for Mr. Kuemper to request a variance or to
consider amending the Zoning Ordinance. Under the criteria for variances outlined in
Section 20-2-2. B of the Zoning Ordinance a variance would not be justified as there is no
unique physical hardship 'involved in complying with the performance standard.
As this same issue is applicable to other properties, the City Council may direct the
Planning Commission to reconsider the requirement that the fence not extend past the rear
building line as a City Initiated effort. Should the City Council decline to have the Planning
Commission reconsider, or the Planning Commission recommend no change, Mr. Kuemper
may make a private application for amendment of the Zoning Ordinance.
City staff is requesting the City Council to take one of the following actions at the City
Council meeting on 25 November 2002:
Motion to direct the Planning Commission to consider amendment of the fence
regulations for privacy fences adjacent to collector or arterial streets to extend to
the front building line.
2. Motion not to direct the Planning Commission to consider amendment of the fence
regulations for privacy fences adjacent to collector or arterial streets to extend to

The Planning Commission held a public hearing on 4 November 2002 to consider the
request of Farr Development Corporation for a Comprehensive Plan amendment for 320
acres located west of CSAH 19 and north of 1-94.
At the public hearing, the applicant was present to discuss the development concept on
which the Comprehensive Plan amendment is based. The Planning Commission
discussed issues of changing industrial guided land to residential and the design of the
development concept. The Planning Commission also took comments from an area
resident who lives south of 8 oth Street and is concerned about the loss of rural character
in the area.
After closing the public hearing, the Planning Commission table action on the request until
their 2 December 2002 meeting to allow additional time to contemplate the proposed
amendment. At the 2 December 2002 meeting, the discussion again focused on the
changing of industrial guided land and the need to consider changes beyond the
boundaries of the subject site.
Ultimately, the Planning Commission members said that the proposed amendment would
serve to make sanitary sewer service available to areas immediately adjacent to the 1-94
corridor sooner rather than later. The loss of industrial guided land in the area north of I-
94 and west of CSAH 19 can be offset by other suitable industrial locations surrounding
the Nashua/Nabor Avenue corriclor. The Planning Commission voted 7 -Oto recommend
approval of the request and to direct City Staff to Initiate amendment of the Comprehensive
Plan and Sewer and Water Plans in accordance with the staff alternative for lands beyond
the subject site.
The City Council is to consider the application at their meeting on 9 December 2002 at 6-30
PM. Options for the City Council to consider in acting on the request are outlined below:
A. Motion to approve resolution amending the Comprehensive Plan subject to the
following conditions:
The Comprehensive Plan amendment is to be in the form of Exhibit B of the
Planning Report dated 25 November 2002. The City Planner and City
Engineer are directed to make appropriate changes to the Comprehensive
Plan and Sanitary Sewer and Water facility plans reflecting the amendment
and initiate an amendment of the Comprehensive Plan in the form of Exhibit
D of the Planning Report dated 25 November 2002, subject to further review
and approval of the Planning Commission and City Council.
2. Applications for zoning and subdivision approvals necessary for development
of the project are subject to the growth management policies and interim land
use provisions outlined in the Comprehensive Plan. Specific provisions for
staging development of residential elements of the project in relation to
commercial or industrial uses are to be incorporated as part of subsequent
zoning applications.
3. Development of the project requires applications for, but not limited to,
rezoning, site and building plan review, preliminary and final plat, EAW, or
other applications required by the Zoning Ordinance or Subdivision
Ordinance.

4. Development of the project shall conform to applicable performance
standards of the Zoning Ordinance and Subdivision Ordinance.
5. The concept plan is to be revised to provide for dedication of park and trail
facilities subject to review by the Parks and Recreation Commission and
Planning Commission and approval of the City Council as part of a
preliminary plat application.
6. The concept plan is to be revised to reduce the intensity of the dwelling units
along the northern portion of the project by incorporating small lot single
family lots ("detached townhomes") in place of attached dwellings.
7. Comments of other City Staff.
B. Motion to deny the application based on a finding that the request based on finding
that the application is inconsistent with the following policies of the Comprehensive
Plan. -

Once established, geographic land use designations and related zoning
classifications shall be changed only when it can be demonstrated that such
modifications are in the best interest of the community. Such changes shall
occur only when they will promote land use compatibility and pre -determined
goals and policies of the Comprehensive Plan. (Policy Plan, p. 38)
2� Immediate, short range market potential and demand of activities which are
not suggested for a site or area by the Comprehensive Plan or allowed by the
Zoning Ordinance shall not be the sole justification for a change in activity.

3. Industrial (and commercial) development shall be strongly encouraged to
create new job opportunities and expand the local tax base to assist in paying
for needed service and reduce tax impacts on housing costs. (Policy Plan, p.

4. Industrial development which maximizes the return on City investments in
public facilities and service shall be promoted. (Policy Plan, p. 49)

A RESOLUTION AMENDING THE COMPREHENSIVE PLAN AS IT PERTAINS
PROPERTY OWNED BY DARREL FARR DEVELOPMENT CORPORATION CHANGING
INDUSTRIAL LAND USE TO A MIX OF RESIDENTIAL) COMMERCIAL AND
INDUSTRIAL USES.
WHEREAS, the City has received a request from Darrel Farr Development
Corporation for approval of an amendment to the Land Use Plan Map changing industrial
land use to a mix of residential, commercial and industrial uses in the area west of CSAH
19 and north of 1-94; and,
WHEREAS, the requested Comprehensive Plan amendment is based on the land
uses identified on the development concept entitled Kittredge Crossings submitted with the
application, and,
WHEREAS, the map changes necessary to accomplish the developer's request are
illustrated by Exhibit A; and,
WHEREAS, the Otsego Planning Commission conducted a public hearing, at their
regular meeting on 4 November 2002, to consider the request, preceded by published and
mailed notice; and,
WHEREAS, the Planning Commission closed the public hearing and tabled the
application until their meeting on 2 December 2002 to allow contemplation of the proposed
land use plan changes and issues surrounding the request; and,
WHEREAS, the Otsego Planning Commission, at their meeting on 2 December
2002 continued discussion of the application and upon review of the application and
evidence received voted to recommend by a 7-0 vote that the City Council approve the
requested amendment of the Comprehensive Plan based upon a finding that the
amendment is consistent with the following policies:
Compatible uses and activities shall be concentrated and clustered into functionally
related sub -units of the community. (Page 37)
Transitions between distinctly differing types of land uses shall be accomplished in
an orderly fashion which does not create a negative (economic, social, or physical)
impact on adjoining developments. (Page 37)
Incompatible land uses shall be properly regulated and related so that conflicts are
minimized. This shall be achieved through the use of natural and man-made
physical barriers (i.e., topography, drainageways, transportation routes, etc.)
distances, screens, and/or proper physical orientation fo lots and buildings. (Page
37)
Wherever possible, changes in types of land use shall occur either at center or
rear, mid -block points so that similar uses front the same street, or at borders of
areas separated by major man-made or natural barriers. (Page 37)
The community shall be planned and developed on a unit (neighborhood) basis as
determined by physical barriers and/or homogeneous land use characteristics and
urban/rural development area boundaries. (Page 39)
Residential neighborhoods shall be protected from penetration by through traffic on
local streets. (Page 41)
Major streets are to border and not penetrate residential neighborhoods. (Page 41)
A high quality "life cycle" residential environment shall be maintained throughout
the community which emphasizes physically coordinated neighborhoods which
incorporate all types, sizes and styles of dwellings. (Page 41)
Residential development shall be promoted proximate to areas targeted for
economic development to provide ancillary and market support. (Page 44).
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
OTSEGO THAT; the request to amend the 2001 Comprehensive Plan Update, as
illustrated on Exhibit A, is hereby APPROVED, subject to the following conditions:

Re: Police Commission Information
I spoke with the City Administrators of Delano and Monticello to
find out about their police commissions.
DELANO
Delano contracts for 12 hours a day of Sheriff's services.
Delano established a public safety commission several years ago.
The commission consists of 9 members plus a Councilmember and
meets quarterly. The local deputy attends every meeting.
Usually the Sheriff or a high ranking officer also attends the
meeting. In appointing the commissioners, Delano was careful to
ensure a balance of opinions regarding the sheriff and police
services. Right now the commission is advocating for a trail
system in Delano to improve public safety.
MONTICELLO
Monticello contracts for 32 hours a day of the Sheriff's
services. Monticello established a commission 7-10 years ago.
There are 5 members plus a Councilmember and it started out
meeting quarterly, but in the last year its only met twice
because there didn't seem to be any issues. The local deputies
plus the Sheriff or a captain attend the meetings. They treat
appointments to the commission the same as to any other
commission.
