The plat consists of 33 single family lots and is located just east of Riverpointe 2nd Addition with access via 55th Street. The remainder of the site is to be platted as Outlot A and Outlot B. Exhibits: A. Site Location Map B. Preliminary Plat C. Final Plat ANALYSIS Preliminary Plat Consistency. The general design of the proposed final plat is consistent with that of the approved preliminary plat in terms of number of lots/units. The City Council approved an amendment to the current residential subdivision moratorium for the east sewer ditrict, allowing for the transfer of up to 45 lots within the Riverpointe subdivision to the River Place subdivision. The proposed phase one River Place final plat consists of 33 lots, leaving a maximum of 12 lots for final plat approval. It should be noted that when the moratorium ceases and sanitary sewer and water become available for the remainder of the River Place subdivision, Randolph Avenue NE will be required to be constructed prior to exceeding 45 total lots. Street Design. All streets, other than 55th street, connecting the proposed subdivision to the Riverpointe subdivision, are to be constructed with 28 foot pavement width and a sidewalk on one side. A temporary road, connecting Raintell Avenue with the existing gravel road running north and south along the west boundary line of the site, must be provided in order to maintain access to the treatment center. The existing driveway at the rear of lots 1-4 of Block 2 must be restored by the applicant. Landscape Plan. As a condition of Preliminary Plat approval, the applicant was to submit a landscape plan that shows an acceptable landscaped bufferyard running east and west along CSAH 36 and north south along Randolph Avenue. The landscape plan is to take measures to protect the Indian burial mound from intrusion. City staff has yet to receive a landscape plan, which will be required with application to final plat Outlot A. Construction Plans. The applicant is required to provide grading, drainage, utility and street construction plans for the project. These plans must be consistent with the Engineering Manual and are subject to review and approval of the City Engineer. Park and Trail Dedication. A $2,100 dollar per dwelling\unit cash contribution in lieu of land must be paid to the City to satisfy its park and trail dedication requirements. Based upon the 33 units, the fee in lieu of land for this first phase is $69,300. Development Contract. The City requires that applicants enter into a development agreement and post all required securities and fees upon approval of a final plat. The development contract is subject to review and approval of the City Attorney. CONCLUSION The proposed final plat consisting of the first phase of the River Place development is found to be consistent with the approval of the preliminary plat. As such, we recommend approval of the final plat subject to the following conditions. Construction of Randolph Avenue is required prior to final platting more than 45 dwelling units. 2. All local streets are to be designed with a 28 foot paved street width, with sidewalk on one side of the street, except for 55th street which shall have a 33 foot paved section without a sidewalk. 3. The applicant pay $69,300 in park and trail dedication fees in lieu of land. 4. A temporary road is to be provided to maintain access to the treatment plant until such time as direct access to the north -south collector street is available, subject to approval of the City Engineer. 5. The development consists of an 18 -hole championship golf course surrounded by 157 single family and townhouse residential dwellings. The development is to be served by a package sanitary sewer treatment system and common water system. The subject site is planned for rural residential uses within the area designated as the Rural Residential Preserve by the Comprehensive Plan. The property is zoned PUD, Planned Unit Development in consideration of the mixed residential and commercial elements of the project as well as the proposed utility services. A preliminary plat for the project was approved by the City Council on 8 July 2002. The final plat application is processed in accordance with Section 21-3-3 of the Subdivision Ordinance and does not require review or recommendation by the Planning Commission prior to City Council action. Exhibits: A. Site Location B. Final Plat C. Development Plan ANALYSIS Preliminary Plat Consistency. The general layout of the proposed final plat and number of dwelling units is consistent with that of the preliminary plat. The applicant must provide a summary of the single family lots showing an average lot size greater than 12,000 square feet and no lot less than 11,500 square feet. The detached townhome lots in Blocks 4, 9 and 10 are also to be revised to provide a smaller unit lot with not more than 10 feet of yard behind the buildings. This will avoid future issues with the properties being utilized more as undersized single family lots versus a townhome type dwelling. Landscape Plans. A condition of preliminary plat approval is that the applicant provides a landscape plan for the project entrances from Kadler Avenue. These plans must be submitted and are subject to review and approval by City Staff. Landscaping plans must also be provided to screen the proposed maintenance buildings from view of Kadler Avenue and 90th Street and to screen the range tees to the east. Landscape plans must also be submitted for the townhouse development sites. The landscape plan must provide for site perimeter plantings and foundation plantings, and specific plantings for the area between two driveways as no "rock gardens" will be allowed. Outlots. The final plat includes 11 outlots. Outlots A through E are established for the golf course. Outlots F, H, I and J are private driveways serving townhouse units. Outlot K is the location of the sewage treatment plant. And, Outlot G is intended to be a future extension of 92nd Street to the east plat line. The final plat should be revised to provide lot and block parcels for the turf management building, which is shown on Outlot B, and for the sewage treatment plant, as Section 21-7-4.R of the Subdivision Ordinance prohibits construction of buildings on outlots. Access. Access to the residential project is to be provided via Kadler Avenue, which the applicant is required to dedicate right-of-way for and upgrade to a rural collector street standard at their cost from CSAH 39 to 85th Street. The golf clubhouse lot is to have direct access to CSAH 39, which remains subject to approval of Wright County. Within the residential project, all of the streets accessing single family lots are to be public streets based on the 32 foot urban design section without sidewalks of the Engineering Manual. Sidewalks are not to be required as the project received preliminary plat approval prior to adoption of the current 28 foot street section design that includes sidewalks. Private drives are to be constructed to serve the townhouse units in Blocks 1, 2, 4, 9 and 10. These private drives are to be 28 foot section designs with concrete curb consistent with the Engineering Manual requirements. Fil The applicant was also to address golf cart access to the course by Lots 3-13 of Block 12 as these lots do not directly abut the golf course and no cart use will be permitted on City Streets. We would recommend that an eight foot wide trail be provided in the front yards of these lots for cart access separate from the public street. Park and Trail Dedication. No land is being dedicated to the City for public parks or trails as part of the project. As such, park and trail dedication requirements outlined by Section 21-8-17 of the Subdivision Ordinance will be paid in a cash fee in lieu of land. Section 21-8-17.M of the Subdivision Ordinance establishes that the cash fee in lieu of land is established at the time of final plat approval. This provision was included in the Subdivision Ordinance prior to approval of the applicant's preliminary plat on 8 July 2002. On 10 March 2003, the City Council approved Ordinance 2003-06 increasing the cash fee in lieu of land from $1,075 to $2,100 per residential dwelling unit and $7,000 per gross acre for commercial development based upon a detailed study of land and park development costs. As such, the residential dedication for the proposed final plat is a cash fee in lieu of land equal to $329,000.00 based on 157 dwellings. The commercial dedication will be based on the area of the clubhouse and turf management lots and not the overall golf course at $7,000.00 per gross acre. Utilities. The proposed development is to be served by a package waste water treatment plant and common water system. The developer's original proposal for on- site sewage treatment was for more of a communal septic system versus mechanical treatment. No plans were ever submitted for such a system as the applicant's effort focused on obtaining extension of municipal sanitary sewer service from the City's west waste water treatment plan. The utility systems, which are to be turned over to the City for ownership and operation after construction, are subject to MPCA permits and approval of the City Engineer. To allow for the system to be integrated with the municipal system being constructed in the west sanitary sewer service disctrict, the City Engineer is requiring a number of trunk facility upgrades to the proposed plant and collection system to be constructed by the developer. The costs for these trunk facility designs are estimated as $105,000.00 and subject to potential reimbursement if any other properties benefit. If other properties are allowed to connect to this system within a given time period, the developer would also be reimbursed the cost of construction for the original treatment plant. Easements. The final plat illustrates perimeter easements for each single family lot as well as easement over wetlands and ponding areas as required by Section 20-7-15 of the Subdivision Ordinance. All easements are subject to approval of the City Engineer. Construction Plans. Construction plans for the proposed utilities, streets, and private drives have been submitted, which are subject to approval by the Ci,Engineer. This is to include plans for upgrading of Kadler Avenue from CSAH 39 to 85 h Street as a rural collector street. 3 Development Contract. City Staff has had lengthy discussions with the applicant over the terms of the development contract during the last several months. A development contract has been drafted for the proposed development with specific language addressing the sewage treatment plant and common water utilities. Because of the issues involved with this project, the development contract is subject to review and approval of the City Council. CONCLUSION The proposed final plat is generally consistent with the Zoning and Subdivision and applicable conditions of preliminary plat approval. We recommend approval of the final plat and development contract as outlined below. A. Motion to approve the Riverwood National Final Plat and development contract subject to the following conditions: The applicant submit a summary of the single family lots demonstrating an average lot size greater than 12,000 square feet and that no lot is less than 11,500 square feet. 2. The final plat is revised to provide not more than ten feet of yard behind the detached townhomes buildings, subject to review and approval of City Staff. 3. Landscape plans for the project entrances, maintenance area, range tees, and townhouse development sites shall be submitted and are subject to approval of City Staff. 4. The final plat is revised to designate Outlot G as public right-of-way and put the maintenance area and sewage treatment plant on lots/blocks. 5. Access to CSAH 39 from Block 13 shall be subject to approval of Wright County. 6. The construction plans are revised to provide an eight foot wide trail along the front of Lots 1-13 of Block 12 for cart access to the golf course. 7. The applicant shall pay a cash fee in lieu of land to satisfy park and trail dedication requirements equal to $329,000.00 plus $7,000.00 per gross acre for the area of Block 13 and the parcel to be created for the maintenance facility. 8. All utilities, easements, grading and drainage, street, drives and construction plans are subject to review and approval of the City Engineer. 4 9. The applicant shall enter into a development agreement with the City that provides for the dedication of the sewage treatment plant, community well and related infrastructure, as well as payment of all fees and securities, subject to review by the City Attorney and approval of the City Council. 10. SANITARY SEWER & WATERMAIN PLAN GENERAL DESIGN CONCEPT The plans, specifications and cost estimates received to date for the WINTP, Sewerage Lift Station and force main, Well and Pumphouse, gravity sewer system and water system represent the developer's improvements to meet just the limited needs of his development as if it would remain a private development and not be taken over by the City of Otsego for operation and maintenance. The City has outlined to the developer at its staff review meeting held on June 26, 2003, the municipal service concepts of design that the City would require before it would approve the development improvements and take them over for operation and maintenance. The developer's engineers were offered examples of current design of the lift station, well and pump house that the City has adopted as standards for its water and sewer systems. To date, no attempt has been initiated by the developer to comply with these standards. The basic components of the City's municipal system for this area of the west community consist of the following; SANITARY SEWER SYSTEM 1. Provide a 12" trunk sewer that provides access to the properties west of Kadler Ave. at the point of the un -named creek crossing. This 12" trunk sewer shall traverse the property generally following the creek as it flows to the eastern boundary of the plat. The upper service invert shall be elevation 916.00 and the lower invert shall be 908.00. 2. Additional access point shall be provided for the property west of the Kagan Ave. intersection with Kadler Avenue. This shall bean 8" sewer with an invert of 967.00. 3. Another access point shall be provided for the property north of the Kahl Way culdesac. This shall be an 8" sewer with an invert of 910.00. 4. A fifty (50') foot wide easement shall be provided for a future 12" trunk sewer that will cross the southeastern corner of the plat near Kahl Way. The easement shall be parallel to the creek alignment and shall be centered at 25' from the centerline of the creek. 5. The sanitary lift station shall be relocated to the termination point of the 12" trunk sewer as described in Item 1. Above. The interim 6" diameter force main from this lift station will discharge to the proposed WWTP on the developers property. A 12" diameter force main and appropriate valves shall be stubbed out to follow the general alignment of the creek flowing to the east. The developer shall provide a \\He01%Shared DocsVAunicipaMots ego2xxx\2246\ot2246Amend Reviewldoc stub out of a 12" gravity trunk line to accept flow for the remainder of the 1,300 to 1,600 acre future service area contingent with the larger creek that crosses the southeastern corner of the plat, as described in Item 4. above. This 12" stub out shall have an invert into the wet well at elevation 908.00 and shall be orientated to receive flow from the eastern direction. 6. The sanitary lift station shall be designed to provide immediate service for the 51,000 GPD plus an additional 49,000 GPD future service area. The pumps shall be designed to provide a peak flow rate of 280 GPM to the proposed WWTP. The wet well shall be increased to a 12' diameter wet well to allow for future regional service area with an ultimate peak flow rate of 2,500 GPM, WATER SYSTEM 1. The well and pumphouse are not in an acceptable location for paved access or frequent maintenance. The pump house site should be on the highest point in the project plat so hat the hydropneumatic tank could still provide some flow and pressure in the event of a 1 hour power outage. A connection for an emergency generator shall be provided. The pump house should be much like the existing Pumphouse # 2 located near the Riverpointe development and the existing WWTP #1. Full treatment of the well water with chlorination, fluoridation and poly sulfate iron sequestering shall be provided. A hydropneumatic tank with an operating capacity of 5,000 gallons, (a total volume of 7,000 gallons)is required. The pump shall be a submersible pump with mechanical soft start contacts, not VFD, 2. The well shall be drilled into the Mt. Simon aquifer, approximately 450 to 500 foot depth. The discharge line shall be 12". The well pump shall be capable of providing the TDH to deliver the water to the 70th Street elevated tower ( under construction) elevation of 1120, approximately two miles south of the project, and at the 500 GPM rate. 3. The trunk water mains shall be a 16" line on Kadler Ave, for the full frontage of the project with both a 12" and 8" connection point for the western property to connect to when it develops. The developer shall provide a 12"trunk water line traversing through the project to its eastern boundary. All other water lines shall be 8" and with 6" hydrants. WWTP 1, The initial capacity of the WWTP shall be 67,000 GPD with two SBR's on line. The room and piping shall be provided to add the third SBR to bring the total capacity up to 100,000 GPD, 2. Phosphorous removal by coagulation followed by gravity sand filters shall be provided to reduce an assumed phosphorous concentration of 4 MGL down to 1 MGL. 3. Redesign sanitary sewer system to provide 12" trunk sewer traversing property generally following creek east from Kadler Ave. to eastern boundary. Provide three future access points for sanitary sewer from adjacent property. 7. Detail comments on well pumphouse, sanitary lift station, and waste water treatment plant designs will follow. STREET & STORM SEWER PLAN 1. Plans prepared by a registered professional engineer shall be submitted for the proposed tunnels (box culverts). 2. Storm sewer pipe shall be 15" diameter minimum. (3.04) 3. The distance pond outlet shall be located as far as possible from the pond inlet to prevent short-circuiting. (ex. Pond located northwest of 92nd Street NE / Kaiser Circle NE intersection) 4. We would recommend Outlot G be dedicated right-of-way if provisions are going to be made for 92nd Street NE to continue to the east. However, if due to concerns by adjacent property owners, the Planning Commission and/or City Council decided that 92nd Street NE should not extend to the east plat line at this time, we would suggest revising the 92nd Street NE/Kaiser Circle NE intersection to a three legged intersection. Creating Outlot G will require future City Council action to convert the property to public right-of-way. The correct ROW shall be depicted. 2. Minimum vertical curve lengths shall be per Mn/DOT guidelines for a 45 mph design speed. We realize that at the vertical curve at station 57+50 it will be difficult to match driveways, but a 30 mph minimum curve must be implemented with appropriate signing. We suggest lowering the PVI approximately 1' and sliding approximately 25' to the north. More specifically, the length of the curve needs to be increased from 290 feet to 320 feet. 3. Kadler Avenue NE run-off shall be directed into a sedimentation basin before being allowed to enter the natural drainage system. 4. From station 48+50 to station 50+50, avoid impacting the trees on the adjacent property to the east. 5. It appears that the abbreviation "CMP" is missing from note 3. 6. The sheet reference for the page break on sheet 2 of 20 refers to "see sheet 3". It should read, "see sheet 4". A ditch system shall be used to convey the stormwater. The contours/cross-sections do not correctly depict this in many locations. It appears that the template used for the road section does not correctly depict a ditch section in some locations (where the existing ground adjacent to the road is lower than 2.5' below the roadway) and some manual editing of the contours will be required. In many cases the cross sections indicate the locations where a defined ditch is not present. The Preliminary Plat for this development was approved by the City Council a little more than a year ago. The Preliminary Plat was extended by the council and a final plat application was submitted earlier this summer. As you will recall, the original Council approval was that the Plat could be served with a separate wastewater treatment facility. The Developer approached the Council late last year regarding the possibility of extending the west Sanitary Sewer service district in order to serve the subdivision. This request was rejected by the Council. The Developer thereafter pursued a package plant and went through the process of applying for and receiving a discharge permit for the facility up to approximately 50,000 gallons per day. This discharge would basically serve the proposed approximately 185 RECs that would result from full residential and commercial build out of the Plat. Discussions were held with the Developer regarding the status of the wastewater treatment plant, possible expansion of the plant and the water system. The first issue was ownership. It was determined by the City, and agreed to by the Developer, that the plant should ultimately be turned over to the City. This would relieve the Developer of the responsibility of entering into some long term arrangement in order to operate and Letter to Otsego City Council September 16, 2003 Page 2 maintain the plant. This would allow the City to operate the plant as a part of the municipal system and possibly expand the plant if necessary. The next issue was over sizing required within the Plat. It is the position of the City staff that it is a condition of being allowed to proceed outside of the established sewer district that the utilities be constructed and located so as to be able to be integrated to the overall City system in the future. It is apparently the Developer's position that they should not be required to oversize, that they should only be required to build that which would serve the Plat. It is my understanding that the Developer will present this question to the City Council at the time of final plat approval. The proposed developer's Agreement addresses the issue of reimbursement of over sizing and for a portion of the cost of the original plant. Under the formula contained in the agreement, over sizing costs for sanitary sewer and water would be reimbursed to the Developer from any additional party hooking up to the facilities. The rate of reimbursement is related to the portion of each individual SAC and WAC charge relates to trunk facilities, as distinguished from those portions related to the treatment plant or water tower. Based upon this formula, the Developer could receive full reimbursement for over sizing costs with the addition of approximately 40 additional REC units utilizing the Plat facilities. Reimbursement for the original plant is based upon a formula which divides the cost of the original plat by a ratio of new RECs created by any increase in the original plant capacity as measured in RECs. Under this scenario, if another party received permission from the City to hook up to the plant, that party would have to pay any costs of plant expansion, the cost of the lines to the plant, and would have to reimburse Developer for initial over sizing costs incurred in construction of the Plat as well as apportion of the original plant. The Developer's Agreement also requires the developer to operate the plant until such time as a minimum flow amount is achieved. As per the advice of the City Engineer, this time period is the period of low flow when the majority of difficulties in running the plant often occur. Once the minimum flow is reached, the Plant and water system will be turned over to the City and thereafter will be run as apart of the overall City utilities. The Developer is required to have the plant operated by a licensed operator approved by the City during the interim period. I have enclosed that portion of the proposed Developer's Agreement with this letter which outlines the sewer and water portions of the Developer's Agreement. Other items related to this Plat will be handled the same as any other development. Changes in Official Controls. RIVERWOOD NATIONAL is a planned and staged development within the meaning of Minn. Stat. 462.358, Subd. 3c, and no amendment to the City's Comprehensive Plan or official controls shall apply to or effect the use, development density, lot size, lot layout or platting requirements for future phases of RIVERWOOD NATIONAL for a period of five years. Thereafter, notwithstanding anything in this Agreement to the contrary, to the full extent permitted by State law, the City may require compliance with any amendments to the City's Comprehensive Plan, official controls, platting or dedication requirements enacted after the date of this Agreement. This provision does not apply to regulations or official controls related to park and trail dedication or any fee established by the City chargeable to the Developer for municipal costs arising from said future phases. Proposed Revision of No.5, relative to Sanitary sewer services: No. 5. Sanitary Sewer Service. Sanitary sewer service for the Plat will be provided through a wastewater treatment facility to be constructed by Developer and turned over to the City after construction is complete and the facility has achieved an average daily flow of 13,000 gallons per day ("minimum flow"). At the time that minimum flow is achieved, the wastewater treatment facility and all related facilities necessary for its operation and all land and easements necessary for future operation and expansion of the facility as well as all easements necessary for eventual integration of the Plat with the City's municipal wastewater treatment system will be conveyed to the City. The wastewater treatment facility and all related operations shall thereafter be owned, maintained and operated by the City. The facility will be constructed as per plans approved by the City engineer and will not be accepted by the City until construction is approved by the City Engineer. At the time that minimum flow is achieved Developer shall also transfer to the City any and all discharge permits for the facility. Any and all warranties on the sanitary sewer facility and related equipment shall also be transferred to the City at the time that the facility reaches minimum flow. During the interim period the wastewater treatment facility shall be operated by Developer. Developer shall contract with a properly licensed operator, as approved by the City, for interim operation of the facility. Upon request of the City, Developer shall provide periodic reports on facility operation. Billing services during this period will be provided by the City through Wright- Hennepin at a usage rate to be determine by the City Engineer. The actual cost of billing services through Wright- Hennepin shall be billed to the Developer at the same rate paid by the City. Developer shall fully indemnify and hold harmless the City from any cause of action or claim related to or arising from operation, maintenance and use of the wastewater treatment facility and appurtenances controlled by Developer during the interim period. Upon construction of the facility and approval of the same by the City Engineer, Developer shall be entitled to sanitary sewer service to all properties approved for construction within the Plat up to the initial capacity of the facility. No City Sewer Availability Charges (SAC) will be applied to any property approved within the Plat. No sanitary sewer service shall be provided outside of the Plat without consent of the City. All costs related to the wastewater treatment facility, environmental review and permitting are solely the responsibility of the Developer. The property to be conveyed at the time that minimum flow is achieved are as follows: See Exhibit Developer shall construct trunk sanitary sewer facilities which may benefit other properties in the future. The cost of these trunk facilities is estimated to be $105,000.00. Developer is entitled to reimbursement for these trunk facilities as well as portions of the original plant constructed in the event that other users are hooked up to the facilities. The reimbursement will be through payment by the City to Developer of a portion of SAC charges actually received. Developer's reimbursement for sanitary sewer trunk facilities ($105,000.00) shall be reimbursed at the time that additional development is hooked up to the facility. Sanitary sewer trunk charges shall be reimbursed to Developer at the rate of $2,745.00 for each REC unit hooked up to the facility, up to the actual cost of sanitary sewer trunk lines constructed by Developer, estimated to be $105,000.00. In addition to reimbursement for trunk facilities constructed, Developer shall be reimbursed for a portion of the original cost of the wastewater treatment facility upon hookup to the facility by a City approved user. Said reimbursement will be based upon the following formula: Cost of the initial plant divided by the result of the total number of RECs available from the expanded plant divided by the total number of RECs available from the expanded plant minus the number of RECs available from the initial plant equals the amount of reimbursement due Developer from Developer B who has been approved to hookup to the facilities [Cost of Initial Plant/ (#of Total RECs - #of Initial RECs) = Payment to Developer from Developer B]. 2 Any reimbursement money received by City will be paid to Developer pursuant to the formula above within thirty days from the date of actual receipt of the funds. The City's obligation to make such payments shall last for twenty years from the date of execution of this Agreement, or upon integration of the wastewater treatment facility with the overall Municipal System, whichever occurs first. The right to receive such payments belongs only to Developer, and may not be assigned without consent of the City. Proposed revision of No. 6, relative to water service: 6. Water Service. Water service for the Plat will be provided through a well, pumphouse, hydro pneumatic tank and other related facilities to be constructed by Developer and turned over to the City at the same time as the wastewater treatment facility is turned over to the City pursuant to No. 5 above. The water facilities will be owned, operated and maintained by the City after transfer. The facilities will be constructed to municipal standards per plans reviewed and approved by the City Engineer. Any required permits for the facilities shall also be transferred to the City. Any and all warranties on the facilities shall also be transferred to the City. All costs related to facility plans, plan approval, construction and construction observation shall be borne by Developer. During the interim period the water system shall be operated by Developer. Developer shall contract with a properly licensed operator, as approved by the City, for interim operation of the facilities. Upon request of the City, Developer shall provide periodic reports on facility operation. Billing services during this period will be provided by the City through Wright -Hennepin at a usage rate to be determined by the City Engineer. This new phone system is needed because of the current and future expansions planned for City Hall, primarily in the building department. We have reviewed several systems, and we have been offered a lease at $4,800.00 a year for five years from the system that best seems to fit our needs.
