Farr Development, Inc. has submitted application for the first final plat of Kittredge
Crossings. The City Council rezoned the subject site to PUD, Planned Unit
Development District along with approval of a preliminary plat and development stage
plan on 12 May 2003.

ANALYSIS
Final Plat. The design of the proposed final plat in terms of street locations and
shapes/sizes of the individual parcels is consistent with the approved development plan.
The proposed final plat consists of 16 outlots and right-of-way for public streets within
the subject site. The final plat includes no buildable lots. This approach is being utilized
to allow the applicant the opportunity to construct roadways and extend utilities to the
project prior to finalization of specific development plans for the individual sites. Except
for the single family lots to be divided from Outlot B and C, each of the other
development sites requires processing of a PUD development stage plan. A final plat
for each of these sites will be processed along with the PUD Development stage plan to
establish the necessary lots and blocks. The applicant can update the City Council as
to their schedule for beginning development of the individual sites.
Construction Plans. Plans for construction of utilities and roadways, along with
grading plans are subject to review and approval of the City Engineer. Construction
plans required for final plat approval have not been submitted as of this date. The City
Engineer requires the plans to be submitted for review to ensure proper right-of-way
locations and easements that are established by the final plat.
Park and Trail Dedication. Park dedication requirements for the proposed final plat
are outlined below:

1. Land Area is percentage of the gross area of the plat minus park areas per Section 21-7-18.E
2. Requirement based on density of 7.3 du/ac per Section 21-7-18.H.1
A total dedication of 17.24 acres is required based on Section 21-7-18 of the
Subdivision Ordinance. Outlots I, J and P are to be dedicated to the City for parks
development. The upland area of these three parcels is 7.5 acres, which is 43.5
percent of the required dedication. The balance of the park and trail dedication will be
satisfied with a cash fee in lieu of land equal to 56.5 percent of the cash fee in effect at
the time of final plat approval for each of the development sites. Based on the current
fees outlined in Section 21-7-18.1 of the Subdivision Ordinance, the cash fees would be
$1,186.50 per dwelling unit for residential uses and $3,955.00 per acre for commercial
uses (Outlots G, H and O).
Development Contract. The applicant is required to execute a development contract
with the City and pay all required fees and securities for the proposed improvements.
The development contract is subject to review and approval of the City Engineer.
CONCLUSION
The layout of the proposed final plat is consistent with that of the development plan and
preliminary plat. The establishment of outlots and rights-of-way will allow for the
applicant to move forward with development plans for the individual sites and initiate
construction of necessary utilities and roadways. However, necessary construction
plans have not been submitted. Until such plans are provided, City staff recommends
the application be tabled.
A. Motion to approve the Kittredge Crossings Final Plat, subject to the following
conditions:
1. Final plats establishing lots/blocks for each of the individual development
sites shall be processed with the required application for PUD
Development Stage Plan approval.

2. All construction plans, grading, utilities, streets and easements are subject
to review and approval of the City Engineer.
3. Outlots I, J, and P shall be dedicated to the City as partial satisfaction of
park and trail dedication requirements. The balance of the required
dedication shall be in the form of a cash fee in lieu of land equal to 56.6
percent of the cash fee in effect at the time of final plat approval for each
of the individual development sites.
4. The applicant shall enter into a development contract with the City and
pay all required fees and securities, subject to approval of the City
Attorney.
5. Comments of other City Staff.
B. Motion to deny the application based on a finding that the request is inconsistent
with the Comprehensive Plan, Zoning Ordinance and Subdivision Ordinance.

FINAL PLAT
APPLICATION: Request for final plat approval of Kittredge Crossings consisting of 16 outlots and
public right-of-way.
CITY COUNCIL MEETING: 8 September 2003
FINDINGS: Based upon review of the application, the recommendation of the Planning
Commission, and evidence received, the City Council of the City of Otsego now makes the following
findings of fact:
A. The legal description of the property is attached as Exhibit A.
B. The property lies within the West Sanitary Sewer Service District and is guided for a mix of
residential and commercial land uses by the Otsego Comprehensive Plan, as amended.
C. The property is zoned PUD, Planned Unit Development District based on the PUD
Development Stage Plan and Preliminary Plat approved by the City Council on 12 May 2003.
D. The planning report dated 18 August 2003 prepared by the City Planner, Northwest
Associated Consultants, Inc., is incorporated herein.
E. The final plat is processed in accordance with Section 21-3-3 of the Subdivision Ordinance
and does not require recommendation from the Planning Commission.
F. The City Council tabled action at their meeting on 8 September 2003 on the request to allow
the developer to submit additional information and required plans.
G. The City Council scheduled a special meeting for 25 September 2003 to consider the
application.
DECISION: Based on the foregoing information and applicable ordinances, the request for a
approval of the Kittredge Crossings Final Plat is hereby approved based on the most current plan
and information received to date subject to the following stipulations:
1. Final plats establishing lots/blocks for each of the individual development sites shall be
processed with the required application for PUD Development Stage Plan approval.
2. All construction plans, grading, utilities, streets and easements are subject to review and
approval of the City Engineer.
3. Outlots I, J, and P shall be dedicated to the City as partial satisfaction of park and trail

GENERAL INFORMATION:
T -Mobile is requesting plan review for the attachment of four antennas to the top of the
City's water tower in the 16000 block of 70th Street, It also intends to construct a concrete
equipment platform with cabinets housing all equipment on the City's tower site to facilitate
the antennas. Cables will be within conduits attached to the inside of the tower structure,
We are providing our comments and issues found on the plan sheets T1, C1, Al, A2, S1,
S2, AND E1. Please provide the necessary changes,
Footing Wal_ I Core
1. Sheets C1 and Al show only a schematic view of the proposed three underground
diameter conduits that are proposed to pass through the reinforced concrete ring wall
supporting the tower, As with the Verizon Wireless conduits, the coring of these
foundation wall penetrations must be performed to avoid the reinforcing steel and
leave sufficient concrete between the cored openings. The spacing of the reinforcing
and the anchor bolts are shown in the two attached sketches of the foundation wall.
The required location of the three cored holes are shown on the attached sketch.
The cored hole shall not exceed 8" in diameter. A steel wall sleeve shall be fully
grouted within the cored opening. The PVC conduit shall be placed inside the steel
wall sleeve and a watertight link seal provided.
Submit a new detail reflecting these comments
SHEET C1 — SITE PLAN:
Provide an as -built easement survey with location of all facilities constructed.
Also provide the survey with descriptions of the easement in preliminary form for'
review.
2. Add detail on restoration of the existing gravel parking lot and road.

RE: Proposed Agreement- T -Mobile
Dear Council Members:
It is my understanding that T -Mobile's lease request was placed on a special Council
agenda for Thi rsday. The following is my response to the correspondence dated
Thursday, September 18 which was faxed to our office on Friday, September 19.
In the original' offer, T -Mobile indicated that they were seeking placement of twelve (12)
antennas on the structure. They are now proposing six (6) antennas on the structure for
$1,150.00 initially with a 5% increase per year, or approximately twice the rental
payment of Qwest for five antennas.
T -Mobile is requesting that the City agree to a modification, as previously discussed,
„which would eliminate the clause which would allow either party to terminate the
Agreement upon six (6) month's notice. The provision in the Agreement with Qwest was
specifically ageed to by both parties and allows Qwest as well as the City to get out of
the Agreement on six (6) month's notice. The Agreement contains other provisions that
let the City cancel the agreement for non-payment, violation of the Agreement or in the
event that the City takes the tower out of service.
Again T -Mobile is requesting three (3) five (5) year extensions rather than the two (2)
three (3) year extensions in the Qwest Agreement.
In their second proposal T -Mobile has agreed that they can live with No. 34 as written in
the Qwest agreement. They originally wanted a portion of this provision deleted.

T- Mobile agrees to a 24 hour notice to People's, and has indicated that the lease will not
commence until the City Engineer has reviewed and approved the construction drawings.
In light of the odditional compensation offered for less tower space, I think the proposed
changes to the Tease are acceptable. The elimination of the six month provision serves to
keep T -Mobile, obligated to the tower, and the other provisions of the Agreement serve
the City's primary interest in keeping the tower leased, but still allows cancellation of the
lease for non-performance. The term of the lease is basically a Council decision.
I will be available at the special meeting on Monday to answer any questions you might
have.

Dear Council Members:
Below are the explanations regarding the proposed changes to the lease.
1. Page 3, No. 6, Term: We are requesting three (3) additional five (5) year terms in
order to lock down the site for an extended period of time. We do this to ensure the
quality of our network and minimize changes for the future.
2. Page 3, No. 8 Initial and Renewal Term: The Qwest lease was for 5 antenna at a
rate of $500.00 per month. With the yearly 5% increase they will be paying $551.25
per month / $6,615.00 per year. After reviewing our needs, we would like space for
a total of 6 antennas. The rental amount we are proposing would be $1,150.00 per
month or $13,800.00 per year. This offer is more than double then rent currently
received by Qwest. We are offering this as compensation for the requested length
of term and changes set forth.
3. Page 10, No. 15, Relocation of Communications Company Equipment: We are requesting
180 days vs. the 90 to allow us the time needed to relocate our equipment if necessary.
4. Page 19, No. 30, Default and Cancellation, Paragraph C: We need this to be
deleted. This paragraph states that either party can, without cause, cancel this
agreement with six (6) months notice. Essentially, this makes this agreement a six
(6) month contract. We look to be here for an extended period of time and need to
be assured that the contract cannot be terminated on a whim. The city has other
methods of termination for cause that protect it.

5. Page 21, No. 34, Interference with Antenna Operations, Paragraph A: We can agree to
the original paragraph.
6. We would agree for access conditions in Exhibit C to provide 24-hour notice to People's
when we need access in a non -emergency situation.
I hope this clarifies the requested changes in the lease. With the rent proposed as double the
current tenant, we would like to see the council approve all of the changes we have requested.
